Different constitutional law opinions on the option of the President citing the 14th Amendment to the U.S. Constitution to raise the debt ceiling. Former President Clinton says he would unilaterally invoke it "without hesitation, and force the courts to stop me." President Obama said recently, "I have talked to my lawyers, they are not persuaded that this is a winning argument." Section 4 of this Amendment was designed to assure creditors the Union debts after the Civil War would be honored and to say Confederate debts would not be honored. This part of the 14th Amendment says "the validity of the public debt of the United States, authorized by law, including debts incurred for pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned." Prof. Jack Balkin of Yale, says it provides a broader principle that the public debt cannot be held hostage for political purposes. His view is that this is something that could be an option when all other options are exhausted. Prof. Lawrence Tribe of Harvard, say the law courts have no plausible point of entry in such a situation. There is a sense that "popular constitutionalism" would play an important part if something like this happened- the meaning of the constitution is what popular sentiment says it is in the particular context and events. ...

70% of the world's internet traffic goes through 6 miles of land in Ashburn, Virgina, that is called Data Center Alley. This part of northern Virginia is filled with data centers that generate tax revenue for local communities. Culpepper where 17 year old George Washington worked as a Surveyor in the 1740's is one of these counties with data centers. Nearby 90 miles from Washington DC is Rappahannock County, which has rejected this development and not increased its population of about 8000 people for decades. WSJ looks at this part of rural Virginia where civil war battles took place.

Efforts to bring better wages and conditions to fast food business  through a law passed by Governor Newsom in California, to bring upward mobility and integration into the mainstream of society for millions of American families and children being opposed by McDonald's and Starbucks. Current wages are $15 a week which would bring a typical fast food worker $30,000 a year for a 40 hour week for 50 weeks. The poverty level for a family of five is $32,470 on the Healthcare.gov site for the USA. Are fast food business corporations saying that children of these families should be kept forever at below the poverty level set by the American government? Why? Are they saying that labor is subordinate to capital? Are they then going to go further to say that upward mobility shall forever be denied to millions of children in these families? On what grounds? Republicans say they are the party of Lincoln. Something more- What did Lincoln fight the Civil war for? The plantation economy of the South also denied labour and children of labour the rights of upward mobility. How did Lincoln win the civil war? By speaking up for the rights of free men everywhere in a land of abundant land and new future. "This is essentially a People's contest. On the side of the Union it is a struggle for maintaining in the world, that form and substance and government, whose leading object is to elevate the condition of men- to lift artificial weights from all shoulders- to clear the path of laudable pursuit for all- to afford all, an unfettered start, and a fair chance in the race of life. Yielding to partial, and temporary departures, from necessity, this is the leading object of the government for whose existence we contend." July 4, 1861, Special Message to a special session of the US Congress. "Our adversaries have adopted some Declarations of Independence; in which unlike the old one, penned by Jefferson, they omit the words " all men are created equal."  Why? They have adopted a temporary national constitution, in the preamble of which unlike our  good old one signed by Washington, they omit "We, the People" and substitute "We, the deputies of the sovereign and independent States." Serious problems are ailing the television channels in the US. This is because the siloing of channels into political spaces as audiences converge to watch particular channels is resulting in these channels unable to take positions based on the merits of issues. Climate change is one example- today no television channel in the US asks the question what would happen to the climate if the US loses another 4 years 2024-2028 in dealing with the climate challenge- makes no investment in climate change action. This is a grave and serious matter that needs to be at the top of discussions alongside the forest fires and floods that show up at the top of news pages every day. This is now the central issue at one of the channels as James Murdoch and his wife Kathryn ask this question of their own family business in television channels in the US and Europe. This is also a larger issue facing the television business.  Another issue is that internet business such as Twitter X, Facebook, TikTok are also concerned with ratings, and think mistakenly that being neutral about climate change action is acceptable, that it is someone else's problem, not theirs. It would cost upwards of 1 trillion dollars in 2028 for the US to simply to address the climate change problems arising from no action for the next 4 years. The problem may become hard to control by then regardless of how much money is put into tackling it, making life difficult on this planet. ...

