Jesse Eisinger compares the public criticism and the response of two executives of major American banks- Dimon of JP Morgan Chase and Blankfein of Goldman Sachs. He says Dimon may come out looking better with his reputation in much better shape because of the changes he made at JP Morgan Chase after realizing that he had made faulty judgements. Dimon has now set the goal of putting JP Morgan ahead of the other banks in its risk management and working with regulators. Blankfein is seen as making only minor changes in the culture at Goldman and having overcome a wave of public criticism without significant change in the way the company does business. In the process Dimon will have learned more from the financial crisis and make improvements that will be good for JP Morgan in the future, an opportunity that Blankfein is seen as missing.

The largest U.S. bank holding companies, including Bank of America, J.P. Morgan Chase and Citigroup, and two foreign banks Deutsche Bank and Barclays PLC must submit initial plans for "living wills" by July 1, 2012. The Dodd-Frank legislation requires financial firms to develop plans that lay out how they could be liquidated if they went under in a crisis. This legislation gives the FDIC and other regulators the power to seize and dismantle a failing financial firm, to help mitigate the problems of "too-big-to-fail" firms. The FDIC and U.S. regulators lacked such powers at the time of the collapse of Lehman Brothers in 2008. The FDIC and the U.S. Fed co-wrote the living will rule for "comprehensive and coordinated resolution planning." In all, 124 banks, including 100 foreign banks with U.S. affiliates, which have over $50 billion in assets worldwide, must submit plans and update on a regular basis. Smaller banks will have the deadline extended to December 2013.

Zapotosky of the Washington Post explains what the Supreme Court's partial approval of the Trump travel ban means for visitors to the U.S. He points out that the Supreme Court's version is limited because it only applies it to persons without any bonafide relationship with a person or entity in the U.S.. In addition the Court urged the administration to complete its vetting procedures review. The travel ban was for 6  countries Iran, Sudan, Somalia, Libya, Yemen and Syria. There are conflicts and wars in most of the countries on the list. Also important to bear in mind is that the administration presented its case as one in which this was a temporary measure till vetting procedures are addressed to reduce the "investigative burden."

Microsoft leaders for reasons of climate change action and aid to poor African and Latin American nations see the positives in Harris-Walz focus on investment in the future. A similar situation exists with JP Morgan Chase bank leaders. Intel and Ford Motor Company leaders see the Biden administration investment in American companies for stronger competition with Chinese or Taiwanese companies, and for climate change action by investing in EV industry technologies, in the same way. Spain's central bank says the Cajas savings banks have 217 billion euros in exposure to real estate and construction companies. Of this 100 billon euros is "potentially problematic." The Cajas have provisions for 38% of this. The government approved rules for minimum capital requirements. The capital ratios are set at 8% for all banks and higher for the Cajas. It said all banks will need to raise 20 billion euros by a September deadline. Barclays estimates this at 46 billion euros, twice the government estimate. The government will extend the deadline on a case by case basis, so that banks have until December 2011 to close sales of stakes to private investors.The government will then take stakes in the banks by September through the Fund for Orderly Bank Restructuring or FROB. After a 3 billon euro bond issuance in January 2011, the FROB has 4.5 billion euros on hand and a 3 billion euro credit line.

The FBI and the IRS were working on the same investigation of FIFA from different directions and began working together since Dec. 2011, as they found that the same people were involved. Richard Weber of the IRS, says another round of indictments can be expected. The IRS case starts with investigation into tax fraud and one discovery leads to another in the case. By 2013 Chuck Blazer had pleaded guilty to tax and corruption charges and agreed to cooperate with the IRS and the FBI, leading to the breakthroughs that followed. Enhanced cooperation between the Justice Department and international banks since the indictments against banks for illicit operations has made banks willing to cooperate with investigations fully. Once the case was built up getting FIFA officials at one place for the meeting in Zurich made it easier to make the arrests.

The problems with a second phase of quantitative easing, go back to asking why the first phase hasn't worked to prevent the economy from sliding back. So far the Fed has engaged in buying $1.7 trillion in bonds in that first phase. This shows the limitations of this approach. A lot of money was injected into banks. And the banks have $1 trillion on their books that is not being used for lending. The reason being its hard to find borrowers, as borrowers are cautious and concerned about the economic future. The Quantitative Easing in this second phase is supported by the reasoning that deflation risks remain. But this raises another question, what level of quantitiative easing would work, and would such enormous levels itself cause bigger problems.

