Paul de Grauwe, a economist at the London School of Economics points to two problems with the June 28, 2012 EU deal that allows the EU rescue fund to buy Spanish and Italian bonds and provide capital aid directly to Spanish banks. One is the limited funds of the rescue fund, European Financial Stability Facility or by its other name European Stability Mechanism. The EFSF or ESM lacks credibility because it lacks resources, it has only 248 billion euros, and has to first raise money in the bond markets. A better approach would be for the ECB to buy Spanish and Italian bonds aggressively, allowing a smaller spread between these bonds and the German bonds, says Grauewe. Germany is the largest shareholder at the ECB and opposes this move as a form of mutualizing of debt in the EU. Grauwe's recent paper shows that the depressed bond conditions for Spain and Italy are driven largely by a psychology of fear and not hard true economic numbers. Christopher Marks, global head of debt capital markets at BNP Paribas, says it is important to create the confidence to get longer term core investors such as pension funds, sovereign wealth funds and insurance companies back into this market for Spanish and Italian bonds by reducing volatility and yield. These longer term investors have left the market creating a severe problem. The shorter term investors, who came into this market in the last 1-2 years, are now the loudest voice saying Spain and Italy are likely to fail. These shorter term investors are either selling these bonds short or getting credit default swaps. A big problem coming out of the June 28, 2012 agreement, is that it is short on details. The details of how the rescue fund will operate, its funding, and the conditions for making making direct loans for stakes in banks or buying government bonds are still to be clarified. Germany's Constitutional Court also will rule on how this would be conducted and the Merkel government would continue tough negotiations on the details creating added uncertainty. ...

How Calpers went over its head and invested in risky properties at the crest of the real estate boom when there were signs of a weakening in property markets and did this with borrowed money for 60-80% of the deals, so the returns on the downside are magnified. Much of it is for land near Pheoenix and Los Angeles that are empty tracts and now worth little in the depressed property markets, with losses of over $ 1 billion on the Los Angeles area land deal which was a $2.5 billion deal. alpers expects paper losses of 103% on its housing investments in the fiscal year ended June 30. Calpers residential and property investments represent 10% of its $182 billion portfolio and its real estate holdings are twice the percentage of the portfolio of average pension funds. Its also showing a 41% loss on its stock portfolio. Greed seems to have motivated Calpers as it sought higher and higher returns even as the market was showing signs of weakness, with returns on real estate deals in the good years averaging 12%. Calpers is the pension fund of the 1.6 million stae workers in the state of California. The average employer contribution rate for California governments including cities and counties is 13% of payroll. Calpers has estimated that if its investments show a20% decline then the payroll of employers would be hit with another 2 to 5% increase....

Paul Singer, head of hedge fund firm Elliott Management and its unit NML Capital, has relentlessly pursued a case in U.S. courts involving collecting full payment on bonds from the Argentine government after its default on the bonds in 2001. Singer bought bonds with face value of about $170 million according to legal filings, but paid a price well below the original value. Elliott and other investors are now seeking $1.5 billion, including unpaid interest. Judge Griesa's ruling in a federal court in Manhattan blocks Argentina from paying bondholders who accepted an agreement for about 25 cents on the dollar from being paid $530 million in interest in July 2014. Argentina has to consider other risks in settling the dispute as more than the $1.5 billion as a one off payment is involved, because as Stevenson points out in another article (see link), the payment could run from $15- $27 billion depending on whether it then has to pay all holdout bondholders or all exchange and holdout bondholders at a higher rate. The result is an intractable dispute beyond the statement of honoring creditor rights, seen by a debtor country facing difficult finances in a different light. Serving as a reminder for Greece, Argentina, and other countries with chronic borrowing and debt history about the need for care and constant vigilance on state finances. In May 2012 Greece paid over $436 million in a one off payment to holdout bondholder financial firm Dart Management in a similiar bind, even as pensions were being cut and Greeks protested daily on Athens streets with over 20% unemployment (see link)....

