As the American banks were better capitalized before the global financial crisis than the European banks, and they were recapitalized with taxpayer money during the crisis, the Europeans and the French in particular feel that they have alot of catching up to do. Geithner at U.S. Treasury is pushing for higher capital requirements for the banks, with agreement by the end of 2010 and implementation by 2012. The way these new rules work the Europeans feel would put their banks at a disadvantage, because their banks would have to raise more capital and constrain their ability to provide credit to their local economies. Capital requirements for banks were part of the previous arrangement called Basel II, which covered USA and European banks. Basel II capital requirements rules measured capital compared to assets weighted on the basis of how much risk they carried, but this relied on credit rating firms which were discredited in the crisis. On the subject of bonuses the large banks are trying to influence the discussions. As a result the Financial Stability Board, an international advisory committee of financial regulators is going to make its own recommendations....

Banco Santander, Brazil, sold 600 million units at a price of 23.5 reais each, according to a filing with Brazil's regulator. With each unit representing 55 common shares and 50 preferred shares. The offering was increased from a planned 525 million to 600 million units so that investor demand could be met. Santander's US traded stock was priced at $13.50 each. Santander following a series of acquisitions is Brazil's third largest bank after Itau Unibanco and Bradesco, having a 10.2% market share. It is also the largest IPO for Brazil. The growing demand for emerging market securities is evident in the rate at which the Bovespa Brazil Index jumped in 2009.

Two realities are affecting exchanges. One is that trading commodities and derivatives is a $600 trillion business worldwide and is more profitable than trading in corporate shares. This shows in the value of ICE and NYSE in the stock market. In April 2011 ICE was valued at $1.5 billion less than NYSE, in Dec 2012 ICE was valued at $4 billion more that NYSE as it makes its bid to merge with NYSE. The other is that the Dodd-Frank financial system overhaul in the U.S. after the 2008 financial crisis has created a new model for derivatives trading providing advantages to regulated electronic exchanges and clearinghouses that handle derivatives trades with transparency. Jeffrey Sprecher, CEO of ICE, the IntercontinentalExchange, which handles derivatives trading through its clearinghouse operations, says: "For the past decade, our solutions made our markets increasingly electronic and increasingly clear. Today, financial reform is imposing that vision on many markets through a rule-making process." Bart Chilton, a member of the CFTC which regulates derivatives trading says Dodd-Frank legislation supports the business model of derivatives exchanges. This is especially true for Mr Sprecher and ICE. Sprecher has a good relationship with regulators with whom he talks directly, and is supportive of CFTC efforts to close loopholes as he is confident he can make money as long as the rules are clear. His confidence stems from his model which is technology based from day one, with its own clearinghouse and technology based transparency of the ICE data vault, information it shares with regulators. Sprecher stumbled upon this opportunity. He is an executive in the power industry. Working on developing power plants Sprecher found it was difficult for power firms to hedge investments in energy with financial contracts because there was no well organized, clear and transparent market for such contracts. This he set out to do by buying a little know exchange in Atlanta for buying and selling electricity, later getting the the backing of BP, and investment banks such as Goldman Sachs and Morgan Stanley, to form ICE in 2000. Banks liked the idea of a having an organized clear place to buy and sell derivatives in oil and other commodities, and having an alternative to the Chicago Mercantile Exchange in futures trading. Swaps trading under Dodd Frank supervision is converting to old style futures contracts where there is less competition for ICE's futures trading creating new opportunity. ICE setup its own clearinghouse, and acquired the Clearing Corporation, which was the base for a derivative called credit-default swap. To make derivatives trading transparent and reduce systemic risk Dodd-Frank legislation required exchanges to provide information to data warehouses which would then share the information with regulators. ICE setup its own data warehouse to do this called ICE Trade Vault. Dood-Frank rules envisioned the formation of clearinghouses and exchange such a ICE to provide a clear process, transparency and reduce systemic risk in derivatives trading. ICE under Sprecher by making this vision its own and using technology has created new opportunity. ...

