The Nation is faced with another Supreme Court decision as in 1868 for the 14th Amendment, in 2025 on birthright citizenship.  The 14th Amendment was written in the 19th century it had no concept of the 20th century and absolutely no idea of the 21st century we live in, unable to even conceive of conditions today, or even think of  setting rules for immigration today. It rejected the Dredd Scott decision of 1857 denying black people rights as citizens, restating the law of the land, had nothing at all to do with stating the opinion of the Judiciary on whether a mother flying in from Asia could secure US citizenship for a new born child by merely visiting the US. As in 1857, in 2025 the law is based on assumed historical facts as Lincoln said on Dredd Scott decision, that are not really true. Lincoln said in 1857- "That burlesque upon judicial decisions, and slander and profanation upon the honored names, and sacred history of republican America must be overruled, and expunged from the books of authority." The 14th Amendment was written to give black people the rights of citizens of the US, in a complete repudiation of the Dred Scott decision of the US Supreme Court of 1857 that deprived black people of rights as citizens because Judge Tanney said the British Empire had set up the institution of slavery in the American colonies and the British were responsible for the institution, little we can do about it. When by 1807 slavery was being banned in Britain and in 1838 totally banned in the British Empire. It created the idea that Americans were not the master of their destinies after the departure of the British to choose which institutions they would keep and which they would reject including slavery. Abraham Lincoln citing President Andrew Jackson said each the executive, the judiciary, Congress, and the common man were entitled to their own view of the US Constitution as they understood it. Lincoln also said Judge Tanney's decision in Dred Scott case was based on assumed historical facts that were not really true- Judge Tanney making no mention of the fact that in 1857 the British Empire had already abolished the institution for 50 years. The DJT Executive Order banning birthright citizenship shown here on the White House site has the title- Protecting the Meaning and Value of American Citizenship. It is written in  simple language in 1 page -Purpose, Policy, Enforcement and Definitions, Provisions.  The purpose clearly states that the Dred Scott decision of the US Supreme Court in 1857 is what the framers of the 14th Amendment had in mind when they drafted the 14th Amendment of the US Constitution. A reading of the 14th Amendment makes this abundantly clear. The wording comes out at the outset reversing the Dredd Scott Decision of 1857. It's repudiation was why the Northern and Southern States fought the Civil War. The National Archives say that with Dred Scott decision to allow the spread of slavery to American territories in the West,  America moved one step closer to civil war. With such  momentous events in the history of the US 1857-1868 the framers of the 14th Amendment were not sitting down to write rules about what was right for America a century and a half later.    ...

Its generally known that US airlines except for Southwest fly older planes but the extent to which this has been going on may not be gauged especially when compared to the foreign airlines. Because of bankruptcies and reducing the number of seats available by shrinking their fleets to keep prices at levels that sustain their margins, airlines are not ordering new planes and using the existing planes. The average age of the big jets in US airlines is now 12.2 years according to Airline Monitor. Boeing has a huge backlog of orders for its new planes but its mostly from foreign airlines. Only 43 of 710 Boeing 787 Dreamliners are going to domestic airlines, 25 to Continental and 18 to Northwest. And none of the 165 giant Airbus A380's are going to US carriers. These numbers are amazing because they suggest the new airplanes more comfortable more fuel efficient with more space and better air quality are just bypassing the US domestic routes. Quite amazing. Of the airlines Northwest has 109 of the oldest jetliners in the industry with an average age of 35 years. And worse still they could remain in service for another 5 years as there are no plans to replace them. Airline cleaning is not as frequent as before because of cost cutting and the dirt and grime, the conditions of the lavatory, all show their age and passengers can tell the difference. The seating is cramped and one passenger described a Northwest plane seating as feeling like being in a tuna can. And the airlines in the US are using these planes for longer routes with more chance of mechanical bfailures leading to more flight delays which are a huge problem this year especially into and out of the New York area. American flies a fleet of 300 older MD-80's which actually cost more to operate because they are gas guzzlers compared to the newer planes. Credit Sights estimates that this will continue for another 5 years because airlines are trying to save a cash cushion for leaner times, payoff debt and strengthen their balance sheets, and shareholders want some of the money returned to them. US Airlines had cash of about $28 billion as of June 30, 2007 but this is not enough. J.D. Poer and Associates estimates that US airlines need to spend $280 billion over the next 20 years to replace the aging planes. Meantime discount airlines in Europe are ordering new planes and Asian airlines have big orders. Air Berlin has about 85 737's on order and Wizz Air of Hugary ordered 50 Airbus A320's. ...

