Did a major U.S. chip maker Advance Micro Devices give away advanced computer chip technology in deals that saved the company as it faced a downturn in business. In Jun 2019 the U.S. Commerce Department issued an order that bars several Chinese companies from getting American technology. In the meantime Chinese versions of AMD chips are rolling off production lines in China, according to this report in the WSJ. It shows that AMD's partner in China, a military contractor, already used those chips to build what could be the world's fastest supercomputer. The AMD deals gave China access to state  of the art x86 chips made only by AMD and Intel Corp. Here the WSJ says AMD's CEO in October 2014 Lis Su, faced AMD's financial difficulties when she joined, with lack of cash, large debt, and declining revenues. Some analysts predicting bankruptcy protection. The deal for China's company Sugon to manufacture the x86 chips included $293 million in licensing fees, and $371 million for selling an 85% stake in its two factories in China and Malaysia to China Integrated Circuit Industry Investment Fund Co, a state backed financier. The U.S defense Department tried but failed to get AMD to submit the deals to Cfius, the committee on foreign investment in the U.S. that has people from Treasury, Defense, Commerce, Justice and Energy. The Treasury Department ruled in AMD's favor in the closing months of the Obama administration. Defense Department officials say the deals were structured to sidestep U.S. regulations through two interlinked joint ventures. The first venture focusses on R&D and production controlled by AMD, the second on design and sale controlled by AMD's Chinese partner. The second company venture enables China to show that the resulting product was developed locally in China. In another development Sugon publicly announced that it was using the AMD x86 chip to advance China's chip technology advancement just as it had done for high speed trains. Making indigenous an imported technology, designing it at home, absorbing it, and then innovating to make China a leader. By mid 2017 this information reached General Spalding at the Trump White House. Lawmakers wanted to give Cfius committee new powers. By August 2018 Defense department submitted the Sugon deal for review a second time. After the Defense Department's deputy undersecretary for Research and Engineering criticized the whole deal publicly in front of industry executives, Commerce Department stepped in and on June 21 it asked for the unwinding of the deal with Sugon,  imposing new export restrictions to limit access to U.S. technologies. For AMD the cash infusion from China enabled it to get back from near bankruptcy. China gained x86 technology in its bid to make the fastest supercomputer, the U.S. faced with another loss in technological edge, and AMD shares jumped 80% to $30 per share recently. This editorial in the Economist magazine says the banks have paid large fines for wrongdoing but individual accountability has not been achieved. Only one individual conviction has been achieved related to market rigging in Britain. The penalties paid by banks between 2009 to 2014 worldwide add up to $245 billion, according to CCP, a research group. The problem says the editorial is that without individual accountability this is likely to be seen just as a cost of doing business. For the culture at banks to change individual acountability has to be established, and only now are banking regulators realizing that the public's disillusionment with the political parties in power during the last decade in Europe and the U.S. has its roots also in the way accountability has been tackled. Editorials in the WSJ and the NYT have addressed the same theme and expressed the same concern. The May 21, 2014 editorial on the U.S. Justice Department's legal settlement with Credit Suisse. "Holder convicts Switzerland," was critical of the Justice Department because this settlement did not bring accountability or justice. Columnists Eavis and Reilly in the WSJ, Protess and Greenberg in the NYT, were also critical of the settlement. Other legal settlements followed the same pattern throughout 2012-2015. Another aspect of this and a larger problem is that the same management has remained in place in some places. Shareholders expressed their feelings at the recent Deutsche Bank meeting in June 2015 when one shareholder association asked the question: "Mr. Jain are you the solution to the problem or part of it?" questioning how the same management that created the problems was going to fix the problems. A week later the two co-CEO's departure was announced and a new CEO appointed. BaFin, Germany's regulatory authority was described as not providing effective oversight on management at Deutsche Bank, by Eyk Henning in the WSJ March 28, 2014. It is too early to say if the public's frustration with the slow pace of establishing accountability and generating culture change is at long last registering with regulators and the political parties running the government. Prime minister Cameron and chancellor George Osborne's decision to put $1 billion into communities throughout Britain from the fines, described in the WSJ May 31, 2015, and an additional $227 million pounds from a legal settlement with Deutsche Bank in April 2015 for creating 50,000 apprenticeships, is the first sign of a conviction developing in political parties that instincts of fairness and the compact between the people and their government handed down over many, many years and generations, need to be respected. In the U.S. communities devastated by the recession and foreclosure crisis, especially inner cities, could benefit from Cameron and Osborne's exceptional idea. For the political parties and the political elites in Europe and the U.S. it is a way to restore some of the trust lost in the last decade. For banks a change of management, cultural change, will benefit the employees and shareholders, and improve relationships with customers, restoring trust over the next decade....

