It also says the Governor Mr. Snyder should have acted when the senior staff memebers at the governor's office asked him to do so.The EPA is faulted for prolonging the crisis by delays in enforcing drinking water standards. The problem began with the emergency manager appointed by the governor acting to make cost cutting moves for a city in financial trouble. The Panel Report puts the responsibility for overseeing the emergency manager role on the state government and the Governor.

How electric utilities and the oil industry are backing California's fight with the EPA to regulate auto emissions, cutting them by 30% by 2016 for new cars and trucks in the state. Its a fight endorsed by 14 states in the Northeast and Northwest. California sued the EPA, and in effect the Bush Administration which controls the EPA, in federal district court and federal appeals court. THe EPA has taken two years to respond to California's request for a waiver so that it can regulate auto emissions in its state. California's auto emissions rules are part of a broad effort to reduce all emissions in the state by 25% by 2020, including by manufacturing, electric utilities and the oil industry. Utilities and the oil industry share the opinion that all sectors of the economy should be required to take on this responsibility, including the transportation sector. In the past oil companies and the auto industry have been at loggerheads about who is responsible for the worsening dependence of the USA on foreign oil and the worsening impact of the oil consumption on the environment and their advertising campaign have often shifted the blame on each other. The LDP's landslide victory in the Dec. 2012 elections is not seen as a mandate for Shinzo Abe, the new LDP prime minister. Abe acknowledged this when he said: "We recognize that this was not a restoration of confidence in the Liberal Democratic Party, but a rejection of three years of incompetent rule by the Democratic Party." The LDP won 294 seats compared to the 308 seats won in the landslide win by the Democratic Party of Japan three years ago. Abe campaigned on a stronger stance in Japan's disputes with China. Yet he is committed to maintaining relations with China, a key trading partner. On China Abe says: "Our goal is to stop China from making these challenges, but we do not intend to allow an overall worsening in relations." Osaka Mayor Hashimoto's Japan Restoration Party was expected to do well but his campaign lost momentum after joining with Shintaro Ishihara, a nationalist politician. The Tomorrow Party which campaigned on the nuclear issue and anti-nuclear sentiment petered out after voters sensed the impact of electrical shortages and prices. The LDP is pro-nuclear and plans to reverse some of the anti-nuclear steps taken by the DPJ. The Democratic Party of Japan gained only 57 seats, and the former DPJ prime minister during the earthquake and tsunami, Naoto Kan, lost his parliamentary seat. Just as the PRI, a party that held a long monopoly of power was returned to power in Mexico in 2012, the LDP is returning to power, but very dependent on voters aspirations for good governance and its performance in office....

The US president calls Brazilian president Lula Inacio Da Silva, "a good person actually," after meetings at the UN in September 2025. Tariffs imposed on Brazil for cocoa, coffee, meat and fruits have been lifted. Lula asserted Brazil's independent institutions and Brazil as a sovereign country. The tariffs were never popular in Brazil and Lula's popularity in Brazil is now up to to 33% after an earlier decline. He is more energized and at 80 is expected to run again for office. COP30 just completed in Belem, Brazil, and Lula has received favorable response in trying to salvage the climate agenda following the shift away from costly climate change decisions to the cost of living crisis.

The Trump administration is looking at ways to protect U.S. automobile manufacturing by enforcing stricter environmental rules for automobile imports. The EPA is looking at whether VW which has 3.5% of the American market can be asked to meet stricter standards because the diesel emissions scandal gives the U.S. legal justification to set stricter emissions rules. VW has accepted that it used illegal software to evade government emissions tests. Such non tariff barriers are faced by the U.S. companies in Japanese, South Korean, Chinese markets. It is not clear how this would affect the 17.1 million cars made in NAFTA factories with parts made in one country and shipped for assembly in another country, between Canada, Mexico and the U.S.

About 33 million went hungry in Brazil in 2022 compared to 19 million in 2020 showing the difficulties Brazil faces. About 700,000 people died during the pandemic. The Worker's party pushed through a constitutional amendment last month to lift a spending cap so that about $28 billion in extra spending  can help alleviate these problems.