FR24 points out that it is not that unusual to see prosecution of French former presidents and prime ministers for campaign financing irregularities or putting political party officials on public payrolls. It shows that this happened to president Chirac, president Sarkozy, and prime minister Fillon. In fact former prime minister Fillon was doing well in the elections after the presidency of Socialist president Hollande. The revelation that he had put his wife on public payroll as parliamentary assistant with little work led to Mr. Macron taking his place as the leading candidate. No jail terms were served for these charges under French law. Here it is important to note that French law limits spending on election campaigns to 22 million euros and Sarkozy exceeded that number. In the US and India there are no such strict limits. So are France's leaders that much worse than the American leaders who spend and collect money lavishly? Or in India where the campaign financing has the result of making it hard to build the infrastructure desperately needed by a young aspiring population. Framers of the Indian constitution including Gandhi and Nehru intent on getting the British out never realized that political parties would look to public funds as ways to finance their campaigns, leaving less for the intended purpose of building roads and bridges making the country a poor place to invest in and entrenching underdevelopment and poverty.  In the US tech companies in Silicon Valley or banks in New York and Silicon Valley, pharmaceutical companies and companies in other sectors, are able to gain monopoly positions or favored regulatory setups for their industries by funding election campaigns for Congress. When this results in egregious behaviour such as the 2009 financial crisis or the current banking crisis this behaviour causes severe damage to ordinary Americans much worse than what Mr Chirac or Sarkozy were prosecuted for.  South Korea has a long history of prosecuting former presidents. Three presidents have been prosecuted so far. One president served as much as five years for a jail term. ...

A major British and Indian collaboration and scientific achievement of both countries is not given the recognition it should get because of mismanaged communication of the results of clinical trials. Tom Whipple science editor of The Times says do not make the mistake of thinking oh Pfizer vaccine scores a 9 out of 10 and Oxford's a 7 or 8 out of 10. Pfizer vaccine says it 94% effective. But this is only part of the story. It is the first exam paper in a long number of exam papers and the final score will require scoring them all. "Oxford vaccine is complex, and we are happy with the complexity," says Adrian Hill, Oxford researcher and head of the Jenner Institute. It is not highly unusual in this complex field for a half first dose to work better than a full first dose in a two dose vaccine treatment. This happened with the Oxford vaccine. As a result the study results were harder to communicate. This happened by accident. Much of medical research and much of medicine's biggest breakthroughs in the last 200 years happened by accident, as one researcher looked for something and accidentally discovered something else profoundly useful. Whipple's points are turning out to be true now that Britain's medicine regulator has asked that Pfizer vaccine not be given to people with history of allergic reactions after 2 NHS workers had strong allergic reactions. A lot of questions remain for all vaccines. How long will the protection last? WIll it prevent transmission of coronavirus? Are there any other complications? Which vaccines can work without ultralow refrigeration storage? Ahead lie the prospect of billions of doses. Two are in final stages in India including Bharat Biotech request for emergency authorization. Johnson & Johnson has a competing one to Pfizer's in the U.S. As many as 30 are being developed in India and 100 around the world. Countries like South Korea say they will wait to find out which one works best and where cost overall combined with benefit is attractive. Some of the vaccines are coming out only weeks apart. The early ones could stumble, if something was missed. ...

Janet Yellen preceded Mr. Powell as Fed chairman, to head the U.S. central bank. Mr. Powell has warned that it took 8 or 9 years for the Fed policies to work to get tighter labor markets where minorities and other less advantaged groups could find employment. A better solution has to be found. Crises should be anticipated and prevented such as the mortgage crisis of 2009- banks, business, regulators in government, bank policy and political leaders all have a responsibility to ensure this. A mediocre leadership in each field alone could have led to the crisis of this magnitude in 2009. The pandemic is a second blow to these same groups in society struggling to make a living and has added many more. Two large whole sections of society were hurt in the rescue from that banking debacle with shoddy mortgages. The rescue involved low interest rates and the offshoot effect of this was to reduce the return on savings of people in retirement or close to retirement who in the past could depend on interest rates of somewhere between 5 to 8% annually to increase their savings over a decade. The high costs of medical care as a result of artificially inflated medical costs and poor managing of this cost are a burden for this section of society- with diminished savings from both low interest rates and loss of employment from the financial crisis. The young people with high tuition burdens were the other section of society hit hard. Tuition costs are also out of control similar to medical costs, putting great burdens on whole sections of society in an unconscionable way for a society that claims to be "for the people." Mr. Mnuchin, Mr. Trump's Treasury Secretary, did not have a close understanding with Mr. Powell. As Mr. Powell enters the last year of his term as Fed chairman, his close relationship with Ms. Yellen at Treasury is seen in a positive way by the WSJ. Powell worked at Treasury in the 1990's. After 2012 to 2018 both Powell and Yellen were at the Federal Reserve, working closely and having adjacent offices. Will this duo make a difference? ...

