The Trump administration sends an official notice to Congress that it intends to renegotiate the NAFTA treaty with Mexico and Canada. The new U.S. Trade Representative Mr. Lighthizer served as Deputy Trade Representative under president Reagan in 1983. He says the focus of the negotiation will to promote economic growth and jobs by making improvements to the treaty. The notice does not mention major modifications of the type that were hinted at by president Trump earlier. The leaders of Canada and Mexico had asked president Trump to renegotiate. Republicans in Congress and business in the U.S. favor improvements instead of the drastic changes. Mr. Lighthizer's approach is stated in his letter that said "NAFTA was negotiated 25 years ago, and while our economy and business has changed considerably in that period, NAFTA has not." New provisions will be needed said Lighthizer for intellectual property rights, state owned enterprises, labor and environmental areas, with effective enforcement.  Because of the rhetoric and language used in the election campaign, it is important to note that Lighthizer has in the past negotiated favorable terms for the U.S. steel industry to prevent dumping from overseas. His style is the opposite of the president. He has stated- "I am friendly when negotiating. I am not theatrical. The art of persuasion is knowing where the leverage is." ...

Amanda Lacaze of Australian rare earths maker Lynas- what can be learned from her experience in rare earths? Lynas is a Australian mining company with a mine in an eroded volcano Mount Weld that has a concentration of rare earths metals. In 2014 it was faced with China's near monopoly of rare earths and price subsidies, lack of awareness in financial markets and the government about the importance of rare earths in manufacturing. It was a period under the Obama administration that after the Bush administration had little grasp of the importance of manufacturing in America and how its decline would affect communities across the Nation, economists trumpeted the virtue of free markets without grasping how China would wrestle control of manufacturing with state subsidies and aggressive pricing and of strategic new technologies.  This included rare earths where the monopoly was close to 100%- if it is 90% today it is because of companies like Lynas. Production processes at Lynas's plant in Malaysia were not sufficiently developed in 2014. When Amanda Lacaze (now 66 years and head of Australia's Minerals Agency) joined Lynas in 2014 the first problem aside from getting Japanese creditors to restructure loans because of aggressive pricing by Chinese firms was to improve manufacturing processes to get 95% quality instead of 48% quality (measured in number of quality rejected product). This was achieved in the first year. To do this she thinned her management ranks and closed offices in Sydney (to cut costs) and moved management to Malaysia where the problems in manufacturing processes would make or break the company. She was able to get creditor Japanese government backed Japan Australia Rare Earths financial institution to renew and extend loans. Had this not happened the company may not exist today. It shows the sheer foolishness that pervaded most of the American industry at that time, the failed economic theory that said America could not support its industry when rivals were supporting theirs, the Bush and Obama administrations that had no understanding of how the industrial competition was takin place in world trade that could substitute other nations for America' s dominance in manufacturing and did little to push back and regain the position for America in world trade. This ignorance continues in some sections of business today that cannot see the plain facts and refuses to see the enormous damage to the Nation from the destruction of its manufacturing base and loss of good jobs in communities across the US. Lynas is now getting contracts from the US government for rare earths and is the only reason China's dominance in rare earths in 90% and not 100% along with MP Materials of the US. Planning was discredited in the crazy euphoria that turned the fall of the Berlin Wall and the Communist Soviet Union, as economists never understood that planning that was used by the Soviets and Chinese in their Five Yer Plans is just borrowed from centuries of basic ways of conducting business that had originated with the Industrial Revolution in Britain. Without planning the growth of the British Navy and the industry that supported it Britain could never have gained the dominance that it did in the 19th century Industrial Revolution. As the Industrial Revolution spread in the US in the 19th and twentieth century every major company had a 1 year Operating plan and a Long Range Plan for 5 Years and 10 Years. The government would have identified rare earths with foresight as one of the newer technologies and the manufacturing infrastructure needed to support its development if these plans were developed at the different levels of government and at the highest levels. This was done under market economy in China. Instead DJT was forced to step back from trade negotiations with China for unfair trade when China held out with a threat to stop export of rare earths materials in 2025, because a huge hole or gap in planning happened at the highest levels of the US government. That happened 11 years after 2014 when Australian rare earths maker Lynas survival was in doubt under a new CEO Amanda Lacaze. This is only one of many misses in American manufacturing and industry, in world trade, that came from misguided economic theory and failure to grasp the basic facts behind the success of the Industrial Revolution in Europe and the US. ...

There are similarities in the Republican and Democratic party platforms in 2016. One area of agreement is in the reinstatement of Glass Steagall Act. That legislation made in the Depression period to separate commercial banking from investment banking was changed  when president Clinton made changes in a deal with Senators Phil Gramm and Jim Leach in 1999. The too big to fail problems of banks and the problems of investment banks during the 2008 financial crisis are attributed to the lack of Glass Steagall protections for financial stability and safety. The result is that in the post 2016 environment banks can expect a tougher regulatory environment. Another are is in trade where both parties are expected to take tougher positions to protect U.S. interests. The Republican platform calls for "better negotiated trade agreemets that put America first."