The auto industry has only itself to blame for shaping and sustaining the retrograde world it finds itself in, says Politico magazine. GM supported the Trump administration's efforts to push back the fuel efficiency rules setup earlier. With Chrysler and Ford it went a step further in getting out of cars altogether and having a line of SUV's and other vehicles. This step is seen as retrograde and a result of several possible lines of thought among the car executives in Detroit. One is that the SUV higher profits would provide a cushion as this cycle in the industry's revival comes to a close. Another is that in a situation where GM's shares are depressed while Tesla with no profits is seeing a higher valuation, this could increase its share price. This has not happened and President Trump is as critical of the layoffs of 15% and closure of plants in GM's announcement, as Democratic senator Bernie Sanders is. Still another is that GM needs to prepare for all the tech changes happening in driverless cars, new tech advances, that a move like this would better prepare itself for the new world of transportation. This remains nebulous however and GM has failed to take account of the fact that only a short time ago about half of all car buyers were still not buying SUV's. Gas prices are volatile and will continue to be so that strategy cannot be based on cheap gas prices and SUV profits.    ...

Cochrane says the best option today is for Europe to accept a sovereign default for Greece. He says the European Central Bank which stands behind the euro, should not be used for buying bonds of troubled countries with shaky "collateral." This would only lead to a situation where EU countries would have to recapitalize the ECB. He emphasizes the fact that Greece will not pay back this debt. And the only way out is to have a situation similiar to Argentina where it needs to start over, and it would at some point be able to borrow again. Austerity is deeply unpopular in Greece and with higher unemployment Greece's financial situation is rapidly deteriorating. Making austerity something that was tried to buy time but will not work. Cochrane also makes the point that the euro itself acts like the euro bonds that EU countries are reluctant to support, it means the ECB backs the currency and supports it- which makes it vital to keep the ECB whole and prevent the dilution of its financial strength. Axel Weber, former head of the Bundesbank, resigned to express his opposition to the ECB buying the bonds of troubled eurozone countries, which he said was outside the ECB's mandate to conduct monetary policy....

Having an adequate supply of N95 masks is critical for each hospital tackling the coronavirus pandemic. The lack of enough masks leaves health care personnel without the basic protection and is a grave emergency. Hospitals are resorting to reuse of the masks in this crisis and this is not a good practice as it increases the chances of infection. President Trump has invoked the Defense Production Act on April 2 against 3M. This gives the federal government more control over 3M's operations to ensure that it goes all out to make the healthcare N95 masks that the hospitals need in this grave emergency. This report in the WSJ covers the situation as of April 3 on the supply of M95 masks for health workers and others. N95 masks block 95% of very small particles. Supply in the U.S. is for 50 million N95 masks. Demand in the U.S. is for 300 million N95 masks as estimated by the Department of Health and Human Services. in March- this is how many are needed by health care workers to fight this pandemic in the U.S. The principal manufacturer is 3M. 3M company has doubled its production since January 2020. The trend before this pandemic was to send production over to China and other countries. This is changing now with the pandemic and the U.S. policy shifting to be self sufficient in medical supplies in the event of an emergency. A policy Peter Navarro, who heads the agency in charge of getting medical supplies, says President Trump is insisting be implemented. Hospital buyers supported the earlier trend to keep costs down, but this appears to be a costly mistake, putting health care workers in hospitals across the U.S. without the basic protection they need. Minnesota based 3M invented the first modern disposable masks in the 1960's. Interestingly 3M continued to make millions of masks in the U.S. even though competitors moved manufacturing overseas. The 50 million disposable masks 3M made globally went to workers in industries where it provided extra safety from metal shavings or other substances, and medical workers. Now 90% of masks go to medical workers. 3M ramped up production globally since January 11 when the pandemic first hit to 100 million masks a month globally, and 35 million a month in the U.S. at plants in South Dakota and Nebraska. 3M says that it will import 10 million masks from its factory in China, which earlier this year was restricted from shipping it outside China as China needed masks for the pandemic. About 10 million more masks are made by two other manufacturers Alpha Pro and Louis Gerson Co.  U.S. Department of Health and Human Services ordered 600 million N95 masks from 5 companies to distribute to hospitals and build up the national medical supply stockpile. 190 million each of this is from 3M and Honeywell and 130 million Owens & Minor Inc.  3M says it will make 50 million a month in the U.S. by June. Honeywell which had moved production overseas, plans to bring back production to the U.S. by making 10 million masks by May at its Rhode Island and Phoenix plants. There is a company in Singapore that makes one million masks a day in China and other Asian countries, Pasture Pharma Pte, but most of it is committed to government agencies in China.   ...

