India's Supreme Court ruled that Vodafone PLC does not owe $2.2 billion in taxes on the acquisition of a majority stake in Hutchison Essar Ltd. The Indian tax authorites were directed to return 25 billion rupees ($500 million) which Vodafone had deposited. With declining foreign investment in India and a lower growth rate of about 7%, this tax case had assumed larger significance. The Supreme Court decision emphasized that taxing Vodafone "would amount to imposing capital punishment for capital investment." Vodafone had difficulties in its Indian operations- a $3.4 billion impairment charge in May 2010 because of strong competition. Vodafone is estimated to have invested $26 billion in India since 2007, and in the fiscal year ending March 2011 showed only $115 million in profit on sales of $3.86 billion.

Bush, says there is every likelihood that the new government in Egypt after the departure of Mubarak will be non-Islamist and committed to a free and democratic Egypt. Theresa May becomes the only candidate for leadership of the Conservative Party after Ms Leadsom withdraws from the race. No leadership vote will no take place with Conservative Party members and no early general election is planned. May is expected to become prime minister of Britain by July 12, replacing David Cameron. Her theme is for "one Britain" and to do away with the rising inequality and gap between London and the rest of the country, which was part of the anxiety of voters who voted 52% for Brexit on issues of immigration burden on social and health services, national sovereignty, and a sense of ordinary people being neglected by elites in both parties. May will invoke Article 50 to leave the European Union and begin a 2 year period of negotiations only after she has developed a clear negotiating strategy. Kenneth Clarke, a Conservative Party cabinet minister called May a "bloody difficult woman," but this did not affect May, who said Mr Juncker of the EU was the one who would find this out in negotiations.  What is significant for Britain is May's moderate position coupled with a clear goal for removing some of the causes of the inequity in British society, which is needed for Britain to remain united. She called on companies like Amazon, Google and others to pay their fair share of taxes, and made clear her intent to strengthen the mechanisms for controlling executive pay. Also part of this strategy will be a more effective immigration control policy, which she did not implement vigorously as Home Secretary in the Cameron government, partly because of constraints set by EU membership. May made clear her agenda going forward by saying: "There is a growing divide between a more prosperous older generation and a struggling younger generation. And there is a gaping chasm between wealthy London and the rest of the country."  Changes May is supporting are to make executive pay rules to become binding not just advisory, and for employees and consumers to gain seats on company boards.  ...

This opinion piece in De Zeit says there are different ways to look at Chancellor Merkel's refugee policy, as a failure, as an act of compassion, influenced by her experience in East Germany, her Christian upbringing as a daughter of a pastor, or Germany playing a role in Europe after Barrack Obama failed to provide American leadership in the refugee crisis. It says some of this commentary in the media ignores the fact that it was always the intention to accept a large number of migrants as part of a policy of European humanism in the face of misery of refugees, but to carefully manage this influx, to reduce the flow of refugees, and wind down the flow by vigorously addressing the causes. From this point of view the commentary about Merkel's failure is overdone. It is interesting that some of the weirder descriptions describe Germans conscious of the history as being outpatients in a American clinic closed down by president Obama. In any case American presidents have overreached, consider Reagan and Bush with German's strong or cautious reaction, and underreached with Obama providing cause for concern and efforts to fill in for a missing American role, with both roles difficult to fill for Germany by itself. America is not defined by its presidents and its politics alone, but by its own history, which has reflected the same values since the founding fathers Jefferson and Washington. Germany's policy has merely reflected these same values, at a time when the U.S. was simply taking a pause from its foreign involvements in regions fragmented by tribal, religious and other divisions. In doing so being the true partner it was its intention to be. ...

