The Labor Department says that by not adopting these standards for social distancing, mask use and paid time off for vaccination, these states are risking the health and safety of health care workers. Border crossings and encounters have fallen to 83,000 under president Biden with unilateral action by Biden in the absence of the Republican Lankford Biden legislation that would have shut the Border down. Border crossings of 83,000 are close to the border crossings that reached 74,000 under president Trump even with the building of a border wall. This was achieved with the support of the Mexican president and with Biden's action to effectively close the Border. The best action would have been to implement the legislation that Republican senator Lankford negotiated with Biden by February 2024 and which was allowed to languish in Congress by new Speaker Mike Johnson under the advice of the former president, which is incomprehensible as it is the first time in decades both parties came on to the same page to slow or diminish migrant entry into the US and remake the asylum laws. Many Republicans and Democrats protested this action of the new Speaker. It was a historic and missed opportunity to fix the Border once and for all, and took the courage of Senator Lankford and Biden. For this action Lankford goes down as a senator who belongs in Kennedy's Profiles of Courage, a book of Congressional leaders since 1800 whose courage and leadership have made America the leading democracy and industrialized nation that has won the respect of the world. ...

Under the Deferred Action for Childhood Arrivals (DACA) executive order of 2012, a group of immigrants brought to the country as children can have temporary status to stay and work in the U.S. In 2012 this was restricted to children brought in under the age of 16, with a maximum age of 30. The program was called "Dreamers." Under president Obama's executive order this will be changed to children brought in under the age of 18, with no maximum age. The number of immigrants goes up from 1.2 million in 2012 to 1.9 million with this particular change in 2014. A new group of parents of children who are citizens or legal residents residing in the U.S. for more than 5 years adds another 3.3 million to this number, with an additional 100,000 for parents of Dreamers. The total 1.9 million children and 3.4 million parents would be 5.3 million given new status to stay and work in the U.S. The 5.3 million will not be eligible for subsidies and for the Affordable Healthcare Act assistance. All will be required to pass security checks. This leaves about 6 million, including farm workers and other undocumented or illegal immigrants not touched by the new executive order. President Obama is expected to make the announcement of the executive order on Nov. 20, 2014, in Nevada, a state with a large Hispanic population. On the question of legal authority for the executive order, Prof. Stephen Yale-Loehr, an expert on immigration law at Cornell says the U.S. president does have broad authority to decide which group should get a reprieve from deportations. The decision to exclude benefits of government subsidies and subsidized healthcare was made to appeal to increased support of the American public for the executive order. ...

Homeland Security and ICE needs new resources- $175 billion from Congress is part of the plan from Republican Senators to boost support for action in immigration. To deliver on plans to control illegal migration there is a need for funding the agencies involved. Senate Budget Committee Chair Lindsey Graham (R-South Carolina) says in this report that Homan was “begging” for funding from Congress. Much of the migrant action is hard to undertake with current resource levels. Graham’s committee adopted a budget blueprint for legislation to boost border security and immigration enforcement by $175 billion. This report by Jia Lynn Yang in NYT covers only the Coolidge period and the JFK period ignoring the wider trend since the 1850's when immigration from Asia to the US was discouraged. The laws limiting Japanese, Chinese and Indian immigrants were put in place long before 1924 by the 1890's. Japan agreed to limit immigration to the US under an agreement with the US after 1900. China was undergoing a transition under the Boxer Rebellion and upheaval in government in the period after 1900, India was part of Britain's colonial Empire.It does not mention that Chinese laborers helped do the dangerous work to build the railroads east to west. It also ignores the immigration from Mexico which was a special case in immigration because of Mexico's relationship along the border, first with the Mexican American War that achieved Jefferson's idea of a continental nation coast to coast. Mexico was a source of labor for US agriculture in the 1930's and 1940's when Asian immigration was severely constrained. When Gen. Eisenhower won the election in 1952 immigration policy was on the agenda, in fact Truman had a commission look at it by 1950. Operation Wetback was launched by Eisenhower and returned millions of Mexican migrants back to Mexico. Fearing the lack of farm help for Mexican agriculture Mexican agricultural interests supported the return of migrants. All this is left out by Lynn Yang. For almost a century Asian immigration was discouraged till JFK with experience in Asia during the war looked at Asian immigration to US differently passing new legislation to support this in the JFK/LBJ terms as president. In this sense the operations under DJT at the Border  and in the US in 2025-2026 are similar to what happened under Operation Wetback under a popular president Eisenhower, after the surge in Mexican migration adding millions of migrants to the US population in the 1930's and 1940's. A greater glimpse of the US can only be imagined if after the early immigration and discovery of the continent by the Spanish, the French and the British by 1600, the continent had not been unified first by the war of 1756-1763 with the French and Indian Wars creating the original 13 British colonies before the War of Independence in 1776, and the expansion to Spanish/Mexican territory to the West and South including California, Texas and Florida in the Mexican American War of 1846-48. In that situation there would be five sectors in America- British, Spanish, French, Mexican and American. The US could not have advanced as an industrial power divided in this way and would not have attracted immigrants from Europe the away it did. If it was split into two Southern confederacy and Northern Union states it would also have led to a similar situation. There would be conflict. It is only divine intervention and the courage and ideas of Jefferson and Washington, the work of president Polk, the leadership of Lincoln, and the industrial revolution on a large scale of one Nation in peace for most of the 19th century, that it became a haven for immigrants from a troubled Europe, a struggling Asia and Mexico. ...

