Even after receiving 5000 complaints over ayear and half about aggressive short selling that amounted to market manipulation, the SEC did not bring any enforcement cases, according to areport by the SEC's inspector general. Of the 5000 complaints between Jan 2007 and Jne 2008 only 123 were investigated, and no cases were brought.12.5% of emails alleging insider trading prompted an investigation. About 1.38 million emails were handled by 4 staffers, showing horrendous understaffing. In a written response SEC enforcement staff played down the likelihood of naked short selling abuses. It noted that alarge number of cases settle over time. The SEC staff said that the agency needed to "intelligently leverage" its resources and alarge number of complaints provide "no support for the allegations". Morgan Stanley, Citigroup and other frims came under extreme pressure from short selling, and short selling has led to near collapse of many firms during the crisis since the middle of 2008, so its strange that the SEC takes this position. But it is not surprising as in recent years enfocement has been lax, regulation has been neglected almost by design, and resources and staffing are severely short of needs for the SEC's mission to be performed with some degree of confidence....

With the reduced demand for Fannie and Freddie mortgages with coupons under 5%, the Fed steps in and purchases $192 billion of 4% and 4.5% conforming mortgages on a gross basis by March 25, 2009. The move helps support falling house prices in the U.S. and reduces mortgage rates. It also helps banks improve profits. Estimates show the top 10 banks increased their holdings of securities issued by Fannie and Freddie and government agencies by $128.6 billion or 30% in 4th quarter 2008, which can be marked up in future quarters.

Intervew by Deborah Solomon with former Clinton era SEC Commissioner, Arthur Levitt, captures the mood of the public in the USA. Super skepticism and disbelief about public servants, including those of some stature in the past like Levitt. The questions are suggestive of the angst and loss of innocence, and willingness to ask the straight question right out. Solomon tries to get Levitt to take responsibility for what has happened under his and others watch. What do you feel Mr Levitt about the American economic landscape and see 401 K's going up in smoke? Have you changed your spending habits? Are you kicking yourself for not having caught Madoff at his game? After you left your SEC post what led you Mr Levitt to become an adviser to the Carlyle Group, which had ties to the Bush family and defense contracting? This question grates on Levitt. He responds that it is such a Michael Moore like exaggeration, that he was an adviser to the Carlyle Group before he went to Washington. And then Ms Solomon asks the question straight out, saying that frankly she can't understand why the SEC culls its leaders from the world of high stakes investment, when there is this "capture theory" that states that regulators get co-opted by the industries they regulate if one isn't very careful. And the response from Levitt is evasive as he talks about the patriotism of the 4,100 people who served with him at the SEC. Ms Solomon isn't accepting this and calls it boosterism, telling Levitt he hasn't answered her question. Levitt tries another escape route and talks about the European system of gray bureaucrats running government agencies forever, and how refreshing the American system of repotting private sector talent to bring fresh ideas is. Solomon's steers the dialogue in another direction. She reminds him about his father Arthur Levitt Sr. , who was the New York State Comptroller for more than 20 years. Yes, says Levitt Sr.'s son, his father was passionate about defending the interests of pensioners, and his mother was a schoolteacher for 38 years. That gets Levitt reminiscing about his growing up years with his grandparents in Brooklyn, when his grandfather would check 75 used bulbs to see if one worked before using a new one. What has thrift got to do with this Solomon starts to think, after all Levitt is an adviser to the Carlyle Group. Put that in your report, yes, says Solomon, I will. Ms Solomon is getting right down to the point by now. Levitt can reminisce about the thrift about the old days, but the public wants answers. Do you feel you should apologize, does this keep you up at night? Levitt's response: not really, I'll try not to think about it. A good account of the history and weaknesses of the Amtrak based