Different constitutional law opinions on the option of the President citing the 14th Amendment to the U.S. Constitution to raise the debt ceiling. Former President Clinton says he would unilaterally invoke it "without hesitation, and force the courts to stop me." President Obama said recently, "I have talked to my lawyers, they are not persuaded that this is a winning argument." Section 4 of this Amendment was designed to assure creditors the Union debts after the Civil War would be honored and to say Confederate debts would not be honored. This part of the 14th Amendment says "the validity of the public debt of the United States, authorized by law, including debts incurred for pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned." Prof. Jack Balkin of Yale, says it provides a broader principle that the public debt cannot be held hostage for political purposes. His view is that this is something that could be an option when all other options are exhausted. Prof. Lawrence Tribe of Harvard, say the law courts have no plausible point of entry in such a situation. There is a sense that "popular constitutionalism" would play an important part if something like this happened- the meaning of the constitution is what popular sentiment says it is in the particular context and events. ...

Derek Scissors writes that the effects of stimulus weakens over time, even in economies like China's that are only partly market based. And he says China has used stimulus for years. He says that in 2001, fixed investment was at 38% of GDP, investment growth 12% and revised GDP growth 8%. In the first 3 quarters of 2010, GDP growth was 10.6%, but this required investment growth of 24% and that was with fixed investment now equal to 72% of GDP. These figures suggest the difficulty of getting growth at higher and higher levels of investment. His view is that more likely than a crisis is a stalling economy.

The local tour guides in Yan'an (Yenan) China, who know absolutely nothing of the history. An American visitor who lived there in the 1940's revisits Yenan. He is stunned by the changes. Th makeover by the tourism bureau has changed the place that was the centre of the Communist struggle with the Koumintang and the Japanese. Mao, Zhou-en-lai and others made this the central location for their struggle for China after their Long March and well into 1948. It says Rittenberg was a place of stark beauty, with its primitive cave city. He sees the commercial makeover as having destroyed this museum to Chinese revolutionary history.

As remedies for the $1.6 trillion federal budget deficit for 2010, which says Hubbard threatens to compromise Americas economic future, set agggressive targets for reducing discretionary spending limiting growth to 2%. Hubbard also wants to see 1% reduction in projected entitlement spending growth for Social Security and Medicare. This can be done progressively, he says, by lowering the growth in spending for middle and upper income households and strengthening the safey net for lower income people. And third he would have a broad based consumption tax to pay for added social spending. Hubbard was adviser to president George W. Bush and is Dean at Columbia Business School.

Zweig cautions against putting too much faith in experts, or quant models such as "value at risk" or VAR, used by JP Morgan to assess risk. He cites physicist Richard Feynmann: "You must not fool yourself- and you are the easiest person to fool." And the address Feynmann gave at the 1974 commencement of Caltech, in which he said avoid the "cargo cult" mentality of Pacific Islanders who believed that just by standing on runways they could make plane full of food and clothing land, similiar to the ways they did after World War II. Ollanta Humala, is the leading candidate for the presidential election in Peru, with 27% of the vote after 43% of the votes were counted. Kuczynski has 23.6%, of the vote and Keiko Fujimori has 21.8%. Humala, lost a runoff against the current President Alan Garcia in 2006. He is modeling his campaign on the effort by Lula Ignacio Da Silva's when he ran for President of Brazil. Both have credentials viewed as left of centre and want to be viewed as offering a more balanced version of development. In Humala's case the rural areas outside of the capital city of Lima have not seen the benefits of rapid development and modernization.

Albergotti and Macmillan tell the story of Jan Koum of WhatsApp who immigrated from Ukraine as a teenager in 1992, and settled wih his mother in Silicon Valley. His interest in messaging apps stemmed from his interest in staying in touch with extended family in Ukraine, Russia and Israel, after losing his mother to cancer and his dad passing away in Ukraine before making it to the U.S. He met Brian Acton at San Jose State University, where he studied programming, and the two founded WhatsApp in 2009. In the early years after 1992, before joining Yahoo following graduation, Koum lived on food stamps.

Chen and Goelfeb provide insights into the life and experiences that led Ukrainian immigrant Jan Koum to found startup WhatsApp. After taking a break from work at Yahoo he decided to travel places including Argentina, where he found it especially difficult to communicate with friends in other countries by phone and messaging. The messaging service was a response to this desperately felt need on his own travels, leading to the conviction that it was best to offer it free and make it easy and convenient to use. A similiar situation on travels to Mexico, with little adequate information on hotels, led to another startup Trip Advisor.

