This editorial in the NYT says Bill Clinton moved the Democratic Party to the centre in 1992. In 2016 about 25 years later, after the removal of the Glass Steagall Act led to the 2008 global financial crisis and a deep recession, after the trade relations with China led to loss of U.S. manufacturing jobs over two decades and the hollowing out of industry in the midwest, things have changed. The revolution led by Bernie Sanders, a shrinking middle class, smaller access to college education for the middle and working class, and wide disparities in income, are putting the Democratic Party closer to its roots and the days of FDR. The Democratic Party platform calls for a 21st century Glass Steagall Act to separate normal banking from investment banking, opposes the TPP to prevent any further export of jobs overseas, and goes for a $15 minimum wage. This was also evident at the opening day of the Democratic National Convention when Sanders told the gathering in Philadelphia that even though he was not the candidate, these are the planks of the platform that Hillary Clinton will be pushing for in her presidency. What the editorial does not point out is that the Republican economic platform also calls for reinstatement of Glass Steagall Act, opposes TPP and opposes any loss of American jobs to overseas locations. It differs on the minimum wage leaving it to the states, and it is likely to skew tax cuts towards the wealthy, but also possibly removing the lower income brackets from taxes as Britain has done under the Conservative Party. Both parties today are looking for support from the middle and working class and have directed their appeal to these two groups which are in upheaval. The election of Trudeau in Canada recently also followed this trend, after the hollowing out of Canadian industry in Ontario and Quebec in a similiar pattern as in the midwestern U.S.  ...

There are similarities in the Republican and Democratic party platforms in 2016. One area of agreement is in the reinstatement of Glass Steagall Act. That legislation made in the Depression period to separate commercial banking from investment banking was changed  when president Clinton made changes in a deal with Senators Phil Gramm and Jim Leach in 1999. The too big to fail problems of banks and the problems of investment banks during the 2008 financial crisis are attributed to the lack of Glass Steagall protections for financial stability and safety. The result is that in the post 2016 environment banks can expect a tougher regulatory environment. Another are is in trade where both parties are expected to take tougher positions to protect U.S. interests. The Republican platform calls for "better negotiated trade agreemets that put America first."

Sanford Weill built Citigroup into a mega bank through repeated acquisitions. He was the strongest voice for the repeal of the Depression era Glass Steagall Act banning banks from risk taking activities in investment banking. The Glass Steagall Act was repealed in 1999, and repeal legislation was given the name of "Citigroup Authorization Act." On July 23, 2012, Weill told CNBC: "I am suggesting that they (the big banks) be broken up so that the taxpayer will never be at risk, the depositors won't be at risk... Mistakes were made." Weill said that the housing bubble and the financial crisis has proved that the repeal was a mistake.

Under the Volcker Rule setup during the global financial crisis of 2008-2009, banks total investments in private equity, hedge funds and similar higher risk funds cannot exceed 3% of high quality capital. During the financial crisis investment banks were highly leveraged leading to the collapse of Bear Stearns and Lehman Brothers, and the precarious financial condition of other banks. Goldman has pared down about 60% of such investments. Remaining are $4.8 billion in private equity investments, $1.2 billion in real estate, and about $1.1 billion in both credit and hedge funds. Regulators have given the bank till July 2017 to comply. As banks recovered from the impact of the crisis, the tearing of the social fabric that happened with high unemployment in some groups especially older white men, has remained six years after the crisis- as evident in the U.S. election campaigns this year. As a result the mood has shifted for tighter regulation and both party platforms, Republican and Democratic, now call for reinstatement of the Glass Steagall Act, which separated commercial banking from investment banking as part of the lessons learned from the Great Depression. Volcker, was chairman of the U.S. Federal Reserve during the Carter administration, known for taking a tough line against inflation. He was the principal driver of the move to restrict banks from risky activity, and faced considerable opposition from banks during the 2009-2013 period when the rule was being formulated.  ...

Senator Byron Dorgan warned about a crisis occurring through the dismantling of Glass-Steagall protections in banking that were put in place after the Great Depression. The change was pushed through with the Gramm-Leach-Biley Act named after Senator Phil Gramm of Texas, and was supported by President Clinton, Rubin, and Summers. Senators Dorgan and McCain called for a special committee to investigate what happened and why. This "select Committee" would have sub peona powers. One of the questions this would help address is whether in the future one would go back and reinstate some parts of Glass-Steagall. That decision says Dorgan has to be made, and he does not think its old-fashioned to go back to protections that previously existed. Its not that he was prescient, says Dorgan, its just that the protections put in place by Glass-Steagall were basically sound then, and they are sound today.

