For years Peter Bernstein has watched the US markets, from the postwar recession of 1958 till today. He is now 89 years old. He sees 2 culprits one is oversecuritization and the second is years of overborrowing by financial institutions and consumers alike. He rules out a V shaped business cycle. he sees an L shaped business cycle or a a flat U. It would be a flat U because it will take a long time for the memory to recover from the excesses of recent years and the consequences. He remembers the early years after World War II, it took a very long time to get the depression out of business and banking decisions. And he says one of the things that helped people take risks was the feeling that the central bank had got things right and knew what it was doing but he says the Fed too now is going to feel what it should do now is less clear. So the feeling going forward will be to be very careful. He thinks this will take a long time to clear up, much longer than people think. Not 2009, he is sure they are wrong, there has to be a respite along the way is how he puts it. He says until credit is going up instead of down you can't have growth. And he thinks housing has to be a part of this. And then there is the uncertainty. What if, what if China goes into a recession? His point that " nothing can go in one direction forever." And China has been growing like this for twenty years since the 1990's. It just does'nt go on forever. and there has to be a respite. Again here him speak: first he goes to housing, he says somehow housing has to flatten out. Then he shifts to say "we have to underpin the consumer" and with that he shifts to saying this is why its different, and to saying this is why its like nothing we have had before. And then he turns to investment, saying its investment that made the V at the bottom of the cycle but he doesn't see the consumer in the USA coming up with a positive till he has worked out the excesses of overspending. Exports or consumer overseas? He thinks they maybe too infected by us to do it. Though Asian growth will help....

South Korea with 2069 hours year has the longest working hours of any developed country, according to the OECD,  and only Mexico exceeds this of all countries. In an effort to increase productivity and boost a dropping birthrate the National Assembly in South Korea reduced the maximum number of working hours from 68 hours a week to 52 hours- starting July 2018 and  initially for large companies. In Japan there is actually a word for working to death called "karoshi." The period of rapid industrialization in the fifties and sixties was a period of long working hours for most Japanese men. Today the working hours have dropped to average of 1713 a year. Africa shows the greatest number of countries in which one third of the labor force works more than 48 hours per week. Asia is the region with the longest working hours with 30% of the countries with thresholds of 60 hours or more.The U.S. is one of the countries where there is no limit- most other developed countries in Europe consider work-life balance important and have maximum limits without sacrificing productivity. ...

Zhou Xiaochuan, is head of the People's Bank of China since 2002. For a long time Zhou has tried to convince party leaders in China to make financial sector changes. The new leadership of Jinping-Li Keqiang has now adopted most of the road map and priorities drawn up by Xiaochuan. The first is bank deposit insurance, which would especially protect small depositors and provide a basis for new private banks to compete with large state owned banks, creating competition in the financial sector. By supporting creation of privately owned banks impetus could be given to loans to the private sector to rebalance the economy away from state owned banks and state owned enterprises. This is a key goal in the road map drawn up by the think tank Development Research Center (DRC) which has the backing of premier Li Keqiang. Competition from new private banks would let banks compete to offer higher rates to depositors, another goal. In a September article for the Communist Party Seeking Truth magazine, Zhou pointed out the pressing need for " supporting private capital to set up private banks and guide them to position themselves in serving small and micro companies." These new companies especially in tech and information technology fields can be the new drivers for growth in the future as the burst of infrastructure building generated growth slows down. The one area Zhou faces resistance is his idea of opening up China to foreign capital inflows and outflows. Here critics,including younger economists, say this protected China in the Asian financial markets crisis of 1997, and would protect China in the event it faces outflows of the type that are happening in India in 2013 after the U.S. Fed's plan to withdraw from its quantitative easing. Xiaochuan sees the flow of foreign capital as another way for capital to flow to new private companies and balance away from the state owned enterprises, and for China's savers to be able to obtain more attractive returns. Zhou says his plan would include the option for China to reintroduce capial controls in a crisis. As China's debt to GDP ratio is set on a trajectory to approach the levels reached in Japan before its banking crisis there is greater awareness from party leaders about the need for prudence. Xiaochuan has worked with party leader Jinping's key economic advisor Liu He for years, and has the support of He and Jinping for introducing deposit insurance as a top priority. President Jinping and Premier Li Keqiang see the need for Xiaochuan's experience and foresight "as a talent who can be counted on," as the sense of importance of changing the economic structure has deepened in 2013. Mandatory retirement for Xiaochuan at 65 was set aside to give him a third five year term, and his road map long ignored by former premier Wen Biao, is now at the top of China's agenda. ...