It is the focus of a WSJ exclusive report on the casualties coming out of an erratic approach to worklife and health. WSJ says it has become a norm to ignore policies set banks a decade ago after similar death and toxic work situations. Bosses it says make impossible and unreasonable demands and younger workers in deference to this are put in a dangerous situation. All this for $200,000 in entry level positions- now Dimon CEO of Chase JP Morgan asks what can we learn from this, saying there are many people at Chase "who give a damn about the human beings at work in this company." The results delivered are also not what is good for the country. Much of the capital allocation that takes place though investment banking leads to enormous waste and poor investment returns. WSJ looks at how the case of Meng Wanzhou and the US Justice Department was settled. In early September the case of Canadians held by China was brought by Biden when he talked to Xi Jinping. Xi brought up the case of Meng, the daughter of Huawei's founder and CFO of the company. Meng was detained in 2018 in Vancouver at the request of US authorites for wire and bank fraud charges related to US sanctions on Iran. The case took a new turn in May when Meng hired a new lawyer William Taylor. Justice Department said it was willing to separate Meng's case from the case against Huawei. Meng's lawyer agreed to have Meng admit to doing what they said she did.  Both US and China wanted to remove an irritant in US Chinese relations. On September 19 Mr. Taylor sent a draft of what she was prepared to admit for wrongdoing. This was the basis of the statement of facts attached to her deferred prosecution agreement and release from Vancouver. The 2 Canadians were then immediately released from China- the Canadians had no knowledge of what had happened. ...

Moody's Ratings company downgraded banks in the U.S. and Europe on June 21, 2012. Morgan Stanley, J.P. Morgan Chase, Goldman Sachs, Citigroup were downgraded two notches. Morgan Stanley managed to stave off a three notch downgrade. Credit Suisse was downgraded three notches. Bank of America was down one notch, and Wells Fargo which has only a small trading operation was not reviewed. This is the first time since 2007 that Moody's has conducted a sweeping downgrade of banks. About 100 banks were reviewed by Moody's. Banks being downgraded have large trading operations or investment banking business that is subject to higher risks. Greg Bauer, a managing director of global banking at Moody's said in his statement: All of the banks affected by today's actions have significant exposure to the volatility and risk of outsized losses inherent to capital-markets activities." For Moody's the main issue was that the capital bases of banks are maintained, considering that government support is less likely than before, according to Mr. Wassenberg, Moody's managing director for European banks. The impact on banks will be fewer opportunities for trading revenues for some banks, and will raise borrowing costs for banks. Moody's also cut the ratings of large European banks with significant trading operations. This includes Deutsche Bank, Barclays, HSBC, RBS, BNP Paribas, Credit Agricole, Societe Generale, UBS, and Royal Bank of Canada....

The Large Institution Supervision Coordination Committee (LISCC) was setup by Fed chairman Bernanke and Fed governor Tarullo, in 2010. The Fed's 200 PhD's, bank examiners and other experts at headquarters are now tapped for the the task of looking at adverse scenarios, checking on assumptions made by the banks in their analysis, requesting data from large banks on their loan and securities portfolios, and asking banks to consider adverse scenarios. Such adverse scenarios include a decline in the U.S. economic growth of 1.5% in 2011, and decline in housing. The Fed checks the banks estimate of its financial position aginst the Fed's own standard and prods the banks to consider new risks. Before the 2008 crisis the Fed's 12 Reserve Banks did the day to day supervision and reported back to Board of Governors, a system that led to a diffusion of responsibility and did not work. Former Fed vice chairman, Alan Blinder, says the bank boards did not exercize responsibility, and "blew it, big time," during the financial crisis. This approach has the effect of acting as a early warning for the banks for things that could go wrong. J.P. Morgan Chase CFO Braunstein made a Feb 15 presentation to show that Chase's stress scenario was more stringent than the Fed's. The current review says Tarullo includes asking banks to do a check before issuing dividends to shareholders, and consider what would happen if the economy is in trouble in the next 9 quarters. According to Fed guidelines issued in November if the bank's plan does not show enough capital to handle economic, regulatory and lending risks, the Fed can challenge the bank's decision....