Mexican president Nieto's poll numbers are at all time low of 24%, according to Reforma newspaper. He took office in late 2012 and has been hurt by human rights scandal of the murder of 43 students in the state of Guerrero, corruption issues, and failure to improve the economy. The invitation to Trump to visit Mexico left even people close to the president surprised, and was criticized widely inside Mexico. It is not clear what Trump or Nieto gained from the trip. As Trump continued his talk about building a wall on the Mexican border and having Mexico pay for the estimated $23 billion it would cost. He did this in a speech to supporters in Pheonix on the same day he met Nieto, showing the use of teleprompters and prepared script was not his way of campaigning. Just as the message to black people that Democrats take them for granted cannot resonate without the basic message delivered with compassion and understanding- such as done by the presidents Bush and Reagan- so also the message to Hispanic people is suffering from the same lack of empathy. Recent polls show only 3% of blacks support Trump. McCain and Romney gained only 4-6% in the U.S. presidential elections of 2008 and 2012. The message of the wall is also baffling as an election strategy. A Gallup poll in July 2016 shows only 15% of Americans opposing a pathway to citizenship for illegal immigrants, and only 24% of Republicans. There is another problem in the strategy. The rhetoric about walls and mass deportations, and the Trump temperament combined with handling of nuclear weapons is not winning college educated women in the suburbs with polls showing Trump lagging behind Clinton by about 20 points or 4 million voters with this group. It is hard to undo the damage done by this kind of rhetoric used in the primary elections as it gains distrust of voters. It would require a bad economy with illegal immigrants taking local jobs, and handling of immigration seen as weak, for such a message to gain some national traction. Both are absent for the most part with a steadily improving economy since 2012, lower unemployment, a tough enforcement policy on deportatons under Obama that exceeded that under Geoge W. Bush, and the talk of a wall comes with illegal immigration having declined steeply since the 2008 financial crisis. The real culprit appears to be elsewhere, the triple hit taken from hollowing out of the manufacturing economy that hurt the Conservatives in Canada, the insecurity created for older whites from the job losses and hits to net worth from the 2008-2009 financial crisis, and the increasing loss of access to health care and educational opportunities with high  costs. About 62 million households or the bottom half of the distribution in the U.S. have a net worth of about $10,000, a quarter of this group having zero net worth, according to the Federal Reserve's Janet Yellen at an Inequality Conference in Oct 2014. Problems no wall is going to solve, problems that built up over 2 decades, problems that will take a generation to fix.  It shows the tech miracle of the last 2 decades as a mirage for quality of life of the middle and working class. Tech as a tool to a goal, not a goal in itself, is the better way forward. ...

This editorial in the WSJ says Judge Hannon was right to question the wholesale suspension of immigration law by the DHS memos blanket use of discretion in impementing existing immigration law. The ruling did not address the broader constitutional issues for an executive order that bypasses the states (and Congress) completely- 26 states have questioned the order. WSJ says Obama's executive order is going beyond presidential powers, and can be done by enacting legislation under Article I of the U.S. Constitution. Hannon's ruling justifies the injunction against the executive order on the basis of unfunded mandates such as the $198.73 it costs to process driver licenses for 500,000 illegal immigrants living in Texas from a total of 1.6 million illegal immigrants in the state, not even taking up the other costs related to education and other benefits.