Roland Arnall who sold his Long Beach Mortgage Company to Washinton Mutual which became WaMu's subprime arm, and ran his own mortgage company Ameriquest. He helped start the whole subprime business when in the early 1990's his company Long Beach Savings and Loan began selling subprime mortgages to financial instituions on Wall Street, where the mortgages were packaged into securities and sold to investors. This packging of securites backed by mortgages and later the shopping for ratings which enabled these securites to get the the AAA rated seal of approval was to get this business the financing and backing on Wall Street. Ameriquest was invoved in questionable practices in its lending. His company and its 270 offices closed in 2006 and $325 million was put up by his holding company ACC Capital Holdings to settle regulators claims of charging excessively high mortgage rates. His origins are with a family that survived the Holocaust by taking refuge in a Catholic church and he became an altar boy, and later immigrating to the Los Angeles area. He was diagnosed with late stage cancer in March 2007 and died the same month. This is one of the individuals who pioneered the whole business of packaging subprime mortgages as securities. ...

Japan's new prime minister told the Japanese Parliament in a policy speech, that a crisis like that in Greece was possible in Japan, if trust in national bonds was lost and the policy of public spending to lift the economy was not reversed. This speech followed the resignation of Shizuka Kamei, as banking minister. Kamei was seen as an advocate of continued public spending. He cautioned that a policy of relying heavily on issuing debt could not be sustained for long. Japan has government debt of $9.7 trillion, which is close to twice its gross national product in 2009. Much of this debt is held by the public in Japan, but analysts have cautioned that with the aging population, it is possible that people who retire will need the cash from bonds, requiring the government to turn to the debt markets for financing. Among the proposals Kan suggested is raising the 5% sales tax to pay for rising social welfare costs for an aging population. Satoshi Arai, the new national strategy minister, says the government will draft a plan by June 22 to address the public debt. He said the government would not exceed $500 billion in bond issuance for fiscal year ending March 2012....

The expectations from the G20 summit in London which ends April 2, 2009, have been toned down both by the Obama administration and by Gordon Brown's government. It has proved quite difficult to get agreement on expanding the stimulus. With Germany and France and some other European governments not going along with President Obama. Also difficult is the task of getting action from these G20 summits, as a lot of meetings have to be held, and agreement has to be reached between many nations, compared to the old G7 which could meet in the White House library. And the local situation in each country is different, with different pressing priorities at home. The long term structural changes, and global regulatory reform, are changes that require more time, more consensus. And some issues such as larger developing country role in governance is not a priority for the large European countries and the USA, which raises questions about the role of the IMF, and the manner in which assistance is adminstered through the IMF. That role exacerbated the crisis in S. Korea during the Asian banking crisis. See the link. As a result there is considerable apprehension about seeking IMF assistance among developing countries.   Rachel Louis Ensign of the WSJ describes one moment in the Madison Square Garden Trump rally. In it Lutnick who Ensign describes as embracing controversial crypto finance business, and EV's Musk, say they plan to  create a Department of Government Efficiency or DOGE, also the name of a cryptocurrency. The US Federal Reserve, the European Central Bank and the central banks of China, India have warned of risks and dangers associated with Crypto currency which has no backing of the government. In one moment of the rally at Madison Square Garden as reported in the WSJ. Lutnick says- "How much do you think we can rip out of this wasted, $6.5 trillion Harris-Biden budget?”   “I think we could do at least $2 trillion,” Musk said.  Fitzgerald says "Yeah" A budget that the large part of includes spending for Social Security, Medicare, Defense, Education, and other departments of government. Howard Lunick is Donald Trump's head of Human Resources in 2024, for hiring people to run the government under his administration. In 1993 he was running the company Cantor Fitzgerald and taking his son to kindergarden when the bombings of the World Trade Center by terrorists killed 980 of the company's employees. Fitzgerald has contributed to Kamala Harris's campaign for US Senate in 2016, and calls himself a fiscal conservative and social liberal. In 2023 he was invited by Trump to help his campaign. Fitzgerald says the Democratic party left him with its immigration and other policies. This report by Rachel Louis Ensign in WSJ says Cantor Fitzgerald's company has embraced crypto, which larger companies have stayed away from. It says the WSJ has reported that a Hong Kong based owner of the stable coin tether used Cantor Fitzgerald to help oversee its $39 billion bond portfolio. During the primaries Trump appealed to blue collar voters of a white working class that felt neglected by leaders and policies of both parties that did not seem to work for ordinary people. Having caught onto this early long before Republican candidates, Trump registered a series of wins in the Republican primaries. He continued this theme in his acceptance speech at the Republican National Convention on July 21, 2016, saying- "The forgotten men and women of our country- people who work but no longer have a voice: I am your voice." The idea was to couple this with the theme of law and order and put perception of Hillary Clinton as part of the rigged system of the past that Trump would change, with Clinton's legacy described in terms of "death, destruction, terrorism and weakness." As a change agent Trump described his entering the political arena in terms of coming into this election only to help blue collar people "so that the powerful can no longer beat up on people that cannot defend themselves." The two themes for the rest of the election season- law and order, and blue collar lives- and who can best defend them a traditional Democratic politician with a fighting spirit for traditional Democratic values, or a blustery newcomer adept with slogans and the public mood and ironically representing the Democratic values of representing the working class to become the  Republican nominee, with the law and order theme thrown in. The voter or independent listening in to all this will hopefully ask what all this means. As the WSJ, July 19, 2016, pointed out in a recent look at economc policies under the two candidates- on Glass Steagall Act being reinstated to increase safety of the banking system that caused many of today's problems through the 2008 financial crisis both Trump and Clinton are similiar, on opposing trade agreements similiar except that Trump's bluster is a riskier approach, on infrastructure building similiar with Clinton's $275 billion plan spelled out out for source of financing and Trump's unclear as to source of financing. On immigration the candidates are different, on the minimum wage which impacts low income people Clinton supports $15 minimum wage and Trump has not taken a stand. On ISIS and the Middle East Clinton is in reality a hawk and not much difference in the candidates, on law and order more chance of divisions in the country with Trump than Clinton. Overall for the working class and blue collar voter his life will take a decade or more to rebuild, with both candidates commiting to go in that direction. And the bluster and ads to come- just that.  ...

