The last time the FBI involved itself in elections was with Edgar Hoover in the election between Harry Truman and Dewey for U.S. president in the 1948 election, when Hoover made clandestine efforts. One Georgetown scholar says it may be an unfair comparison for Comey, but it raises questions about his bringing up the email inquiry a week before the election. Other experts say it may be a sort of moral hubris of Comey that led him to this. An expert at New York University School of Law, Mr. Gillers, is cited by NYT. Gillers says the letter to Congress was a second or third mistake to cover up a previous mistake, that Comey should not have made repeated public statements, not the statement criticizing Hillary Clinton about the email practices, not writing a letter to Congress a week before the election. Michael Chertoff, a Republican who led the criminal division of the Justice Department under Bush, says Comey violated longstanding Justice Department rules and practices in July and this week, and provided fodder for all kinds of speculation.  ...

Comey sends another letter to Congressional committees on Nov. 6, just 2 days before the election, saying that "based on our review we have not changed our conclusions that we expressed in July with respect to Secretary Clinton." Just 9 days prior to the election Comey had written to Congress that the FBI was looking into emails found on the computer of Mr Weiner, estranged husband of Clinton aide Abedin. By doing this Comey had inserted himself and the FBI into the election in a way that was not proper said leaders of both parties. The heavy criticism continued with Vice presidential candidate Kaine, president Obama and Secretary Clinton, seeing this as a blatant political move by Comey, who is a Republican. It is likely to remain a subject of criticism long after the election, say experts.

Gretchen Morgenson of the Times distills key insights from 633 page report by the Financial Crisis Inquiry Commission. Morgenson points to the role of the Federal Reserve in Washington and New York in being as she describes it, defiantly inert and uninterested in controlling the mortgage bubble even when it had grown to enormous proportions.The problem now is that the same Fed has received more regulatory powers under the Dodd-Frank law. The same Fed repeatedly did not exert its authority on predatory lending. Page 94 of the report cites a total of only three institutions referred to prosecutors by the Fed from 2000 to 2006. Page 164 shows why there have been so few prosecutions for mortgage fraud from the bursting of the mortgage bubble. William Black, a former fraud investigator and professor at the University of Missouri-Kansas City School of Law, says the FBI has received virtually no assistance from the regulators, the banking regulators and the thrift regulators. The report contains some outrageous comments by one of the key players in fueling the mortgage bubble, Angelo Mozilo of Countrywide Financial. Morgenson describes him as a lender that roped unsuspecting borrowers into poisonous loans. Mozilo says in an interview on page 105 that his company prevented "social unrest" by providing loans to 25 million borrowers, many from minority groups. Never mind that this wave of poisonous loans has clogged the arteries of the nation's financial system, and resulted in foreclosures for millions of homeowners, creating a troubled housing market that hobbles the economy. Neil Barofsky, special inspector general of the Troubled Asset Relief Program, sees further bailouts ahead. He said in a report to Congress in late January 2011: "Unless and until an institution like Citigroup is either broken up, so that it is no longer a threat to the financial system, or a structure put in place that it will be left to suffer the full consequences of its own folly, the prospect of more bailouts willl potentially fuel more bad behaviour with potentially disastrous results." ...

This analysis by Gerald Seib in the WSJ shows the FBI chief Comey reopening the investigation into Clinton's email server just one week before election date November 8, as a move that does not enhance the democratic process because either way it will lead to questions why this was done at this late stage. The emails were found on a laptop used by Huma Abedin, an assistant to Hillary Clinton. Experts say the emails can be processed in a few days, and the FBI, the Justice Department are moving quickly to do this. 

Election experts say most of the decided voters for both parties will not be affected by this especially since most people will have made up their minds by now. Some voters who had questions about Trump might be moved to vote for him, and some undecided voters may be less enthused to come out to vote, though it is not clear at this stage. By mid week a clearer picture is likely to emerge.