Elliott Abrams quotes former President George Bush from November 2003 when he asked the question: "Are the peoples of the Middle East somehow beyond the reach of liberty? Are millions of men and women and children condemned by history or culture to live in despotism? Are they alone never to know freedom and never even to have a choice in the matter?" Abrams, former deputy natonal security advisor for President Bush, says the autocratic regimes and dictators of the Middle East have offered a false choice to the US- its us or the Islamists. Roger Cohen also points this out in a recent article in the New York Times. For Tunisia he says this was never defensible. It is a largely secular nation with a literacy rate of 75% and per capita GDP of $9,500, and Ben Ali, the dictator of Tunisia, jailed moderates, human rights advocates, editors, anyone who represented hope and change. Abrams says Mubarak has done the same in Egypt. And he warns that if you make moderate politics impossible as Mubarak in Egypt and Ben Ali in Tunisia have done, then you make extremism more likely. Ruling by emergency decree for decades creates a real emergency, as has happened in Egypt. Bush made that speech at the 20th anniversary of the National Endowment for Democracy, and he reminded Americans that "sixty years of Western nations excusing and accomodating the lack of freedom in the Middle East did nothing to make us safe- because in the long run, stability cannot be purchased at the expense of liberty." He admits that the Bush administration did not always conduct US diplomacy in this vein, but the President took the lead and the Obama administration's abandonment of that mindset is nothing short of a tragedy. Obama's policy of "engagement" actually endangers the US position as a supporter of liberty and freedom wherever it is stifled or muffled, because it turned a blind eye to the people themselves as it engaged with the dictatorial regimes in the Arab world and other countries. When the elections in Iran were stolen the Obama administration hesitated, waffled in its committment to liberty, fearing that it would affect nuclear negotiations. Obama did not -as of late Friday night Jan 28, 2011- call for free elections or clearly demand democracy. The law school analytical processes that Obama brings to the presidency and the demands of geopolitical diplomacy are impervious to the loud voices demanding freedom in countries denied liberty. Obama has forgotten the very same voices he passionately heard when he wrote in his first book that in the words "we hold these truths to be self-evident" he could hear the spirit of Douglas and Delaney, as well as Jefferson and Lincoln, the struggles of Martin and Malcolm and unheralded marchers to bring the words to life. He could hear the words of interned Japanese families, the voices of Russian Jews in lower East side sweatshops, of dust bowl farmers during the depression, all these voices clamoring for recognition and asking the question about what is community and how it can be reconciled with freedom. This failure to recognize these voices clamoring for freedom and economic opportunity is all the more striking because it was vision and a bold sense of purpose that energized the Obama campaign and both the vision and the bold sense have eluded the administration. Abrams calls for a clear unequivocal committment by the US government in favor of freedom and peaceful efforts to achieve it in the Middle East, because he says that as the demonstrators are telling the world outside supporting freedom is the best policy of all. ...

A NYT series on the forgotten men and women of the second world war includes stories on black women breaking the logjam of 17 million pieces of mail in Britain ready to be sent to allied soldiers in Europe. Read about Captain Adams from South Carolina who is the first black woman in the officer corps of the American Women's Auxiliary Corps, part of the American Army by 1944. By 1942 General Dwight Eisenhower had already found an equal role for black men in the war and American forces. He also included a role for black women in roles such as that facing Captain Adams whose unit made critical contributions to getting the mail to allied soldiers fighting in Europe. This included sorting mail in Birmingham, England, in difficult conditions, and in France as the Battle of the Bulge took place in France with heavy casualties, and after the war ended in 1945 in Rouen, France. Mail meant life and death correspondence between loved ones when there were no phones with connections we have today. In this sense it was a role that had great significance. These women worked 7 days a week, round the clock, in rotating shifts. It was an activity that meant as much to the army as anything else. ...

Sheila Bair leaves behind a much stronger FDIC. William Isaac, a former FDIC chairman says she has had a positive effect on the agency by raising its profile and energy level. Under the Dodd-Frank financial reform legislation FDIC now has the powers to take over large complex financial institutions that are in serious trouble. Mr Gruenberg, who succeeds Ms Bair, has worked closely with her at FDIC. Jim Wigand, heads the new Office of Complex Financial institutions at the FDIC. One of the powers given by the legislation is for FDIC to have its examiners at financial firms to go over operations, providing backup supervision to the Federal Reserve and the Office of the Comptroller of the Currency. According to FDIC officials analysts should be in place at financial firms the FDIC oversees during the next 12 months. The FDIC is also working on a rule requiring banks with assets larger than $50 billion and other large nonbank financial firms to provide a "living will," a plan that would help regulators speedily and cleanly wind down a firm in a future financial crisis. In March 2011 the FDIC approved a draft rule requiring firms to submit these plans, along with regular updates and reports on the firms' current credit exposure. Ms. Bair says the proposal will be completed in August. Bair has also put in place FDIC managers with considerable experience who can continue the work of strengthening the regulatory system she started in 2006. Fuel efficiency rules require average fuel efficiency in the U.S. of 35 mpg by 2016. The debate is now on what to do for 2017 to 2025. New technology such as the P2 systems for hybrids already used in VW, Nissan and Hyundai vehicles makes a 20% increase in fuel efficiency possible. Large investments are being made to bring new technology to bear on increasing fuel efficiency significantly. Government agencies are looking at different scenarios by which the new fuel economy standards beyond 2017-2025 could be set between 47 mpg and 62 mpg. An additional factor is the reduction in greenhouse gas emissions- at 47 mpg the reduction would be 3%, at 62 mpg the reduction would be 6%. Another factor is how much the impact is on the cost of vehicles and reduced cost on gasoline. Here there is a wide range in the numbers for average mpg rules at 62 mpg- with EPA estimates at $2800-$3500 increase in vehicle cost and $5000 savings in fuel cost, Centre for Automotive Research estimates at $9790 increase in vehicle cost. The 62 mpg translates into "real world" actual efficiency of 45 mpg. In April 2011, 17 senators put out a letter of support for the 62 mpg proposal. There is a public value involved in this that is also significant- the reduced dependence on foreign oil means savings in defense expenditures in parts of the Middle East, and an economy that is less impacted by volatility in the price of oil. As this aspect of public value or benefits cannot be quantified easily even though they are significant, this may tend to be lost in the debate and the politics of fuel efficiency. For automakers there is significant marketing value in having a visible and strong presence in fuel efficient vehicles because of perception as forward looking- something that hurt Detroit carmakers in the last decade. During periods of gasoline prices at $5 a gallon this provides carmakers with an extra cushion of safety in securing car sales. Carmakers in one country such as the U.S. also have to worry about what carmakers in other countries such as Japan and Germany are doing- if the standards in the U.S. develop a gap compared to other countries developing advanced fuel efficiency technologies this poses significant risks because of the global nature of the automobile marketplace. Many of these less quantifiable factors do not get the attention they deserve because they are significant from experience but not easily quantified. Throw into this the large unknown of what new technologies not yet developed lie ahead with a burst of effort by one country or another, which bring cost reductions at the same time - and the debate requires as much a good sense of what is the path offering the greatest advantages in years ahead than a pure exercize in numbers. ...