US DJT administration using Section 301 creates the tariffs the US Supreme Court struck down- the EU, Mexico, Canada at 10%, Japan,, India China at 12.5%- June 2 2026. These countries are not doing enough to control the importation of products made with forced labour. This only goes to show what was said at that time and which the SCOTUS itself said the DJT administration could do, find other laws by which the same tariffs could be imposed. By the time the US Supreme Court reviewed the case it was already clear that all these countries had accepted DJT tariffs, and most had negotiated fair deals with the US including making up for past abuses by these countries of the international trading system. The US Supreme Court its shortsightedness ignored this or did not quite grasp this as Justices legal knowledge of facts does not mean grasp of the facts of commerce, trade and business and the history underlying it. Jamieson Greer interviewed at the Council of Foreign Relations this week and Robert Lighhizer in Foreign Affairs (covered and summarized on these Lyrarc pages this week as found rarely in other places) have documented these abuses in detail leading to the US losing $20 trillion in wealth shifted to these countries and its manufacturing dependent communities devastated by loss of over 5 million jobs through the shortsightedness of Bush/Obama adminstrations who let this happen, and these countries that took advantage with reckless disregard for these communities in the US, on a scale unknown in history.  ...

There are 240 Norwegian and Finnish companies in India, says this report in The Hindu. Nordic countries are providing green technologies to India. At the Nordic-India Summit held in Copenhagen in May 2022, the five Nordic prime ministers and prime minister Modi agreed to intensify cooperation on digitalisation, renewable energy, maritime industries and the circular economy. Denmark is helping India with ports and logistics. Trade ministers of Norway and Finland visiting India together  Feb 9-10 describe the efforts to provide Nordic technology solution in green transition to India. Trade between Norway and India has doubled in the last 3 years and the Norwegian Sovereign Wealth Fund is likely to become on the largest investors in India at $17.6 billion. Societe General's Jerome Kerviel worked at a Delta trading desk in the investment banking operation. Kweku Adaboli, 31, a UBS trader, worked at a Delta One trading desk specialized in exchange-traded funds and other securities positions. He is charged with two counts of false accounting and one count of fraud. Delta is a term in the banking industry for how a bank can customize a security for a client, and following this closely replicate another transaction that acts to mitigate the risk. The first transaction is a "derivative" trade, which is basically a bet on the direction of a group of stocks or other securities. Jerome Kerviel was accused of trying to hide $7.2 billion in losses and was sentenced to three years in prison. The Delta One trading desks can generate $1 billion in annual revenue for banks and are used by Societe Generale, BNP Paribas, Goldman Sachs and Morgan Stanley U.S. At the same time risk is increasing with unpredictability and higher volatility in the financial markets in 2011. Another feature of the trader problems at UBS and Societe Generale is the relative youth and lack of experience of the traders, and that risk management systems allow traders with insignificant experience to make such large transactions. Other questions about how much risk a bank should be allowed to take, and about ring fencing the investment banking units of each bank, are relevant. Swiss banking regulators were working to ringfence the investment banking units of UBS and other Swiss banks after earlier problems at Swiss banks in the global financial crisis of 2008. Under the proposed regulation by Swiss regulators UBS investment banking unit would be headquartered in another country and hold its own capital, and be subject to local regulators. ...

Supply chains are unraveling in many industries with the tariffs imposed by president Trump on imports from China, and renegotiated trade deals with South Korea and other countries. The growth in the value of foreign value added was possible with cuts in tariffs in the period after 1990 and the emergence of China as a low cost manufacturer with cheap labor. Foreign value added increased from 20% in 1990 to 30% in 2011. The impact on factory towns and communities in the U.S. of trade in which the U.S. manufacturing declined as it shifted to China resulted in the surge in support for president Trump. The tariffs war with China is an effort to correct this imbalance. The result is a shift in supply chains away from China in some industries and gradual shift in others. Rising wages in China had already resulted in early shifts and the the environmental costs adding to this trend. President Trump temporarily suspended a threatened imposition of duties of 25% on $325 billion of Chinese imports. A renegotiated Nafta agreement with Mexico for automobile production and determination of U.S. based content and wages was designed to reset the relationship with Mexico and the auto supply chain for production in Mexico. A threat of tariffs on European auto imports to the U.S. is set for a decision in November. The trade dispute between Japan and South Korea and threat of tariffs also shows the effect this is having in other countries. With the U.S. looking at its own interest in the global supply chain and its advantage or disadvantage, industries and companies are not free to make decisions based on which country offers the best arrangement and deal for manufacturing. President Trump has taken a careful response to events in Hong Kong so that the situation does not affect U.S. China trade talks and tariffs negotiations. For the first time he tweeted that China's restraint would be reciprocated by the U.S.

