I mean, it seems that it might be directly applicable. You have a claimed source in IEEPA that had never before been used to justify tariffs. No one has argued that it does until this -- this particular case. Congress uses tariffs in other provisions but -- but not here. And yet -- and correct me on this if I'm not right about it -- the justification is being used for a power to impose tariffs on any product from any country for -- in any amount for any length of time. That seems like -- I'm not suggesting it's not there, but it does seem like that's major authority, and the basis for the claim seems to be a misfit. So why doesn't it apply again? GENERAL SAUER: Well, we agree that it's a major power, but it's in the context of a statute that is explicitly conferring major powers, that the point of the statute is to confer major powers to address major questions, which are emergencies. So it would be unusual... And another excerpt from the hearings on fentanyl- JUSTICE KAGAN: And, in fact, you know, we've had cases recently which deals with the President's emergency powers, and it turns out we're in emergencies everything all the time about, like, half the world. GENERAL SAUER: Well, this particular emergency is particularly existential, as Executive Order 14257 says, and, of course, no one disputes the existential nature of the fentanyl crisis, which, you know, we had an agreement last week to create progress on, which illustrates the effectiveness of the tariffs tool (this refers to the agrement with China last week by Nov 1 that cuts the 20% tariff from 20% to 10% if China completely cuts off flow of fentanyl from inside its borders.)  Clearly some in the US have not grasped the existential nature of the fentanyl crisis, a crisis of proportions so great that it would be an existential crisis for any nation. A concentration of the world's manufacturing in one nation with a trade surplus of $1 trillion with the world is also an emergency that extends into the existential sphere. ...

Strong growth in Europe and Japan and in the rest of Asia plus the weaker dollar which has energized exports will help the US to handle the housing crisis. Asian countries will be less affected than before because of a surging trade between Asia and Europe, Europe just passed the US as China's leading trade partner this year, as well as trade between Asian countries which is also surging. Still if consumer spending is impacted heavily it will affect big export oriented economies in Asia to some extent. Its interesting how the mortgage securities that were passed on from the US to Europe, show up also in the holdings of the likes of Mizuho bank in Japan.

In the interests of a stable government and for rapid development in the state on an unprecedented scale the position of Chief Minister was given to a smaller party with 51 members in the Assembly of Maharashtra. The BJP party the larger party in the new coalition has 106 members in the State Assembly. Mr. Eknath Shinde was sworn in as Chief minister and Mr. Fadnavis of the BJP was made Deputy chief minister based on the understanding of leaders in the federal government in New Delhi on the best way to move Maharashtra forward as a leader in economic and infrastructure development in India. Maharashtra and the capital city of Bombay once the commercial capital of British India has a difficult history of post independence politics. With Nehru's Congress party giving way to George Fernandes trade unionism after 1967 and after 1986 a movement led by Bal Thackeray that sought to give local Marathi youth jobs preference in Mumbai. Lacking the capital, technology and the industrial expertise for development on an American scale, much of this political arrangement has failed to meet the growing aspirations of the young people of Maharashtra and of India. These reasons motivated the federal government to put more emphasis on the "karya karta" or "good worker" principle itself than on the position of chief minister. Much of the rapid development will take place under the leadership of the most competent IAS Indian civil service officers selected for the largest infrastructure projects and the leaders of Indian industry, making the old conception of chief minister redundant. The focus shifts to who can get things done to meet aspirations for Maharashtra 2030 and how it will compare with Uttar Pradesh 2030, or Tamilnadu 2030. How will Metro rail, Bullet trains and Semiconductor Parks, Logistics networks and Exports in the new supply chain the US and EU is setting up in Asia, how will all this look in the 3 states in 2030? This will become clear in 2023 as development accelerates to what India needs. ...

Sweden stands as a success story with growth of 5.5% in 2010, and Citigroup estimates expected growth of 5% in 2011. Sweden has significant export growth to the rest of Europe and emerging markets. The Swedish currency has appreciated significantly to 8.76 krona to the euro and 6.52 against the US dollar. Compared to China Sweden has not limited the appreciation in the currency, as the prime minister Fredrik Reinfeldt believes that currencies should be "market valued." The central bank raised the interest rates three times in 2010 to 1.25 %, pushing the krona up by 14% against the euro. Sweden aims to double exports to $310 billion by 2015, according to Trade Minister Ewa Bjoerling. International sales of Swedish companies drive the growth in exports. Truck maker Volvo AB's Asia sales were up 50% in the first 9 months, and Electrolux AB's sales went up by 11% in the fourth quarter.