How the nations private investors, private equity funds and funds that are backed by public pension funds, could acting as vulture investors, become part of the solution to taking bad assets off the banks that have them. The first step is forming apublic private partnership and White House advisor Summers has already met with private equity managers about this. Again these investors are in for making atidy profit so the government would have to pick up alarge part of the tab. In the case of IndyMac private investors paid $13.9 billion but only took responsibility for 20% of the losses the government picked up the rest of the losses. The WSJ's Latour, Browne, Tejada and Wei interview Lou Jiwei, chief executive of the China Investment Corporation (CIC), China's sovereign wealth fund. He says it is too early to talk about eurobonds as the financial arrangements necessary have still to be put in place. CIC is reducing its exposure to Europe. CIC is interested in infrastructure investments and sees infrastructure investment as the way out of the economic crisis for the U.S. and Europe. He has the most confidence in investing in China. Other locations are in emerging markets Brazil, S. Africa, Latin America. CIC's target is to have 50% of the assets in long term investments in infrastructure investments, commodities, real estate and direct investment and private equity, etc. and the other half in public securities. But this will pose challenges and CIC has not reached this level. It is learning from ATP, the Danish pension fund, Calpers, TRS, and CPP, the Canada pension fund. The portfolio is mark to market which creates pressures to reduce short term volatilities....

Jay Powell, a former US Treasury official, now a scholar at the Bipartisan Policy Center, says the fears of budget problems in US states are survivable, even though they will be difficult and painful. He does not see widespread defaults, the way Meredith Whitney has predicted. Kenneth Rogoff of Harvard University, says a major default would cause serious macro-economic dislocations. It would have impact beyond the US, in the European economies with serious budget problems such as Greece, Portugal and Spain. Analysts cite the following reasons why a widespread debt default by states and local governments is unlikely. Municipal bonds are held mostly by individuals, who own about two thirds of US municipal bonds, directly or through mutual funds. Most state and local government debt is long term, and does not rely on short term borrowing the way a Lehman Brothers did in the recent financial crisis. The states can raise revenues, as Illinois did recently. With the economy improving state tax revenues were up 6.9% in the fourth quarter of 2010, compared to a year earlier, according to preliminary data from the Nelson Rockefeller Institute of Government, Albany, New York. That said, the following reasons show that life will be difficult and painful for states and local governments. State budget gaps total at least $125 billion, as they look to the coming fiscal year, according to the Center on Budget and Policy Priorities. And no federal help is in the works, as it was in 2009. Far less of newly issued muni-bonds are insured today - 6% compared to 57% in 2005- according to the Bank of America Merrill Lynch. Insurers are still recovering from losses in the recent financial crisis. A massive supply of new bonds has depressed the market just as Dec 31 expiration of a federal program, Build America Bonds, which provided help to states that were borrowing. Investors withdrew $23.6 billion from muni-bonds mutual funds since November, 2010. Moody's Investor's service has listed the states that will need to issue bonds to fund current operations. California will borrow billions to cover cash flow needs, and Illinois is considering an $8.75 billion 'debt restructuring bond' to pay past due bills, and a $3.75 billon bond for contributions to its pension system. Because banks have only 1.3% of assets in muni-bonds any defaults will not affect their ability to lend. But the impact will be felt in the US economy and overseas. In the event there was a default, some analysts believe the federal government would find it hard to say no when the federal government said yes to AIG....

Care home care or nursing home in Germany goes from $1700 a month in 2018 to $3760 in 2025 doubling in 7 years. Most of it is from increase in nurses pay and training that has gonu up after years of stagnant pay levels.

In Germany 85% of older citizens elder care is in their own homes with help of relatives and outpatient care assistance is covered from a nursing care insurance fund that pays $330 to $990 a month depending on level of care required. The average pension is $1100 a month.

Statutory long term care insurance is part of German Social Security System with long term care insurance compulsory paid for by employers and employees and 3.6% of pay income going to contributions for this long term care.