The campaign rhetoric for renegotiating NAFTA and building a wall at the border has had a sharply negative effect on growth in Mexico. Growth slowed in 2016 and is expected to be close to zero in 2017 with declining foreign investment in the economy. The uncertainty is leading to sharp decline in foreign direct investment of 24% in the first 9 months of 2016, according to the Bank of Mexico. Further declines can be expected in 2017. The decline in the value of the peso of 16% since May 2016 has led to 6 interest rate increases in the past year. Inflation on annual basis was at 4.72% in Jan. 2017 and is rising. As Mexico depends on exports for one third of its output growth, and 80% is sent to the U.S., there is a need to diversify with trade agreements made with the European Union and other countries. Mexicans now question the value of NAFTA trade agreement as average growth of 2.6 since NAFTA was signed is below the 4.6% in the 2 decades prior to that. And poverty level is the same with about 60% of people in the underground economy. In addition crime, drug trade, a weak education system, weak rule of law, political corruption, show that Mexico has not made the progress since NAFTA that it should have made. ...

Michael Shear says president Biden is listening to his head about the US Border with Mexico- that he would close the US Border if the bipartisan bill is passed in the US Congress, the same day that he signs it to become law. The new bill agreed to in negotiations between Senator Graham and other Republican Senators and the White House ends current parole and asylum policy  that have led to chaos at the border. Shear who has covered presidents for 30 years shows that president Biden held the view that he was elected to provide a human face to the crisis at the border from international migration and close private prisons and poor treatment of children. He listened to both sides of his party during 2021 and 2022 after becoming increasingly aware that something was wrong and by Jan 2023 was convinced that tough action was needed at the border to deport Haitians and other people from central America smuggled northward with 13 flights a day to Haiti to deport illegal migrants.  He made his first major immigration speech at that time. The problem was that there was a major upheaval in Venezuela adding to the tide of illegal migrants as Venezuela sent millions to all countries in Latin America and north to the US, an international crisis playing out in Colombia and other neighbors for the last 10 years. When Lopez Obrador of Mexico closed his own migrant deportations Biden sent Blinken to Mexico with Homeland Security minister Mayorkas, and after discussions Obrador resumed the deportations. Trains going north in Mexico had conductors who were bribed to slow down to take on migrants. This was stopped and all trains going north were stopped at Eagle Pass in December 2023. Republican governors Abbott of Texas and DeSantis of Florida have sent busloads or flights of these migrants to New York and other cities in the US showing that the entire system of migrant handling was breaking down even as president Biden was convinced by his own advisers including Jake Sullivan that the border required tough action. The president increased planned legal migration to lower illegal migration from Nicaragua and rest of Latin America. By January 2024 Biden was convinced the only solution was closing the US Border immediately after the bipartisan solution. Lindsay Graham senior Republican Senator agreed with Biden with one problem- the Republicans in US House of Representatives did not think it right to work with president Biden to settle the problem.  ...