The average of vehicles on the road reached a record of 11.1 years in 2011, according to R.L. Polk research company. Using the average of 15,000 miles driven a year used by the EPA for cost calculation on fuel economy labels, shows that car are being driven for much longer nowadays, over 150,000 miles. In the 1960's and 1970's the average was closer to 100,000 miles. Because of the EPA mandated fuel emissions standards and technological advances the newer cars in 2012 have better life than the older cars in the 1970's. Toyota's, Honda's and Volvo's frequently get 150,000 or 200,000 miles and still have some usage left for example. In addition the tighter fuel efficiency standards of the Obama administration and technological advances now underway are likely to bring a new generation of cars that provide another level of improved performance.

How to get smaller supply chain companies with less than investment grade ratings to shift to renewable energy contracts that last 5-10 years when banks have strict lending criteria. Walmart has a solution working with Schneider Electric. Consider that companies are tackling emissions across their entire supply chain. For Walmart this means cutting one billion metric tons of emissions by 2030. Under Gigaton PPA Walmart suppliers can form a group to buy energy. So that Amy's Kitchen, Great lakes Cheese, and Levi Strauss collectively purchased a12 year renewable energy purchase agreement  from a wind farm in Kansas operated by Danish energy company Orsted. Energize is a similar program funded by drug companies Pfizer, Biogen and others for their supply chain and delivered by Schneider Electric. Consider that for Microsoft's 13 million metric tons of carbon dioxide emissions, 96% come from the supply chain. It needs to cut emissions by half by 2030, a big challenge. In the European Union the solution being considered is for the European Commission to offer state backed and market backed guarantees for deals. Guarantees would be offered by member states of the EU or banks and insurers to provide backing for purchase agreements buyers to overcome credit constraints. ...

On May 13, 1954 Republican president Eisenhower signed the Seaway Act and authorized construction of the St Lawrence Seaway with Canada at cost of $C135 million with 22,000 workers.The US Army Corps of engineers began construction of the US section in 1957 and completed it by 1959 for oceangoing ships to navigate the St. Lawrence River from Duluth in Minnesota and Milwaukee to Quebec and on to Montreal and the Atlantic. The politicians in Japan are seen as aself-selecting elite, not just the LDP which has been the party in power for mostly all the post war years, but also the Democratic Party of Japan. Mr Ozawa the DPJ leader was from the LDP, and the new leader Hatoyama's grandfather was an LDP founding father. The LDP prime minister is Mr Aso whose grandfather was Shigeru Yoshida, a prime minister after the war. Mr Hatoyama and another DPJ leader are defectors from the LDP, and both have large family fortunes, as do many LDP leaders. Mr Hatoyama has abrother in the current cabinet. And LDP olitical families treat seats in the paliament the Diet, as inheritable sinecures. Actually half of the current cabinet of Mr Aso are offspring of former politicians. So the Economist is pessimistic about the prospects of real change and fresh ideas for Japan from this crowd of politicians. It sees the need for new ideas. The economy has seen asharp decline in exports. Companies like Toyota are seeing a drop in sales. Government debt is twice the annual output, larger than Italy's. Export led growth which was the basis of recovery since 2002 has crumbled. The demographics estimates show that Japan's working age population will fall fastest as its overall population drops significantly in coming decades. This makes the schemes of the LDP like sending back immigrants of Japanese descent to Brazil with no chance of return as a particularly nutty in the light of the demographics. Leaving change to Mr Hatoyama and Ozawa of the DPJ now makes the prospects of new ideas just as elusive as before. And the public is just as disillusioned, considering the very low ratings of Mr Aso and other politicians....

RICO prosecutions in Georgia for racketeering use a broader definition of the term. Mr. Trump's intent matters and Attorney General Barr's telling Trump that there was no substance to fraud claims.  WSJ says the state RICO law is broadly written giving the state prosecutors more latitude than federal prosecutors when pursuing alleged criminal enterprises.The Georgia RICO law on racketeering say defense lawyers is unconstitutionally vague and overbroad. Yet the state's highest court has upheld the law and cases have been filed and successfully prosecuted in Georgia. Most recently by prosecutor DA Fanni Willis against 35 school officials and teachers for a test cheating scandal. Of 12 charged in that case 11 were convicted, one acquitted.