With Putin now president and putting his support behind Rosneft CEO, Igor Sechin, and the idea of building Rosneft into a large state owned company that champion's Russian interests, the deal to buy BP's stake in the TNK-BP joint venture is more likely to succeed. Earlier efforts in mid 2011 for Rosneft to buy BP's stake stumbled, with president Medvedev pushing in the other direction for a smaller state control of industrial assets in Russia, and calling for political leaders like Mr. Sechin to give up corporate positions. It appears that Putin is now convinced that this is the right direction for Russia. Under the proposed agreement Rosneft would value BP's stake at $25 billion, half of this in cash and half in the form of Rosneft shares, making BP a part owner of Rosneft with 10-15% of Rosneft shares, and potentially a partner for future projects providing access to western technology. The 2011 deal valued this stake at $32 billion. For BP it provides a more reliable partner after its troubled relationship with the AAR group, the 50% owner of the BP-TNK venture, with no majority control for either partner and AAR's political influence leading to many conflicts....

The German and French positions on solutions to the eurozone debt crisis are in conflict. As a result the negotiations between France's Sarkozy and Germany's Merkel are deadlocked. The basic differences revolve around three basic issues. Germany wants to see a lasting solution in which Greece debt is restructured so that banks and other creditors that loaned money to Greece voluntarily take losses so that Greece's debt can be reduced to a sustainable level of no more than 50% of what it is now. France, the ECB and the French banks do not want to restructure Greek debt in this manner beyond the 21% reduction in value of debt under the July 2011 agreement. The voluntary reduction in Greek debt by the banks would prevent a default by Greece and unsettling of the financial markets. France fears market contagion from the restructuring of Greece debt that would place pressure on French banks as the value of the Greek, Spanish and Italian sovereign debt French banks hold declines in value. That would require a major recapitalization of French banks and additional cuts to the French budget. Additional twists to the negotiations are that Sarkozy is unpopular in France with elections six months away. For this reason Sarkozy would prefer to recapitalize after 9 months. A way to get around the need for more deficit cutting (austerity measures) in France, is for the European Financial Stability Fund to be able to borrow money from the European Central bank. The ECB can print euros in that situation. Germany's chancellor Merkel has to consider German public opinion and experts from the German central bank, who are adamantly against using the ECB to print money and Germany committing itself to bankrolling most of the effort. Germany wants France to use its own money to recapitalize French banks, with Germany only responsible for recapitalizing its banks. Merkel told her parliamentary caucus in Berlin that "the path is closed for using the European Central Bank to ease liquidity problems." Because of Germany's insistence on financial soundness for any solution, France being in the more difficult financial position and Sarkozy facing elections willing to come up with a short term fix, and the unwillingness of French and German banks to take the losses necessary for a lasting solution, the Germans see a real solution taking a long time. ...

The struggle between the Detroit automakers and the states over auto emissions of carbon dioxide and other heat trapping gas emissions. California adopted the first state law requiring auto manufacturers to reduce emissions of carbon dioxide in 2002 and in 2004 set standards for the emission reductions. Vermont, as well as Connecticut, New Jersey, New York and Pennsylvania adopted the same standards. Automakers sued toblock these standars in Vermont and California. While the California case is pending, Judge Sessions issued a ruling on the Vermont case this week against the auto manufacturers. This follows a decision by the US Supreme Court in April 2007 that the Environmental Protection Authority has the right to regulate heat trapping gases like carbon dioxide as air pollutants. This endorses the idea that states can set their own limits. What is needed for a state to do this is to get a waiver from the EPA, as the federal Clean Air Act has a provision that allows California to set ists own standards with a waiver from the EPA, and for other states to follow California's lead. A detailed opinion includes analysis by the Judge in this case stating why the Transportation Department's authority is limited to automobile fuel economy standards and does not carry over into auto emissions as pollutants of the atmosphere, the area of pollutants being reserved for the EPA and the individual states to work out together. Under California law as it is now emissions reductions for cars could be 30% or more below the current levels in the 2016 model year. By 2012 emissions are required to be below 2005 levels by 25% for cars and light trucks, SUV's and larger trucks 18%. Note that what is technologically feasible to accomplish in the area of auto emissions is an unknown. At the same time its a function of determination, R&D investment, collaboration between companies to pool technological and capital resources, development of engineering and manufacturing investment and knowhow to learn mass manufacture at low cost, introduction of the already feasible features quickly such as stop start engines which the Germans have already in the works for mass manufacture across product lines, and so forth. The first comer in these technologies enjoys an advantage as Honda constantly advertises itself, and the the only way to say what is technologically feasible or not is by pointing to these pioneers. In this case because of the stronger environmental movement in Europe especially in Germany, some of this pointing will be done in the direction of the German auto manufacturers progress in this direction to meet the new EU standards of 120 micrograms of CO2 per kilometre. ...

