WIth China reluctant to make concessions on agricultural imports at a recent Shanghai meeting of Mr. Lighthizer with Chinese trade representatives, the trade dispute with China has escalated. Mr. Lighthizer had little to show Mr. Trump at a meeting in the WHite House. After a 2 hour meeting Mr. Trump told his advisers that his patience was wearing thin. His response on what the U.S. should do- "tariffs." A tweet was prepared saying U.S. would place import duties of 10% on imports of additional $300 billion in Chinese goods. China responded by lowering its currency value to 7 to the dollar to offset the import duties. China also said it was suspending all agricultural imports of U.S. farm products. The U.S. designating China as a currency manipulator.  The situation today is that there is a level of mistrust between president Xi and his advisers and Mr. Trump and his team. The situation has taken a new turn with China saying the U.S. is supporting protests in Hong Kong. President Trump has stated China is waiting it out to deal with a new administration in Washington. Both sides do not see any solutions till after the U.S. elections in 2020. For China there is also the upcoming 70th anniversary of the People's Republic. ...

Chandrachud. He was giving the Nani Palkhivala Memorial Lecture in Mumbai.  Prime minister Modi could not pursue India's rapid development program to benefit all parts of society without the help of the Supreme Court in interpreting the Constitution in a way that supports India's development. "The identity of the Indian Constitution has evolved through the interaction of Indian citizens with the Constitution and has been accompanied by judicial interpretation... If you look at the Constitution, it does not favor unbounded economic liberalism. Rather, our Constitution seeks to find the right balance. When individuals can exercize their liberties and to be fairly rewarded for their efforts, then economic justice becomes one of the many inter-related dimensions of life. Ultimately, we share common faiths and destinies to the point that development of each individual fosters social justice in the entire world." "The basic structure doctrine of India's Constitution is that it guides and gives certain direction to its interpreters and implementers, when the path is convoluted. The craftsmanship of a judge lies in interpreting the text of the Constitution with the changing times while keeping its soul intact." This happened when Nani Palkhivala presented the idea before the Supreme Court in 1973 against prime minister Indira Gandhi's Emergency rule that parliament had limits to its powers when it came to amending the Constitution if by amending it the amendment would destroy the spirit of the Constitution or its basic idea. This includes freedom of expression, rule of law, separation of powers, freedoms guaranteed to all citizens. The amending power is limited and cannot be turned into an absolute power. Another way of looking at it is that parliament itself is organized by statutory authority. And it cannot destroy or dismantle the very basic features of the law (the Constitution) that created it in the first place.     ...

The 2016 Republican platform is written to express the ideas in the Republican Party for family values, child rearing using the Bible and traditional values, calling pornography a "public health crisis."  The Family Research Council and tradition or family focussed groups played an important role in writing it, with Mr. Trump playing less of a role. Instead of "physical barrier" with Mexico, it says "a wall"  should be built in a taking up Trump's idea, but in general it is a clear expressing of traditional family values that Republicans have supported for years and expressed frustration with the movement of social lives in an opposite direction. The same sex marraige decision by the Supreme Court and transgender debate were not present in 2012 election, so in that sense the Republicans see the country as moving in a different direction. More of the pendulum having swung too far in another direction is how Republicans perceive it, and their response is to go back to how things used to be and the world they knew, based on what they see as positive outcomes for the whole of society. Hence language that encourages teaching of the Bible in public schools, condemning pornography as a menace particularly for children, and insisting on "man made laws being consistent with God given natural rights." In his State of the Union speech president Trump was off on some points such as how many jobs were created, how good the economy is, and on on safety of cities El Paso and San Diego after border walls and fencing, according to the WSJ. El Paso was the second safest city of twenty similar sized cities in the U.S. before the border wall with Mexico, and continued to be that way after the wall was built over that section. San Diego has seen 91% drop in border apprehensions over a decade after fencing the border but this has not meant a discernible impact on people crossing illegally.  Mr. Trump was right that customs duties increased by $13 billion in the third quarter of 2018 after placing tariffs on $250 billion of Chinese goods. Wages are growing faster for manufacturing and construction workers than service occupations, as Trump claimed. On the growth of the economy the economy GDP grew by 3.5% in 2018 before slowing down by the end of the year. India and China's growth in GDP is much faster. Growth in jobs was at the pace in the first 2 years of the Trump administration in some 2 year periods of the Obama administration, and much faster in manufacturing in the 1990's, says the WSJ.   ...

Only Canada and China are holding back because of the imbalance in trade heavily in their favor and a failure to see that it is about fairness. In the EU only Germany has a surplus many nations have a deficit, it seeks to start negotiating at the first opportunity. Contrary to what most of the American and British media says Lighhizer and Jamieson have thought this thing through for many years before arriving at the Tariffs advice they gave the US president as his 2 USTR. It is these two not the president acting on his own whim as the media like to show. And Lighthizer has done this before- as Deputy USTR in the 1980 with Japan on the opposite side and come out of it with winning solutions for the US and for the world.

This Editorial Board view in the WSJ asks what does it say when Mr. Biden beats Mr. Trump 44% to 41% even with Mr. Biden's low ratings of 33% in the Siena/New York Times poll, and Republicans looking good in the upcoming midterms to win both the Senate and the House. It says so far most of the recent elections for seats in the Senate and the House have shown that Trump backed candidates have not done well with one or two exceptions. It cites elections for two Congressional seats in Georgia where Democrats prevailed against Trump backed candidates.  It says Trumps position that the election was stolen is not going to help Republicans. That Democrats are keen on keeping the attention on Mr. Trump and not on inflation through events such as the January 6 hearings on the Capitol attacks. The WSJ editorial board opinion is offered in the spirit of free markets and free people from Jefferson's Declaration and Adam Smith's Wealth of Nations. Yet it is a complete misreading of Adam Smith as Smith had a social side which called for corporate interests of that time such as the East India Company of Britain to behave in a responsible manner with public interests and social sentiment in mind. Smith also sought to preserve the national interest of Britain and its role as dominant power. Whereas for for three decades WSJ is taking enormous risks with the national interest of the US in remaining a dominant industrial power. No one at the WSJ can explain how this can be done by shipping out the manufacturing industrial capacity and technological knowhow of any Nation, especially the United States over 3 decades. Worse it risks the entire period and the ideas of the awakening in Europe in ideas and science that powered the Industrial Revolution, that did not happen in Asia,  and led to so many of the advances in science and industry that we enjoy today, and share with large Asian nations China and India. That amazing period of awakening and the Industrial Revolution and its achievements is not part of the collective memory of the nations of Asia, of China India and Japan, and this kind of attitude of neglect of this essential part of our mindset and makeup in the US and Europe, acts to our detriment, and to the detriment of China, India and Japan. ...

US has a $11 billion surplus in $148 billion two way trade with UK which is just ahead of India and behind Vietnam in trade with the US. Vietnam has acted as aproxy for Chinese exports to US something the DJT administration is taking action to correct. UK first 100,000 cars exported to US will not face a 25% levy, and UK exports will only face the 10% levy on all countries, including on British aluminium and steel. This agreement happened Thursday May 8 after a night call from Trump to Starmer moving up the negotiations to get awin for the US and the UK, that will also act as a model for other countries to reach trade agreements with the US. India, Japan, South Korea, could be next followed by EU. It also opens up engagement with China on a trade agreement. UK's Starmer thanked president Trump. The agreement was a first and it boosts stock markets in the US, shows the US can do this. ...