Eric Holder Jr, the Attorney General of USA, told the Financial Crisis Inquiry Commisssion that the F.B.I. was investigating more than 2800 mortgage fraud cases. Of these 2800 cases, 1842 are classified as major cases, involving losses of more than $1 million. In addition federal charges are pending against 826 defendents. Lanny Breuer, assistant attorney general of the Justice Department's criminal division stated that the fraud cases included loan origination schemes, property flipping, foreclosure rescue schemes and loan modifications. Those accused of wrongdoing include real estate brokers, appraisers and bank insiders and "plain old fraudsters who gravitated to mortgage fraud." Sheila Bair in her opening remarks to the Financial Inquiry Commission, led by California state Treasurer Angelides, stated that it was necessary to find a way to breakup large banks without using the option of government support. Bair pointed out that the basic assumptions about financial supervision, credit availability and market discipline that were considered acceptable in the regulatory reform scheme for decades are now appearing seriously flawed. A whole reassessment was needed to change the existing mechanisms and methods. And she emphasized the serious distortions and imbalances in our national policies which moved away from savings to consumption, away from investment in our industrial base and public infrastructure toward housing, and away from real sectors of the economy towards the financial sector. Ms. Schapiro who heads the S.E.C. called for a stable , adequate funding to support the commission's work....

Several reasons cited- the fragility of the financial system in 2009, the lack of support from regulatory agencies, the lack of funding for the FBI and the Justice Department to assign special resources for the effort. David Stockman was Budget Director under President Reagan and known for his prodigous grasp of statistics in the national budget. Here he takes on what he describes as disproportionately large and destructive banking system for the U.S. economy, which he says the nation desperately needs less of. He supports the small tax of 0.15% of the debts other than deposits of financial conglomerates. His words are some of the strongest yet to come from one of the most prominent people on Reagan's economic team about how the nation's banking system has beome unproductive in supporting economic activity which is its reason for existence. The destructive effects on social cohesion and the middle class is emphasized. He says for years the Fed has run an insanely loose monetary policy that has encouraged this behaviour and socially detrimental profit seeking by the banks and other companies. He sees the big banks as dangerous institutions in today's economy engaged in a bull market culture which believes in entitlement and profitseeking behaviours regardless of its detrimental nature for the national economy. The recent profits of the banks in 2009 and the resulting bonuses are a result of the Fed's easy money policy and bank's gambling at the Fed's monetary casino as he puts it, with money obtained at little cost from Fed-controlled money markets. This article helps to eliminate the distorted perspective in today's climate that paints criticism of splitting up the banks, or otherwise restricting banks in engaging in proprietary trading and risky behaviours, as government interference. As Stockman puts it these banks are already in some sense wards of the state and not private enterprises and this issue is not relevant. The question now is how to set things right and this involves possible solutions such splitting up banks that are too big to fail, restricting risky behaviours and preventing proprietary trading, and other actions as unusual steps for unusual times to get things working back to normal. In other times Stockman would not have said this in an op-ed piece if this were not so....

U.S. District Judge Jed Rakoff was critical of the S.E.C.'s practice of entering into consent judgements which allowed defendents to not admit to wrongdoing. In his order Judge Rakoff rejected a $285 million settlement with Citigroup for a mortgage-bond deal. In his order he said such settlements are viewed by the business community as "a cost of doing business." He found it hard to discern what the S.E.C. would be getting out of such a settlement "except a quick headline." Rakoff summarized the problem with such settlements and the S.E.C.'s practices when it comes to the public's interest: "In any case like this that touches on the transparency of financial markets whose gyrations have so depressed our economy and debilitated our lives, there is an overriding public interest in knowing the truth. In much of the world, propaganda reigns, and truth is confined to secretive, fearful whispers. Even in our nation, apologists for suppressing or obscuring the truth can always be found. But the S.E.C., of all agencies, has a duty, inherent in its statutory mission, to see that the truth emerges; and if it fails to do so, this Court must not, in the name of deference or convenience, grant judicial enforcement to the agency's contrivances."...

Prof. Gorton and Prof. Metrick of the Yale School of Management review 16 scholarly studies and papers on the causes of the 2008-2009 global financial crisis in the current isue of the Journal of Economic Literature. Another article in the same journal reviews 21 books on the subject. Samuelson says the most cited causes- lax regulation and passive regulators, and the policy of home ownership that encourage the packaging and of securitization of mortgages to government sponsored agencies Fannie Mae and Freddie Mac- are only the surface causes. If we are to explain how a whole society seemed to believe in the idea that somehow there was a way to maintain a rising tide continuously, with only small corrections over several decades, by the clever manipulation of monetary and fiscal policies; then one has to look to the hubris of economists who acted as if this was possible and the gullibility of business and a public that desperately wanted to believe as some have put it "that this time it was different," or that shrewd management of economic policy could actually bring about such a panacea. The abiding lesson is economic policies based on a better understanding of how modern industrial economies work are merely useful tools, no more no less, and there is no substitute for a good ethic, wise management and careful thinking on the part of the public, business and government, particularly for the people in leadership positions. ...