Goldman Sachs estimates litigation related losses at $3.4 billion and J.P. Morgan Chase estimates litigation related losses of $4.5 billion after the financial crisis of 2008. Citigroup's estimate is $4 billion, Bank of America's is $1.5 billion, Wells Fargo at $1.2 billion above reserves. These are potential legal losses required in reporting to the S.E.C. under the new rules. These losses are above the amount already set aside by the individual banks.

Reserve bank of India's Governor Dr. V.Y. Reddy, who was a strong regulaor and did not allow mortgage securitizations, derivatives, and increased the reserves banks had to hold in case things went wrong. He had strict rules for bank lending in the real estate industry even as a real estate bubble developed in India, all of which is keeping India's banking system in good shape as it faces the global credit crisis. Criticized at the time by bank executives for his strict no nonsense rules, he is now regarded highly by Bank CEO's in India. One of this no nonsense rules was that banks had to hold on to loans they made on their books as banks all over the world have always done in the past, because it made good sense as banks were likely to police themselves for loans they were responsible for. Vague and possibly dangerous experimentation in the name of productive change was frowned upon and the tried and tested rules were followed.

To make custom loan modifications of the type that became necessary overnight on a large scale requires resources, investment in people and technology. On top of this a bank makes about $500 a year on a $200,000 mortgage loan, and if the loan is delinquent the bank may already have lost $2500, say experts, so there is little incentive to do much about custom loan modification. As a result, they used what a former J.P. Morgan executive called "Burger King kids." Or the banks outsourced the operation, some to law firms like David Stern, which in turn used outsourcing firms in Guam or the Philippines. The result is a largely chaotic process according to former mortgage officers of banks, and clerical staff that did not know what they were doing. Now atttorneys general in all 50 states have stated that they will investigate foreclosure practices of banks. It all started with the lone effort of Pine Tree Legal Assistance in Denmark, Maine, in succesfully challenging one of these improperly conducted foreclosures. See the NYT article on Pine Tree. In that case it was about a mother with two children who had her payment go up to $474 after loan modification, who is on food stamps after losing her job as an employment counselor....

The central bank of China, People's Bank of China, cut its benchmark one year deposit rate by 0.25% in Nov 2014 to 2.75%, and reduced the one year lending rate by 0.4% to 5.6%. Banks will be allowed to offer interest rate on deposits of 120% of the benchmark instead of 110% previously. Experts say the effect on GDP is small. The cut helps large firms reduce debt pressures. China is going through a phase of slowing growth.

As early as June 15, 2007, internal J.P. Morgan documents show, high-level risk management officers at Chase's investment bank sent e-mail to colleagues to report that Madoff was suspected to be running a Ponzi scheme. In Feb 2006, a risk analyst at Chase reported to his superiors that the returns of the Madoff Fund did not make sense, as it did far better than the securities reportedly in the portfolio. A lawsuit is being filed by the bankruptcy trustee of the Madoff Fund against Chase for allowing Madoff to bring billions of dollars of investor's cash into and out of his Chase bank accounts right upto the day of his arrest in Dec 2008. At the same time Chase had withdrawn $241 million of the $271 million it had invested in Madoff-linked hedge funds.

By July 2013 only about 40% of the Dodd-Frank financial reform legislation rules were completed, 60% of deadlines were missed, according to law firm Davis Polk & Wardwell LLP. A singular aspect of the Dodd-Frank legislation was that rule making was left to regulators in different agencies and open to lobbying by the financial industry. This has the effect of delaying the rule making until a consensus is reached, diluting some of the original intent as financial firms jockey for advantage, and making it voluminous in many cases because of the wording designed to achieve consensus and account for objections by various interests. Reform legislators such as Barney Frank openly said they had no interest in learning enough about the financial industry to do the rule making, and may have left an excessive amount of the rule making to regulators in the future. A consumer protection agency was established under the new law and derivatives are required to be traded on exchanges. The Volcker Rule to separate investment banking from deposit taking and a requirement that banks hold onto a portion of mortgage securities marketed are not completed. The S.E.C. has to write the rule on how much money brokerages must set aside for losses on swap trades. Another bubble in financial markets would leave the U.S. and European economies vulnerable to problems similiar to the global financial crisis of 2008, which is why the U.S. Federal Reserve, the Bank of England and the European regulatory authorites are requiring large banks to set aside more capital reserves. The S.E.C. under its new chief is also taking a more active role in overseeing the banks for violations of securities laws, including a series of actions taken against JP Morgan Chase bank in 2013. This has a deterrent effect as the huge monetary easing by the U.S. Federal Reserve to reduce unemployment also creates bubble conditions in financial markets, according to Fed governor, Jeremy Stein. Former FDIC chief, Sheila Bair, says the lack of leadership in this area is simply astonishing....

