A 3 year old lawsuit by Viacom against Google's You Tube, was decided in favor of Google. Google was granted a summary judgement in this case. Viacom claimed that You Tube tried to exploit Viacom's copyrighted works and make a profit on them. Google's argument was that it was protected by the Digital Millenium Copyright Act. Viacom had sought more than $1 billion in damages. Judge Stanton said that general copyright infringement was not the same as knowledge of specific and identifiable infringements of individual items. In this case once Google received specific notice that a particular item infringed a copyrighted work, it quickly took that item out. And none of the aleged video clips are on the site.

BJP led by prime minister Narendra Modi wins a huge majority of 325 seats out of 405 in India's largest state Uttar Pradesh for the state assembly elections. The national opposition party Congress wins only 7 seats in what was once the main source of Congress support during the period of Jawaharlal Nehru and Indira Gandhi. This will enable the BJP to push forward with the modernization program for infrastructure and roads, and other development. Opposition in the upper house Rajya Sabha and lack of support from states will not be a major hurdle in development now that BJP has won in states such as Orissa, Maharashtra, Uttar Pradesh, and Uttarkhand in recent state elections after its win in the 2014 national parliamentary election. This also gives credibility to the government's other efforts such as demonetisation to fight corruption in real estate and other areas. India's GDP is a fraction of China's and it is smaller than that of countries such as Indonesia, because of the poor administration and lack of development in India's 2 largest states of Uttar Pradesh and Bihar in the northern Hindi speaking region. To double the GDP from its current level will require doubling the GDP of Uttar Pradesh and Bihar. Britain will offer a pathway to citizenship to 3 million Chinese in Hong Kong, British Foreign Secretary, Dominic Raab confirmed an earlier statement. This applies to British National Overseas status (BNO) and their dependents upto 3 million. He stated that the new security law to control protests in Hong Kong were a "flagrant" violation of the agreement made with China 23 years ago.  He called it a "clear and serious breach of the joint declaration" of the two countries in 1997. The new arrivals from Hong Kong and their dependents will be given 5 years limited leave to stay and work in the country, at that point they can apply for settled status and after 1 year of settled status they can apply for British citizenship. The Foreign Office expressed alarm at one provision article 38 of the security law that seeks jurisdiction over anyone who criticizes China wherever they are in the world, putting them at risk if they travel to Hong Kong or China. ...

An independent parliamentary panel in Japan described the Fukushima nuclear plant disaster as a "profoundly man-made disaster." It was sharply critical of TEPCO, the company running the plant, and the Japanese government's response. The investigation chairman Kiyoshi Kurokawa said in the report: "What must be admitted- very painfully- is that this was a disaster 'Made in Japan,' its fundamental causes are to be found in the ingrained conventions of Japanese culture: our reflexive obedience; our reluctance to question authority; our devotion to 'sticking with the program'; our groupism; and our insularity." This comes as a report by TEPCO shifted public attention to "a tsunami beyond our imagination," creating a large credibility gap with the Japanese people, because the public is skeptical about TEPCO's attention to safety during the period leading to the accident. The parliamentary report calls attention to safety factors that were ignored so that companies would be required to take further steps including costly modifications of plant equipment. A critical flaw was the lack of a independent safety agency that could enforce safety measures that TEPCO might be reluctant to make because of cost considerations. Astonishing as this may sound, the Nuclear and Industrial Safety Agency (NISA) in Japan is part of the same government ministry that promotes nuclear power, creating a sort of "nuclear bloc," which before the accident connected the safety agency to the bloc. Because of this the panel report says, NISA did not require TEPCO to prepare for a full station blackout- the loss of main and backup power- because the "probability was small." Other factors that need to be addressed are the breakdown in communication and cooperation between the people operating the plant and the people responsible for Japan's nuclear safety. The prime minister's office waited too long before declaring a state of emergency. To come up with the conclusions the panel made 1000 intervews and conducted 900 hours of hearings. The questions left behind by the nuclear accident in Japan are whether Japan should continue with the same level of dependence on nuclear power, whether it should shift out of nuclear power on a gradual basis as Germany is doing ironically after the Fukushima accident while Japan is reactivating its nuclear plants to meet energy needs. If Japan continues with a smaller reliance on nuclear power what changes have to take place for an effective safety agency completely outside the "nuclear bloc," and the series of other changes that have to take place in the nuclear power industry's handling of safety. Public opposition continues to focus on this because of distrust of the nuclear power industry after the accident....

