The US Labor Department will now require not just 401(k) administrators but also advisers for retirement plans called IRA's to follow the higher fiduciary standards of the 1974 ERISA law that aims to protect American retirees. When workers leave a company or retire they rollover their money into IRA's. This retiree money will now be protected with a high fiduciary standard as it should have been all along. In 2020 alone the IRS estimate is that $620 billion was rolled over to to such IRA's.

Doctor are suffering from a "demoralization syndrome" says Eric Reinhart, physician at Northwestern University. He sites one study that shows universal access to health care in America could have prevented at least 338,000 deaths during the pandemic. Overwork comes from physicians retiring from the healthcare workforce in large numbers. In 2021 117,000 physicians retired and only 40,000 physicians joined the workforce. Another 20% will retire in 5 years. Burnout itself comes from a realization that the system is failing its people and you are working within it without the social and cultural narratives that supported previous generations of physicians. It is these narratives of honesty and service that are the essential parts of the human condition that are lacking without access to good health care for all the people and the education to promote good health.

About 5-10% of the people attending the rallies are steadfast supporters who attend multiple rallies. What was once seen as a debacle on CNBC and Wall Street in 2015- the decision of CEO McMillon at Walmart to raise wages from 7.25 an hour to $9.00 an hour with share price drop of 10% turns into a big win by 2025. The renewal of America requires new leadership at the helm of America's institutions for higher learning when men's enrollment in college education is endangered as reported in WSJ. This WSJ report shows presidents choosing to retire at Dartmouth, NYU, Columbia, U Penn, MIT. Lee Bollinger is 75, he started at Columbia as president in 2002. He helped raise $13 billion and expanded the 13 acre Manhattanville campus. Yet what does it say for so many college presidents when during the period when they raised vast sums of money and during the last 2 decades college education is harder and harder to afford for ordinary Americans? During the pandemic WSJ reports in 2021 even show that American men are having a hard time paying for college education and rates of enrollment are dropping for men to alarming levels. Never before in America's history has it been said that American men are becoming endangered for higher education. One rarely hears college presidents talk about these social issues that are top and center for ordinary Americans. It is not just Columbia or what are called Ivy League institutions, most of the leading colleges in America have forgotten why they are here in the first place and what made America what it was and again can be, a land of opportunity for all. It is time for anew generation of leaders in American higher education to dedicate themselves to this task - so that we hold these rights to be self-evident, to renew America in the face of many challenges and set a model for the free world. ...

Retired General Keith Kellogg was in National Security roles in the DJT first term. He is the new DJT envoy to Ukraine and Russia with the goal of negotiating a settlement between Russia and Ukraine. He was chief of staff of the National Security Council in DJT's first term. And also the National Security Advser to vice President Mike Pence. The 80 year old veteran co-authored a paper for America First think tank which says- "The United States would continue to arm Ukraine and strengthen its defenses to ensure Russia will make no further advances and will not attack again after a cease-fire or peace agreement."  "Future American military aid, however, will require Ukraine to participate in peace talks with Russia."  This comes as Zelensky's popularity in Ukraine has dipped to 16% and Ukraine's people do not want him to run again for president. Toyota CEO Akio Toyoda, grandson of founder Kiichiro Toyoda, assumes new role just as net revenue is down 38% for the second quarter 2009, and a loss of $819 million. Akio says he is extremely frustrated with the situtaion and wants to start again from the ground up. With the restructurings at GM and Chrysler and focussed effort at Ford, efforts of Korean carmakers, and new competition from China and India looming, Toyota expects severe competition in the American and global markets. About 40% of Toyota's senior management has been retired or reassigned.Four of five executive vice presidents are new to their jobs, and only one Takeshi Uchiyamada, the product development chief is left from former CEO Watanabe's team. The outward looking Akio, whose background includes an MBA from Babson college in Massachusetts, and overseas experience including America, is likely to give the relatively insular culture at Toyota, a jolt. Under the new arrangement each of the executive vice presidents has been put in charge of a global region. One of the biggest problems Toyota will face say experts is the mundane looking lineup of vehicles bought mainly for reliability, just as competitors are making big strides in quality and new design, with new technology reshaping what the automobile might look like. The focus on the Tundra truck and SUV's like FJ Cruiser now looks misplaced. Yoshimi Inaba, a Toyota executive with experience overseas, will take charge of the American operations. Germany's homeless problem compares with that in the US, with Federal Working Group Bag-W estimating it at 600,000 of which 50,000 live on the streets. In Germany authorites are expected to give emergency shelters to people on the streets. The Federal Ministry of Housing and Urban Development and Building put out a 31 point Action Plan as a first step. Previous efforts have failed. The Action Plan includes getting financial assistance to state governments to build social housing -18.15 billion euros were allocated for 2022-2027 to build affordable social housing. Yet in the first year 2022 only 22,545 units were built short of the 100,000 goal per year. Affordable housing is at the heart of the fight against homelessness. There is an acute shortage that is driving up cost of housing in the US and in Germany. WSJ recently showed about a third of US housing is tied up by retired boomers hanging on to large homes. Germany's allocation of $3 billion per year is inadequate  for a problem of this magnitude that colors out perceptions of the quality of life in American and European cities. Capital markets are misallocating funds, and doing little for work that is an absolute priority for quality of life in the streets and neighborhoods of America and Europe. The title says it all. The Jobs bank the United Autoworkers trade union in the US setup in GM in 1984 threatened American automaker GM's very survival in 2006. It put workers who were not needed at GM in a jobs bank. It basically meant the idled workers -many of them close to retirement -would stay there till they retired doing nothing collecting full salary. As Mohandas Gandhi had done for India in Hind Swaraj in 1910, the American labor movement needs to look at itself in the mirror if labor is to find its way into a world of dignity and fairness in wages that Mr.Biden truly seeks for American workers.   It was setup when GM had 45% of the US market and 415,000 workers. By 2006 113,000 workers were not needed with GM having lost marketshare to Japanese makers and the Jobs bank was costing GM about $10 million a week, half a billion a year threatening its survival. The Labor movement and the UAW union did nothing to fight its own membership and set it on the right course in union with management, putting at risk the very foundation that labor had put in place since Wilson, FDR and Truman for  fairness in wages and working conditions. Jeremy Peters tells the story in the NYT. That it was recent as 2006 and shows how much had gone wrong with the labor movement and the failure of its leaders to do the right thing. The Jobs Bank says NYT was intended to prevent manufacturers from shifting manufacturing overseas, instead it did just that by undermining confidence in unions and the American labor movement, and in American workers. Two crippling wars initiated by Republicans Bush and continued by Democrat Obama, disinvestment in American manufacturing, companies like Apple shifting their entire manufacturing through outshoring to Taiwan and China, the 2009 crisis from deregulation of American banks, led to the loss of not one, but two decades for America. In today's news a modest $2 in minimum wage increase from $15 to $17 over 3 years is all that New York governor Kathy Hochul could get- even though Assembly Democrats were asking for more- to give American workers and families a fair wage to meet the cost of living crisis.  ...

