Le Monde looks at actual cases of workers and their families and why they end up choosing platform work with Didi as drivers, or as home delivery workers for other companies. 84 million platform workers 1 in 5 workers in China in 2025, and 420000 civil cases filed in Courts in China over period 2020-2024 for excessive hours, safety, injury and lack of social insurance. Workers send money home to rural areas and work upto 90 hours a week to make about $1 per delivery in China and strive to make about $1220 a month with excessive hours and little in benefits. This sector acts as a backup to absorb labour when companies close such as the bankruptcy of big property construction companies such as Evergrande. In 2024 the government set rules to regulate abuses in this sector. As China shifts from dependence on construction, and as exports to the US face resistance and tariffs, laid off sorkers end up in this sector with few benefits. Mitt Romney's position on the auto industry bailout was spelled out in an article in the New York Times in 2008 titled "Let Detroit Go Bankrupt." Romney opposed government loans to the auto industry. Because of the unusual factors that faced the auto industry such as the subprime mortgage driven financial credit crisis, financial market volatility and GM and Chrysler being shut out of credit markets, the need to maintain buyer confidence during bankruptcy, the planned bankruptcy with government loans was seen as the way to rescue a crucial part of the U.S. manufacturing industry by other business executives such as Jack Welch of GE, and by many adviors to the government from the private sector.

GM management is now considering government supported bankruptcy as a serious option, after insisting for months that that would not work, and that it would affect the whole supply chain. This comes as GM's auditors raised "substantial doubt" that GM could operate as agoing concern considering its state of finances. Prices on GM's bonds are down to less than 20 cents on the dollar, for GM's $3 billion 30 year bond. according to Thomson-Reuters. Under bankruptcy GM's entire debt load could be reworked and bondholders would see it in their interest to make necessary concessions for this to happen. Also the franchise overhaul could proceed on the retailing side. A prepackaged bankruptcy would typically be accomplished in afew months.

On my bookshelf is NY financier Felix Rohatyn's 2009 book, Bold Endeavors, citing the bold investments America has made in the past from Louisiana Purchase, Erie Canal, Transcontinental Railroad, Land Grant Colleges, Homestead Act, Panama Canal, Rural Electrification, Interstate Highway System, and how this needs to happen once again. NYT lacks this vision. In this Op-Ed it  leaves the field open after comparing Mamdani to De Blasio's failure to run NYC. NYT Editorial Board says Mayor Bloomberg was an effective manager and ran the city better than other mayors, it describes the accomplishments of Andrew Cuomo but does not give Cuomo second chances to use his experience to serve New York City, after Michael Bloomberg comes out in favor of Cuomo. This is  NYT and NYC dysfunction. It says there is so much to do in NYC to improve life in the city but refuses to make the tough decisions needed to make things happen, turning into someone who decides who gets second chances to serve the city and the country.  The Washington Post was clear in warning about the danger of a "free everything" Mayor as this has never worked and fiscal chaos happened in NYC in the 1970's, a NYC near bankruptcy in 1975 which Rohatyn tackled as head of NY's Municipal Assistance Corporation and $10 billon in bonds backed by New York state. NYT and NYC residents have short memories. Most have forgotten Rohatyn and his vision in Bold Endeavors, or were not part of the American fabric of the 20th century, which again points to the importance of history, civics and education. ...