During the primaries Trump appealed to blue collar voters of a white working class that felt neglected by leaders and policies of both parties that did not seem to work for ordinary people. Having caught onto this early long before Republican candidates, Trump registered a series of wins in the Republican primaries. He continued this theme in his acceptance speech at the Republican National Convention on July 21, 2016, saying- "The forgotten men and women of our country- people who work but no longer have a voice: I am your voice." The idea was to couple this with the theme of law and order and put perception of Hillary Clinton as part of the rigged system of the past that Trump would change, with Clinton's legacy described in terms of "death, destruction, terrorism and weakness." As a change agent Trump described his entering the political arena in terms of coming into this election only to help blue collar people "so that the powerful can no longer beat up on people that cannot defend themselves." The two themes for the rest of the election season- law and order, and blue collar lives- and who can best defend them a traditional Democratic politician with a fighting spirit for traditional Democratic values, or a blustery newcomer adept with slogans and the public mood and ironically representing the Democratic values of representing the working class to become the  Republican nominee, with the law and order theme thrown in. The voter or independent listening in to all this will hopefully ask what all this means. As the WSJ, July 19, 2016, pointed out in a recent look at economc policies under the two candidates- on Glass Steagall Act being reinstated to increase safety of the banking system that caused many of today's problems through the 2008 financial crisis both Trump and Clinton are similiar, on opposing trade agreements similiar except that Trump's bluster is a riskier approach, on infrastructure building similiar with Clinton's $275 billion plan spelled out out for source of financing and Trump's unclear as to source of financing. On immigration the candidates are different, on the minimum wage which impacts low income people Clinton supports $15 minimum wage and Trump has not taken a stand. On ISIS and the Middle East Clinton is in reality a hawk and not much difference in the candidates, on law and order more chance of divisions in the country with Trump than Clinton. Overall for the working class and blue collar voter his life will take a decade or more to rebuild, with both candidates commiting to go in that direction. And the bluster and ads to come- just that.  ...

For the 1st quarter 2009, finance industry spent $104.7 million to lobby Congress and the administration, down 8% from the prior year, according to WSJ analysis of data collected by the Center for Responsive Politics. The health-care industry spent $127.1 million for lbbying, up by 12%. Lobbying can affect legislation in ways that can be for either good or bad in the public interest. Since 1990 the financial industry has spent $2.2 billion in political contributions to lawmakers, more than any other industry tracked by the Center for Responsive Poltics. Since 1998, the earliest available data, the finance industry has also been the highest spender on lobbying activities , with spending on lobbying lawmakers at $3.6 billion. Its significant that the financial industry landscape has been changed, the higher risktaking by banks enabled, and the reduced regulatory activity environment advanced by heavy lobbying. The banking industry lobbied for the 1999 repeal of the Glass-Steagall Act, a1933 law that kept banks out of the securities business. That effort led by Citicorp, J.P. Morgan,Bankers Trust took 20 years, many tries and more than $300 million in lobbying funds according to the WSJ. The Mortgage Bankers Association with a 10 story headquarters in Washington D.C. has 114 staffers, and SIFMA the Securities Industry and Financial Markets Association has 120 staffers and 14 people in its lobbying group. As a sign of how all this lobbying is viewed across the country, Rep, Barney Frank, chairman of the House Financial Services Committtee, frankly told Mr. Courson, the President of the Mortgage Bankers Association, "everybody hates you, and now they're starting to hate me for hanging out with you," a remark Courson recited at a meeting....

But he asks who today would not ask how anyone could oppose social security, and yet FDR passed Social Security against the vote of entrenched interests. And in establishing the Tennessee Valley Authority to priovide cheap electric power to the impoverished South, FDR did not consult wth utility giants Commonwealth and Southern. When he created the SEC he did not request the cooperation of those to be regulated. So goes the situation in September 2009 as President Obama's initiative on health care is bogged down by lack of support from Blue Dogs in the Senate and Republicans.

Warren Stephens, head of Stephens Inc, in Little Rock, Arkansas, says repeal of the Glass-Steagall Act was a mistake. U.S. banks should have a 5% cap on holdings of total deposits in the U.S., and no "grandfathering" of banks over the 5% limit. Five institutions controlling 50% of the deposits in the U.S. creates too much systemic risk in another financial crisis. Banks should be expected to be one or the other, commercial banks or investment banks, not both. These recommendations are not new. Bank of England Governor, Mervyn King, called for breaking up the largest banks or shrinking the size of the largest banks during the global financial crisis in 2008. This position for banks that are smaller in size is supported by veteran bankers Paul Volcker, Thomas Hoenig and other experts.

