Fact checking Apple CEO Tim Cook's statements on the EU Commission ruling for $13 billion in back taxes, shows that CEO Tim Cook's statement that "we never asked for, nor did we receive any special deals," is not true. Ireland let Apple determine what it would pay in tax, and Apple had the benefit of loopholes in Irish tax laws, the fact check by experts shows here. Apple's Cook also says it would hurt investment and jobs in Ireland. Another NYT article showed that the entire healthcare budget of Ireland would be covered by the $13 billion, and 66% of its budget for social support services to the public. Apple has 22,000 employees in Europe and 6000 in Ireland in 2016. Based on the $13 billion owed in taxes, for every job in Ireland the cost to Ireland is 2.17 million euros, and for every job in the EU the cost is 590,000 euros. Apple could turn around and locate in some other place, other than Ireland, in which case Ireland does not get the 6000 jobs. This is Ireland's incentive to give Apple tax benefits. Only if all EU countries had common tax laws would it be possible to avoid this situation, and generate much needed tax revenues at a time of cuts in public spending in healthcare, education, and social services, and invest in infrastructure, worker retraining. The alternative is for the EU to look at other remedies. This is what the EU Commissioner Vestager did when she announced that this was a state subsidy and illegal under EU rules. Because the appeal by Apple goes to the EU Courts the appeal is difficult say legal experts. The EU courts look at the legal aspects of the ruling, was it justified, not at the overall aspect of the ruling by Vestager, as EU Competition Commissioner. This may be why there is so much outcry from Apple, and other digital companies.  ...

The NASDAQ index reached 5000 by April 2015, a level reached in the stock market boom in 2000. Yet investment strategists who were wary of the stock market in the period before the 2000-2002 collapse of the market see this market differently. The NASDAQ itself is not what it was in 2000, with the 2015 NASDAQ component stocks being different for the most part, and the healthcare and other sectors better represented in the index. Only three of the stocks in the top ten in 2000 are in the top ten today, including Microsoft. The S&P 500 trades in April 2015 at 18.5 times its company earnings for the past 12 months, compared to an historical average of 15.5, according to research firm Bespoke. A big part of the difference today is the investment climate of low inflation, which gives the U.S. Federal Reserve flexibility in raising rates. Low rates make bonds with lower yields less attractive, and increase the present value of future earnings. The yield of the 10 year U.S. Treasury was 1.917% on April 25, 2015. In April 2000 it was 6%, and in mid 2007 it was 5.3% before the financial crisis in the two periods. James Paulsen, chief investment strategist at Wells Capital Management oversees $347 billion in fund investments. He also was wary of the U.S. stock market in 1999, yet he does not see the similiar kind of risks today, and sees a long term bullish trend. The scenario he envisages is more of a pause or temporary decline. Paulsen has shifted money to European markets, as U.S. stocks are becoming more expensive relative to their European counterparts, a strategy that is being followed by other money managers since 2014. Higher price volatility is seen in the markets in 2015, with the S&P 500 up 2.9% for the first four months of 2015, and the Dow up 1.4%. ...

The smartphone market is critical for Sony as it makes its way back to profitability in 2013. Sony sees smartphone unit sales growing at 50% in the year ending March 31, 2013, compared to a decline in unit sales of video camcorders of 9%, decline in digital compact cameras of 29%, and decline of televisions of 31%. The Sony-Ericsson joint venture was a world apart from the current Sony Mobile business. Sony Mobile executive vice president, Kaz Tajima, expressed his frustration that Sony was missing opportunities when working at the joint venture. Decisions came slowly as they had to be approved at different levels. Sony Mobile moves quickly on all decisionmaking. Companywide technological capabilities are also quickly available in designing a new product. The Experia Z uses all of Sony's technological capabilities in design, cameras, television and other areas. It now appears that the joint venture was the worst thing that happened to Sony. Sony bought out Ericsson's stake in the venture in 2011. Sony starts with global smartphone market share of about 4.5% and has a lot of catching up to do....