With the sale of its stake in TNK-BP to Rosneft BP will have 19.75% of Rosneft. It will lose TNK-BP's oil production of 986 billion barrels of oil equivalent, and it will gain 900 million barels from its share of Rosneft output. BP's oil reserves will increase by 12.5% after the deal. TNK-BP has paid annual dividend of an average of $2.2 billion since 2004, BP payout from Rosneft is estimated at $500 million. BP's share of the new Rosneft after the deal would be $3.6 billion in expected earnings for 2013 compared to $4.1 billion from the 50% share of TNK-BP. Some of this dilution may be restored by share buybacks by BP.

Plans are being made for renovation in 2013 even as there is an abundance of office space in New Jersey. This is part of the 473 acre site for Bell Labs in New Jersey. Fisher and Taub of the NYT look at the populist politics in Europe and the U.S. following the French election first round. Trump won in the U.S. with the deep polarization of politics in the U.S.- leading to the Republican Party to decide to support him to avoid the result of four more years of an administration led by Democrats, and with the support of discontented voters in midwestern states with falling living standards. The situation in Europe is different as the mainstream parties have united in the past to block populist politicians with negative messages on immigration and an open economy. This happened in the Dutch election, by the co-opting of the nationalist message of populist politicians by mainstream parties and mainstream politicians, and is likely to continue in the French and German elections in 2017. Fisher and Taub point to another development that is happening- shifting the debate to ethnonationalism vs. open economies, which has happened with Brexit and the UK Independence Party. They cite the 2015 British elections in which UKIP won 13 percent of the vote, as having influenced prime minister Cameron to call for a referendum on Brexit, in a effort to revive the fortunes of the Conservative Party. In the end this resulted in the 52 percent vote supporting Brexit.  Another way of looking at the populist movement is that with Trump it called attention to trade and the way working class Americans were being marginalized especially in the industrial midwest. With this problem being addressed in a Trump administration and a reviving economy, the mainstream parties have an opportunity to reassert themselves. In Europe the AfD called attention to immigration issues, and the Merkel coalition government of CDU and SPD by making changes such as the deal with Turkey, and returning economic refugees, is able to assert the role of mainstream parties. In Britain the situation could be a result of a brash decision by a Conservative prime minister Cameron, in making a bad miscalculation, that has put Britain on a course that is likely not in its best interest. The Brexit referendum yes vote galvanized opinion by showing an endless stream of refugees in their advertising- a development following the opening of borders by Germany and Austria to address the plight of Syrian war refugees. That situation has passed and is unlikely to happen again as both the SPD and CDU parties in Germany have pointed out that this was a one time situation that they responded to following the exodus from Keleti rail station in Hungary under special circumstances. With this kind of perspective populist politics can be seen as reflecting other voices in a democracy, that are heard and responded to, yet keeping the sense of balance and openness necessary in today's global economy and societies. This is also the perception of Germany's outgoing popular president Gauck in his final address, pointing to the need to listen to other voices in a democracy, and the need for openness in a democracy, as well as democracies always in the process of Becoming and evolving to adapt to new situations in economy, society, and politics.     ...