Most agree that American students deserve the same opportunities. The need for a global response to a global problems not a lot of local solutions is the subject of this article by Dr. Larry Brilliant, who for 7 years 1973-80 worked with the World Health Organization to eradicate smallpox globally. 1. Action for a global response-The WHO can act as the vehicle for action globally-  restructure it and empower it to do the job. Put the right people in place who have the confidence globally. Set a new pandemic treaty and put it in place. 2.  Get a more advanced version of the mRNA vaccine which does not need a cold chain. India is reportedly working on one. Put funds and people in place for vaccine drives in poor countries.  Other action needed is learning from the situation in South Africa where the HIV patients are reported by Stephanie Nolan in NYT to have been more susceptible to mutations of the new variant. How can resources be put in place in poor countries so that patients in vulnerable populations get their medicines regularly, and are vaccinated. Overall how can these populations have the vaccine supplies needed- including ones without cold chain suggested by Larry Brilliant, potentially through vaccine work in India. Can international teams be developed with developed countries in Europe and US financing the effort and India offering its manpower and knowhow?   ...

In a Fox News Interview with Sean Hannity Venezuela's Opposition leader Maria Corina Machado says her stand-in Edmundo Gonzalez won by 70% of the vote in the 2024 election. In 2026 she says she would get 90% of the vote. She tells Hannity:  "I do want to say today, on behalf of the Venezuelan people, how grateful we are for his courageous mission.” She wants to share the Nobel Peace Prize with DJT.   Secretary of State Marco Rubio, points out that one reason the US is working through the interim leadership is that most of the Opposition has left Venezuela. DJT has said "it would be very tough" for Machado to become the leader of Venezuela because of the military, gangs and other militias that Chavez and Maduro have created that would disrupt the country's transition. DJT's view is that “We have to fix the country first. You can’t have an election. There’s no way the people could even vote...No, it’s going to take a period of time. We have — we have to nurse the country back to health." The key is maintaining the county's stability after Maduro and this is what the US president intends to do first. Secretary of State Marco Rubio pointed to this, that most of the Opposition is now outside Venezuela, sadly. Rubio told NBC Meet the Press - “We are dealing with the immediate reality. The immediate reality is that, unfortunately and sadly, but unfortunately the vast majority of the opposition is no longer present inside of Venezuela. We have short-term things that have to be addressed right away.”  For getting the right result to restore Venezuela and the US to carry out the Monroe Doctrine in the best possible way- the US is taking each step carefully to achieve good results well into the future. ...

The eight member panel of experts led by a retired judge gets high marks from the youth movement, and all oppositon parties. All have a good grasp of the legal theory to build a good system of democratic processes with checks and balances and necessary protections. The chief of the panel, Tareq-el-Bishri, is a retired senior judge, and an author of a book titled: "Egypt: Between Disobedience and Decay." Bishri wants to see prosecutions done in civilian courts, and wants a balance of power between government institutions. Members of the Youth Movement say they encouraged military leaders to setup the tasks of writing a new constitution in several steps, the first being rewriting the key articles and holding an up or down referendum. It was felt that a better constitution would emerge once elections were held, and enough time and debate could occur for the new constitution.