The WSJ provides a fact check of Trump statements on crime, debt, and taxes. Trump says he is looking at a new plan for taxes not the $10 trillion in tax cuts over 10 years reducing tax collection by 22%, but something about a third of the size. No details are available on the plan. WSJ disputes Trump's statement that the U.S. is "one of the highest taxed nations in the world." WSJ points out that the U.S. in 2014 for federal, state and local government taxes collected 26% of gross domestic product in taxes, compared to average of 34% for about 30 countries, according to OECD. Debt to GDP ratio is about 75% that is high, but because of low interest rates the budget deficit is less than 3% of GDP, which is close to the long run average. For this reason economists say the government should invest in infrastructure and R&D that supports long run economic growth. On crime the record is mixed with increase in Chicago, Los Angeles, and New York City, but decreases in Washington D.C. and Baltimore. Police shootings were 67 in 2016 compared to 62 in July 2015, and the high being 280 officers in 1974 when Nixon was President. Crime was an issue in the 1968 Republican National Convention during the Vietnam era protests, police shootings and terror incidents attracted attention in July 2016, yet the situation today is very different from the war protests of the Vietnam era. On terrorism fact checks by the NYT and in Lyrarc shows Clinton at State Department and Panetta at Defense Department taking hawkish stands only to hit a barrier from President Obama for taking action needed in Syria, Iraq and Libya. Panetta's new book calls for robust action where needed. A Clinton administration would take action with allies in the Middle East. Even Hollande and Obama who pulled the U.S. and France out of following up in the French-British Sarkozy-Cameron led intervention in Libya, have changed policy, with Obama calling it his biggest mistake. France under Hollande with the U.S. is now actively engaged in the Middle East, having changed policy. It is highly unlikely that a Trump led policy which alienates most allies in the Middle East- Iran, Iraq and Saudis- is likely to work better than a determined Clinton-Panetta led effort which has support of the local countries on the ground actually currently on both sides because of complexities of Middle Eastern politics.  On trade a new administration will still have to work with China, India, the European Union, and other countries, as global trade supply chains are not likely to evolve overnight. Lessons will have been learned by Clinton about the need to bring back jobs and ensure the strength of U.S. manufacturing. Economic and jobs growth will require prudence in strengthening U.S. manufacturing coupled with global cooperation, which a Trump administration that alienates trading partners without the possibility of making any serious immediate gains in jobs, is highly unlikely to do better.      ...

US Trade Representative Lighthizer in the Report on China's Entry into WTO sees this as a mistake in the policy of president Clinton. Clinton has said that was a mistake. David Sacks raised this issue in a podcast with Larry Summers, an economist who was deputy to Robert Rubin and Deputy Treasury Secretary, then Treasury Secretary succeeding Rubin in 1999. Clinton on the advice of Rubin and Summers set up the framework for China to join the World Trade Organization without the safeguards and the setup that would prevent it using state capitalism and subisidies to build its own economy with exports, to ally with American corporations to support the outshoring of almost the entire industrial base of the US. Shocking as it sounds this has happened, had happened by 2016, when Donald Trump with the advice of USTR Lighthizer took the first steps to reverse this with Tariff policy, which was supported by president Biden, and continues in its new phase under DJT in 2025. Rubin and Summers had supported deregulation of financial markets and removal of the Glass Steagall Act by 1999. This was to led to the financial crisis of 2009 that was to be one of three body blows to the American working and middle class. The others China entering WTO without safeguards that led to deindustrializing US and loss of its manufacturing base, loss of 5 million jobs, tens of thousands of factories. Anat Admati, is a professor of finance and economics at Stanford University School of Business. He says banks should depend on generating 30% of their assets from equity, something the banking industry of today in the U.S. and Europe considers heretical. More of the bank's assets should come from equity and much less from borrowed funds. Outside of banking healthy corporations in the U.S. carry debt at about 70% of assets and there is no reason banks should not do the same. In 2013 says Admati, the situation is not much different from that after the 2008 global financial crisis- large banks carry liabilities and debt at over 90% of their assets. The $2.2 trillion in debt at JP Morgan Chase bank is about 91% of assets of $2.4 trillion. Basel III regulations allow banks to borrow upto 95% of assets, and proposed banking regulations in the U.S. put this at 95%, with the way this is measured still being debated. At such high levels of debt the margin of error is small, and systemic risk which is high in a globally interconnected banking system means the whole banking system can freeze from one large bank going into failure such as Lehman Brothers. This happened in 2008 and the margin of error is still small, which is why global banking is such a high wire act with the U.S. Federal Reserve, the ECB and other central banks issuing regular warnings and regulators faced with the task of keeping the banking system in check through vigilance and investigations of banks violating laws. How much difference has Dodd-Frank legislation in the U.S. made after 2008? Jason from Atlanta says in response to Admati's article, that the Glass-Steagall Act of 1933 was 37 pages and the banking system did not freeze up in the way it did in 2008 for the rest of the twentieth century until its repeal. The 879 page Dodd-Frank legislation of 2011 is overly voluminous and still leaves 243 rules to be written by regulators in consultation with the financial industry. Banks are larger now than they were in 2008 and have an outsized influence in shaping the rules, leaving the U.S. Federal Reserve's supervisory committee and Fed Governor Daniel Tarullo with the job of somehow keeping banks out of trouble. JP Morgan Chase, Admati reminds readers, has $2.4 trillion in assets as of June 30, 2013, and debts of $2.2 trillion, with $1.2 trillon in deposits and $ 1 trillion in other debt owed to money market funds, other banks, bondholders and the like. ...