At 79 years, Wilbur Ross will be one of the oldest people serving in any administration, as he serves as Commerce Secretary in the Trump administration. Wilbur Ross is best known for the turnaround efforts in the steel industry. In 2002 he acquired LTV Corp, a third largest steel producer in the U.S. facing tough times and legacy costs, for $125 million in cash and $200 million in environmental liabilities. In 2005 he sold his International Steel Group to Arcelor Mittal for $4.5 billion, and is still an independent director on the Arcelor board. Ross's earlier experience was as a bankruptcy specialist at Rothschild Inc. in the 1970's working on restructurings at Texaco, TWA and Continental Airlines. Analyst Charles Bradford is cited in this report by WSJ's John Miller, who competed with Ross in restructuring proposals for failing assets, and describes Ross as working harder and being tougher to make the deals. Some of these restructurings involved cutting pensions and large layoffs. The entire U.S. steel industry faced problems from foreign competition and legacy costs at the time. This included representing bondholders for Taj Mahal Casino in Atlantic City. At the time Ross told creditors considering seizing the asset for a possible missed payment that it would be better to keep Trump in charge for Trump properties as they would be worth more with Trump inside. This led to Ross later providing critical backing for the Trump campaign and raising money from the business community. Mitt Romney had similiar work at Bain Capital in turnaround of failing companies, later turning to politics as Governor of Massachusetts, and 2012 Republican nominee for president. Both Romney and Ross have come under criticism for their role in cost cuts at companies involving layoffs and cutting worker benefits. ...

The use of Chapter 11. or the US bankruptcy code, was astrong point of the American system of free enterprise, because it gave enterprises with problems but otherwise having healthy businesses a chance to reorganize and emerge stronger from the crisis. DUring the time in bankruptcy it could work out its debt load with creditors under court protection. Now this is no longer working in the current economic crisis. Because under current law derivative transactions are given preferred creditor status in a bankruptcy many creditors are designing their loans as derivative transactions. And creditors are creating the empy creditor situation by taking credit default swaps to ensure that they get paid if acompany fails to make apayment. In the process the creditor does not have the same interest in the company staying in business as it did before. This happened with Goldman Sachs buying credit default swaps on its loans to AIG. Complicating the situation further creditors are using the law to seize inventories and in other ways get aclaim on the assets if acompany like Circuit Stores for instance runs into difficulty. As aresult CIrcuit City was gforced into liquidation. So on one hand businesses that have achance if reorganized under Chapter 11 are being forced into liquidation and on the other hand companies that are not going to be the source of innovation or productive gains for the economy like Citigroup are simply tying up huge amounts of government money as there is a fear that a proposed bankruptcy could lead to arepeat of the Lehman collapse, where bankruptcy proceedings are too slow and cumbersome for this situation and things fall apart in days. ...

WSJ says that administration officials are considering aplan whereby on the first day of bankruptcy the government would announce the setting up of a "new GM" with Chevrolet, Cadillac, and good assets as part of it and a separate "old GM" that would hold the bad assets, retiree and health care obligations, Hummer and Saturn. The "good" GM would have responsibility for $20 billion in government loans. THe old GM could stay in bankruptcy for longer till buyers are found for parts of it or as it is wound down, with proceeds from the sales of assets going to creditors claims. WSJ sources familiar with the developments and the administration's views say that the administration prefers this route, and GM will likely will be forced into filing for bankruptcy protection in mid-May. That would be 45 days into the 60 day period President Obama has given GM to come up with a new plan that will work. The submitted plan was rejected by Obama's team on grounds that the assumptions for sales were too optimistic, none of the concessions from bondholders and the UAW that were needed had been made, the Chevy Volt was not going to pe price competitive, and fuel efficient car production was not a critical part of the plan. The government has asked Fiat to scale back its planned ownership of Chrysler to 20%, as part of an agreement for more government loans....