The Stimson Center looks at the closing of an era of Conservative politics in Japan which ended in 2025 after the death of Shinzo Abe and the 2 year premiership of Kishida. Interview is conducted by the Stimson Center of a senior Japanese political figure with 30 years of experience in the Foreign Service, and the author of the only English language book on Shinzo Abe, reflecting the paucity of research on Japan. Shinzo Abe was premier for a short time in 2005-2006 and for a full term in 2012. He made changes to Japan's SDF, its partnership with India, Australia in the Quad, and his economic policy which increased women's participation in the economy. For the first time in post war Japan there was a new sensde of confidence under Abe and he is missed sorely in Japan today. Yet as this senior Japanese politician says, Japan has changed the way the US and Europe have changed, and nationalist politics are replacing old Conservative politics of the LDP. In a way also how the deindustrialization of US, Europe and Japan has also taken place discrediting that era. Takaichi Sanae is itself a representative of the new era, as she did not hesitate to say Japan would get involved if China attacked Taiwan. Her popularity is at 62% and she has called a snap election, as she came in to replace Shigeru Ishiba in October 2025 and was not directly elected PM. Yet in the long view this is also a misconception because neither the Stimson Center or the interview participants had a keen sense of who Abe really was and Abe's grasp of the history of the Kamakura period of Buddhist Japan and China, India, of the 12th century before the foreign invasions from the north. One of Shinzo Abe's biggest legacies is the relationship that was close to his heart, the relationship with India and prime minister Modi. This week chancellor Merz of the Federal Republic of Germany was at the kite festival with PM Modi in Ahmedabad and at the Sabarmati Ashram of Gandhiji. The same degree of warmth shown by the German leader and Modi reflecting Vivekananda's time in Germany, was seen long time back between Modi and Abe. The bullet train project Mumbai to Ahmedabad and the ones that follow across India are a testimony to the warmth shown by Abe for India, and his knowledge of history from the Buddhist period in India when by the 12th century in Japan in Dogen's time Tenjiku (India) was the sacred homeland of Buddhism. Today India has revived the Buddhist traditions and centers of Buddhism, the universities and research centers for Buddhism from that period in Indian history. Buddhism started in India near Nepal in what is now Bihar state at Sarnath and Kushinagar, and spread through China to Japan and Korea. The whole continent of Asia would reflect Buddhist ideals and ideas without the intervening period of Vedic culture in India and China's Mongolian and Manchurian northern invasions, and the periods of European colonialism. Today Buddhism and The Bhagavad Gita are itself strung like pearls on a string as the Gita itself says, part of the long spiritual traditions of three nations- India, China and Japan, and of the many others Vietnam and Korea. ("All these worlds have their rest in me as many pearls on a string." -Mascaro tr. of Bhagavad Gita, Penguin). As Asian nations and peoples come to their own inner selves, find their inmost self, this is the culture that really pervades all of Asia. ...

The Russian position for a ceasefire in Ukraine and peace talks is set forth by president Putin. "Our principled position is that state of Ukraine must be neutral, non aligned and free of nuclear weapons." Putin wants Ukraine to give up Donetsk, Luhansk, Kherson and Zaporizhzhia regions, Russian speaking regions in the east of Ukraine. Capitals of Kherson and Zaporizhzhia regions and some of the territory is controlled by Ukraine today. It means that Russia could accept a ceasefire under the present lines of control. It also means Ukraine would not be part of NATO, though it could be part of the European Union, as a peace settlement. All western sanctions on Russia would have to be lifted. Throughout the decade of this war Russia has maintained close connections to the Russian speaking eastern part of Ukraine with historically close ties to Russia and as Ukraine public opinion shifted to the EU Russia began its efforts to bring these regions under its control even when German-Russian relations were better during Merkel years. Russia has the support of China and Brazil in its position. At some point if a settlement is reached one possibility is that the line of actual control or LAC would be put in place. It happened in the Korean War, when the demilitarized zone was setup and in other conflicts on the Indian border with China and Pakistan, in Cyprus between Greece and Turkey. For it to happen Russia will have to dispel fears in the EU and the US that Russia will continue the conflict at some later stage till all its objectives are achieved. This requires removing the perception that Putin is set on achieving all his objectives to reopen the war at some later stage. Mr. Putin hinted at this by saying "today we are making a concrete real peace proposal," and adding that Russia was not ''talking about freezing the conflict, but its final resolution." In this situation it is the western doubt about Putin's intentions that is another barrier to a settlement on European security, with continued destruction in Ukraine when the war has entered a stalemate where both sides have exhausted their resources and have little to gain by prolonging this conflict. ...

