Different constitutional law opinions on the option of the President citing the 14th Amendment to the U.S. Constitution to raise the debt ceiling. Former President Clinton says he would unilaterally invoke it "without hesitation, and force the courts to stop me." President Obama said recently, "I have talked to my lawyers, they are not persuaded that this is a winning argument." Section 4 of this Amendment was designed to assure creditors the Union debts after the Civil War would be honored and to say Confederate debts would not be honored. This part of the 14th Amendment says "the validity of the public debt of the United States, authorized by law, including debts incurred for pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned." Prof. Jack Balkin of Yale, says it provides a broader principle that the public debt cannot be held hostage for political purposes. His view is that this is something that could be an option when all other options are exhausted. Prof. Lawrence Tribe of Harvard, say the law courts have no plausible point of entry in such a situation. There is a sense that "popular constitutionalism" would play an important part if something like this happened- the meaning of the constitution is what popular sentiment says it is in the particular context and events. ...

Pakistan has moved ahead in developing its nuclear arsenal. The production of uranium and plutonium for bombs and developing new weapons to deliver them has actually been accelerated during the recent period of unrest in Pakistan. Four years ago Pakistan had an estimated 30 to 60 weapons. Hans Kristensen, is the director of the nuclear information project at the Federation of American Scientists and author of the annual global nuclear weapons inventory published by the Bulletin of Atomic Scientists. Kristensen says it is not unreasonable to say that Pakistan has produced at least 100 weapons. Simon Gregory, Director of the Pakistan Security Research Unit at Britain's University of Bradford, puts the number at between 100 and 110. India is estimated to have 60 to 100 nuclear weapons. A 2008 agreement that lets India purchase nuclear fuel for civilian purposes was a motivation for accelerating nuclear weapons development in Pakistan. In December 2008, Peter Lavoie, the US intelligence officer for South Asia, told NATO officials that despite impending economic catastrophe, Pakistan is producing nuclear weapons at a faster rate than any other country in the world," according to classified State Department cables released late last year by the Intenet site WikiLeaks. This leak angered the Pakistan army chief Gen. Kayani who said "the real aim of US war strategy is to denuclearize Pakistan."...

GM's new Cruze to be built in April 2010 in the Mahoning valley area of Ohio hit hard by shuttered steel mills, will give 45 mpg. It will be smaller than a Malibu and larger than a Cobalt, and will be built also in Gm's European and Asian markets, so unlike models from before the car will be sold everywhere and being built on the same platform will share common parts and engineering, which is the automakers are now making their cars. GM will spend $150 million in developing the Cruze and an additional $350 million in building the Cruze plant in Ohio. GM's car strategy is now to increase production of the Malibu which had a sales increase of 79% compared to last July, shut down the Cobalt once the Cruze come in 2010, Cobalt sales increased only by 4% this July over July last year, and have a third shift producing the Impala next year in Oshawa, Ontario. GM's CEO Wagoner says he sees small cars making a profit for GM as now the new union agreement helps to reduce GM's costs and he sees customers willing to spend more on small cars. This is evident in the way affluent buyers have signed up to buy the Smart car, once shunned there is now a 1 year waiting list, and Daimler is expanding production at its French plant for the Smart car. The unemployment rate drops to 7.8% from 8.1% in September according to the Labor Dept. The decline partly comes from people taking part time jobs because they are unable to find full time work. The establishment survey shows 104,000 jobs added in the private sector in September, and revises the figures for July and August to show 86,000 additional jobs created. Of the 104,000 jobs added, jobs increased in health care and transportation. Government added 10,000 jobs. Manufacturing jobs declined by 16,000, a cause for concern. A more accurate measure of unemployment is the underutilization of labor called U-6 by experts, this includes part time workers who would prefer to work full time- this has remained at 14.7% for Sept. 2012. The overall picture is that the job market remains sluggish. Because Labor Department numbers are prone to revision this could change in coming months. The slowing economy in China with the new stimulus in China coming in at one eighth the size of the old stimulus (1 trillion yuan over 4 years compared to 4 trillion yuan over 2 years 2009-2010) because of inflation concerns and risks of aggravating a property bubble, and the declining growth in the eurozone- France with zero growth in 2013 and Germany at 0.9%, Italy and Spain declining growth- means the prospects for U.S. economic growth will be lower in 2013. U.S. GDP growth was 1.3% in the second quarter according to the Commerce Department, and Macroeconomic Advisors predicts GDP growth of 1.5% in the third quarter in downward revisions. ...