Jimmy Lai is one of the prominent Hong Kong businessmen who have actively spoken up for universal suffrage without screening of candidates by the government, instead of sitting by on the sidelines. He says he is not talking to the student leaders, and it is upto the young generation to take the initiative as it is about their future. At age 12 Lai was smuggled into Hong Kong by parents in Guangdong province in 1960, making him one of the older generation who has lived through the many changes in Hong Kong- from the British period, through the years of turmoil on the mainland in the seventies, the transition period and transfer to China under the Basic Law. He worked in factories instead of going to school, and later started his own clothing chain Giordano, followed by a move into media publishing. He is the publisher of the Apple daily and Next magazine publications which support the pro-democracy student movement. Lai says the roots of student protest are in the May Fourth Movement of 1919, a cherished part of Chinese history because it led to the awakening of China, sparked the interest in breaking away from the past leading to modernization, lasting for 2 decades till the Japanese invasion and Communist control. Lai says the protest movement is more mature than the movement in China at Tiananmen in June 1989. Another factor that makes this different is that the protest in Hong Kong does not chart out an indefinite future for China just when it is embarking on the path to modernization, the situation facing a cautious Deng in 1989 who experienced the chaos of the sixties and seventies. The movement in Hong Kong is about reinstating what is felt to be in the spirit of the Basic Law- universal suffrage in its true spirit and intent without prescreening candidates for 2017- it is a limited objective and does not risk the modernization drive, more likely to enhance it by keeping dialogue with the outside world open as China looks for new ideas to tackle many prblems left behind from the industrialization period of 1990-2014. ...

Japan is playing an increasingly positive and significant role in stabilizing the international financial system, and in providing new ideas for solution and proactive measures, some of it based on its own experience with a long sustained economic downturn from which it only recently emerged. It has dedicated $100 billion to the IMF for loans to emerging economies, which will be a significant help in preventing a severe downturn in developing countries. Here Prime Minister Aso outlines ideas that Japan will bring to the global talks this weekend November 15-16, 2008. The significant immediate steps are early and thorough disclosure of nonperforming loans based on valuation and reliable standards, and the removal of these loans from their balance sheets as a top priority. Japan was slow to do this prolonging its downturn into a decade or more of no growth. Other two priorities are injecting capital into banks with government money, and supplying ample liquidity from central banks and US dollar liquidity. After the immediate challenge there lie 7 areas to be addressed in the medium term. Improving savings and reducing consumption in countries dependent on external debt and moving to domestic demand led growth in export dependent economies. Bolstering the resources of the International Monetary Fund and the Asian Development Bank. Changing the governance structures of the IMF and the World Bank and other bodies to give proper representation to emerging economies that play an important role in the world economy. Giving the Financial Stability Forum a status above standard setting institutions like the Basel Committee, the Forum reinforced and reorganized to give membership to emerging economies. International Accounting Standards Board, governments, companies and investors in ajoint effort work to come up with a set of standards that have global application. And tightening standards for credit rating agencies through the International Organization of Securities Commissions. Aso proposes giving various countries legal authority over these agencies and the nurturing of credit rating agencies in each region in addition to global agencies, for the development of regional bond markets. Aso is also pushing for regional cooperation like the initiatives in East Asia such as the foreign exchange swap mechanism. ...

American companies on the Standard and Poors 500 stock index are sitting on a pile of cash-estimated at $960 billion. This includes undistributed foreign earnings that would incur 35% taxes if brought into the U.S. At the same time companies are hoarding this cash, using some of it for acquisitions, and only gradually increasing dividends. The dividend payout ratio- the percentage of earnings paid out as dividends- is at 28.9% for the past 4 quarters according to Standard & Poors. The dividend payout ratio was 46% for three decades since 1936, and 52% for the last two decades, according to Standard & Poors. Zweig cites Benjamin Graham who stated that companies should pay two thirds of dividends to shareholders. Why? Because shareholders can make better use of the money. With too much money companies tend not to make the best productive use of capital. One example is Microsofts's purchase of Skype at $8.5 billion, considered inflated by many analysts. Graham stated that when the companies are not making productive use of the capital it is appropriate to expect that it be returned to shareholders in the form of dividends. At the 50% ratio one dividend fund manager says companies could return $207 billion to investors. ...