Baby boomers are aging and leaving the workforce. Not enough people are expected to replace them to meet the higher demand for infrastructure workers to rebuild America's roads, bridges, airports, rail, and other infrastructure. US president Biden' $1.4 trillion investment planned for renovating infrastructure will mean a large demand for workers that will be difficult to meet, says this report in NYT. Fewer students are going into community colleges, and fewer new workers are replacing older workers who retire in the construction related industries.

Textualism or strict interpretation of the Constitution word for word may be back but one can never be sure. No sooner is one decision made in a certain direction with a particular approach to the law whether it be textualism or something else it then comes up for rethinking a few years later, under a different approach to the law or from a new angle. This is the law practiced in most British style courts of law including the US.  Former Justice Breyer of the US Supreme Court replaced by his law clerk Ketanji Jackson, is interviewed by NYT's Adam Liptak. Today so much is written about Breyer as a non textualist, and Gorsuch, Kavanaugh recent additions to the Court as textualist or strict interpreters of the Constitution based on when it was written with what intent. Yet as thinking individuals who like the rest of the American people grow in their understanding all Justices cannot be categorized  in this way. Breyer says he worked with retired Justices Kennedy and Souter and found them to be willing and keen on hearing all angles. Then it has to be said that both Kavanaugh and Gorsuch were law clerks for Kennedy. Much of American law at the highest court actually is no better than any other human creation - it tries to approximate as best one can the people of the US. Sotomayor coming from Puerto Rican descent, Ketanji Jackson from minority black, Kavanaugh and Gorsuch from Georgetown preparatory schools where Kavanaugh's paternal grandfather attended Yale something even JFK could not claim, Chief Justice Roberts coming from a company professional type background, Barrett a professor at a Catholic university, Kagan with a Bostonian JFK style background, Alito old Italian and Clarence old minority black background. Breyer retired recently to make way for a younger judge, Judge Ketanji Jackson who was law clerk to Breyer. Breyer is writing a new book which he hopes the conservatives on the Supreme Court will read- Justices Kavanaugh, Barrett and Gorsuch. The book coming out March 26 has the title- Reading the Constitution- Why I Chose Pragmatism not Textualism. He hope these Justices will read the book and say their colleague was making sense, would say that it was not a bad point. ...