Michel Sapin faces the challenge of convincing the EU and Germany that France should get more leeway for tax cuts and other measures to boost the economy and lower unemployment. He has been through difficult situations before when following approval of the Maastricht Treaty the French Franc came under speculative attacks by investors betting France could not implement the Treaty. At the time he was finance minister in the Mitterand government. As labor minister since 2012, Sapin implemented Hollande promises in the elections- for government sponsored jobs for young people, creating contracts to bind young and older workers in the workplace, and reform of professional training schemes.

Banking careers do not have to be damaging as widely stated following the missteps and bad practices that caused the 2008 financial crisis, which made America and its middle class poorer than before and damaged the reputations of many banks. Here Josh Barro provides one example. He says its critical to choose being the right kind of banker doing the nuts and bolts of banking such as reviewing loan applications, and doing it diligently and well. Equally important, says Barro, is picking the right bank. He chose Wells Fargo, which avoided the worst errors and bad practices of that period under the leadership of CEO Kovacevich.

The election of the Metropolitan Krill to head the Russian Orthodox Church marks a new beginning for Russia. His father and grandfather before him, were dissidents who spent time in soviet prison camps and were priests. He talked about the need for the church to rely on its own inner spiritual strength to carry on the dialogue with society and the state, and the need to find ways to restore the moral values now in decline in Russian society. He believes in the outreach to secular society. Greater involvement of the church to bring Russian society improvements in values and moral fabric can be expected.

Tata Motors is to manufacture it low cost car which would sell for less than $3000 at a factory being built in Singur near Kolkata. Ford gets $5.9 billion from the Advanced Technology Vehicles Manufacturing Loan Program of the U.S. government. It will use hte money to rettol 11 factories in the midwest. It will help Ford make 13 of its models more fuel efficient. Ford plans to sell 4 models of electric vehicles by 2012. Lawmkers in Congress are pushing to increase the size of the program from $25 billion to $50 billion. The $5.9 billion will be loaned to Ford and given between now and 2011, with Ford beginning repayment in 2012. THe plants are in Illinois, Kentucky, Michigan, Missouri and Ohio, and employ about 35,000 engineering and factory level employees.

After failing to come to an agreement for early elections with the central government in Madrid, Catalan leader Puigdemont says he will put the matter of secession from Spain to the region's parliament. This makes it certain that the government in Madrid will assume emergency constitutional powers over Catalonia. Mr. Puigdemont is the head of a coalition that has 72 seats of 135 in the Catalan parliament. As this NYT report points out Mr Puigdemont heads a coalition of separatist parties that won about 48% of the vote in parliamentary elections of Catalonia in 2015. He announced a referendum in 2017 which created more uncertainty because Spain made an effort to suppress voting and many Catalans stayed away from the voting booths. Other reports show it is not clear that a majority of Catalans favor all out independence from Spain, though they oppose the way prime minister Rajoy of Spain has handled the crisis. Control of the police and broadcasters under Article 155 of the Constitution is a step Mr Rajoy now plans to take. Mr. Rajoy says it was a decision forced on Spain by the "capricious decisions" of Mr. Puigdemont, and that it endangers Spain's economic recovery from the financial crisis with high unemployment. Puigdemont faces an internal revolt inside his separatist party if he backs down, according to this report in the NYT. As a result of this Spain is likely to move ahead with constitutional backed rule by the central government over Catalonia till a solution can be found. Mr. Puigdemont's action has created the biggest crisis for Spain since it moved to democratic elections in 1978, coming at a time when national elections led to no clear winner and the economic recovery was just beginning. Public perception is that both Mr. Puigdemont and Mr. Rajoy appear to have handled the situation poorly. ...

Serious doubts remain about the effectiveness of value at risk or VAR quant models used by JP Morgan Chase to measure potential losses on a trade on a bad day. A newer model used by Chase in the first quarter showed smaller losses. When the old model was run this trade showed double the losses according to Chase managers. Greenberger, a former CFTC official and a professor at the University of Maryland School of Law, says if the trade become hard to unwind it shows poor risk management. And experts say it is not much of a hedge if it is done in an obscure part of credit markets and hard to unwind without serious losses. Peter Tchir, a former head of index trading at RBS bank, says CEO Dimon must have seen these kinds of hedges as part of his overall strategy, which is why he supported them in April 2012. The problem lies in that the bank size has grown to such proportions that its simply too big to manage, with trades it has to make becoming massive as a consequence.