Making some territorial concessions appears to be the only way for peace talks to succeed. For a long time there was insistence on territorial sovereignty of Ukraine by EU and NATO leaders. This appears to have prolonged the war- with needless loss of life on both sides, and costly damage to Ukraine infrastructure, a population that had to face additional winters and hardship in war ravaged areas. NATO's Stoltenberg from Norway, leaders of northern Nordic and Baltic countries, the UK, could take that position without having to face the hardship of the war. NATO had to be re-formed under a new name and new structure  following the collapse of the Soviet Union, with wariness about the possibility of centuries old since 1700 UK and Nordic historical adversarial relationship with Russia casting a shadow over that organization, and embroiling the US in conflicts not of its own choice or of wise leadership. This is the root cause of the Ukraine war. It would have been best to completely restructure NATO and give it a new name without Northern European nations leading it. Principles matter once soviet communism was no longer there NATO formed for its expansionism in 1950's had served it's purpose. Rasmussen from Denmark and Stoltenberg from Norway led the organization for the last decade and half from 2009-2014 and 2014 to 2025, with backing from Obama/Merkel for most of the period of the war in Ukraine. Also most of the period NATO expanded to Russian borders happened under Northern European leaders from Spain, Britain and Nordics (Solana, Robertson, Scheffer, Rasmussen and Stoltenberg) and the organization NATO getting the northern European slant based on historical adversarial relationship of Britain and Russia since 1700- for no other reason than the British wanting to protect its large Empire and commerce in India which in the 18th and 19th century included most of Asia. Under Robertson the UK Defense Secretary much of this transformation into turning NATO into something anti-Russian happened which was primarily because of British and Nordic perceptions of Russia as an adversary. Robertson added the following countries at the Prague Summit in 2002 to NATO- the Baltics, Romania, Slovakia and Slovenia. Russia faced internal upheaval in those years and Yeltsin in resigned in 1999, Putin was elected in 2000. It is clear that Russia had suffered severe economic hardship in that period and Putin's first goal in 2002 was to stabilize the economy.  It could be said that this turning NATO over to UK and Nordics was a huge mistake considering that Russia was still the largest nuclear power after the US, and British policy was now determining US policy. And Britain's Robertson/NATO should not have involved itself in the Afghanistan war using Article 5, as the US could have handled this alone and limited that engagement. It got US involved in another conflict, conflict with Russia that was to come in Ukraine on the side of the Baltics and Ukraine, without US clearly understanding what the roots of that war was about and implied confrontation with Russia 20 years after the Prague Summit in 2002 under George Bush junior. The incompetence of Bush and Obama/Merkel laid the seeds of the Ukraine war in 2022 following Robertson, Rasmussen, Stoltenberg, small Nordic nations and Britain creating a conflict that did not need to happen, with loss of hundreds of thousands of lives of Russian speaking fraternal peoples of both Russia and Ukraine. The Republican sentiment under DJT of the tragedy of such huge losses of young people, and desire to end this loss of life, can nowhere be seen in bellicose talk in northern European nations, that take the US for granted to fight their wars.  The wisdom of Washington, Lincoln and TR/FDR clearly caution in getting involved in European centuries old animosities. For the US it meant in practical terms that it could no longer carry out the Monroe Doctrine essential for peace and good governance in the western hemisphere as only a Russia desperate to make its views known about NATO would interfere in the western hemisphere against US assertion of the Monroe Doctrine with the US Navy. Instead drug trafficking gangs took over Latin American countries and created a flow of fentanyl and millions of people through migrant traffickers across the US southern border. As America has expressed its concern for loss of Russian and Ukrainian men in the war for the first time under DJT Russia has distanced itself from Venezuela, Mexico and Latin America. The loss of hundreds of thousands of young Americans to fentanyl is a shared tragedy with the loss of hundreds of thousands of young Russians and Ukrainians in the last decade. How reliable are Northern European countries when it comes to protecting the eastern seaboard of the US with the acquisition of Greenland? It is a policy pursued by presidents since the Alaska Acquisition from Russia. By Seward, Teddy Roosevelt, Harry Truman and DJT. Denmark the land where NATO secretary general Rasmussen was from followed by Stoltenberg from Norway  (for 15 of the years of the war in Ukraine 2010-2025) the US efforts to protect its eastern seaboard are rebuffed by both Denmark and Norway, and the US presented in a negative light as an imperialist power in the face of Danish East India Company's  colonial attitude since 1700 clearly imitating the colonial British East India company.  It shows Northern European nations looking out for themselves not for the US, and embroiling the US in their wars at the cost of the entire western hemisphere being destabilized. The population of UK, Denmark and Norway, Baltics is far less than the Mumbai, Shanghai, Sao Paulo , Berlin and Tokyo regions. Should the views of a small population in northern Europe of 2% of the total determine the future of US, Europe, China, India, Brazil, and other parts of the world with 5 billion people the 98%, when issues of war and nuclear conflict, nuclear buildup, the western hemisphere destabilized with drug trafficking gangs running rampant in countries, divide the world in opposing blocs, when the wellbeing of most of the world's people in Asia and Latin America, Africa is at stake by establishing a essential degree of cooperation by all sides. The US under DJT has chosen a wise policy of cooperation over conflict -with China, with Russia, with all the major powers, and with smaller powers. Reading the wisdom contained in the writings of Washington, Lincoln, TR/FDR confirms it is clearly the wise choice. ...