In comparison to industrial companies digital companies such as Google and Apple have more room to find gaps in the U.S. tax system which was designed for the industrial period. Apple paid a tax rate of 9.8% in 2011 on its global profits in 2011 of $34.2 billion, a total of $3.3 billion. Wal-Mart for instance paid a tax rate of 24%, on its booked profits of $24.4 billion, a total of $5.9 billion. The issue is significant because of the large U.S. deficit and spending cuts by local and state governments for essential services, especially in California, where Apple is located. Apple is able to avoid state taxes on some of its profits by locating an office in Reno, Nevada. Nevada has zero corporate taxes, California's corporate tax rate is 8.84%. In the current fiscal year Apple is expected to earn $45.6 billion which if taxed at the rates companies paid in the 1950's - 30% in the 1950's compared to 6.6% in 2009 for corporate tax receipts according to a New York Times report- would enable the state of California to avoids some of the sharp cuts in funding to community colleges such as De Anza College only minutes away from Apple, Google and H-P. De Anza College's president says he simply cannot understand this, how the whole psychology of corporations and the public itself has changed over the years, to where a college where one of the Apple co-founders Steve Wozniak got his education in 1969-74, is now struggling to survive with funding cuts. The California college system of the 1950's and 1960's was funded by other companies tax dollars creating the educational resources which helped create todays companies- one generations responsibilities transferred to another generation that has failed to understand what this is about....

Entergy is one of the largest energy companies. Its CEO for nine years, Wayne Leonard, talks to Joseph Rago of the Wall Street Journal. Its the No.2 generator of nuclear power in the USA, and uses coal for only 7% of its energy. He has made his name in nuclear energy, and here he talks about the government's cap and trade program and nuclear energy. He points to today's technology as far superior to the technology that was used in the Failed Three Mile plant, that put back nuclear energy plants in the USA for decades. He believes that price signals are needed for CO2, and the cap and trade program helps to do this, so he supports the cap and trade program. He admits that self interest colors perception of Entergy, compared to coal using utility producers like Duke Energy and American Electric Power. With coal only 7% in its portfolio of plants, and big in nuclear energy, it stands to gains from a cap and trade program, whereby Congress will set a ceiling on emissions, then allows businesses to sell any of its extra allowances that stand for the right to make emissions. And in doing so creating the largest commodity market, in carbon backed securiites. He and the government agree on the point that the allowances should be auctioned off, rather than given away as the companies with many coal plants believe. And the billions in new revenue from these allowances would be returned to the public. He understands that the view of companies like Duke and AEP, that use coal and would have to increase rates, and face the anger of ratepayers as they pay more for the allowances. He also thinks the bill should be written with a fine pen, so that if Congress mandates 20% of energy come from renewables. That it should specify replacing coal not natural gas as what this replaces, to get rid of the most polluting sources. He points to the real need for looking at things globally, as doing things locally, even to show responsible leadership in the world community, can lead to no progress in the global picture. The reason is that China is going ahead with the rapid construction of conventional coal plants. It has surpassed USA coal capacity, and is on track to double it sometime in the next decade. If the USA closed down every single coal plant, and all the time new coal plants are going up in China and India, then we would have ruined our economy, and it was'nt making much difference globally. And he says, if we just say lets lead and people will follow us, "its silly", because China isn't going to follow us, especially when they have $2 trillion invested in their coal plants, and they still aren't feeding feeding all their people. So how to deal with this? Develop the new technology for carbon capture for existing conventional coal plants, and help the Chinese with retrofit technology to curb emissions in a realistic manner. At this time most current funding is devoted to technology for second generation systems, that are still 10-20 years away....

The in-house manufacturing approach has benefitted Lenovo. This was especially evident during the flooding in Thailand when PC manufacturers were faced with a shortage of hard drives. Because Lenovo assembles its own computers unlike competitors Dell and H-P, it was able to move quickly to focus on products for which hard drives were available and emphasize high profit margin products. The additional flexibility and speed helped Lenovo increase market share from 13.7% to above 14% in the 4th quarter of 2011, and ship 13 million computers. H-P experienced a market share decline to 16% in the 4th quarter 2012 from 18% the prior quarter. Profit for Lenovo after several years of losses was $473 million for the fiscal year ending March 31, 2012. Lenovo co-founder Liu Chuanzhi and Mr Yang took control in 2009 and refocussed the company on China and emerging markets leading to increasing sales. Mr. Yang has been with the company since 1988, when it was not called Lenovo. He became CEO in 2001 and recently he has taken the post of CEO and chairman. Yang's four year plan in 2009 was focussed on increasing its network of resellers in China to the point that even in rural areas customers could reach a Lenovo store with customer service. At meetings in 2009 the decision was taken to increase in-house manufacturing to 50% from 30%. Lenovo hoped to gain an advantage with its own manufacturing capabilities in working closely with suppliers to come up with differentiation in key components such as display screens, battery and storage, and improve existing products for a market edge. Lenovo is also promoting its brand with increased advertising to promote customer acceptance of the brand....