Sony is trailing badly in the smartphone business in 2014-2015. Global market share is at about 3.1%. Sales in China have failed to gain with only 0.4% market share, as Xiaomi has made large gains in China in 2014, and with other low cost competitors such as Lenovo. Even in India once considered a promising market Sony smartphone sales market share is at about 3.2%. Market share is about 6.9% in Europe and 14.4% in Japan, according to Counterpoint Research. The mobile division is cutting staff by 2100 from current level of 7000, as mobile becomes Sony's only money losing unit. The head of the mobile division and CEO Hirai are now considering options including selling the unit or joining with third parties. Mr. Totoki, head of the mobile division, says Sony has learned through this experience that creating customer enthusiasm for products involves much more than simply putting together powerful parts.

Nokia is initiating a search for a new CEO to replace Mr Kallasvuo who became CEO in 2006. Since then Apple's iPhone has changed the market and Nokia has not been able to match the trend set by iPhones in the mobile phone device market. Nokia's stock has fallen 42% since April 19, 2010. Nokia's response to the iPhone was to replace its mobile phone executive and to create a separate operation for smartphones. Nokia plans to have a new line of smartphones in 2010 to compete with the iPhone. The main problem is its operating system software which needs to be more sophisticated. Nokia holds about 40% of the cell phone market with Europe and countries like India being its strong points. But Nokia's margins in India are low because of intense competition. Apple has already surpassed Nokia in the profit in phones, making $1.6 billion in profit in the third quarter of 2009 compared to Nokia's $1.1 billion.

Providing an insight for the auto industry and other industries, Nokia has managed its own downturn from a few years ago. Nokia has taken a strong position in emerging markets without letting profit margins sink and keeping the average price of a Nokia cellphone from dropping much. See the groups and links to Motorola's situation. Continued dominance in India and China helped Nokia achieve mobile phone shipments growth of 27%in 2007 over 2006 to reach 133.5 million units. Nokia is also gaining market share increasing it to 40% in the 4th quarter 2007 from 39% in the 3rd quarter. And Nokia is now poised to gain back the market share it lost in the USA in the last few years. It sees the market for mobile phones growing by 10% a year wordwide with strong growth in Asia balancing slower growth in developed countries. Nokia follows the average selling price of mobile phones which suggest the direction the market is taking in price and higher end lower end sales distribution, especially at a time when Nokia competes in price sensitive Asian markets with higher lower end sales distribution. Here the average selling price of Nokia phones dropped from euro 89 in the fourth quarter 2006 to euro 83 in 4th quarter 2007. Nokia is careful to keep introducing new feature laden phones that customers want to keep this average price up. In the 4th quarter 2007 the average price was up from euro 82 in the 3rd quarter to euro 83. Nokia's operating margins in the mobile phone business reflect a surprising result, actually increasing from 17.8% to 25% even as average price is dropping from euro 89 to euro 83? How was this achieved? Some of this is probably from better manufacturing in better locations without compromising quality, moving factories to eastern europe and other places. Nokia plans to close a factory in Germany with 2300 workers and move this to Romania by mid-2008. The increased sale of higher margin multi media phones also helped. Another aspect of Nokia's approach- grasping the fact that extremely high sales were needed to do well in in the lower end of the market at the euro 30 price level. This means that competing in India and China with the high sales volume helps it stay ahead in this lower end. These markets are also interesting in another way, they are fast changing markets with a lot of things happening. Because they are price sensitive there is a lot of competition including from lower end makers in China. Asian markets also have young users who have different usage, lifestyle and trends and Nokia can learn a lot on how to stay abreast of these demographics and other changes. And competing at this level helps you develop the manufacturing knowhow to bring down the cost of the higher end phones with more features. There are crisscross benefits to competing at every price range in different demographics and in different regions, and continually learning and building the people and structures to compete effectively. . Robert Morgenthau, District Attorney for Manhattan, 1975-2009, says there is more money on deposit in the Cayman Islands, than in all the banks of New York put together, with 19,000 companies listed there. Cayman is one of several tax havens. Apple use Luxembourg for iTunes. Other tax havens are the British Virgin Islands, Gibraltar, Antigua, Bermuda, the Bahamas. He cites the Senate's Permanent Sub-Committee on Investigations in 2008, which gives the estimate of $5 trillion to $7 trillion sheltered in offshore places on this list, by Americans, Chinese, Europeans and others. Morgenthau says these tax havens help American and European companies not only to avoid taxes, but also structure complex international transactions. He estimates these transactions cost the U.S. Treasury about $40 billion from outright tax fraud each year.