system of rail service in the USA. Questions abound about the queer situation where you find rail popular in Europe and so not prevalent and scarce in the USA. How efficient is Amtrak's rail service in conserving energy? Amtrak uses electricity made from coal, it uses 17% less fuel than a passenger car and 32% less than a airline airplane according to the Oak Ridge National Laboratory. Is this based on new fuel efficient locomotives? No the locomotives are old and Amtrak equipment is aging, so much more fuel efficiency gains could probably be made with new technology and investment. Rail service is coming out of a 40 year period of neglect, and Amtrak itself was probably created to put in one place and hold together a dwindling service, as the passenger services of freight railroads were consolidated to create Amtrak in 1970 by the federal government after the interstate highway system built during the postwar Eishenhower years led to a boom in car travel and the spread of housing to spread out suburbs. At the time private operation was not a consideration as Amtrak itself was a rescue operation to preserve some semblence of rail service before it died out. Now with fresh incentive to do mass transit the whole question being posed is whether private operators should be brought in and would do a better job than Amtrak. Today Amtrak has in all 632 usable rail cars an astonishingly small number, its Amfleet cars are 30 years old, and the Acela trains are 8 years old. In all it carried 25 million passengers last year and in 2008 probably will get to 27 million. Many of these are on long haul routes and where passengers can get to small towns where there is no plane service. Its labor contracts require it to keep these routes. So its a peculiar Amtrak that exists today as a result of historical events and shift to road travel, and it may not be the best vehicle to move the USA towards greater use of mass transit to conserve energy, as its slow to change and takes years to introduce new technology and is not spread out evenly over short and long haul routes. The customer service suffered all these years with no competiton and competition may be healthy for better technology, better service and service on new routes. The UK rail service from London to different parts of the country has been privatised for instance. Better technology and fast service are essential to attract new customers and this is an area in which Europe has made significant progress. At this point even with federal money Amtrak would take years to get new technology from the current manner of writing specification for bids, picking a vendor and waiting for delivery especially as vendors have dwindled because of the lack of demand in prior years....

Friedman says Putin acted emotionally by letting impulsive reaction to the anti-Russian feelings in western Ukraine determine Russian policy following the collapse of the Yakunovych government. The months long Russian response in Crimea and eastern Ukraine may have secured Russian pride at a large cost. This includes the damage to the relationship with Germany, seting the EU on a path to look for other sources of energy to reduce dependence on Russian gas, a natural gas deal with China in which the price was kept "a secret" and may have provided China with a bargaining edge considering the timing of the negotiations. The most severe impact is in the loss of confidence within Russia, reminding the Putin administration that though the economy has grown in the Putin years it is still fragile and connected to the global economy. The capital outflows of the magnitude of $160 billion at a time of high inflation and sharply slowing growth actually put at risk the gains Putin and Russia made in the last decade, and risk the future agenda to improve the standard of living of the Russian people eyond the major cities. Putin's own assessment would eventually be closer to that of Alexei Kudrin. Kudrin, finance minister in Putin's previous term, correctly saw the dangers of impulsive policy concentrated in one figure, and the suppression of other voices including the opposition needed for Russia to be governed in a manner similiar to western Europe, to attain a similiar level of economic progress and standards of living. In today's global economy even the U.S., France, UK and states inside Germany need foreign investment for jobs, new ideas and technology, and the opinion expressed on media television and internet shapes investor sentiment to a larger degree than fully understood....