Experts say China's official GDP figures are unreliable and cannot be verified. Transparency is sorely lacking. The methodology, inflation assumptions and other basis for the calculations are not presented, so that many of the numbers cannot be reproduced. The official figure for 1st quarter GDP growth is 7%, from China's Bureau of National Statistics. GDP growth estimates developed by Capital Economics show 4.9% growth, by Citi 4.6%, by the China Center of the Conference Board 4%. Since 2012 the Capital Economics estimates are just above 5%, and the Conference Board estimates about 4%, showing that the growth rate has slowed markedly since 2012. As Communist party chief of Liaoning province, the current prime minister showed serious doubts about the GDP numbers and preferred to rely on figures for rail cargo, electricity consumption, bank loans.

After the election which followed Syrian withdrawal from Lebanon, the Shiite parties joined the coalition government an took 2 ministries , energy and labor, and negotiated veto powers over any cabinet decisions. 3. The Lebanese Democratic System that emerged from the 1989 accord. This gave Maronite Christians, Sunni Muslims (for long time priviliged and better educated groups in Lebanon compared to the less well educated Shiites having higher rates of unemployment and illiteracy as well as less access to governace, ) a proportionally bigger say in the government. About 40% of Lebanon's population is Shiite, but their representation in the Parliament of 128 seats is a maximum of 35 seats, with the rest going to other Muslims and Christians. Saving the deal between Mitsubishi UFJ bank and Morgan Stanley, done over the weekend, is huge in the dimensions this could have taken in unsettling financial and credit markets at this fragile stage, and sending all the wrong signals after the collapse of Lehman caused a tightening in credit markets. Its a remarkable effort by Treasury and the Japanese government and Mitsubishi UFJ to get a workable deal negotiated and ready for markets by Sunday. This makes for an infusion of $9 billion into Morgan Stanley by Mitsubishi UFJ and gives Mitsubishi UFJ decent terms on which to make the investment. The presence of the Japanese and American governments at the table made for extrarordinary precautions that nothing is left to chance and the details are worked out to a successful conclusion for Monday opening of markets. This is how global coordination is supposed to work and at no time was it more needed than after the Lehman collapse. An agreement with Treasury that Mitsubishi UFJ would be protected by the American government in the event that Treasury had to put money into Morgan Stanley and shareholders would lose the value of their investment. Second Mitsubishi wold get 10% dividend not on aportion of its investment but on its entire $9 billion investment, reminiscent of the Buffett deal, and is good for Mitsubishi. And third with Lehman's share trading at $9 range Mitsubishi now would pay ...