Fears of nervous investors is now touching the bond markets. AIG's insurance subsidiaries traded their bonds at prices ranging from 38 cents on the dollar to around 81 cents, from more than 50 cents on the dollar a month ago, according to MarketAxess. Investors are worried that future restructurings will cause cash generated by AIG's units to go to the government before its bondholders, as the government has already chalked up a huge bill of $177 billion for AIG. Long term bonds of triple rated General Electric Company, which with GE Capital is the largest US corporate debt issuer, dropped last week to 63 cents on the dollar. Again investors are worried that they may not get all their money back. And again GE's CFO Sherin had to reassure investors that GE's capital position was strong. The bonds of Citigroup are trading at 70 cents on the dollar. Sales of blocks of securities called "bid lists" are not a good sign, as big groups of sales are an indication investors are desperate to unload investments quickly. Bonds issued by Goldman Sachs and General Electric without the government's backing have dropped to 96 cents on the dollar and 73 cents on the dollar, respectively in the last few days. Their government backed debt trades at close to full value or 100 cents on the dollar. ...

The World bank president Robert Zoellick in an interview with Sudeep Reddy of the Wall Street Journal. He says its frustrating to see Europe respond to problems in banking, sovereign debt and competitiveness that have a chance to work, but only to find that the action is a bit late and a bit short every time. He says the Germans are right in insisting that credit cannot be given away freely, and that reforms have to be made. Yet these reforms in the case of Spain and Italy to increase competitiveness will take time and in the meantime both countries will need bridge financing. A direct recapitalization of European banks by the European Financial Stability Facility is needed to avoid this slow and continuous decline in confidence from negative news and uncertainty. Because the problem now is of a longer term nature with debt issues that will take time to resolve and energy price volatility, Zoellick says simply doing short term stimulus and monetary will not work, and a longer term plan needs to be implemented. Zoellick supported the China Development Report of the World Bank and China's DRC which called for a shift in the economy away from reliance on state owned companies and heavy infrastructure spending. Here he says the new stimulus plan for China was necessary because of slowing growth. Yet he hopes China's leaders keep this in mind as they develop solutions for the long term that avoid the rampant credit expansion and investment of the 2008 Stimulus, and come up with a new policy mix....