Donald Trump is acquitted in the second impeachment trial with a vote in the Senate of 53 in favor to 47 against. A two thirds majority is required to impeach a president. Senators Burr of North Carolina and Cassidy of Louisiana were Republicans who joined the expected ones to vote for impeachment- the Republicans Mitt Romney of Utah, Pat Toomey of Pennsylvania, Ben Sasse of Nebraska, Susan Collins of Maine, Lisa Murkowski of Alaska. The Republican defense lawyer insisted that Trump's speech to his supporters was not an intention to incite them on the day of the Capitol riot on Jan. 6, 2021 but an expression of his rights to free speech guaranteed under the U.S. Constitution First Amendment. He made the point that the prosecution lawyers had selectively focused attention on the words "fight like hell" and taken them out of the entire context in which they were made, ignoring key parts of Mr. Trump's speech. The defense argued that the president had already left office and this made an impeachment unconstitutional. Seventy five million voters voted for Mr. Trump and he cited this as the most number of votes won by a sitting president. President Biden is shifting his attention to the president's agenda and needs Republican support to pass key legislation including financial help to households, unemployed, and business to recover from the pandemic. The U.S. health effort behind the vaccination drive and seeing the struggle in Europe to access key medical supplies of vaccine is also leading to new efforts to move beyond the rhetoric to the hard work ahead with support of all parties. As part of this the trial once it reached the Senate was quickly resolved in about 5 days. The defense used only a small fraction of the time allotted with bipartisan effort to not let the trial drag on, bipartisan effort to putting some statements simply on the record and not calling witnesses.   ...

BBC News provides a look at the first proposals of the Boris Johnson minority government to the European Union. This includes replacing the Irish backstop. The Irish backstop is a way set up by the EU and the previous UK government of prime minister May in negotiated agreement to prevent a hard border in Ireland. It means Britain would remain in the customs union with the EU after December 2022 if no agreement for withdrawal is reached by then. Conservative Party hard liners oppose it because they say it leaves the UK indefinitely in the customs union. The EU insists on this to protect the interests of a member state Ireland. The moderates in May's Conservative government agreed to it to keep the peace accord in Ireland. Boris Johnson wants to get rid of it, and his proposals include customs checks between Northern Ireland and Ireland which removes the free flowing border between the two Irelands, a major achievement of the Irish peace accords.  Which is why the negotiations could end up going nowhere, with each side presenting the other as the side that wouldn't negotiate terms of withdrawal. The Liberal Democrats and the Scottish National Party, and the Labor Party except for its leader Corbyn's neutral stance, oppose leaving the European Union. And parliament opposes leaving without a negotiated agreement pitting Boris Johnson against parliament and the opposition.  Another referendum or a general election would settle the issue with Boris Johnson thinking he can flip former safe Labor seats in working class areas in the north of England to win the election. Labor party's McDonnell says he has miscalculated and Labor party is buying time to organize an effective election campaign to get back the working class vote lost under Blair with his confusing Third Way that lost workers on the way.   ...

Willingham of the NYT points to the crisis in the U.S.as many adults with high school education lack even the most basic skills to understand or check facts. National Assessment of Education Progress tests show little progress over 30 years. He cites the tests from the National Assessment of Adult Literacy for 2003 showing 95% of the people could not compare two editorial opinions and check a table for the facts.  Willingham says the problems are the lack of vocabulary, the lack of knowledge of usable facts that writers assume the reader knows.   Building and providing knowledge intensive education early on in earlier grades is needed. Standardized tests need to check for this knowledge so that it builds up. Don't ask about random topics, if a child is taught knowledge on New Zealand, he should be tested with questions on New Zealand. The Common Core Standards neglect this importance of content intensive, content rich information in curriculums. Massachusetts improved education by emphasizing knowledge. High information texts should be used in early grades so that children pickup knowledge early on and build on this grade after grade. The important thing is no to see reading comprehension as a skill but something that is intertwined with knowledge, the more knowledge exposure one has early on the better so that reading comprehension grows quickly and advances. Willingham brings up the idea that technology is not the culprit, it is not the answer either. What is important is to correctly grasp the need for vocabulary and knowledge and push this in the early grades to get good reading comprehension that advances grade after grade. Also important is getting children excited about reading, to get their imagination to work with knowledge gained, so that they pursue reading inside and outside the classroom and become regular readers.  ...