Several key events happened that damaged America and the working people of the Nation -and each time Rubin and Summers are seen as giving wrong advice. The first deregulation of financial markets setup by Clinton-Rubin-Summers in 1999 led to financial crisis of 2009. The second setting up China's entry into the World Trade Organization without safeguards that caused China to use unfair practices to destroy much of America's manufacturing base. The 2009 financial crisis-  The support for repealing the Glass Steagall Act in 1999 and for deregulation of financial markets by Rubin and by Summers led to deregulation that caused the financial crisis of 2009 with overleveraging of US banks and faulty mortgages. This was the first blow to the social and economic fabric of America, to America's workers and families. The second body blow came from decisions made by president Clinton with advice of Larry Summers as Deputy Treasury Secretary and Treasury Secretary in 1999.  Advice that Clinton regrets  and sees as wrong and which have shaken American workers faith in the traditional Republican and Democratic parties of Bush, and of Clinton-Obama 1992-2016, a 20 year period which saw almost the entire industrial base of the US shipped to China  by American corporations working with China. Gretchen Morgenson cites two views on the newly approved Volcker Rule in December 2013. Prof. Richard Sylla of New York University sees the rule as going part way in the direction of the Glass-Steagall Act, which gave the financial markets five or six decades of financial stability. Just the fact that the rule is on the books should give the bank officers pause before engaging in questionable financial activities, is his view. Prof. David Skeel of the University of Pennsylvania Law School, believes only aggressive enforcement can make the law work because of the way it is written. He says regulators have fallen short in enforcement in the past and have not been held accountable. Only by making regulators accountable, including penalties for regulators failing to do their job, would this work says Skeel. By not imposing penalties for regulatory failures in the last crisis there is more likelihood for this sort of behaviour to continue. Instead the same regulators are now given greater powers after an earlier failure. Considering the Skeel view, the importance of the attestation- that is now required from bank senior executives that the Volcker Rule's provisions are being followed- take on an important role in ensuring enforcement. This also coincides with Mr. Volcker's view that the bank officers should have to take on the responsibility for making sure that they are doing it the right way....

Charlie Rose talks to Nouriel Roubini about his thoughts on the next bubble and his book- "Crisis Economics." He says financial crises don't just happen out of the blue, they don't happen at random, instead they are predictable. Excessive risk taking and leverage have undesirable outcomes which are predictable as they take shape and get overblown. What happened to all the toxic assets? Banks are still carrying these assets hoping and praying that they don't need to be written down. His view coincides with that of Jeremy Grantham and other experts who see a growing danger in a prolonged period of zero interest rates which encourage risk taking. In all the developed economies of the U.S., Europe and Japan, borrowing can be done at zero interest rates. Investment banks are back to huge profits in proprietary trading using money borrowed at zero interest rates. A new bubble is developing that could burst in 2 or 3 years. The value of most risky assets has gone up by 50-80% in the last year. See Shiller's expert view on the danger from declining confidence levels and from higher uncertainty. Roubini says the Dodd bill is not enough. It does little to addresss the "too big to fail" problem as banks actually became larger after the financial crisis of 2008, and are too big and complex to manage. He also points to the risks of not separating proprietary trading from bank holding activities, and the need for something similiar to Glass-Steagall to separate the two. Bernie Sanders with 46% of the delegates, 13.4 million votes, 22 states, and many of the young people in the U.S. behind him, told a news reporter at his home in the final sprint two weeks before the election- he plans to see the major planks of the Democratic platform implemented. He said Clinton is progressive on a number of issues, but the platform is more progressive with upward mobility a critical concern. Sanders played a critical role in shaping the platform. He says he opposes someone from Wall Street in positions of Treasury Secretary, Trade Representative, and will make known his views who would be best in these positions, including Attorney General. Sanders is supported in the Senate by Senators Sherrod Brown, Jeff Merkley, and Elizabeth Warren. Warren has campaigned with Hillary Clinton in New Hampshire, and both support minimum wage, women's rights. WIth a win for Democrats in the Senate Sanders will become either the chairman of the Budget Committee, or with his preference chairman of the Health, Education, Labor and Pensions Committee. His main goal now is to see key economic Cabinet positions that affect upward mobility, intergenerational mobility, which is damaged today for the middle and working class, go to persons who would do the most to improve it.  ...