Benny Gantz of the wartime Unity government calls for new elections in September as demonstrations for a new government take place in Jerusalem and Tel Aviv. US president Biden tells Netanyahu on Thursday that US support hinges on treatment of civilians in Gaza. Biden says he "outraged and heart broken" at the airstrikes on aid workers vehicles in Gaza. Gantz, a former general and prime minister of Israel, said- “This agreed-upon date for elections will leave us time to continue the security effort, and it will allow Israeli citizens to know that we will soon need to renew the trust between us,” he told a news conference. “It will prevent the rupture among the people.”  One of the problems Israel faces is the political fragmentation, many parties and frequent elections leading to changes in government unlike the early decades after independence when the Labor party offered effective leadership. The social Labor and agriculture farms movement is how Israel started and prime ministers till 1980's were from this Labor and farms movement including David Ben-Gurion and Golda Meir. As Israel evolved into a more technology oriented state this aspect was lost leading to a great measure of inequality, and changing governments without a clear vision for the future.   ...

With the US, India, Australia, and Japan committed to freedom of navigation and international law in the region. It is all about investment, new supply chains, trade and growth, science and technology. Sidney Poitier accomplished a great deal for the cultural changes that happened since the fifties in race and attitudes in America and Europe, by portraying black people in brave and interesting roles. Here Germany's DW.com looks at Bahamian-American actor, film director, and civil rights activist Poitier in a European perspective. Poitier was born to parents from the Bahamas where he grew up, and lived with his brother in Miami at age 15. There he could barely read and learned reading from a Jewish waiter while doing dishes at a restaurant. DW.com says "In the Heat of the Night" remains one of the best films to deal with the issue of racism. Other Poitier films also took up the issue of racism from different angles to defuse prejudice. Critics said the black characters in his movies are always good hearted, strong, proud, but not showing human flaws. DW.com points out that Poitier would have preferred to also play different roles, but he wanted to contribute to the black community through his acting. Poitier had depth of talent and character. A quote on Arizona State University website for the film school named after Poitier shows his thirst for knowledge: "No one knows all there is to know. The task is to learn as much as you can about as much as you can."  Both Poitier and Belafonte who had backgrounds growing up in the West Indies in families struggling to make a living, never stopped learning. ...

Sanders, the most senior leader  for Democrats in the Senate says Biden is the most effective president in modern American history, through the pandemic with a bold vision for the country. Bernie Sanders, the senior senator from Vermont, says he will do all to get president Biden reelected.  To critics he says Enough! Sanders says Americans should support Biden because of the American Rescue Plan that he orchestrated and helped the economy recover faster than was thought possible. It put Americans back to work, provided cash benefits to people worried about the future, and protected hospitals, small businesses and schools. Through his Infrastructure Plan Biden has created millions of well paying jobs and is repairing America's broken and neglected for decades infrastructure- roads, bridges, airports, and mass transit. Then there is the largest investment for climate change action in history, there is student debt relief for 5 million people, delivered free vaccines, cheaper insulin, and capped price pharmaceuticals. Biden says the health system is broken and hugely expensive and America still needs a health coverage for all single payer system. A lot remains to be done and this is just the beginning to fulfill the hopes and aspirations of the American people. No amount of dissimulation, distortion of facts can change that. Roosevelt said in 1932- "GIve me your help not to win votes alone, but to win in this crusade to restore America to its own people." ...

Even though volatility is high in stock markets, the U.S. stock market has rebounded to levels in August 2019. The level on March 10, 2020 after effects of the coronavirus on the global economy was for the DJIA average in the U.S. to be at the level it was on August 14, 2019, as shown on the graph in the WSJ, in the neighborhood of 25,000. In the last quarter of 2019 there were steep gains in the Dow Jones averages that could not be fully explained, these gains have disappeared. Considering the suddenness of the crisis from the coronavirus in China, and the double whammy of impact on global manufacturing supply chains of first the tariffs on Chinese exports to the U.S., followed by the coronavirus, the impact on stock markets seen in this overall context is comprehensible. Particularly the sharp gains in the last quarter of 2019 which now appear to be muted. There is also some good news for economies such as China and India, which are large oil importing countries, and the rest of Asia, in the sharp drop in oil prices that helps cushion some of its impact on the global economy. For the U.S. this also happens at a time when the economy is in much stronger shape than at any time in the last ten years. ...

The small car Fiesta will take a cue from Toyota's Corolla and Honda's Civic and be sold around the world under one name. The Fiesta has beeen sold in Europe for 30 years. The unaffordability of housing is pushing more people to rent homes and apartments. The price increases for housing was 4.4% in January 2025 over 2024. This is lower than during Covid years. The supply of housing is tapering off and declining. As a result in the next 2-3 years says the WSJ the housing rental costs will rise sharply again. Added is the effect of deportation on construction workforce which has 13% of workforce as migrant labor. 

Housing makes up one third of the price index. Expect this cost to go up and inflation will not be coming down to 2%. The Fed will have to hold off on cutting rates to prevent another surge in inflation.