Its also complicating the military situation as the political situation shows noone in charge and the military of Pakistan negotiating a separate truce with border militant organizations that are making attacks in Afghanistan complicating life for Karzai, President of Afghanistan and NATO's mission there.

Jair Bolsonaro, a former army officer, is expected to win by a large margin in the runoff election in Brazil against Fernando Haddad of the Brazil Workers Party. Crime, corruption including the Car Wash scandal involving the state oil company and politicians, a deep recession with the fall of commodity prices, have led to a shift in Brazil away from the Workers Party. Polls from Datafolha show about 60% of the vote in runoff going to Bolsanaro. About 30% of supporters say they are voting for something new after the deep recession and failure in providing government services with no money in the budget for adequate spending on infrastructure and services, education and health.  Both the centrist PSDB and the Workers Party that came in following the shift to civilian rule from military dictatorship in the mid-80's failed to win a significant part of the vote. The conservative PSL party only had 5 seats in the outgoing 313 seat house showing the deep dissatisfaction with the existing Congress and politicians in Brazil. Crime is a big issue with 64,000 deaths in Brazil in the last year, with failures in government services, including a failure to tackle a yellow fever epidemic over 2 years, are other issues that have led to the change in the mood of the voters in Brazil. ...

The small segment of society in Pakistan that controls business, has large agricultural holdings, and the politicians in parliament, all benefit from a system in which they pay very little in taxes. These groups draw the maximum benefit from their privileged position. According to a transparency promotion organization in Pakistan, the average member of parliament in Pakistan has net worth of over $900,000 and pays little in taxes. A senior tax offical says the tax revenues in 2009 were the lowest in the country's history. According to Pakistan's tax rules income taxes are owed by anyone making more than $3,488 a year. Analysts estimate that of the 10 million who should be paying taxes only 2.5 million are actually paying taxes. And the tax collection is extremely poor, so that less than 2% of the population of 170 million pay taxes, with tax collection as a percent of GDP among the lowest in the world. Pakistan's laws do not allow questioning of money transferred from abroad, so a lot of money can be channeled to Dubai and brought back into Pakistan. This is important becuase the burden of this falls on the poor, in the appalling quality of infrastructure and public services, and the widening gap in the quality of life of most people in the country compared to the affluent few. ...

Labor in the U.S. stood firm in its opposition to bills in Congress granting fast track trade authority and promoting the TPP trade agreement. The bill failed to clear the House of Representatives as labor unions lobbied hard against the legislation. For the first time public sector unions of teachers, firefighters, and other service workers actively worked with industrial labor unions. This is a result of a realization in labor unions that the decline of communities with the closing of plants reduces the demand for public sector workers, and reduces the revenues of cities leading to cuts in services for firefighters, teachers. The low wages in manufacturing with globalization, also reduces the support of factory workers for higher wages for teachers, firefighters and other public sector workers. Also adding to support for workers is the realization that the investment in infrastructure is now a higher priority, as experts say most of the gains in trade are already behind us. A general feeling that the decline in U.S. manufacturing is not good for the country, the difficulty of competing with countries which do not enforce rules for fair practice and treatment of workers, and a general sense that the lowering of wages in manufacturing is both hurting the middle class and increasing inequality, also have created support in the media....