Citigroup remains extraordinarily leveraged, with tangible leverage at 47 times tangible common equity. JP Morgan's is 26 times and Goldman's is 21 times. The government's two preferred shares capital injections of $45 billion does not reinforce the common stock, which fell 20% on the 14 January, 2009, and the discarding of the universal bank structure this week does not adequately address the root problem of problem mortgage related assets and excessive leverage. The government's agreeing to to take a large share of losses on $306 billion of problem assets helps, but with the leverage being so high significant problems remain. So what are the options. Reducing leverage to where J.P. Morgan Chase is would take $35 billion in common equity, something that would make the government the owner of Citibank, as Citibank's market capitalization on January 14, 2009 was $25 billion. The risk of doing this would be that other large bank stocks also fall steeply as the market prices in a similiar outcome. And there are political considerations as giving capital to banks is not popular with so little bank lending to show constituents. The capital needs of Bank of America as it completes the acquisition of Merrill further complicates the picture. But stopgap moves like additional loss sharing agreements will leave Citbank's problems still unresolved. ...

Citigroup is bleeding even as the government has ringfenced $300 billion in bad assets and its not likely to go under. The next step may be to get these bad assets into a bad bank as Bernanke has suggested. Citigroup is now divesting many of the assets like Smith Barney that were hastily put together by Sandy Weil as some kind of financial supermarket. None of the companies with their separate cultures melded together, and managing this was a huge undertaking which never really got off the ground. Now its all coming apart and Citigroup will go back to its core assets.

Former Fed chairman Paul Volcker has opinion about the financial crisis that is deeply felt. He wants the wall that separates banks that take in federally insured deposits from the public separated from the risky trading activities of investment banking houses. That would essentially put us back to the situation that existed before Glass Steagall Act of 1933 was revoked in the 1999. The lessons of the thirties apply today. Says Volcker "people say I am old-fashioned and banks can no longer be seaprated from nonbank activity, but that argument brought us back to where we are today." The Obama advisers like Geithner and Summers are close to the bankers- see the links to Geithner and Summers- and believe that extensively regulating the banks would prevent the banks from engaging in risky practices. However as this reporter Louis Uchitelle of the NYT has not pointed out, the problem is that this is more easily said than done. The very fact that there were close ties between Geithner and Summers and the bankers during the Clinton Administration and Geithner as head of the New York Fed under the Bush administration, and the aggressive lobbying by the investment banks like Goldman and others who are now banks to water down any regulation on derivatives trading and on other supervision, can only lead to a situation where neither Volcker's solution or the Obama people's solution is put into effect. THis will only invite another crisis. With the public anger even worse as the bonuses and compensation from trading profits by Goldman and other banks come through cheap money created by the Fed- see links- for the purpose of addressing the financial crisis. Volcker would separate JP Morgan and Bear Stearns trading operations and separate Merrill from BofA, and Goldman would revert from abank holding company to a investment banking house. Volcker believes that the pay on Wall Street "has gotten grotesquely large." Volcker believes that the separation of deposit taking institutions from investment banking would reduce trading profits and consequently automatically reduce these large bonuses. So is Volcker being ignored by the Obama administration, even as his glow helped the Obama people win public support as a better steward of the economy than McCain during the election campaign? During the crisis Volcker headed the president's Economic Recovery Advisory Board. Today he is rarely seen in his Washington office, he talks to administration officials mostly on the phone, at 82 he is not knocking on doors, and the advisory board has been assigned to look at the tax law on overseas corporate profits. Volcker agrees with most of the Obama plan on financial regulation including higher capital requirements and and pay guidelines, but if this is not enacted because of lobbying by bankers then the nation will have the benefit of neither the Volcker Plan or the Obama Plan. ...