Mr. Trump has described the Hong situation as "a tricky situation," and has called for the protests to be handled "humanely." He tweeted- "I know President Xi of China very well. He is a great leader who very much has the respect of his people. He is also a good man in a 'tough business.' I have ZERO doublt that if President Xi wants to quickly and humanely solve the Hong Kong problem he can do it." Concluding "Personal meeting?"

An assessment of progress in free trade and generating jobs in N. America under the NAFTA agreement between the U.S., Canada and Mexico. The agreement was signed under President Clinton in 1994. NAFTA removed existing tariffs on over half of the exports from Mexico to the U.S. and phased out remaining tariffs between the U.S., Canada and Mexico. The U.S. had two way trade of $918 billion with Canada and Mexico in 2010, according to the Office of the U.S. Trade Representative. Canada is the U.S.'s top trading partner, with $462 billion in trade through Sept. 2012, and U.S. trade with Mexico- expected to overtake China- is at $369 billion in the same 9 month period of 2012.

Let sleeping tariffs lie is the approach of S. Korea, Taiwan, Japan, China, India, European Union, Germany, UK-  expect all trade agreements with the US to remain in place after Supreme Court decision as no country wants to go through the intensely difficult process of renegotiating on tariffs. It is also the case that DJT can replace these same tariffs using other tools and different legislation passed by Congress to stop unfair trading practices by other nations. The president is also appealing to the public, some of the tariffs are about fentanyl flows into the US, the unfair trade practices and subsidies were a problem for the Biden administration and rebuilding manufacturing was the goal of both DJT and Biden, and will be for future administrations.  When the media NYT, Washington Post respond they are following the editorial line taken that opposes the DJT administration on all issues, when WSJ respond it takes the textbook approach of economists and finance people that free markets are best without considering the real life issues. This is why the president said at his press conference after the Supreme Court decision that 22 Nobel Prize economists had said the economy could not be turned around for growth and low inflation in 1 year, and were proved wrong after the experience of 2025 with low inflation at 2.8%, low unemployment 4.3%, and growth of 2.2% in real GDP (with strong growth in quarters 2&3 of 3.8% and 4.4%). Expect all tariffs to be in place under other legislation to be in place in coming months. ...

It says Xi and the six other members of the Politburo Standing Committee were out planting trees to prevent deforestation while DJT was announcing big tariffs. And BBC News report Live goes on to say that the picture of Xi planting tress gives out the vibe that - go on America "this is China, we are not interested in your crap."

With Britain preoccupied with Brexit, and the U.S. in a trade dispute with China, Chancellor Merkel remains the only western leader to visit and hold extensive talks with Chinese leaders Li Keqiang and Xi Jinping. She also visits other Chinese cities such as Wuhan and gives a speech at Huazhong University of Science and Technology in Wuhan, in which she commented on the social credit system being implemented in China about the social creditworthiness of individuals and businesses.  Merkel sitting next to premier Li Keqiang in Beijing advocated "that conflicts be resolved without violence and that anything else would be a catastrophe." She called for a peaceful resolution of the situation in Hong Kong and for Hong Kong's rights to be "guaranteed." This is significant because the close cooperation between Germany and China is critical for China today to tackle the economic problems created by the trade disputes with the U.S.  Merkel has a close relationship with Chinese leaders and has visited China many times, giving her the confidence to talk to Chinese leaders without arousing any sensitivities about internal affairs of China. She is the only leader who can speak her mind to Chinese leaders, without offending them. When she used the word "catastrophe" she chose it carefully. It took decades for China to build the trust and relationships with Europe and the U.S. that it has.  Trading relationships matter for both China and western nations and are built on trust and good relations. With the Shenzen region growing faster than Hong Kong, and thinking like Beijing, China could tackle the situation in Hong Kong over a long period. ...

Promises made by China when it entered the World Trade Organization to open its markets in telecommunications, banking and other fields have not been kept. 

Seventeen years later the U.S. sees China as intent on gaining competitive advantages through joining the World Trade Organization. During that period successive Republican and Democratic administrations did not take action to make China comply with its obligations under the WTO agreement. The broken promises and how to have an agreement that has protections that ensure that each side lives up to the spirit and letter of the agreement, is a key challenge for Mr. Lighthizer and his negotiating team.