Italy and Spain get Germany's chancellor Merkel to agree to direct recapitalization of eurozone banks by the European rescue fund instead of the government having to ask for rescue funds as happened for the $125 billion aid request from Spain. The condition is that a European banking regulator with wide powers to regulate eurozone banks has to be setup first. This means Spain will have to provide the initial funds to recapitalize its banks but can reduce the stress this places on its debt by letting the banks get aid directly from the European rescue fund later this year. This is one of the short term measures needed to restore market confidence. Italy pushed hard for the rescue fund to be allowed to buy Italian or Spanish bonds in the private markets to reduce the high yields on Spanish and Italian government bonds, which reached 7% for 10 year Spanish bonds in June 2012. Merkel agreed to this with fewer strings attached. These are the immediate short term measures which were very important for Spain and Italy. Through marathon 14 hour discussions described by Monti as "hard and tense," the Italian and Spanish governments stood firm on these short term measures, and at one point indicated their willingness to let the talks collapse if Germany did not agree. France's president Hollande stood by Italy and Spain in the negotiations. Other long term fixes such as a European authority for country fiscal policy review and a detailed road map were left for future meetings in October 2012....

An indepth look at Mexico, its assets, its huge potential and what is holding Mexico back. It ranks much higher than Brazil in many respects- higher investment as a fraction of its GDP, technical education, an easier place to do business, less regulation, better management talent, more industrialized. In 2010 Mexico had $400 billion of business with the U.S. With rising Chinese wages Mexico is an attractive place for foreign investment, with a hardworking and educated workforce. Mexico suffered badly during the 2008 recession in the U.S. It is trying to reduce its dependence on exports to the U.S in key areas such as the automotive industry. Exports to the U.S. by the automotive industry are now 65% of the total, and the auto industry association in Mexico is working to bring this figure to 50% by exporting to Latin America and Europe. Economic growth was 5.4% in 2010, and expected to be 4-5% in 2011. Drug violence may have reduced the growth by one percentage point according to some estimates. The think tank, Mexican Institute for Competitiveness, estimates that economic growth would be 2.5% percentage points higher if labor market and competition laws are changed, and the oil industry is opened up to foreign investment as happened in Brazil. A study by OECD and the Federal Competition Commission (CFC) of Mexico has shown that 31% of Mexican household spending goes to products operating in high price monopolistic or oligopolistic markets. The bottom ten percent spend even higher proportion of incomes, around 38%, for products supplied in such markets. This includes pharmaceuticals, airline travel, banking, and electricity. Taking on these cartels is a difficult task. The CFC is beginning to take the first steps in this direction, in what will be a long road to fair prices for Mexican consumers. Banking was opened to Wal-Mart. The collapse of Mexicana was an opportunity to auction landing slots to other airlines. An auction system has been developed by CFC for drugs. A new competition law sets penalties for collusion in pricing, with upto 10 years in jail. And Carlos Slim's telephone monopoly was fined $1 billion for its telecom monopoly practices. In 2009 the Calderon government shut down Luz y Fuerza, a state electricity company costing the governmment $3 billion in subsidies for an highly inefficient operation. ...

Alan Blinder points out that the political partisanship that has emerged in 2010 has not served America well, as it has deprived the government of the fiscal policy tools, which would be more effective than the Fed's only mildly effective tool of buying $100 billion a month of medium and long term Treasury debt. The country he says is tied up in partisan knots that prevents the use of the fiscal policy tools, and leaves the Fed with the choice of doing something only nudging the rates on government and private securites a bit (by 30 basis points for Treasury debt and 15 basis points for private securities as an example, not enough for more than a mild impact on corporate spending). The fiscal policy tools are he says of a wide variety and pack a lot more power, and he cites three as examples: offering significant lasting tax breaks for job creation, large enough to produce results (larger and long term than the HIRE program), government hiring directly onto public payrolls and government paying local and state governments for hiring at the local levels, the government offering to compensate states for a cut in the sales tax for a year to stimulate consumer spending. Would'nt this raise the deficit though? Blinder points out that the deficit problem lies in the future. Right now there is so much slack in the economy, that public spending will not crowd out private spending. And with Treasury rates at an all time low, Treasury can finance the larger deficit in the short term. A depreciation of the dollar or inflation, he says, is not a worry, because now there is worry about deflation, and the USA needs a lower dollar to push exports up and rebalance its economy. This does not slight the deficit issue and the culture of poor budgeting among both parties, as Reagan Budget Director David Stockman pointed out in an op-ed piece, but accomodates the real dangers and opportunities of difficult policy choices. This is why he laments the advertising campaign and public relations campaign against the 2009 stimulus bill, and the expected paralysis of fiscal policy from the extremely partisan 2010 midterm elections, and public opinion consumed by fear of deficits. Leaving the Fed with the unenviable choice of using only mildly effective tools. Other experts and columnists mention the risks associated with the Fed's large scale purchase of securities, if this leads to another asset bubble and subsequent collapse, and another bailout needed for financial institutions. Peter Eavis in one column in the WSJ points to the lack of effectiveness of the first round of quantitative easing of $1.7 trillion. The Fed's own files, data from 21,000 Fed transactions over 2007-2010, are revealed in a kind of Wikileaks release. The data is available because of a transparency provision in the Dodd-Frank bill introduced by Vermont Senator Bernie Sanders. This editorial in the Wall Street Journal shows that banks on Wall Street received much more help than advertised. Goldman Sachs is shown to have used the Primary Dealer Credit Facility 212 times for an amount of nearly $600 billion. Morgan Stanley is shown to have used the overnight Fed lending program 212 times from March 2008 to March 2009. The Wall Street Journal editorial concludes that this makes it impossible for someone to argue that either bank would have survived the financial storm without the Fed's help. The same is true for General Electric. GE tapped the Fed's Commercial Paper Funding Facility 12 times for more than $15 billion And with the help of the FDIC's debt guarantee program GE sold $60 billion of government guaranteed debt. GE and Citicorp are shown to be the heaviest users of that program from November 2008 to Juy 2009. The overwhelming lesson, says this editorial, is to ensure that there is no repeat of this kind of situation. And the new Congress needs to tighten the too-big-to-fail criteria....