Britain with the Conservatives in charge is without a clue and financially strapped- the mood in Birtiain is now for Labour under Starmer to right things the way Biden is doing in the US.  ...

Without this money that goes to tax cuts for wealthy there is not much to invest in Make at Home, in manufacturing in US the way Biden is doing and plans for next 4 years creating hundreds of thousands of jobs every month and still keeping inflation low at 3% through an investment driven economy. ...

An unattended vegetable stand in the Ebusi neighborhood of Tokyo. A few minutes from the rail station is this vegetable stand run by Tomo from Hiroshima and her son 14 year old Satoru, a former real estate office worker who quit to open a vegetable store. One day she was shocked to hear a customer say she had money enough to only come once a month for vegetables. Tomo closes this store and opens a vegetable stand which prices vegetables at prices young workers on low wages can afford. One young worker from Okinawa who works for a large company made so little that she had only $70 for food in her monthly budget. She becomes a regular customer and asks her grandmother how to cook zucchini, eggplants so she can save money by cooking at home. This is a really heart warming video about Tomo's farm in a prefecture near Tokyo a 2 hour drive away. Tomo prices everything at 70 cents or 100 yen a plastic bag of vegetables. Her son learns to farm and to run the stand. Mostly the stand is unattended with long caring messages on a message board to customers. It tells young workes not to worry too much about the future. ...

Bayer AG CEO Marijn Dekkers talks to the Journal's Geoffrey Rogow about the company's pharmaceuticals business and job retention. Dekkers says profits are reduced by the tight budgets of European governments and the pressure on pricing. He cites the 16% mandatory rebate in Germany on prescriptions. For Bayer diversification through the chemicals business offers a way to handle the ups and downs in the pharmaceuical business with patent expiration. He is not interested in acquisitions because of the high premium involved and the difficulty of recovering this for investors. Bayer like other drug companies has extensive operations in China. Bayer is training salespersons in top and second tier Chinese cities. It has a program to train 10,000 physicians in rural areas of China working with the local government. Dekkers makes an interesting point about jobs and job retention in the U.S. He says a lot of jobs were outsourced in the 1990's and its difficult to bring them back. Germany has done a better job with job retention with "kurzarbeit" and other programs working in partnership with industry. In his view this could have been managed better in the U.S. with active programs such as this in the last two decades....

This WSJ story provides a fascinating look at how Italy planned for too long, but failed to finally execute the final step of using the submersible steel floodgates that were already built to tackle just the kind of flooding that happened recently.  Problems include the use of submersible steel floodgates that would go back under water  after use in a flood, causing an additional complication to building the floodgates. The city itself was not entirely behind the plan so that execution was delayed. The politics and corruption added additional delays that astonishingly delayed the plan for over 10 years. About 80% of Venice was flooded with waters rising 6 feet above normal levels on November 12, 2019. It is hard to believe that 78 yellow steel barriers stayed on the seabed instead of blocking the three points at which water could enter from the sea into Venice. Most of the area has normal land barriers and the steel gates were designed to block water from entering at the smaller points that separate land barriers. It is also unbelievable that the plan started after a bad flood in 1966, construction beginning in 2003 after approval by over 12 public bodies, expert panels and courts on the complicated design. Costs went up as years passed from $1.7 billion to $5.5 billion. Ordinary Italians say Rotterdam has similar problems and has dams and no flooding, that the underwater design of the gates did not make sense just for aesthetics. Some experts say the underwater design doomed the project by making it costly and difficult, bureaucratic delays did the rest. The longer the delays and higher the cost the faster it eroded support in Venice and Italy, leading to this improbable result of building the flood gates with the underwater design, testing them but not making it operational in the final step, and not authorizing the use on November 11, 2019. The gates were in disuse astonishingly for so long that rust was discovered at one point.  Venice is now losing much of the population near its canals with only 50,000 remaining from a one time population of 171,000. The latest flood damage is over $1 billion and inexplicable after so much effort building the 74 yellow floodgates under water. ...

Tsai Ing-Wen is elected president of Taiwan by a landslide in the Jan. 2016 election. Tsai, leader of the Democratic Progressive Party (DPP) was elected with 56 percent of the vote, compared to 31 percent for the Koumintang candidate Eric Chu. The DPP won 68 seats out of 113 in Taiwan's parliament. Tsai told a news conference about Taiwan- China relations - "I also want to emphasize that both sides have a responsibility to find mutually acceptable means of interaction that are based on dignity and reciprocity."

Trade between Russia and Germany was about $100 billion in 2013, or about 3.3% of German exports. About 300,000 jobs depend on exports to Russia, according to Germany's DIHK Chambers of Commerce.