There is only one way to interpret this. Putin and Russian influence have calmed down the Israel Iran war. DJT opening up discussions and talking to both Russia and China has created a sense in both countries that their vital interests are with the US, China on a trade agreement with the US, and Russia for a settlement of the Ukraine war on terms that it sees as fair. There is the issue of nuclear non-proliferation on which US, Russia, China, India, Germany and the EU, and the rest of the world are in agreement which meant action to end Iran's nuclear program. Putin met with Iranian Foreign Minister and looked for a way to end the war. Putin said: “This gives us a chance to…think together about how it would be possible to get out of this situation,” said Putin. From the point of view of a safer planet Biden's period of not talking to China during the balloon incident, and not talking to Russia with a single minded focus on Ukraine conflict, can be seen as not the way a responsible world power should act. DJT's emphasis to end the wars in the Middle East yet standing firm on Israel's right to exist and the non proliferation of nuclear weapons, and working to end the war on Ukraine by puting pressure on all countries, is proving to be an approach that gives all world powers a chance to reflect truly on their obligations to their peoples and the people of the world. Progressive caucus in the US House of Representatives led by Pramila Jaypal, a first time Indian American Congresswoman defeats an attempt by Josh Gottheimer of the Problem Solvers caucus to separate much of the president Biden's agenda in health, education and social policy and risk it being defeated by Senators Manchin and Sinema in the US Senate. Without the efforts on child care, education and health, climate change and social services part of the Biden Workers and Families Plan much of the Biden agenda would remain unfinished and Democratic party promises not kept. This also means that Manchin a Senator from West Virginia with a population of 1.8 million and Arizona with a population of 7.2 million, both conservative leaning Democrats could sink the entire agenda of president Biden to support American families and workers for a population of 331 million people. That two states with a population of less than 3% of the American population could sink the entire agenda of president Biden shows how fragile a situation has been created within the Democratic party to support workers and families even during the pandemic following the leadership of Carter, Clinton, and Obama Ms. Jaypal, a three term Congresswoman from Seattle, Washington state, was first elected in 2016 with an endorsement from Bernie Sanders who was the Democratic Party's leading candidate for president till the late stages of the 2020 US presidential primaries. Bernie Sanders says of Jaypal- "I think she is doing an extraordinary job. And I think the Progressive Caucus is doing an extraordinary job." Sanders founded the Progressive caucus after getting elected to the Senate from Vermont 30 years ago. Even though it is hard to imagine the Democratic party being the Democratic party without bold policies in climate change, affordable housing, reducing income disparities,  investing big in childcare, education and healthcare, attempts were being made to sink the entire Democratic party and national agenda going back to Franklin Roosevelt. Jaypal is described in the WSJ as diplomatic and firm, saying "I am so proud of our caucus; I have never seen our caucus so strong. And I am a very good vote counter also." Fifty members of the 100 member Progressive Caucus held firm in support of president Biden's original agenda without which the president would have little to show in keeping promises he made to the American people in the election and little to differentiate him from Mr. Trump who also supported infrastructure spending. Separating the infrastructure bill would have risked sinking Mr. Biden's plan for recovery of America from the pandemic and the devastating policies pursued by American presidents in the last two decades. Policies by previous presidents that have impoverished the country, created huge income disparities, weakened America in the world in trade and technological leadership, and wasted resources in foreign wars. There are no centrists or far left- these are just labels. When Ms Japal said "Let's just remember the Speaker (Nancy Pelosi) is a great champion of this agenda. I think she was trying to do as much as she could to get this done," she could have said it is Mr. Biden's own agenda pushed forward with conviction to help workers and families during the pandemic, and build a solid American recovery, restore American leadership in the world. Pramila Japypal is the first Indian American woman in the US Congress, and one of only two dozen naturalized American citizens in the US Congress. That she could play such a critical role for good in the US Congress shows that with the right convictions, determination, experience, much can be done for the common good in America and the world.   ...

Media accounts have given so much attention to the Nixon Feb. 1972 visit to China that most people may be unaware that this was just an important yet small beginning. The significance of what happened after 1972 is not fully understood. In 1973 the US liasion Office was setup in Beijing and China's liasion office in Washington DC.  Beyond this not much happened. Why? In 1972 election year the Watergate scandal started in June of that year only 4 months after the Nixon China visit. Nixon was too engaged with fighting impeachment that there was not much followup to the visit to China. In 1974 Nixon resigned and Gerald Ford became president. Till Carter became president in 1976 and in 1977 negotiations began to upgrade relations with premier Deng Xiaoping visiting the US in 1979. In China too a lot was happening. Mao was hospitalized in 1972 during Nixon's visit to China, the reason for the urgency on the Chinese side. In 1976 within a few months first premier Chou en lai and then chairman Mao passed away. A power struggle led to the head of the Military Commission Deng taking control. It was not till 1977 under Jimmy Carter 5 years after 1972 that China began full normalization, gained diplomatic recognition as the People's Republic of China and trade, cultural contacts were started.   ...