On November 17, 2008, as the Bush administration and Secretary Palson ponder their options including merging the 2 companies GM and Chrysler, firing old management and putting in new management, and someone to oversee the process of bankruptcy Chapter 11 with guaranatees such as debtor in possession financing and warranty guarantees by the government, and protections for the supplier base, so that an orderly bankruptcy takes place with clear goals of renegotiating terms with the unions, dealerships and debt holders. Under this process Chapter 7 liquidation would be clearly avoided and the process of recovery set in motion. Its interesting to note that Sorkin has outlined just how something like such Chapter 11 would work with all of the above steps taken. As the issue finally reaches closure with Secretary Paulson's decision expected at any time now its interesting to note Sorkin's comments about Wagoner's leadership saying that it was under Wagoner that the neglect of the things GM should have done ocurred and to think that he should be there running the company in this situation is laughable, yeas laughable. Arvind Panagriya, Prof. of Economics at Columbia University, points out the key initiatives of the Modi government in its first four years which will show results in future years for development of the country.  He mentions the Swachh Bharat Mission and cites results that show rural households with toilets are now 84% up from 38%.  By 2019 the whole country will be defecation zone free on the 100th anniversary of the birth of Mahatma Gandhi. The Dhan Jan Yojana DJY accounts opened for rural households are up to 316 million. Aadhar cards for identification are up from 650 million to 1.2 billion. The Aadhar and DJY work together to enable direct transfer of benefits to poor households, eliminating the leaks in benefits transfer and ghost accounts of the period since independence in 1947. Not mentioned by Panagriya is the Health Insurance scheme for lower income households that enable families to survive a sudden medical expense that could put them in dire straits.  These efforts work in a way to change India from the ground up from its villages and rural areas as envisioned by Mahatma Gandhi in the struggle for independence. The land acquisition law amendments were put on hold till farmers concerns could be better accomodated, an area of concern for industrial development cited in an editorial in the Hindu newspaper. Fiscal consolidation and inflation targeting have resulted in an average inflation rate of 4.3% for the 4 years of the Modi government. Inflation was over 9% in the last 2 years of the previous Congress UPA government with GDP growth dropping to 5.9% for the last two years. Average GDP growth for four years for the Modi government is 7.3%, even after the changes to implement GST taxation for one national tax eliminating state barriers in interstate commerce and demonetization to fight corruption and black money. Rate of GDP growth should be higher after the gains from the initiatives and the new GST integration of the country are felt, with increase in investment and FDI, after infrastructure improvements and land acquisition arrangements are made. Transportation infrastructure modernization initiative pushes ahead with the first bullet train in the pilot project for Ahmedabad- Mumbai set to start in 2022. This is a $17 billion project financed for $13 billion by the Japanese government at 0.1% loan for 50 years, moratorium on repayments for 20 years, using E5 Shinkansen series technology. Implementation of this project on a sound financial basis should lead to transformation of the Indian rail network, raising the level of technology implementation across the entire Indian rail system. Such an achievement would rival the first introduction of railways into India in the nineteenth century under the British. A new bankruptcy law is intended to free up capital for investment by putting behind the large number of non performing loans in the Indian banking system. Changes made by the central bank RBI are designed to speed up this process so that loss making enterprises are absorbed, consolidated or shut down, a legacy from the earlier period.     ...

Nocera looks at the lack of efforts to help homeowners under water in the Obama administration. Sheila Bair comments on Geithner's role, as Geithner's book "Stress Test" provides little detail on how the Obama administration addressed the issue. A story by Dougherty in the WSJ on April 20, 2014, points out that about 10 million households in America are underwater in 2014, and another 10 million households have only 20% equity in their homes. Unemployment statistics in the same issue of the WSJ show 7 million people taking parttime jobs because they cannot find work. These households are critical for consumer spending to support growth. The weak economic recovery could very well be one of the results of poor policy decisions by the Obama administration including this one, when other alternatives proposed by Sheila Bair and Martin Feldstein were offered repeatedly in 2009-2010. In the case of GM complex union and dealership contracts and a number of creditors means someone in the government has to use governmental powers and authority, and with the leadership of the President, and help from Congress with new legislation, to get the job done in a short period of time. The New York Stock Exchange has temporarily suspended its $1 minimum share price requirements to prevent a wave of delistings. There is a concern about another implosion like Lehman or AIG. Samsung has a 45% share of the market and Hynix Semiconductor has a 21.5% share, with Micron at 12.1%. Elpida Memory's CEO, Mr. Sakamoto says: "we never imagined the yen would become this strong." Plans for an alliance with Micron Technology did not materialize. Elpida was the result of merging the operations of NEC and Hitachi in chipmaking in 1999. Japanese chipmakers subsequently focussed on the high end chips for smartphones, moving production of lower margin chips to Taiwanese operations. Ironically Elpida comes from the Greek word "elpis" meaning hope, and the d for dynamic and a for association.