Lulu Garcia-Navarro interviews Homeland Security head Alejandro Mayorkas and asks him direct questions about the border with Mexico, published Feb 2, 2024 in NYT. Why the surge in migrants asks Navarro. Mayorkas is himself a Cuban born immigrant. Republicans in the House are impeaching Mayorkas. Navarro asks can you clearly say what has gotten us to this place and what went wrong? Clearly something had happened in Latin America. Central America drove migrants north after conflicts in Salvador, in Nicaragua and drought affecting Guatemala's agriculture for over 2 decades under different administrations. Mayorkas says in response to the question that the world is experiencing the largest level of human displacement that it has seen since World War II. He says the entire hemisphere is experiencing the enormous displacement in Venezuela as its economy collapsed. During the nineteenth century after president Monroe put forward the Monroe Doctrine that created a uniquely American sphere that asked European powers to stay away from the Americas north and south, any attempt by European powers was seen as an hostile act. It was American opposition to European colonialism. By the time of the Eisenhower and Kennedy administrations this policy was not followed with the intervention of the Soviet Union in Cuba leading to a a wave of refugees from Cuba in the sixties. In the last decade the situation in Venezuela has worsened to the point that 8 million people have left Venezuela for neighboring nations, 2 million to Colombia alone, destabilizing the southern hemisphere. Venezuelans many from the educated middle class form the bulk of the surge in migrants across the US border with Mexico in 2022 and 2023. The problems were actually exacerbated under the Republican administration as the Venezuelan inflation spiralled after 2016 skyrocketing into hyper inflation by 2018 leading to the flow of immigrants outward that reached 8 million. This kind of hyperinflation the worst in the history of Latin America need not have happened with better managing of the crisis at that time. Mayorkas says the problem is that America's system of asylum is broken and both parties need to fix it. This is proposed by Tillis-Graham and Lankford all Republicans in the US Senate with president Biden's support. When he joined the Department of Homeland Security in 2009 Mayorkas says, US Border Patrol chief told him the real problem was that from the moment a migrant claims asylum at the border under US law and the adjudication of that claim it takes several years. This is the root of the problem the law can be fixed with the will of enlightened persons in both parties by simply passing a new law. Immigrants from Latin America are just as likely to vote Republican as Democratic and this may be particularly true for Venezuela's middle class that left the country as the economy collapsed with policies that led to inflation not seen in this hemisphere.  The other alternative is for the US and both parties to agree to what would be today's version of the Monroe doctrine- then opposing European colonialism, now opposing the breakup from within of Democratic countries in Latin America leading to waves of migration north of the border and causing upheavals all over the western hemisphere. Much less a policy of such resolution both parties have failed to fix basic policies of asylum and parole that today are being addressed by legislation being put together by Senator Lankford of Oklahoma, Lindsay Graham of South Carolina, Senator Tillis of North Carolina, three core states that are Republican since the Civil War, with the help of the White House and Senator Schumer. Yet in the House of Representatives Speaker Mike Johnson calls it dead on arrival simply refusing to break the status quo. ...

This report in the Economist points to the improved situation for Mexico after the scare from Trump's plans to build the wall and deport large numbers of immigrants. The peso dropped by 15% between mid November 2016 and January 2017, but has since recovered, and non-oil exports were up 5.5% in February 2017 over prior year with the manufacturing growth in the U.S.  Growth forecasts are now up from about 1% GDP growth previously to 2% for 2017, close to the 2.3% in 2016. Much of the change in mood in Mexico is a result of the failure of the early travel bans being blocked in the courts, the failure to get health care legislation through Congress, and the effort by the trade advisers and economic advisers around Trump to move Trump's positions more to the centre and closer to traditional Republican party positions. Wilbur Ross, the Commerce Secretary, says " a sensible agreement" can be reached with Mexico. Peter Navarro, trade adviser, talks about making "a mutually beneficial regional powerhouse." Robert Lighthizer, a veteran from the Reagan days, is likely to be made the new U.S. Trade representative. Still as the Economist points out the "20% border adjustment tax" continues to be supported by Paul Ryan in Congress to pay for tax cuts. But certainly the mood has lifted in Mexico in the first 100 days. This is true for economic policy in relation to China and Germany, and the close circle of Ross, National Economic Council head Gary Cohn, and Secretary of State Tillerson is moving Trump to the centre in policy statements to get things done. Mexico is faced with internal challenges of reestablishing the rule of law, improving infrastructure, reducing red tape and corruption, addressing problems in the education system, to promote economic growth. These challenges may prove to be as large as the external challenges were once thought to be. ...

When Whitmer in Michigan said "FIx the Damn Roads" that is exactly the kind of language people wanted to hear. Harris and Walz should do the same. They should take up Border Security in a big way face the issue head on. President Biden has already used executive action to cut migrant flow at the border. It was evident in Arizona today when Harris said she would sign into law the legislation negotiated by Republican Senator Lankford that passed the Senate and was held up by Trump for making it an election issue. Immigration declined in the 1920's so that when FDR became president it was easier to build a working class coalition. After 1965 when president Johnson signed into law a bill that allowed family unification it was seen as not adding significantly to legal immigration. Yet in the period after 1965 millions of immigrants entered the US. This writer says the Democrats have forgotten that FDR built the Democratic worker base when immigration was not an issue. Today the rise in immigration has muddled the Democrats efforts to build back the working class coalition of FDR, with loss of support from workers and non college educated people who see migrants crossing the border as a serious problem.

US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026.