Illinois uses a discount rate of about 8% for its pension liabilities. This makes them look smaller than they really are. The 8% represents expected return on assets. Illinois's five pension pllans assume returns ranging from 7% to 8.5%, yet their average 10 year returns ranged from 2.4% to 3.6%. The Netherlands uses a discount rate equal to government borrowing rates, which would be 4% for the U.S. And Dutch plans have to be fully funded or take steps to make up the difference. Illinois will have its plans 90% funded by fiscal 2045. Canada uses a government return adjusted for inflation and an additional premium, which is about 6%. The Ontario Teacher's Pension Plan for instance uses a discount rate of 5.4% and is about 85% funded. The Ontario plan's CEO, Jim Leech, says his fund would be 200% funded if it used the Illinois approach. Which raises the question is the Illinois approach realistic and isn't the best approach to be realistic about the finances.

On the negative side Japan has public debt that is about twice the size if its $5 trillion economy. In the USA government debt is up to 98% of GDP.On the positive side only 10% of it is owed to foreigners compared to 46% of it for the USA. Japan is also rich in personal savings and assets. Over half of government bonds are held by the public sector and the rest are with long term investors like banks and pension funds and insurance companies. So any sudden sell off of bonds is very unlikely.

Grethcen Morgenson says investor Paulson who handpicked the bad apples from mortgage securities that were placed in the basket called Abacus 2007-AC1, and sold by Goldman to institutional investors, knew exactly what he was doing. Paulson paid Goldman $15 million for creating and marketing the Abacus deal according to the complaint by the SEC. Alexandra Stevenson provides this exceptional account of how the debt deal between Argentina and the hedge funds was negotiated. A decade long deadlock was broken for the first time when Argentina's finance secretary in the newly elected government of Mauricio Macri met Jonathan Pollock and Jay Newman of Elliott Management on Dec. 7, 2015, at the Waldorf Astoria hotel in New York. It is based on 8 intervews with the participants in the negotiations, court filings and emails. Critical to the settlement was the work of Dan Pollack, a trial lawyer with the McCarter & English law firm who acted as the mediator and made some rules including no pen and paper allowed, building trust through open discussion. Back channels helped including one setup through Marcos Mindlin of energy firm Pampa Energia in Argentina, who helped the hedge funds communicate with the Argentine negotiators. Mindlin met the hedge fund representatives at the World Economic Forum in Davos. Argentine president Macri insisted on making the terms he offered public on Feb. 1, 2016 of $6.5 billion because this is a sensitive issue in Argentina. Pollack pushed for a simple business transaction to close the issue and not the complex debt structuring the hedge funds favored. On Feb. 19, Judge Griesa of Federal District Court in Manhattan, who presided over the legal settlement, agreed to lift an injunction that would prevent Argentina from making bond payments and raising new money, and set a deadline of Feb. 29 for the settlement. On Feb. 28 the deal was signed by all the hedge funds. Argentina paid all holdout hedgefunds $9.3 billion, according to the Economy ministry, Elliott getting $2.4 billion....

To meet the budget deficit Russia plans to issue $50 billion worth of ruble denominated bonds and privatize $10 billion in state assets every year until 2014. Russia is also changing its policy to attract foreign investment. For the first time since the 1998 financial crisis Russia will turn to international banks and pension funds in the US and Europe to maintain financing for a whole range of activities- from modernizing the military to paying high public sector wages. Russia is planning the sale of a stake in state bank VTB. And shares in oil companies, hydroelectric dams and shipping lines are also expected to go on the market.

Starting January 1, 2011, new rules governing European finance will be put in place. Three new European regulators will exercize control over large parts of Europe's financial markets. The new bodies take over from three committees that earlier co-ordinated the supervison of European banks, insurers, pension funds, and securities. Credit derivatives and ratings agencies will be brought under regulation. The new rules centralize authority that was exercized by national supervisors -or as in some cases as in Ireland not exercized at all. Considerable power will be exercized by the new agencies. The European Securities and Markets Authority (ESMA) will directly supervise ratings agencies.