The auction of the Libra ultra-deep water oil field in the waters off Rio de Janeiro, Brazil. Shell, Total and two Chinese companies took part in the auction. Libra is estimated to hold about 12 billion barrels of oil and combined with the other fields in the newly discovered area has about 50 billion barrels of oil. Brazil's laws passed after the discoveries offshore were made in 2006 give Petrobras a critical role in development of the oil fields. A new company Petrasal was created to oversee the new oil fields. The winning bidder in this auction is required to pay the government $7 billion in an upfront payment and source much of the equipment inside Brazil. New investments are required in education, infrastructure and supporting public services after nationwide street protests, making oil field development and new revenues a priority for the government of Dilma Rousseff and the Workers Party that runs the government.

This conversation of the president with the NYT is remarkable for its frankness about people close to the president during the election campaign, particularly Jeff Sessions of Alabama. The president also says Mueller should stay only with information related to Russia and not stray from that to delve into Trump's finances. During the election efforts were made to get Mr. Trump to disclose more about his finances as a real estate businessman- most of these efforts failed and not much is known about president Trump's finances. The president says he never said he would order the Justice Department to fire Mr. Mueller, yet he left open this possiblility, according to the NYT, as the president feels it has affected the first 6 months of the Trump presidency. This interview with president Trump was published on July 20, 2017, the day after an editorial in the WSJ by the Editorial Board of the Journal on July 19, 2017, calling for transparency from president Trump on the Russia investigation. This was an exceptional and powerful editorial by its editorial board telling president Trump that he must tell everything he knows now or face the risk of losing public confidence, and risk his presidency. It said that president Trump was wrong to think that his larger than life personality and social media role could insulate him from the effects of this lack of transparency. ...

David Brooks of the NYT says the Republican party is failing when it embraces Trump's version of populism with its racial division, tax plan that favors Republican donors and ignores fiscal conservative concern over deficits that affect future generations, supporting the election of Moore in Alabama, the constant Twitter comments that show prejudice. He says this will have destructive effects that could last an entire generation. This isn't the Republican party he has known for so long, says Brooks. The time is passed says Brooks when sensible republicans could go along in the middle by not agreeing with Trump, yet avoiding the task of opposing the elements of Trump policies that conflict with America's long held ideals shared by both parties. He calls its a corrupt deal that Republican party leaders in the Senate and Congress have agreed to make with Trump thinking that somehow this will all work out for them even if it doesn't for the party. Hedge funds betting against China's currency in Jan. 2016 puts Wall Street at odds with China's central bank's effort to manage the decline in the currency. Some hedge funds see a large drop in the value of the yuan in 2016-2017. China also faces the risk of large capital outflows. This is happening against the backdrop of China's effort to cut overcapacity in steel and other industries, manage large debt and the slowing economy, to shift towards a less export dependent and more domestic consumption oriented economy. The U.S. House of Representatives votes 285-144 to suspend the debt ceiling till Feb. 7, 2014. The deal forged in the Senate by Democrat Reid and Republican McConnell passed in th Senate by 81-18. The U.S. stock markets closed with the DJIA at 15374, up 1.6% compared to Sept 30 when the government shutdown began. The Republicans opposing the passage outnumbered those supporting it 144 to 87 in the House of Representatives. Because this was a repeat of similiar failure to reach agreement and last minute deals in 2012 and 2011 the equity markets appear to have taken the conflict between the two parties in stride.

After taking the recent writedowns Bankia should have setu provisions for losses on real estate bad loans equal to 48.9% of its real estate portfolio. The Spanish government said on May 25, 2012 that it would inject 19 billion euros to recapitalize Bankia. Yet this raises more questions about the rest of the banking system and the need to set aside adequate reserves for bad real estate loans. Extrapolating from the writedowns at Bankia for real estate losses, about 45 billion euros would be needed for the other Spanish banks, according to UBS. And this raises the question of how the government would raise the money to recapitalize the banking system, as Spain's borrowing rate on its 10 year bonds has increased to 6.45% in May 2012. If Spain provides government bonds to banks the markdown on the bonds would still need to be shown separately, and a large figure would be a sign of increasing riskiness to bond investors.

With funding from the International Finance Corporation, Bangladesh, Pakistan, and other developing countries with shortfall in energy supplies are building offshore LNG terminals. The demand for LNG in these countries is expected to surpass the demand in developed countries.  IEA estimates show 90% of global LNG demand growth by 2022 coming from these emerging economies. Shortages of electricity in places such as Karachi and Dacca are the reason for the growth. Putting LNG terminals offshore is a viable and economical alternative. Petrobangla is completing a offshore LNG terminal by 2018 with IFC funding. Pakistan completed a floating LNG terminal at Port Qasim in 2015 for importing LNG from Qatar. This terminal alone covers 30% of the needs not met from domestic supplies in Pakistan for gas, according to Engro Elengy data.