Academy Heights Elementary, of Pinehurst, N. Carolina, is expected to close as part of the cost cutting efforts in North Carolina. The state is trying to close a budget deficit. Monroe County's superintendent proposed closing the school to save $500,000. The school has a 98% pass rate on state exams, an award winning math program. It is ranked the second best kindergarden to 5th grade schools in North Carolina. Parents and teachers point out that many of the students come from middle class families where both parents are working, and military families from Fort Bragg, and this is not just the demographics of being near Pinehurst resort; as higher income parents tend to send their children to private schools. They point to the way staff, parents and students work to create an environment that challenges children to learn. The questions here remain ones that are being taken up throughout the country- how to invest or disinvest in education in the face of budget deficits. Should education take cuts and how much? Another twist here is that Academy Heights is in a depressed black neighborhood of Tarrytown whose residents go to to other schools even though Academy Heights urges students from Tarrytown to apply. It is an elementary school and as elementary education has a special role to play in early childhood development, how much of these cuts should fall on elementary schools? Should the best schools be cut under any circumstances or should they be supported with sacrifices made elsewhere or do moderately higher taxes make sense in these situations? Does it make sense to preserve existing excellent schools even as the search for improvement in educational systems takes place -with investments like the $290 million the Gates foundation is committing to improving selected schools? produce excellence in other schools?...

The Economist points out that China's total debt of government, corporate and households has grown by about 100% of GDP since 2008. The 2009 crisis led to rapid increase in debt. It is now about 250% of GDP, according to the Economist. Slower growth of below 7% risks reducing China's ability to service this debt. About half of this debt is owed by state owned companies and property developers. China can use its sovereign reserves to continue supporting bank and state owned companies. Investor's are pricing bank shares to reflect about 10% of this debt as bad debt even though government estimates are much lower. The reserves provided China time to fix the banking system since 2008, yet the debt keeps growing and China has failed to take strong action in the last 6 years. Complacency is a problem, and the incentives for local governments to continue prior practices that increase debt continue. As Krugman and other experts have pointed out at some point the rules of finance will apply to China as they have for other countries that faced a debt crisis- Japan in the late 1980's, South Korea and other Aisan countries in 1997, and the U.S. in 2008. Even without a crisis through deft managemen and use of reserves China risks zombifying the economy as old loans are backed up by new loans, with the further risk of misallocation of capital or poor use of capital. This lowers productivity of capital and hurts development. With poor statistics such as the figure of 1% of debt being bad debt cited here, the problems of complacency can be magnified, as there is less reason for a strong response....

As India's growth rate improves, one weak area is agriculture which is growing at about 3% a year, and contributes only 13.7% to GDP. Of huge significance is that about 600 million people depend on agriculture. Lagging development in this area leaves the nation backward as a whole. Farming practices are still backward and have not changed significantly. Agricultural markets, infrastructure, is still backward and needs improvement. Decline in the size of plots since 1970 from about 6 acres to about 3 acres today, and low productivity on farms is a problem. Farmers fear being pushed off the land and politicians look to the rural vote to preserve the status quo. Poor monsoon rains can increase problems for farmers as three fifths of farmland is still without irrigation. Agricultural markets are fragmented, so that apples from Himachal Pradesh in the north are not easily shipped to Karnataka in the south, and coconuts in the south not easily shipped to the north. State marketing boards in India called Agricultural Produce Marketing Committees (APMC's) control trade in fruit and vegetables. There are about 3000 fragmented agricultural markets in India, and markets can be fragmented within states. Laws from the 1950's to prevent hoarding are still on the books reducing incentives to invest in cold storage and warehouses, a significant problem in India leading to much waste and rotting of agricultural products. This hurts farmers because it leads to cuts in price. The distribution chain also hurts farmers with middlemen and commissioning agents taking as much as 6% in commission compared to the international level of about 0.5%. This review of the state of agriculture by the Economist says that 25 years after the first reforms opening up India's economy in 1990, agriculture as one area which touches the life of about half the population has not seen much change....