The authors, Becker, Davis and Murphy, are from the University of Chicago. They point out that the uncertainty created by the Obama administration's programs including healthcare and social investments in education, energy conservation, and the desire to reduce carbon emissions, all tend to slow business expansion and investments to create jobs by putting additional costs on business. The expanding federal deficit and national debt also create additional uncertainty. Their point is that it was a mistake to start making major changes to transform the U.S. economy at this time, and that it would have been wiser to do these changes after the economy had recovered completely from the crisis. All efforts they say should have been concentrated on establishing conditions for a strong recovery. When combined with the lack of regulatory reforms to fix problems left behind from the crisis, and other failures, serious questions arise about how things will turn out in coming years. The head of failed bank HBOS or Halifax Bank of Scotland, which needed $17 billion of British taxpayer money, and was merged with Lloyds Bank after heavy losses, is Sir James Crosby. In a strange turn of events he ends up as a trusted advisor to Prime Minister Brown and becomes deputy chairman of the Financial Services Authority, Britain's regulatory agency. Sir James obviously knighted, obtained the appointment to FSA in 2006 when HBOS was growing rapidly, the losses came in 2008. But just as in the USA some of the people who were in the financial institutions or in regulatory agencies where alot of bad judgement or lack of necessary fiscal prudence was exercized, are still in positions that have as their principal task getting the US or Britain out of this crisis in financial institutions. In this case a House of Commons' committee investigating the banking crisis released written testimony that Sir Crosby summarily fired one of his executives Paul Moore after warning that HBOS bank was moving too fast in acquiring billions of dollars in new debt. One line in the Moore testimony is telling in its description of what happened at HBOS, as it must have in a host of other places in the US and Europe: " Sadly, no one wanted to speak up for fear of stepping out of line with the rest of the lemmings who were busy organizing themselves to run over the edge of the cliff behind the pied pper CEO's and exectuive teams that were being paid so much to play that tune and take them in that direction." End result, Crosby resigns his position before Prime Minister Brown is embarrassed and faces tumult and questions in the British House of Commons....

It is not clear whether Citigroup is off the problem list of banks, banks which rate a 4 or a 5 on the scale of 1 to 5. This could change even now after the stress tests. Here's why. Since late 2007, Citigroup has more than $50 billion in write-downs and loan defaults. The recent stress test of the 19 largest banks produced results that showed additional large losses looming over Citigroup, and questions are raised how Citigroup passed. The test found that estimated losses could reach $104.7 billion in loan losses through 2010 under the government's worst case scenario, and face nearly $20 billion in losses on its credit card portfolio. Yet the Fed's conclusion that Citigroup needed to bolster its capital by only $5.5 billion to withstand another economic shock did not reflect these facts. Investors and analysts also saw Citigroup as being in much worse shape than the other banks. THe FDIC did not agree with the Fed's conclusion. Only the Comptroller of the Currency agrees with Citigroup CEO Pandit, that the Citi model is not broken and just needs more time. THe FDIC wanted the rating lowered for the Citibank unit, and sparred with the Comptroller of the Currency over this. The FDIC has 305 banks on the "problem" list, and would like to add Citigroup to this list, so that it could keep a tighter review of what is going on at Citigroup. FDIC is helping finance a $300 billion loss sharing agreement with Citigroup, and has large exposure to Citigroup. FDIC's Bair thinks Citigroup has not moved fast enough to get rid of unwanted assets which might cause problems if the economy deteriorates, and would like to see a change in management. FDIC officials have approached former US Bancorp CEO, Mr Grundhofer, who is highly regarded in the industry, as a possible replacement. One reason being that while most of the problems of Citi stem from consumer loans, Pandit's experience is in investment banking, and he has not moved fast enough to get rid of risky and unwanted assets. He has failed to bring in managers with experience in handling the kinds of problems Citigroup faces in this crisis. With the FDIC's Bair having anticipated the crisis earlier than other regulators, the FDIC is expected to get additional powers in the new regulatory structure. This may result in tighter supervision of Citigroup. It also shows gaps and flaws in the stress tests that let some banks off too lightly, and make them vulnerable to the next episode in this crisis. ...