Glen Hubbard, who was Chairman of the Council of Economic Advisors under President George W. Bush and is now Dean of Columbia University Business School, Hal Scott professor of International Fiancial Systems at Harvard Law School, and Luigi Zingales professor of finance at the University of Chicago Booth School of Business, say a different plan of action is needed from what the Obama administration is doing to tackle the banking crisis. They are really skeptical about the the Public Private Investment Program and other plans put forth upto now for several reasons. First, in every case they say there is a lot of carrot but very little stick, and this won't work. TARP program was mostly carrot, with Treasury getting back securities worth $78 billion less than the $254 billion invested, as pointed out by the Congressional Oversight Panel.The FDIC's guarantee of short term debt was worth $100 billion just for the original nine TARP participating banks, and the mortgage related asset guarantees offered Citibank and Bank of America were worth tens of billions. They see anew round of TARP injections with the conversion of the government's preferred stock into equity after release of the stress test results. Then there is PPIP the Public Private Investment Program, and its plans to subsidize the purchase of bank's"toxic assets" by hedge funds and other investors. They estimate the government will spend $2 for every $1 the private sector puts up. And even with this subsidy their thinking is that the probability of succes is low for the same reason that has prevailed since the earlier efforts by Treasury Secretary Paulson- there is just too big a gap between the bid and ask prices on the toxic assets, and add to that the reluctance of investors to partner with the government. Its time for more stick say these experts as the problem of toxic assets, and of credit and lending in the economy, will hang like a large shadow over the economy, as long as these tough problems are not wrestled with. This is the Hubbard-Scott-Luigi Plan: 1) The FDIC should announce that its guarantees of short term debt set to expire in October will not be renewed. Insolvent banks, defined not by stress tests but as those that cannot fund themselves in the private market, will be taken over by the FDIC under aclear and credible action plan. 2) The FDIC lacks the resources to run several large and complex banks which may become insolvent. And waving the idea of nationalization the creditors may try to get the government to bail them out. The authors of this plan say the FDIC should solit each bank into a "bad bank" and a "good bank." The "bad bank" would carry all the residential and commercial real estate loans and securitized mortgages as assets, and all the long term debt as liabilities. THe "bad bank" would obtain along term laon from the good bank to fund the assets of the bad bank. Al the remaining assets including the derivative contracts and the loan to the bad bank would be assets of the good bank. It would also have all the insured deposits and the FDIC guaranteed short term debt as liabilities. With the split accomplished the good bank can be released from FDIC receivership. 3) The long term debt holders would be compensated by receiving all the equity of the good bank. The old shareholders would get the equity in the bad bank. And in any restructuring bondholders should do better than equity holders. If banks are not really insolvent as some say and just facing temporary dislocations, then the bad bank will eventually surge in value, and the equity holders will do alright, and if not they will receive nothing as they should. 4) For this to work legislation needs to take effect before October for FDIC procedures for handling failed banks to be also applicable to bank holding companies. And this new legislation puts no new cost on the taxpayer....

This Wall Street Journal editorial comes out in favor of higher capital reserve requirements similiar to that suggested by Federal Reserve Board governor Daniel Tarullo. The Journal says that if regulators are serious in the U.S. about controlling systemic risk, then the 14% rule or a 15% rule for assets held in reserve by banks should be adopted. Daniel Tarullo had suggested a 14% capital reserve requirement. These requirements would be phased in gradually over several years. Basel III requirements require only a 7% requirement and is phased in over many years. Capital standards are likely to be gamed. For this reason the requirement for only Tier 1 capital to be eligible is essential. What about the Basel III standards and the European banks? Would this put them in a better position to earn higher returns. This should be a problem left for European taxpayers to tackle says the Journal. As long as U.S. taxpayers are supporting U.S. banks with an implicit subsidy to take on larger amounts of risk -because they will be saved in a crisis with taxpayer dollars- the Journal says it makes sense to require 10-14% in capital reserves. It cites the Japanese banks which were highly overleveraged with lower capital reserves compared to American banks, and fared poorly. The Dodd-Frank bill imposes a complicated set of regulatory requirements with regulators required to write new sets of rules. The editorial concludes that it is far better to tackle the problems in the banking system with a sufficiently high requirement for capital reserves to manage risks than to have the detailed rule making on every subject that Dodd-Frank suggests....