Barcelona is one of the richest clubs along with PSG but says this report it has wasted a lot of money about $950 million getting players that it later deemed not needed, 30 players for that amount since 2014.This includes Coutinho who scored 2 of the 8 goals of Bayern in the 8-2 Bayern win over Barcelona. Bayern also played with Thiago Alcantara a player released by Barcelona. All the time Barcelona was looking at players to support Messi and making bad decisions. It released Neymar to PSG for $260 million even though it had second thoughts about the merits of that decision, just because of the money. For what you get for the money Bayern got key players for under $120 million to beat Lyon. Manchester city spent $600 million by contrast to put together its team. For Bayern its home grown talent comes from Thomas Muller and Alaba. Lewandowski and Goretzka were signed up. The best talent comes from youngsters Serge Gnabry of France and Alphonso Davies of Canada, for a combined $21 million. PSG also has broken the bank in signings but it has cooled down since and is calmer now. It signed Mbappe for $160 million, a critical piece of the plan for PSG. PSG coach Tuchel brought back Chuopo Moting for free and he was the hero for the win over Atalanta in the closing minutes. Simply an act of faith in his players by Tuchel from old times when Tuchel coached the youth leagues, which he loved doing.  Bayern chairman Rummenigge says "we'll try to save money." Making the best use of money starting with homegrown talent and young promising players is a winning game. At key points in the game with Barcelona, Davies and Coutinho showed the value of this approach. ...

After the failure of 3 prime ministers selected by president Macron to form a functioning government and pass the Budget in 2025, it looks increasingly apparent that Macron has failed as president in 2025. He has hung on to power through one protest after another, yet has failed to bring together people with a plan to improve the living standards of the French people from all sectors and parts of society, including the lower income groups and rural parts of the country. France has become more fractured politically than ever under Macron, with the result that no one or two parties can form a viable government with enough support in parliament. Macron started out as Minister for the Economy under Socialist president Hollande, but never really supported the Socialist party, preferring to branch out on his own seizing a political opportunity to call all other parties part of the old system with a hastily put together Movement of his own. It has managed to win and hold power for nearly a decade for lack of better alternatives, yet today it is clear that this Movement did not have the power that comes from a genuine effort for the improvement of the lives of the people of France from all parts of society and all income groups, and both urban and rural parts of France. It is a missed opportunity for France and a failure of a president who failed to grasp the needs of France and of the French people. It has pitted different sectors and ideas, rural and urban, parts from neglected industrial development and thriving regions, against each other instead of pulling together the country into a coherent whole for improving the lives of the people. Tactical moves replaced a larger sense of strategy and purpose, and personal power replacing the interest of the nation as a whole for all parts of the country. ...

China's effort to tie Vietnam and Malaysia to its economic system- will it work? China has trade worth $982 billion with 10 neighbors in South East Asia compared to trade of $786 billion with EU and $688 billion with US.

Some of that $982 billion is product shipped to Vietnam by China, assembled there and shipped to the US. This is why DJT/USTR put 46% tariff on Vietnam, now reduced to 10% for 90 days till negotiations. President Xi of China visited Hanoi, Vietnam, to sign 45 bilateral cooperation agreements to bind Vietnam closer to China's state run capitalist system. At the same time premier Lam of Vietnam is seeking negotiations with US and has talked to president Trump. What is going on? Vietnam hope to have ties to both US and China. Will it work?

The Ifo Institute's Hans-Werner Sinn presents the German view on bailouts for Greece, Ireland, Portugal, Spain and Italy. He says that socializing of debt was proved to be a bad idea even in the U.S. experience when eight states and territories were allowed to go bankrupt in the 1830's and 1840's, and even though California is close to being bankrupt no one suggests socializing the debt. The European Economic Advisory Group has favored short term assistance and liquidity assistance but not aid for insolvency. Bundesbank assistance for international shift of refinancing credit, also called Target credit, is estimated at $874 billion, since 2007. Greece and Portugal current account deficits were financed using this. ECB purchase of government bonds $250 billion, and $500 billion in rescue programs from the IMF, and additional help from the European rescue funds such as EFSF. Sinn says Germany would lose $1.35 trillion if the euro fails. If Greece, Ireland, Italy, Portugal and Spain go bankrupt and repay nothing, and the euro survived, Germany would have lost $899 billion by his estimates. He responds to critics by saying that the Marshall Plan gave Germany 0.5% of GDP for 4 years, or 2% in total, or about $5 billion today if taken as 2% of Greek GDP....