Out of hundreds of comments, (looking at the comments based on reader recommends from 70 to 15 readers recommend range), with over 90% of comments favoring no bailout money for automakers without coming to grips with problems and replacing management and the board, it is clear that readers cite in order of importance the following against the automakers. Complicity with Congress and lobbyists in keeping fuel efficiency low. This sent billions of dollars to mideast nations for oil, which in turn bloated liquidity here at home, helping fuel the cheap credit era in the US and building consumer and mortgage debt. This lack of conservation in gasoline use burdened economies around the world with high oil prices, and then hit the car companies in Detroit hard as sales of large vehicles collapsed. Its entirely the Detroit carmakers own shortsightedness they say. Second most mentioned is bad management, and bad decisions and arrogance. Third the unions bloated contracts, and bankruptcy as the only way to get rid of them. Fourth failure to make green cars. Fifth the lack of any idea what $25 or $50 billion given to GM and Chrysler would get the taxpayer, because if the market has collapsed then more money will be needed each year to pay salaries and contiinue operations in 2009, followed by 2010. The market has gone from 16 milllion to a 10 million rate in October 2008, if it drops to 8 million in 2009, it would require the companies to shrink by 50% as a rough guess, and the union contracts just negotiated would be totally inappropriate for the new market and financial conditions. Getting rid of those union contracts could only be done in a bankruptcy filing, as in bankruptcy everything would have to be done from scratch. Whereas in a bailout the unions would simply refuse to cooperate as they have done in the past. This is also what readers are saying when they say let the market economy work. A look at the reader comments on similar articles in the Washington Post and the WSJ also show an overwhelming number of readers not favoring taxpayer money for automakers without serious changes, and bringing a completely new management and board to get things off to a fresh start, with no legacy from the past. ...

Davey and Walsh tell the story of years of mismanagement in a city that lacked proper record keeping to keep track of costs. A municipal auditor brought in a financial consultant as far back as 2005. He found an additional $7.2 billion in retiree health costs that had never been taken into account. That warning was ignored. All the time the city was losing jobs with mismanagement at the auto companies and lack of labor-management cooperation. The Kilpatrick years as Mayor were largely wasted as problems piled up. The city was unable to borrow, and its revenue base was continually shrinking. Under Mayor Bing the city had a hard time meeting payroll. Other cities had faced financial crisis before, New York in 1975. Detroit was different in that two of the three major auto companies went into bankruptcy followed by the city itself facing bankruptcy, with mismanagement of finances and lack of a good plan for the city and the auto industry that brought everyone together behind a single goal of regeneration. ...

What are the systemic effects of one of the automakers going out of business? It affects the whole supplier base. This is the case in the event of a liquidation of assets, closing Delphi and so on. This was mentioned by Wagoner as the alternative and not prepackaged bankruptcy with DIP set aside loan for warranty financing which some experts are advocating in combination with a government loan with strings attached including a change in management. Some of the strings are covered in a New York Times editorial reflecting public opinion on the democratic side on this issue, and that includes removal of current management of Detroit auto companies, and fuel efficiency targets raised higher than legislation passed recently under heavy lobbying pressure from these automakers. Contraction of automakers and job contraction should be differentiated from liquidation of assets. The contraction of automaker jobs not just at the Detroit companies but also at Japanese plants in the US is going to happen even with a government loan to Detroit as Honda is also reducing its workforce and this will happen at Toyota also. The carefully planned bankruptcy with carefully and fully addressed warranty and other issues could be made to work along with sufficient government loan money in the $50-$70 billion range in return for equity and other conditions, and its not clear why the management of the Detroit auto companies see it as impossible and not just difficult, when they are already facing considerable difficulties in this market and with public opinion. Rampell talks about how jobs lost are not recoverable, and this is fairly obvious considering that the Japanese and the Germans are unlikely to relocate in the same areas that Detroit has located its plants , and prefer to go and build green plants to specification, and hire very carefully so that workers with the Toyota or Honda frame of mind are hired to work there. This can change depending on individual circumstances but is what they generally prefer to do. Also its important to bear in mind that forecasts that are being used of 13-14 million vehicle market in 2009 are just guesses, it could turn out that the sales drop to something like 10 -12 million vehicles, in which case there will be contraction of jobs on a large scale even at the Japanese and Korean and German plants which there is even now but on a smaller scale. ...