Russian oil policy at work in towns like Kalyazin, 100 miles north of Moscow, and across Russia. Gasification program is being extended, plan is to increase coverage from 53% to 60% of the people in Russia in the 2005-2007 program. Increase prices to discourage wasteful use and promote energy saving technologies in cooperation with German companies so that more gas is available for export at higher world market prices, especially to the European market. Use profits to promote exploration and increase exports. Germany gets 45% of its gas from Russia and has built close relationships with Gazprom. See the article in BW, July 31, 2006, Jack Ewing, "The Lines that Bind" and references to German-Russian ties: 1) Gerhard Schroeder, former Chancellor, as managing director of the pipeline joint venture, the $5.7 billion North European Gas pipeline formed by partners Ruhrgas, BASF and Gazprom. Ruhrgas owns 6.4% of Gazprom, and its CEO Burckhard Bergmann sits on Gazprom's Board. 2) The survey by Berlin pollster Forsa shows that 75% of Germans support the pipeline project, 45% consider Gazprom a reliable energy supplier vs. the 26% who consider Saudi Arabia as dependable. 3) At an industrial fair in Hanover German business leaders supportive of Gazprom as follows. Klaus Mangold for Daimler management board member considers it " a totally normal market economic process" for Russia to have threatended to supply China with the same gas if European countries cultivate other sources of energy supply. Michael Gloss, German Minister of Economics and Technology, says its good thing to have a neighbor close to home as a supplier. Ruhrgas, Essen based, is a subsidiary of Dusseldorf company E.O.N., and Wintershall, Kassel based, is a subsidiary of BASF. Wintershall management Board member Rainer Seele, speaks of not just partnerships but friendships. 4) Interlocking ownership of assets between Gazprom and the German companies. Gazprom 35% ownership of the assets in the WinGas Joint Venture, Wintershall gets 35% of the equity and 25% of voting shares in the gas field that supports the pipeline. Ruhrgas traded assets in Hungary for 25% ownership of the same gas field. 5) The German relationship under Merkel changes little because she has no options, German suppliers have long term contracts with Gazprom. This article shows how the Russian policy is being shaped on the ground in small towwns like Kalyazin. The one on Gazprom about "The Lines that Bind," shows how the policy is to build relationships with German suppliers, interlocking ownership of assets, increasing the supplies to Germany from the current 45% to over 50 %. Using German investment in joint venture with Gazprom for exploration and development and building pipelines and securing long term contracts at higher prices. Note the reference in article "Can Gazprom Keep the Gas On?" by BW's Moscow Bureau Chief, Jason Bush, BW July 31, 2006- ironically the policy that caused a lot of controversy between Russia and Ukraine about Russian energy prices will actually provide Gazprom with more profits to put into exploration. A big hurdle for local brands in China is the Chinese consumer's interest and respect for foreign brands. Asked about local brands buyers say they can't think of any, or say Chinese brands are shoddy in quality and value. Brands such as Haier in consumer appliances and Lenovo in tech are an exception. During the big surge in consumer sales in the last two decades Chinese companies producing local brands thought it adequate to simply imitate foreign brand names rather than take the difficult route of establishing the credibility of their own brand- an effort which might take years. Often the foreign name was changed slightly to keep the resemblance but mean something positive to Chinese consumers in the local language. Common are names such as Adidos, Hike, Cnoverse and Fuma for sneakers. Clio Coste keeps the connection to Lacoste with its crocodile logo. Coca Cola in Chinese is Kekoulele, translated to mean Tasty Fun. Only now are local companies giving serious attention to creating long term brand entity and image. The serious attention to brand names and branding comes at a time when China increasingly depends on consumer sales to power the economy with the decline in real estate and slower manufacturing. For the 11 months of 2014 retail sales were up 12 percent over the prior year period to $3.8 trillion, according to the National Bureau of Statistics. ...

Novartis is taking a new approach to drug research and drug discovery. The old one which was popular in the drug industry was to go directly for blockbuster drugs for large numbers of users, with a long time in the research pipeline because the area of research was largely an unknown. This was costly and becoming less and less productive. Dan Vasella who heads Novartis, is taking a different approach which comes from his understanding of medical science as a physician, in an industry run by accountants, lawyers and business people. This is to go after wellknown molecular pathways identified by Dr Fishman at Harvard in his research, and do this by taking on problems in diseases that afflict small numbers of people. These drugs have some established medical science to work with, and the research work takes a shorter period. Once the drug proves its effectiveness in one illness, it is tested for other illnesses that afflict a large number of people but which shares some of the same underlying phenomena that cause the disease in the two situations. Dr Vasella stumbled on this approach after the development of the drug Gleevec by Novartis. Gleevec was originally approved for a rare blood cancer, but has now shown to be effective against six other dieases. Gleevec brought 3.7 billion in revenues in 2008 for Novartis. In 2002 Vasella made a bold move to discard the old drug development