The IMF predicts UK budget deficit at 13.2% of GDP in 2010. And that public debt could hit 98% of GDP by 2014. Ctigroup expects that inflation will be 3.4% in 2010 and the expectation is that the Bank of England will raise interest rates before the ECB or the Federal Reserve. The large deficits and debt are affecting the value of the pound which is in steady decline.

John Taylor, says Obama and Alan Krueger (Obama's new head of the U.S. Council of Economic Advisors), said some of the same things in early September, 2011, that were part of Obama's old plan to revive the U.S. economy. And the old plan has failed to produce results. The part that puts construction crews to work on the roads, railways and airports was tried earlier in the stimulus plan. Because of a lack of showel ready projects, and the state governments putting most of the money in their state coffers, this only increased infrastructure by a miniscule 0.05 percent of GDP, according to research by Taylor and John Cogan. Taylor's sees the moves by the Obama administration and the Bernanke Fed as not only being ineffective, but having the opposite effect of lowering investment and consumption demand through increased concerns about the federal debt, another financial crisis or the risk of inflation or deflation. The U.S. private sector has the money to make the investments that create jobs but their concerns have led to holding back. Taylor points to the need for a comprehensive economic strategy to replace these temporary interventions. The debt limit agreement of 2011 is a part of this strategy, and he agrees with reducing spending in a gradual way in a weak economy. The other parts of this strategy he says are entitlement reform, tax reform, regulatory reform, monetary reform, including a reappraisal of the role of government in the economy. This should lead to a more stable and predictable economic environment and reduced uncertainty about the future, which is critical to improving supply and demand....

Snowden tells the WP's Gellman he feels vindicated by Judge Leon's describing the NSA security surveillance of phone records as "Orwellian" and the president's own panel calling for changes. He says he brought the same issues up for review by his superiors at the NSA. His goal says Snowden was for the public to have a say in the expanding information collection by the NSA, as the normal processes of review by Congress and the Foreign Intelligence Surveillance Court had failed. For Snowden personally this meant making a decision in unknown territory not knowing how the public would respond, and what impelled him to act was the idea that doing something was better than the alternative of doing nothing.He says he considered the fear that the public would be apathetic- as it turns out the public has been anything but apathetic. After 9/11 defense and security officials operated on the basis that complete knowledge of information about U.S. and foreign citizens was needed, this gives the public an opportunity to test that assumption and see if that is itself a problem in a free society and too high a price to pay. Considering that Al Qaeda and other movements in the Middle East are a result of past U.S. support to dictators and autocratic regimes which have turned some parts of Islamist movements into forces hostile to the U.S., changes in U.S. policies to support freely elected governments are a better solution than hyper extensive policing and surveillance- defeating the problem at the source. That process has already been underway in the U.S.-in the media, and with policies supporting freely elected governments encouraging the people in the Middle East to decide their own future. With the change in policies bringing Arab and Muslim opinion on the side of the U.S. that chapter of hostility to the U.S. may be closed and a new chapter opened, making this an opportune time to close the chapter of hyper surveillance and return to surveillance that does not violate U.S. citizens right to privacy. Technology also played a part making such hyper surveillance possible- such as collecting the entire Library of Congress information in less than 15 seconds- and Congress and the Surveillance Court failing to address the issues raised by techonological advances, similiar to the way the S.E.C. and regulatory agencies failed to keep up with the changes in the financial system till after the 2008 financial crisis....