Bondholders and the Greek government are stalled in talks and waiting for Germany and the IMF to come up with the 14.5 billion euros that is due on March 20, 2012. It may suit the bondholders holding out for a higher interest rate in the 4-5% range for the new bonds to be issued at 50% of face value with long term maturities, but is bad for Europe. This Journal editorial points out that this is bad for European taxpayers and points to other steps that can be taken which are being discussed in European circles. One step is for acollective action clause to be inserted for the existing Greek bonds under which all bondholders have to accept losses if two thirds of the bondholders agree to accept losses. To ensure the safety of the Greek banking system Greece would restructure the bonds held by Greek banks so that they continue to be acceptable as collateral with the ECB, and issue new bonds to the ECB with face values, interest rates and maturities matching existing holdings. The idea is to make it possible for Greece to reduce its total debt and its debt servicing costs- which is really the only way out of the crisis. The ECB and Greece would use the collective action clause to restructure the Greek debt to reduce interest and debt servicing costs on new bonds to be issued. The Journal editorial says it should also mean Greece and the ECB are not required to put up the 30 billion euros in up-front cash that was agreed to in a poorly devised agreement in 2011....

In depth interview with Kyohei Morita, chief economist of Barclays Capital, Finance Asia explores different aspects of the Japanese economy and developments after 1987 and under Koizumi, the role of exports and how ordinary households are affected. He points out a few important things about the Japanese economy that are not generally recognized. One is that Japanese banks are vulnerable in the way the subprime crisis has exposed banks in the USA. Their vulnerability comes from owning 15% of the shares on the stock market which came down from a higher number after years of reducing stock holdings. When the Nikkei drops below 9000 this reduces the bank's capital and leads to credit tightening. Morita points out the risk of turning a moderate slowdown from lower exports into a severe slowdown if banks are reluctant to lend. The other point he makes is that small nonmanufacturing companies in Japan have to thrive for Japan to thrive, but he is bearish about private consumption. In a revealing statement he says that in his research he has found that the path connecting corporate profitability to households is seriously eroding. This is due to globalization as Japanese companies are offshoring aggressively, and 30% of the Japanese market capitalization in held by foreigners. His point is that Japanese managers now tend to see wages as costs just like American managers do and not the way they did in the past, so salary costs are suppressed in favor of shareholder dividends which flow out of Japan. Finance Asia referred to an OECD study that shows Japan's ranking in terms of per capita income fell from fifth highest in the OECD in 1992 to 19th in 2002, a fact that Morita recognizes as strange as western economies have tended to follow relatively stable long term income growth, and which he attributes to Japan's terrible demographics with population shrinking since 2006 and more elderly and retired supported by a smaller percentage of working age people. In an exceptionally revealing statement Morita points out that Japan has globalized from the outside but not from the inside. Japan he says needs more foreign direct investment and ideas, and more immigrants, fresh labour and fresh taxpayers. Which is remarkably true as Japan tends to be rather insular as a country and tends to keep out immigrants. The influx of Polish and Eastern European immigrants to the UK under the Blair-Brown Labor government years would be unimaginable in Japan. In the meantime Japan's estimated $15.7 trillion in financial assets held by households or three time national GDP is something that makes it possible for now for Japan to sustain the upward trend in the debt to GDP ratio....

The port of Long Beach which takes in 20% of the container shipping of the USA,, and is next only to Los Angeles port in container shipping, is becoming a story of two economies, the American and the Chinese. Thousands of cars from Toyota, Nissan and Mercedes are piling on port property turning it into one huge parking lot, as dealers across the country say they have no need for them, and piles of paper and metal baled together to be shipped back on these ships to China to be recycled into cardboard for export boxes are also piling up as China no longer needs them. The drivers who drive the trucks are also being laid offf and looking for new jobs, which are signs that a deeper economic downturn is underway and the the Detroit automakers GM and Ford CEO's who told the Banking committee that they are making their estimates for 2009 on the basis of a 13- 14 million vehicle sales year may be in for another rude shock. The figure for the last quarter may be running at 10 million, and if this continues into 2009 as its expected to do, even the producton of cars after accelerated plant closures may have nowhere to go in 2009. Which is why there are so many questions about what is going on in the auto industry and so much need for candour and frank discussion that was missing in the evasiveness apparent in the Senate hearings on November 18, 2008, as CEO and union president skirted around the issues and senators failed to ask many other questions like these on what is happening on demand as well as many others....