Kessler in the WP corrects Obama's claim that he created 800,000 jobs. He says this is clever arithmetic as it takes a low point in Feb. 2010 following the financial crisis. Kessler points out that according to the Bureau of Labor Statistics, U.S. manufacturing jobs were 12.56 million in Jan. 2009 when Obama became president. In Nov. 2016, early estimates show there were 12.26 million manufacturing jobs, a loss of 300,000. This loss does not reflect the problems in the U.S. auto industry and older industries in the midwestern states as a result of trade and globalization that speeded up with the rapid industrialization of China. And led as Greg Ip pointed out in a recent WSJ report to a rapid acceleration of job losses in a decade that did not happen in the same scale during Japan's industrialization and urbanization in the sixties. This aggravated the situation in Michigan, Ohio, Wisconsin, Indiana, and Pennsylvania, and was met with a feeble response from Democrats. Even a economist like Krugman favoring the Obama administration's efforts came to the conclusion that TPP did not add much to gains from trade as most of the gains had already been realized. More of the gains went to tech and IT in California, at the expense of the auto industry based in the midwest. A report in WP show a president too close to IT in California and failing to grasp the situation in the midwest. Voters punish whoever is in power, regardless of being Conservative or Liberal, in Canada the hollowing out of manufacturing under Harper in Ontario and Quebec led to the win by Trudeau's Liberals.  ...

Germany imports hardly 6% of it's oil from the Middle East compared to 13% for the European Union. This makes it possible for Germany to take its own position on Iran independent of oil supply considerations.  More important for Germany is Iran's support for Russia in the Ukraine war, a sore point for Germany and the EU considering the enormous damage done by Iranian drones in Ukraine including civilian targets. Merz says" the threat posed by this regime stretches far beyond the region. It must be shut down."  A breakdown of German imports of oil shows mostly all from outside the Middle East, after the shift away from Russia Germany has made a decision to stay away from the volatile Middle East for supplies. (Germany had a deal with Qatar for LNG but the EU has already done a deal with the US for LNG and Germany has followed the EU with its own trade deal to import LNG from the US.) This report in the Economist points to the improved situation for Mexico after the scare from Trump's plans to build the wall and deport large numbers of immigrants. The peso dropped by 15% between mid November 2016 and January 2017, but has since recovered, and non-oil exports were up 5.5% in February 2017 over prior year with the manufacturing growth in the U.S.  Growth forecasts are now up from about 1% GDP growth previously to 2% for 2017, close to the 2.3% in 2016. Much of the change in mood in Mexico is a result of the failure of the early travel bans being blocked in the courts, the failure to get health care legislation through Congress, and the effort by the trade advisers and economic advisers around Trump to move Trump's positions more to the centre and closer to traditional Republican party positions. Wilbur Ross, the Commerce Secretary, says " a sensible agreement" can be reached with Mexico. Peter Navarro, trade adviser, talks about making "a mutually beneficial regional powerhouse." Robert Lighthizer, a veteran from the Reagan days, is likely to be made the new U.S. Trade representative. Still as the Economist points out the "20% border adjustment tax" continues to be supported by Paul Ryan in Congress to pay for tax cuts. But certainly the mood has lifted in Mexico in the first 100 days. This is true for economic policy in relation to China and Germany, and the close circle of Ross, National Economic Council head Gary Cohn, and Secretary of State Tillerson is moving Trump to the centre in policy statements to get things done. Mexico is faced with internal challenges of reestablishing the rule of law, improving infrastructure, reducing red tape and corruption, addressing problems in the education system, to promote economic growth. These challenges may prove to be as large as the external challenges were once thought to be. ...

China's exports to all countries surged in November by 21% from a year earlier. Chinese made consumer goods and electronic goods were the main products with increased exports. According to WSJ calculations November exports were up 10% to the U.S. and 46% to Asian nations in ASEAN trade group of countries. Some of the exports to ASEAN including Vietnam and Malaysia find their way to the U.S. New tariffs by U.S. on China lead to some products diverted to Asian destinations and reexported to the U.S. China's imports of goods from the U.S. were up 33% from a year earlier but imports of farm, energy and other products and services were below what was expected under trade deals. Experts say Chinese imports of goods covered in the agreement were 55% of the year to date targets. The Biden administration will leave the tariffs on $370 billion in Chinese goods in place. China is not expected to make up the gap by the end of 2020. Experts also say the exports of Chinese goods has accelerated during the pandemic in 2020 and with the size of the second wave in the U.S. In 2021 U.S. imports from China should slow as the U.S. manufacturing recovers following the vaccination effort.  Also expect increased focus on the trade gap as U.S. trade policy continues to focus on closing the trade gap and continuing policy of the Trump administration. ...

Public sentiment shifts sharply against free trade in the March 2016 Michigan primary for the U.S. presidential election, with candidates saying trade agreements do not take into account the interests of American manufacturing workers making large gains. Between 1999 and 2010 public sentiment shifted against trade agreements for all age, education and income groups. A study by Autor, Hanson and Dorn showed loss of 5.6 million jobs in the last decade and large trade deficits, and demonstrated the effect by counties in the U.S. most hurt by trade policies.