model. The basis of this approach was to go after new drugs that were desperately needed and where the genetics of the illness were well understood. Whereas pursuing rare dieases is considered foolhardy by most drug company leaders, Vasella's idea is to use the common genetic underlying arrangements for that drug to go after other diseases that would be good prospects for the now proven drug. The known genetics makes it possible to complete the research in a shorter time. In 2009 Novartis has 93 drug candidates in the pipeline, 40% more than 3 years ago and 80% of Novartis' drugs last year made it from early testing to late stage development. This was a 60% improvement over 2005. The new approach fits the current regulatory climate, with regulators concerned more about safety, and Medicare and Medicaid and other payor less willing to pay for treatment with modest benefits or with uncertain outcomes. The approach had to be executed in terms of organization and staffing. Vasella moved the R&D global research operation from Basel to Cambridge, Massachusetts, and spent $4 billion on the move. He recruited a renowed researcher and cardiologist at Harvard University, Dr Mark Fishman, who had done research on the genetic mutations in the cardiovascular systems, to run the center and set the new direction for global research. Fishman convinced Vasella that medical research should focus on a small number of molecular pathways- the complex suquences of interactions among chemicals, proteins, and larger cell structures in the body that are behind all illnesses. Says Fishman, there are 24,000 genes in the genome, but only a few dozen pathways conserved through evolution. Fishman's theory is that you find all the links in a pathway and then locate the signals that can turn the genes on or off to develop medicines for illnesses. Bercause disease after disease share a common pathway, the knowledge gathered can then be applied across that region with more accuracy and directly, to address a range of illnesses. Fishman's approach means marketing and sales no longer make the decisions. There is a new method for doing things. Fishman focusses on clinical data and insists that commercial analysis comes after sufficient clinical data. A major restructuring in 2007 led to shedding 1260 sales and marketing jobs, as clinical science now takes precedence and medically trained scientists take senior leadership positions. The new approach is being used for a drug developed for Muckle-Wells syndrome. Computer simulations are shortening the time to late stage trials. The drug has applications for Type 2 diabetes and severe arthritis. The whole process will take many years, as its a sea change for the industry and for Novartis, a fresh approach when the approach used by the pharmaceutical industry for so long is failing. An oral drug treatment for multiple sclerosis is being developed along these lines. On one hand Chinese environmental officials are aware of the pollution problems in Beijing and Shanghai and other cities. Levels of nitrogen dioxide in Beijing exceed the WHO clean air guidelines by 78%. On the other hand the newly emerging middle class is seeking car ownership, and the local government officials need growth in the car industry to show good GNP and GDP growth numbers on which their performance is judged. Beijing and Shanghai and Anhui province local governments are part owners of some auto companies. About 416,000 people are employed in the Shanghai area auto industry alone and the auto industry in Shanghai pays about 900 millon dollars in taxes, according to government figures. At seven cars per 1000 population car sales are just beginning to take off. And with China's population its clearly not going to be possible to have the same level of ownership as in the US. The same is true for India. This would increase by many times the current demand for crude oil and increase emissions to the point of creating a disaster. And even today because of lax enforcement, and older models on the road, about 40% of vehicles in Beijing have no pollution controls and the other 60% have varying degrees of pollution controls. Experts say changes to the subsidized oil price policy, refineries that produce cleaner gasoline, policies to build more mass transit which has lagged behind in China as car sales took off (and probably more GNP impact from car plants than mass transit which act as inducement for local officials), and stricter fuel efficiency and auto emissions standards are needed....

The story of how Mr. Rausing of Sweden built Tetra Pak from a small Swedish packaging company. Today 500 millon Tetra Pak containers a day are sold globally, making it possible to store milk, juice for over 6 months. Mr. Rausing says he understood machinery, but not finances, and had no idea how much money he had.  Estimates run to $12 billion. In Europe Tetra Pak containers are known for storing milk, and in the U.S. for fruit juice with straws that puncture a foil seal. They are very popular in India, Latin America and Africa. Teta Pak's innovation was to devise machinery that could fill long tubes of paperboard with fluid and pinch the material into individually sealed containers, with box like shapes for easy storage. Hans Rausing studied economcs, statistics and Russian at Lund University. The Rausing brothers were patient in building up their fathers small company which was unprofitable for more than two decades. Eventually Rausing moved to Britain, to East Sussex in 1982. As a privately held company Tetra Pak was nimble and made long term bets. In 1984 it started China operations with a factory long before other companies when China was just opening up. Rausing invested in Ecolean AB in 2001.  Tetra Pak is considered one of the most important Swedish inventions of all time with a display at the British Science Museum. ...