Jon Gertner makes several critical points about the importance of supporting and investing in manufacturing. The U.S. private sector in new industries such as alternative energy, and electric cars is competing not just with the private sector in Germany, S. Korea or Japan. It is competing with the governments of these countries which are investing heavily to build innovation and jobs in their home countries. Innovation, design and manufacturing are woven together in these new industries in a manner that is different from the iPhone/ iPad/ Search algorithms /Facebook software type industries dominated by names such as Apple, Google and Facebook. The software industries are the opposite of jobs intensive industries with Facebook having 2000 employees and Google having 29,000 employees. By comparison the lithium battery industry could generate over 62,000 jobs in the next 10 years, and the electric car industry as a whole with its supplier networks could generate much larger numbers of jobs. Because of the advanced technology involved these are good well paying jobs. The finance industry in the U.S. is attracted to the quick returns in the software related fields, leaving a gap for the American government to fill a role nurturing these industries. This would be similiar to the manner that the German and Japanese governments do working with their own private sector. The private sector in the U.S. needs only the early nurturing and can operate on its own by innovating its way to competitiveness in manufacturing and cost after the early years. Because of missteps in failing to support manufacturing in the U.S., the U.S. may have to import some of the technology from countries such as Japan and S.Korea to make up for these missteps. This is happening in the lithium ion battery manufacturing technology and facilities, which experts say is being successfully imported from these countries to the U.S.. The Obama administration has provided $2.5 billion dollars from the stimulus investments to support projects of 30 companies operating in the advanced battery technology field. This includes companies such as A123 Systems and LG Chem Power in Michigan. As a result of these efforts the Department of Energy estimates that by 2015 the U.S. will have the capacity to manufacture 40% of the world production of lithium batteries for the autombile industry. In 2009 the U.S. had capacity to manufacture 2% of the batteries....

Product obsolescence in a matter of weeks- the situation with the HP Touchpad. The Touchpad tablet is introduced at a retail price of $399 for 16GB and $499 for 32GB versions on July 1, 2011. The product is scrapped by CEO Apotheker after disappointing sales within weeks of introduction. It is now sold at a sale price of $99 in the last week of August 2011. Hon Hai chairman Terry Gou told corporate employees that Hon Hai plans to increase the number of robotic arms in its manufacturing plants from 10,000 to one million by 2013. He says the move will "improve working conditions and provide a better career path to employees." The improvement of working conditions is a major concern after a number of suicides. The plans to automate dangerous and monotonous tasks is intended to migrate workers to other work. Hon Hai has about 1 million employees in China. Hon Hai, a Chinese company which makes IPads and IPhones for Apple has grown by doing high quality work for lower prices than anyone else. In the process Hon Hai has generated a culture that is tough even by Chinese standards. About 250,000 workers are employed in its factories in Shenzen alone. A series of suicides at the plant has attracted attention to the tough conditions. One worker says conversation on the production line is banned, bathroom breaks are limited to 10 minutes for every 2 hours, and the discipline is strict. Hon Hai won Apple's order says one supply-chain search expert, by pricing low. Its CEO Gou was willing to sell some components at zero profit according to people familiar with his actions. Workers come from rural areas, are very young, the first time they are away from their families, and live in dormitories, eight to ten people to a room. Hon Hai's response is to increase wages 30%. But a report about a college graduate who was asked about conditions reflects the general feeling. This graduate makes twice as much in product development, at 2000 yuan a month, or $293 a month. But the monotonous life and the feeling of no future affects this worker and may be a sign of something changing in China's factories. The unwillingness to accept the conditions that existed in the past....