Bond and derivative deals made between U.S. banks and Jefferson County in Alabama have resulted in steep losses and higher taxes to pay for the losses. Spencer Bachus represents Jefferson County in the U.S. Congress. He also received $7.1 million from financial companies, according to the Center for Responsive Politics. J.P. Morgan Chase which arranged the deal for Jefferson County, is also the largest contributor for the political campaign donations to Bachus.

The cost of fixing the nation's financial system could be around $2.5 trillion with an additional $350 of the second TARP funding and the rest of the money coming from the Federal Reserve through the Fed's ability to print money and from private investors. About $1 trillion of this is to compensate for the lack of issuance of securities backed by consumer loans of $1.2 trillion between 2006 and 2008, so that credit markets can function again like they used to. Another component of the plan is to give banks more government money which they will now be expected to lend to consumers and businesses. But a key feature of the plan much awaited by markets was the bad bank or aggregator bank solution which would enable banks to transfer bad assets to this bank. And on this one Geithner said very little so it was adisappointment for financial markets. Also the plan lacked details and was more broad brush and small on specifics. Another area on which Geithner said little is how the government will tackle rising forecolosures and keep people in their homes, which in turn would help stabilize housing prices. But by building up expectations and offering little of specifics on the bad bank solution Geithner earned withering criticism from Senators Kerry, Shelby, Frank, and others. A former managing director at Morgan Stanley Frank Pallotta, now aconsultant to buyers and sellers of distressed mortgages, says the fundamental problem still is the pricing and the gap between what abank like Chase thinks its mortgage is worth of 75 cents to the dollar and aprospective buyer who thinks its worth 45 cents or 25 cents. This is a huge gap and would be expensive to fill in. A bad bank one analyst says could be very expensive and this is why Geithner acknowledges the goal of setting up a fund of some $1 trillion. ...

The $2 billion losses at Chase highlights the need for completing the Volcker Rule with language that prevents banks engaging in risky trading activities. Former FDIC chairman Sheila Bair says precise language is needed to clarify the defiinition of hedging after the losses by a single trader's complex hedging bet in London. Individual traders have too much authority in existing trading arrangements to make complicated bets in finanial markets. Large losses were incurred by Swiss bank UBS when an individual trader in London made risky bets in 2011, raising all sorts of questions about the bank's risk management systems.

$2000 rebate to all Americans to help meet cost of living concerns is put forward by the US president. This would put the tariffs revenue to good use to achieve the goal of bringing back manufacturing and supply chains to the US using tariff policy. This is to counter other nations use of subsidies and other ways to put American manufacturers out of business in industry after industry for 30 years by pricing way below US producers. The rebate would offset the domestic effects on US consumers of products imported with tariffs, which are priced somewhat  higher because of the tariff even though most of the tariff is borne by exporters. The end result is the goal of bringing the product manufacturing for these products back to America, where manufacturing was shipped overseas through the shortsighted behavior of American producers since 1990, mostly to China. The WSJ takes no responsibility for this behavior of American corporations, and does not see this complete dependence of the US on overseas supply chains as a threat to America being able to conduct and independent policy for the Nation based on its own interests. For 30 years the WSJ and American economics profession has adopted the view that it does not matter if product after product is made in another country, or in only one other country as is the case with China as the sole manufacturing superpower in 2025. Who made China the manufacturing super power? Who ignored warnings of concentration of manufacturing in one place? It is these same economists and media such as the WSJ that have through their willingness to ignore these concerns even when it comes to advanced technologies that has made China the superpower in manufacturing it is in 2025. DJT and most of America is fighting a battle to bring these supply chains back to America knowing this is best for America and the American people. It is owing to this new spirit that once mighty industrial towns that had fallen to new lows are making a resurgence in the US- an example is in today's Washington Post report by Irina Ivanova with the title- An Old Manufacturing City sputters back to life, Nov. 11 2025. ...