The Paulson Plan for helping homeowners facing higher rates will help only about 250,000 homeowners with 800,000 foreclosures already ocurred and 3.5 million defaults expected from now till 2010, too litttle too late in the view of the New York Times editorial. Lenders who agree to better terms for homeowners face potential lawsuits from investors and Congress should protect the lenders from lawsuits with legislation. Only then can really effective terms be worked out for homeowners facing defaults and foreclosures. Another legislative measure for Congress is to allow homeowners to restructure their mortgages under bankruptcy protection.

President Obama has 63% job approval rating in a New York Times/CBS News poll. His backing is among Democrats and independents alike which is very useful for Obama.But the poll shows more American having faith in the President than in the handling of specific issues. He gets good approval on foreign policy initiatives at 59%, but in the handling of the Auto bankruptcy, or of health care his ratings are below his personal ratings as President. A majority of those polled were concerned about the rising budget deficits. BUt his ratings among Republicans has fallen from 44% in February to 23%. American, Alaska Airlines, and Southwest Airlines are the only 3 airlines that never filed for bankruptcy. Analysts say that this has left it with a higher cost structure, and estimate that American's costs would be $600 million lower if it has the contracts Delta and Continental have. Delta Airlines merger with Northwest in 2008, and the planned merger of Continental and United, does not affect American Airlines management. CEO Arpey sees American as more nimble and trying to build something profitable, and sees being smaller than these newly merged competitors an advantage. American is focussed on markets around 5 major cities- Dallas, Chicago, Los Angeles, Miami and New York. In international travel it has One World partnerships with British Airways and Japan Airlines.

With a unanimous vote of the company's board on Nov. 28, 2011, American Airlines filed for bankruptcy. Gerard Arpey, CEO since 2003, is known to have resisted the move. Arpey decided to retire and will be replaced as CEO and chairman by Thomas Horton, the president of American Airlines. Analysts and management say the move is a proactive effort to take action before AMR's financial posiiton deteriorates further. AMR has about $4.1 billion in cash and short term investments. One airline analyst described it as an offensive bankruptcy to reduce labor costs and leasing costs in a proactive manner. American Airlines management has said in the past that its costs are $800 million higher than other airlines, because its pilots fly shorter hours and have more liberal work rules. Cost per available seat mile, an industry metric including labor and operating costs, is about 10% higher for American compared to Delta Airlines. American is also hit by higher fuel costs especially because about a third of its fleet uses older McDonnell Douglas MD-80's, and its regional carrier American Eagle flies 50 seat jets that are less efficient. American has total losses of $11.4 billion for the period 2001-2010. Additional loss was incurred for $982 million in the three quarters of 2011. Efforts to increase fuel effiicency of its fleet which is on average 15 years old, are underway. A $38 billion order for 460 new single aisle planes from Airbus and Boeing, with $13 billion in financing from the aircraft companies, was placed in July 2011. AMR says it will keep the order as planned. The end result is likely to be a smaller airline with fewer employees, fewer planes, fewer routes, and cuts at AMR's smaller hubs in Los Angeles and Chicago, says one aviation specialist....