American journalist Bob Schieffer spent 46 years with CBS. He was host of the news show on CBS "Face the Nation" for 24 years. Schieffer says he made the biggest impression on the American public only in the last 12 years since turning 65. During these 12 years he moderated several presidential debates, put CBS at the highest level of viewership as other leading journalists retired, and published a best selling memoir, "This Just In." Things were not expected to turn out this way. In 2003 Mr. Schieffer found out he had bladder cancer, and he says ever since he saw things differently- everything appeared as a temporary assignment. In 2005 he announced he would retire in 2007, when he was 70. Each year after that CBS persuaded him to stay. He replaced Dan Rather for "CBS Evening News" in 2005, and gave it solid ratings till he stepped down in 2007. Schieffer is the same person he was many years ago for people who remember him from CBS since 1982, as the chief Washington correspondent. It is this power of experience, of being always there, that attracts viewers who want to hear about what Bob Schieffer finds important, with an authentic voice asking the right questions....

UN projections show median age of Chinese citizens will overtake that of Americans in 2020. Yet China's median income is only a quarter of that in the U.S. Life expectancy in China today is 76, very close to that in America. In 1960 a Chinese person born that year had life expectancy of 44 years.  China is aging at the pace of Japan, and a bit slower than South Korea, but wealth per capita was three times higher in South Korea and Japan than China when the aging accelerated. A Chinese woman fertility rate today is 1.6 compared to 4.6 in 1973. A prominent Chinese economist says in a recent report that median age in China in 2050 will be nearly 50 compared to 42 in America and 38 in India. WSJ cites figures showing China will have gone from 9 working age adults per retired person in 2000 to just two by 2050. So how to pay for retirement of all these workers today? Government spending on retirement is a tenth of GDP, about half the level in older wealthier countries, and increase in spending will impact growth. Today this is about 6.2% potential growth rate. It also pushes wages up with a shortage of workers in cities such as Shenzen and X'ian even with the use of new technology and robots in factories.  Solutions are to raise retirement age currently set at 60 years, increasing labor force participation of women as Japan has done, and increasing productivity. China has transferred 10% equity stakes in four state owned financial firms to the national pension fund to shore up its finances as estimates from the Chinese Academy of Social Sciences show it running out of money in 2035. Traditionally children supported families in old age but the one child policy leads to situations where the child is working or in another city. In Suzhou near Shanghai, a retirement business sends 1800 helpers to private homes and 130,000 retired people, in a new trend. The city administration of Shanghai plans 400 neighborhood care centres for elderly by 2022, with health clinics, drop in facilities, and homes. 12,000 elderly people use one centrre in central Shanghai area of Changning. ...

US president Biden joins a UAW picket line in Detroit. Biden says he supports the UAW in its wage negotiations for 40% increase in wages. Workers wages are depressed because of concessions made a decade ago to ensure the survival of the US auto companies. UAW leader Shain Fawn was elected directly by the rank and file members for the first time. He has gone back to the UAW's roots for strike action, as it seeks to reverse concessions on tiered wages and address the cost of living crisis.

Adjusted for inflation wages for automakers have fallen 19% since 2008 because of tiers new workers making about $17 an hour significantly less than the $32 an hour. UAW seeks an end to tiered hiring.  For GM it is about committing to a long term contract in an industry that is unpredictable and uncertain. GM wants to make substantial investments in the EV industry with president Biden's help even when not making profits from EV's. For the UAW Ms. Janis of Jobs to Move America says labor is a very small part of what it costs to make EV's, batteries are the most. None of the earlier difficulties are likely because much fewer workers are needed making labor cost a much smaller component. Toyota has been slow in its EV start, BYD in China is leading but US carmakers are supported by the US government for EV's. Auto workers want a fair contract . And GM working with partners can still build joint venture factories for batteries in the South just like Tesla where work is not unionized. In the competition in EV's R&D and quality of management will play a bigger role. Fairness for workers will motivate American carmakers, with worker training and quality+value of EV's important for success.   ...

The WSJ offers this view on the UAW strike by 13,000 of 150,000 workers at GM, Ford, and Stellantis factories. No one gains from the strike, workers say are behind by 19% lower wages today than in 2008 after making concessions to the carmakers. They just want fair wages, and president Biden is backing the UAW union. Is Tesla and non union labor in the south going to put GM out of EV's? Unlikely, labor is a small part of EV cost, Tesla is too dependent on one leader with much of its glow reduced after the Twitter acquisition, whereas workers and management at GM at all levels are more resilient today than at any time in GM's history. President Biden also brings a tempering influence on both sides with the national interest uppermost in building a strong EV industry.

Autoworkers want a raise of 40% from depressed levels with two tiers one for entry level workers set really low during a crisis when auto companies were near or entering bankruptcy. Automobile companies want to use high profits for EV vehicles.  Autoworkers have worked hard through the pandemic and have suffered low wages for a decade, now face a cost of living crisis- the 40% should be seen in the context of starting a depressed level trying to meet costs of living that have surged in 2021-2022. If both conditions are removed the increase might be a modest closer to 10% over a hypothetical higher wage and lower cost of living.