The U.S. support for action in Libya to support Britain and France comes from the efforts of Clinton, and any lack of followup one of president Obama's errors in foreign policy. Here Landler describes the meetings with Gen. Keane who pushed for the troop surge that worked in Iraq under president George W. Bush. Clinton supported Keane's proposal made in April 2015, for a no-fly-zone in Syria that would help opposition forces till a settlement could be negotiated. Keane pointed out to Clinton that there was a flaw in Obama's policies- that negotiation would work only if the no-fly-zone was used to support opposition forces. By the end of 2015 Hillary Clinton publicly adopted this position. During a period when Americans are weary of foreign entanglements but understand the need to provide leadership where needed, Hillary Clinton, provides a balance between the pendulum swinging too sharply in one direction in the Bush years and in another direction in the Obama years, says Landler. Christina Romer, Prof. of Economics at the University of California, Berkeley, was chairwoman of the Council of Economic Advisors under U.S. president Obama. Here she discusses the different aspects of the debate on raising the minimum wage. Romer says the negative effects on unemployment are small. The impact on consumer spending is also limited. The anti-poverty effects are real for raising the minimum wage from the current $7.25 an hour, says Romer, as over half the families earning a minimum wage make less than $40,000 an hour. President Obama called for raising the minimum wage to $9 an hour in 2013. Studies show 13 million U.S. workers earning less than $9 an hour. Raising the incomes of these families by about $3500 an year under the president's proposal gives workers badly needed income to cope with rising cost of gas, food and other basic necessities. The effects on consumer spending are small, estimated at between $10 to $20 billion. Its main virtue is keeping the principle of fairness and maintaining social cohesion at a time of increaing inequality. Romer says there is competition for workers which makes it possible for workers at the lower end to get a fair wage, but does not account for the effect of high unemployment which takes pressure off raising the minimum wage in the market economy. Another benefit for countries of keeping a fair minimum wage is that other actions can be taken to improve competitiveness for business and manufacturing and reducing the deficit and be seen in a positive context of overall improvement. This is part of the case made in Europe for boosting the mnimum wage as austerity measures are taking place....

Story about a Quant's life, this a math smart kid, Peter Muller, who worked for a risk analysis firm called Barra Inc in Berkeley, California, and later joins Morgan Stanley to help set up its Quant trading business. "Pairs trading" is one of the strategies Quants have used in the past in which two stocks which have a strong historical relationship provide clues as to how to short one and by another betting that the historical relationship will assert itself. "Statistical Arbitrage" is a more complex version of this and Muller's specialty was in this field at Morgan Stanley's Process Driven Trading Group (PDT). This Group produced profits from trading of about $3.5 billion in ten years upto 2006. This group now contains about $6 billion of Morgan Stanley's own money and accounted for 7.2 % of Morgan Stanley's net income with profits of $540 million in 2006. In the two weeks prior to August 9, Morgan Stanley's PDT lost about $500 million as the mortgage crisis broke out and put a wrench in the normal workings of the Quant's strategy and the fact that there are so many Quants operating with computerized trading may have added to the problem. the PDT has since recovered some of its losses. And its by no means certain that this has shaken Morgan Stanley's continued pursuit of income from Quant trading operations. The story thats told about Peter Muller is interesting as he tries everything to find happiness leaving his job for a while and playing his own music on albums and in the streets of Barcelona and New York city subway stations to soothe his restless soul and still comes back to his old job. The failure of the Maliki government to bring together Sunnis, Shiites and Kurds, as a new election apporaches and Maliki is likely to be elected for a third term. A divided parliament and the lack of U.S. presence after the withdrawal in 2011 at Malik's insistence. The U.S. has refrained from supplying the Iraqi military for fear of aggravating ethnic tensions, with the Sunnis saying Maliki is practicing ethnic cleansing under the guise of fighting terrorism. Under Maliki Iraqi airspace has been used to supply the Assad regime from Iran, according to some reports, making the U.S. wary of supplying the Iraqi military as it has little influence left.

Thomas Frank writing about the public outrage about executive compensation quotes Bill Black, a Professor of economics and law at the University of Missouri-Kansas City, who makes an important point. Beyond the size of this compensation there was something else happening that was perverse in its design and in its effects. Black says that at each point in the development of the disaster of mortgage securitization, it was the pay for performance systems that sent the wrong signals to loan officers, real estate appraisers, accountants, and bond rating agencies. The compensation or reward systems actually encouraged wrong, unethical and ultimately disastrous behaviours for the companies and the economy. Another way to look at it, the way it happened on Wall Street- especially at Merrill Lynch and some other financial institutions- the bonuses and other compensation was a way for executives to recklessly milk (loot is the other word) the companies for all they could yield regardless of the results afterwards.