About 11% of student loans outstanding amount were over 90 days past due in Sept. 2012, increasing from 8.9% at the end of the second quarter 2012, according to the Federal Reserve Bank of New York. This now exceeds the figure for credit cards. U.S. student loan debt is now at $956 billion for the third quarter 2012, increasing by 4.6%. About 93% of student loans made in 2011 were made by the U.S. government, which is promoting access to loans without asking for information about borrowers finances and education plans and ability to pay the loans back. Because student loans have to be paid back and are hard to discharge even in bankruptcy, this means many borowers who cannot find jobs are deep in debt, and unlikely to get loans for many years for cars and other needs. Moody's warns of a wave of student loan defaults in coming years.

The unravleing of Borders bookstores chain in the US, after Borders management failed to anticipate and build on the new trend to electronic books and made a series of mistakes. Borders filed for Chapter 11 bankruptcy protection in early Feb. 2011. Its online strategies simply failed to come up with answers to the cultural trend to online shopping for books and buying e-book readers. A serious bad decision from which Borders never recovered was to transfer its internet operations to Amazon Inc. in 2001. Amazon quickly built up customer relationships with millions of customers. Other decisions followed which put Borders in an untenable position. Borders increased its debt from $159 million in 2001, to $554 million for the fiscal year ended Feb 2, 2008, using the money for overseas expansion and share buybacks, which did little to address the looming internet problem. By contrast Barnes and Noble took the opposite strategy of paying down all of its $667 million in debt. Borders has modest beginnings starting in 1971, when Tom and Louis Borders, started a small used bookstore. By the 1990's bookstores with tens of thousands of books in one location were changing the bookselling landscape, as smaller bookstores were closing. Borders was able to ride this wave. When the next wave hit in 2010 with the internet, Borders was unable to respond and went into permanent decline. A costly trip through bankruptcy court means Borders will have to close one third of its 674 Borders and Waldenbooks stores, and cut a large part of the 19,500 staff. This will mean customers shifting to Amazon, Barnes& Noble, Apple Inc. and Google Inc. Mike Shazin, CEO of Idea Logical Co, a New York consulting firm, says he expects 50% of bricks and mortar bookstores to go away in 5 years, and 90% to go away in 10 years. ...

GM CEO Wagoner was asked to resign by the Obama admninistration. The news was given Wagoner by Steven Rattner, who heads the auto industry task force setup by President Obama, at Rattner's office at Treasury. Mr Henderson, GM's Chief Operating Officer will fill in for Wagoner. When Wagoner assumed office in 2000 GM's stock price was $70, now it is $3.62, and GM capitalization is $2.21 billion in March 2009. Since 2004 GM has not earned aprofit, and has logged $82 billion in losses. Right upto the end the board of directors and lead directors backed Wagoner, even when the company was short of cash in the waning days of the Bush administration, and public opinion was very critical of the way management and unions had driven the company into the ground, all through this they held on, showing how hard it is to get an entrenched board and management doing things the wrong way. Now the Obama administration has taken years of festering issues in the auto industry and at auto companies head on. Not only Wagoner, the task force is working with GM to replace a majority of its directors. Kent Kresa a longtime director is to serve as chairman of GM. The President in a speech today on the auto industry said that he was rejecting the plans for restructuring provided by both GM and Chrysler. He is giving GM 60 days to come up with a new plan. The government would provide suffficient working capital for the next 60 days, during which time a revamped board and top management would have to come up with new restructuring plan. Obama made it clear that an expedited government sponsored bankruptcy was a clear option. And officials said that the inordinate amounts of debt at both GM and Chrysler have to be scrubbed, and bankruptcy would be "quick rinse" to rid the companies of much of their debt and contractual obligations. And the government would stand behind the warranties of both companies. For Chrysler the government is giving 30 daysto come up with a new plan, and time to reach an agreement for Fiat to work to revive Chrysler. And Obama reassured the public that FIat would have to repay the government before it could take money from the new Fiat run Chrysler out of the country. If Fiat and Chrysler reach an agreement and only then would the government step in with $6 billion in loans. If not Chrysler would be allowed to collapse....