Following president Trump's decision to increase tariffs on $200 billion of Chinese goods on May 9, 2019, the WSJ looks at the mistakes made by both sides in misjudging each other's negotiating position. Mr. Trump says he is willing to increase the pressure on China by imposing tariffs on all Chinese imports into the U.S. after what he sees as China reneging on its commitments on trade by deleting key sections on enforcement provisions and Chinese legislation for enforcement to take place in the 150 page agreement prepared for both presidents to sign.  Early on in the negotiations between Liu He and Mr. Lighthizer, China misread the thinking on the U.S. side. Chinese thinking was that president Trump's urging for the Federal Reserve to lower rates was a perception sign of the weakening U.S. economy. It also may have misread the extent to which Mr. Trump trusts Mr. Robert Lighthizer, who Mr. Trump respects for winning a good deal with the Japanese in similar situation of Japanese rejection of U.S. demands. Mr. Trump also thinks the U.S. has a strong economy, is the largest world producer of oil, strong economic growth in the last quarter of 2018, is also negotiating better deals with other countries including the ones with Mexico, Canada and South Korea. It is also much less dependent on exports to China, giving it a stronger position with more experienced negotiators. China has whole sectors of its economy dependent on exports to the U.S., and crucial numbers of jobs at stake.  China also misread the signals from its stronger than expected economic growth from stimulus efforts in the last quarter, leading to it staking out a tougher position than the U.S. would accept. The U.S. position was set after decades of waiting for China to change and was unlikely to be affected by any temporary considerations.  As a result the U.S. not anticipating the Chinese response of deleting key sections agreed to in advance from the 150 page written agreement gave a strong response. Mr. Mnuchin who accompanied Lighthizer in talks says Mr. Lighthizer "read them the riot act" to the Chinese side. For the Chinese side the effort now shifted to continuing good faith talks without appearing to back down. ...

For 150 years before 1965 the US only opened up for Europeans immigrating to the US. The changes since 1965 coincided with deindustrializationn of the US and the failure of the governing class to do anything about the steady shipping out the nation's manufacturing sector to China. Which is why there is so much anxiety about America's position in the world and a sense of a culture that is being lost- of Robert Frost's poetry set in New Hampshire, of Shakespeare's plays and morals for Western civilization, of the values of Emerson and Thoreau that guided Gandhiji and other Asian leaders. ...

About the idea that Helmut Kohl's fourth term as chancellor being not good for Germany and for the CDU, Merkel responds that she has given it considerable thought. She found that she still has the intellectual curiosity to learn new things, understands that she has much to learn about how the country and the world is changing. This has been decisive in her decision to run.  Merkel believes that someone who has worked in politics should be able to work in private industry following historic practice in Germany. On the government links with the automobile industry Merkel says her approach has been to look at what was best for an industry employing 800,000 people in Germany, yet deplores the diesel emissions cheating at VW. Has democracy lost momentum after the U.S. elections and the refugee crisis? Merkel says democracy is still strong, and that she will do everything to strengthen democracy in Germany and other parts of the world.  Merkel's view is that it is important that there be counterweights in democratic systems. In this way democracy is strong in America, and also in Poland and Hungary. The chancellor cites high voter turnout of 82% in 1998, 79% in 2002, 78% in 2009. Since then she says in 2009 it dropped to 71% and 2013  72%, yet  expects that with the issues in this election people will come out to vote in larger numbers.  For many years Merkel is seen as co-opting the issues of the left parties and the SPD, being careful to move to the centre. Der Spiegel puts this idea forward to the chancellor by asking her if she is the best SPD chancellor Germany ever had.  In her matter of fact style Merkel responds that voters do not think of it this way, simply expect her to her job as best as she can possibly do it.       ...