Uber and Lyft, ride-hailing apps are adding to the traffic in downtown areas of major cities in the U.S. It is getting worse to the point where cities are looking for ways to ease the congestion in downtown areas of Chicago, San Francisco, New York, New fees are being enacted in these cities on Uber and Lyft, and regulators are also considering fees. The problem is that ride sharing apps customers prefer not to pool or share rides as the ride sharing apps said they would to prevent congestion. Another problem is that Uber and Lyft are actually pulling people away from buses, subways and walking creating new waves of congestion and poor utilization of public transportation designed to ease travel for most of the post war period. Worse they are not supporting healthy living because it is harder to walk on traffic congested streets and some people become lazy and just grab a ride rather than walk a short distance or walk to public transportation. Another issue is that an estimated 40% of the time the Uber and Lyft drivers in major cities cruise around for fares without passengers. San Francisco county officials have found in a study that over 60% of the slowdown of traffic speeds in San Francisco between 2010 and 2016 was due to the introduction of ride hailing apps. In Chicago, the policy director in the mayor's office says there is exponential growth in traffic congestion from these ride hailing apps.  A December report by the California Air Resources Board found that ride- hailing cars are driving with no passengers 39% of the time, and New York city estimates cruising at 41%. Mr. Schaller, a New York City official who has studied this issue says surveys in many cities show about 60% of riders in Uber and Lyft would have walked, biked or taken public transit or stayed home if a ride hail car was'nt available. More and more so called disruption by Silicon Valley in the interest of rapid and chaotic growth is looking like a bad thing, says this report in the WSJ, creating a whole new set of problems. What is not even understood here is the vast misallocation of resources, the billions of dollars that could have improved public transportation, bike paths and other means of getting around, improvements in cities downtowns to make them friendlier and with new park spaces with those dollars invested there instead of in ride hailing apps.   ...

John Steele Gordon has done a good job of covering the history of banking in the United States since the days of Alexander Hamilton. One of his books is "Hamilton's Blessing", describing the first effort to set up a central bank in the US, the Bank f the United States, modeled on the Bank of England. Here he describes the resistance by Jeffersonians and their successors like Andrew Jackson who did not understand the purpose served by a good central bank and did everything to either dissolve it or to not give it the powers and the authority and the staffing that it needed. It was not till after the crisis of 1907 in which JP Morgan acted as the central bank in loaning his own money to prevent a bank and financial panic and collapse, that the first central bank the Federal Reserve was set up in 1913. Even then it was not given the authority and powers and staffing needed to command the economy in panic or financial collapse which happened in 1931. Part of the reason the crises were less frequent after 1931 is because of a better understanding of economics and also because of the Federal Reserve's ability to step in during a crisis. What went wrong in the 1990's with the S&L crisis and in 2008? Gordon points to a system of undue political influence as one big problem. And the lack of a unified, coherent regulatory system free of undue polticial influence. Both in the 1990's and in 2008 Congress and the regulatory authorites failed to keep undue political influence from distorting and damaging the financial system. In the 2008 crisis ideology simply componded the problem as deregulation and dependence on free markets without any checks simply compounded the problem into its huge dimensions. ...

In the current situation where the "too big to fail" problem for banks has only worsened since the crisis with the remaining banks even larger after mergers, and no dividing wall between speculative trading in securities and the utility banking of collecting deposits and making loans, the country depends on regulators to do the job of supervision. Regulatory reforms have faced resistance from the banking industry and the reforms have been watered down in Congress. It is in this environment that Patrick Parkinson takes on the job of head of bank supervision at the Federal Reserve. He will work with Daniel Tarullo, the Fed governor who heads the committee of governors overseeing bank supervision. But he is also one of the old faces at the Fed when the Fed failed in its role of bank supervision. From 1993 to 1998 he was the top staff advisor to the Fed chairman, for matters considered by the President's Working Group on Financial Markets.

Citigroup is in negotiations with the New York state Attorney general's office, the SEC and other state securities regulators for alleged fraud in the marketing and sales of auction-rate securities, and for wrongly telling customers that the securities were safe and liquid and cash-equivalent. Mr. Cuomo the NY state Attorney General's office said that Citigroup failed to tell investors that from August 2007 until early 2008 the market for auction-rate securities was kept afloat primarily because the bank placed bids in auctions for the securities. UBS also faces similiar charges. If Citigroup reaches an agreement it could be forced to spend more than $5 billion to buy out individuals, charities and other investors whose cash is tied up in the frozen auction-rate securities market, and it could face a fine of $100 million.