U.S. President Obama's speech at the General Assembly of the United Nations, Sept. 25, 2012, in which he praised the work of Ambassador Stevens in Libya. He defended First Amendment rights in the U.S. of free speech to an audience that was not fully convinced that the "anti-Muslim video" designed from the start as a provocation, produced as a violation of probation rulings by the individual, and being given the distribution channel of a vast internet audience by Google owned YouTube, falls neatly into free speech. The German government is reported to be looking into banning the video from distribution in Germany, and Germany also protects free speech under its constitution. He cited the "voices that rally against bigotry and blasphemy," as the way a First Amendment democracy protects against this type of abuse; which would suggest that Google as one of these voices has the responsibility to treat such content similiar to other extreme content of a pornographic nature or other such provocative material inducing violence, which it routinely excludes from distribution. The ultimate protection of First Amendment rights comes not from the U.S. constitution itself, but from the responsible exericize of wisdom, vigilance and common sense. During the long years of drafting of the Constitution when Madison, Jefferson and others who drafted the document took pains to include every protection so that basic rights would be preserved, George Washington pointed out that one could do this only upto a point, because it was upto the wisdom of future generations to preserve these rights, and this could never be done completely....

This editorial in the Economist magazine says the banks have paid large fines for wrongdoing but individual accountability has not been achieved. Only one individual conviction has been achieved related to market rigging in Britain. The penalties paid by banks between 2009 to 2014 worldwide add up to $245 billion, according to CCP, a research group. The problem says the editorial is that without individual accountability this is likely to be seen just as a cost of doing business. For the culture at banks to change individual acountability has to be established, and only now are banking regulators realizing that the public's disillusionment with the political parties in power during the last decade in Europe and the U.S. has its roots also in the way accountability has been tackled. Editorials in the WSJ and the NYT have addressed the same theme and expressed the same concern. The May 21, 2014 editorial on the U.S. Justice Department's legal settlement with Credit Suisse. "Holder convicts Switzerland," was critical of the Justice Department because this settlement did not bring accountability or justice. Columnists Eavis and Reilly in the WSJ, Protess and Greenberg in the NYT, were also critical of the settlement. Other legal settlements followed the same pattern throughout 2012-2015. Another aspect of this and a larger problem is that the same management has remained in place in some places. Shareholders expressed their feelings at the recent Deutsche Bank meeting in June 2015 when one shareholder association asked the question: "Mr. Jain are you the solution to the problem or part of it?" questioning how the same management that created the problems was going to fix the problems. A week later the two co-CEO's departure was announced and a new CEO appointed. BaFin, Germany's regulatory authority was described as not providing effective oversight on management at Deutsche Bank, by Eyk Henning in the WSJ March 28, 2014. It is too early to say if the public's frustration with the slow pace of establishing accountability and generating culture change is at long last registering with regulators and the political parties running the government. Prime minister Cameron and chancellor George Osborne's decision to put $1 billion into communities throughout Britain from the fines, described in the WSJ May 31, 2015, and an additional $227 million pounds from a legal settlement with Deutsche Bank in April 2015 for creating 50,000 apprenticeships, is the first sign of a conviction developing in political parties that instincts of fairness and the compact between the people and their government handed down over many, many years and generations, need to be respected. In the U.S. communities devastated by the recession and foreclosure crisis, especially inner cities, could benefit from Cameron and Osborne's exceptional idea. For the political parties and the political elites in Europe and the U.S. it is a way to restore some of the trust lost in the last decade. For banks a change of management, cultural change, will benefit the employees and shareholders, and improve relationships with customers, restoring trust over the next decade....

Thomas Hoenig, chairman of the Kansas City Federal Reserve Bank, says the five largest financial institutions in the US are 20% larger today than they were before the 2008 crisis. These five institutions control $8.6 trillion in financial assets or the equivalent of 60% of gross domestic product in the USA. He points out that whether we like it or not, these firms are too big to fail. Though these institutions survived the 2008 crisis with a bailout from the Fed as shown in the Fed's recent revealed documents, Hoenig says, little has changed on Wall Street. Two years after the crisis of 2008, these firms again operate with bonus and compensation schemes that reflect not the recent failures but a sense of success. Hoenig says this is why the American people are angry. An absence of accountability and blatant inequities with which smaller businesses and institutions were treated compared to the large ones, is why they will remain angry. Without this accountability he feels Americans cannot build a national consensus for the sacrifices needed to rebuild the American economy....