India plays a critical role with the US, Australia and Japan to ensure international law and open shipping lanes for all nations in the Indo-Pacific. Jaishankar also touches on infrastructure developments such as the new Trilateral Highway that connects India's northeast to Burma and Thailand. This opens up ties on land between the three nations with connections into Malaysia and Indonesia. That would enhance the movement open people and goods, and cultural connect that would create a new northeast- southeast Asian connection. It restores what was the long lost connection that India once had with nations from Thailand to Indonesia, and Vietnam to Japan through China. This is the connection that brought Buddhism from India's north east in Bihar and Uttar Pradesh to these countries.  Look East, Act East, the Quad, Indo-Pacific Economic Framework are all ways of saying the same thing of making the East connections the vital ones in India's social, economic and political, cultural life, restoring the connections in which India thrived and existed as one entity. It also brings life to the Gulf countries which are otherwise isolated in a sea of European nations on one side of the Mediterranean and Russia on the other side near the Black Sea that have different historical interests and cultures. This sees the central Asian connections through Afghanistan as being secondary and of less significance in the long history of nations such as India, China, Korea and Japan from the Buddhist era. That secondary connection brought an interruption of the long Buddhism and Vedanta civilization in India, intermittent wars, and the division of the country under the British Empire. It is a natural progression in a long history that seeks to restore the natural and intuitive connections to the Vedanta and Buddhist regions in the East that are part of the Indo-Pacific. These are now integrated with the settlers from Britain who sought to build better and fairer societies based on the rights of man in the new nations of Australia and America. This gives new life and meaning to this vast Indo-Pacific region. The British Empire and the other colonial empires simply bring back an orientation to the period of colonial wars of the nineteenth and twentieth century, which tore apart China and then Japan, and used resources in India for these wars, and which ended with the atomic bomb in Hiroshima and Nagasaki. These wars also leave behind memories in China, Indonesia, Vietnam, Japan and Korea that can only be truly be put behind by looking at Vedanta and Buddhist Asia as it once was from India to China to Japan. And to the regions of Australia and the US that brought new meaning to the modern scientific period and the rights of man in settler societies away from Europe. ...

A shift in priorities away from focussing on high growth to lower sustainable growth was announced by China's premier Wen Jiabao at the National People's Congress, China's parliament, in March 2012. This shift will reduce investment in infrastructure, power generation and exports, which will affect the level of imports of commodities from commodity producing nations in the Middle East, Australia, Canada and Brazil. It should increase imports of software, computers, entertainment, tourism and high tech goods from the U.S. and Europe. Chinese leaders have said they would make this kind of shift for some years now but growth has consistently increased more than the target rate, and domestic consumption as a percentage of the economy has actually decreased in the last decade. Now 9-10% growth rates may be a thing of the past and the target of 7.5% set this year may be actually closer to the real figure. The Chinese leaders have belatedly realized the need to make these changes now because slowing markets in Europe -which is seeing declining growth and high unemployment- and in the U.S., make the issue impossible to avoid. Wen told the Congress: "Accelerating the transformation of the pattern of economc development... is both a long term task and our most pressing task at present... Domestically it has become more urgent but also more difficult... to alleviate the problem of unbalanced, uncoordinated and unsustainable development." This is his way of saying that its unavoidable and better to start in earnest now, and at the same time recognizing the resistance to change from the stateowned companies and the other interests who have benefitted from surging growth, and now occupy a central role in the power structure. An opinion article in the People's Daily, China's official newspaper, said: "imperfect reforms are to be preferred to a crisis caused by no reforms." The World Bank's president Zoellick is respected by the Chinese leaders. He also urged them to make changes now. The recent report of the DRC, China's planning research arm, and the World Bank, also laid out the new direction away from a focus on infrastructure to domestic consumption. The fear is sudden deceleration in the absence of policy action. The impact of this will be negative for commodities over time, leading to slower growth in Australia, Brazil, and Canada. It should boost imports from Europe and the U.S. of high tech, consumer, pharmaceutical goods over time....

Lee, Nicholas and Harris of the WSJ describe the responses being considered by president Obama to Russia's hacking of DNC, and other cyberattacks during the U.S. presidential election. Obama said the goal will be "to send a clear message to Russia or others not to do this to us because we can do stuff to you." He said some of this would be done publicly and other things would be done where the Russians know but not everybody else. Mr. McFaul, a former ambassador to Russia, is cited here saying that declassification of intelligence by president Obama in the remaining weeks in office is needed so that all ambiguity about Russian involvement is removed.