The Obama administration's proposed budget for fiscal 2013- for the year beginning Oct. 1, 2012- shows the budget deficit for the year at over $1 trillion. It shows new revenue of $1.7 trillion over 10 years mostly from ending the Bush period tax cuts on families earning more than $250,000 a year, restoring the estate tax to the 2009 level and limiting subsidies for oil and gas companies. It proposes raising the tax rate on dividends from 15% to as much as 39.6%, for households earning more than $250,000 a year. This measure is expected to generate $206 billion over 10 years. The budget also offers "principles" for future tax reform by proposing the Buffett rule replace the Alternative Minimum Tax (AMT). The AMT was not indexed for inflation so it has the weakness of putting more middle class taxpayers into AMT, leading to temporary solutions by Congress. The Buffett rule would have people earning more than $1 million pay a tax rate of at least 30%. Many wealthy Americans like Mitt Romney paid lower taxes using deductions to lower tax rates- Romney's tax disclosures show he paid effective tax rate of 14%. The White House says the budget will reduce the deficit by $3 trillion over 10 years through the new taxes, and small changes to Medicare and Medicaid and other spending cuts. This is in addition to the $1 trillion in spending cuts agreed to in a deficit reduction agreement in 2011 between Democrats and Republicans in Congress. The budget proposal proposes investment in education and transportation projects of $137 billion, and continuing through Dec. 2012, a tax break for businesses to increase investment. It includes mandatory spending of $2.7 billion for new community college programs, $6 billion to modernize schools, and $1.8 billion to make homes more energy efficient. It also increases the resources of the Securities and Exchange Commission and the CFTC (two agencies overseeing the banks), $26 million for a new Interagency Trade Enforcement Center to counter unfair trade practices, and cuts U.S. postal delivery to 5 days a week. The result is a program designed to be balanced in terms of economic fairness, making modest investments in the future for education and energy, continuing policies to stimulate growth, and extending the date for bringing the deficit under control to 2018 instead of 2014 as planned earlier....

COFCO is the abbreviation for China National Cereals, Oil and Foodstuffs Corporation, which was the state company importing grain and other staple foods into China during the period before China opened up its economy. It is now a dominant company in China's grain and other staple products from edible oil, dairy products to bacon and beer. Under CEO Ning Gaoning, Cofco has transformed itself since 2004 from primarily being a grain importer to value added products, food processing, and technologies in the food business. Cofco is expanding rapidly overseas with deals and acqusitions, and has about $10 billion in state funds for acquisitions. Recent acquisitions include $2.7 billion for Dutch grain trader Nidera BV, and 51% ownership of Noble agricultural unit. Earlier acquisitions include vineyards in Chile and France in 2010, and Australia's Tully Sugar in 2011. Current plans are for acquisitions in the U.S. and Latin America. Revenues in 2014 were an estimated $63.3 billion. Interviews with cane farmers that are part of Tully Sugar in Australia show Cofco has managed the company well and won the support of farmers....

India like China is more interested in modernization that brings equality with Europe and America so that the period of misfortunes that struck India and China- as a result of the vastly superior technology and force of Europe as it found a passage to the East around the Cape of Good Hope- is over.  Think about this. If anything happened to democracy and pluralism in the US Indian democracy and pluralism would still be standing a hundred years down the road or the next hundred years after that. What does that say about India? Why? Because India has learnt its lessons under Vivekananda, Tilak, Gandhiji, Modiji, and understands the need for technology, trade and modernization, which is what Modi as a Gujarati with the trading mentality like the British is really after. The so called Hinduism as it is really about the Upanishads and the Gita and the Buddha, and Communism, are really not the driving force in India or China.The Upanishads and Bhagavad Gita like the Bible offer a way an ethos to resolutely fight the corruption and leakages of funds that take the investments out of modernization leaving everyone poor. And India also benefits when democracy works and acts as an enabling force for a modern economy that creates "a rising tide that lifts all boats" (people). Democracy is the tool for development and to tackle diversity of 1.4 billion people. Adam Smith was right writing then in the 1780's around the French revolutionary period and American independence - "Hereafter perhaps the natives of these countries (India, China, Indonesia) may grow stronger, or those of Europe grow weaker, and the inhabitants of all the different quarters of the world may arrive at the equality of courage and force, which by inspiring mutual fear, can alone overawe the injustice of independent nations into respect for one another." India's leaders fought hard after the 1700's for preserving independence from the Portuguese, the Dutch and the British, only they were divided. Ranjit Singh in the north fought the Mughals and the British in the Punjab. The Marathas on the western front fought the Mughals and the British. The result as Gandhi points out in Hind Swaraj in his question "who made the British Company Bahadur?" It was Indian princely kingdoms vying for support from the armies of the British East India Company interested in profits from seizing Indian princely treasuries and trade. Note that Sri Lanka or Ceylon fell to the Portuguese in 1505. The technology gap between Europe and Asia had opened up even that early by 1500's in ship building, in warships and use of maritime navigation technologies. Consider that in 1534 Jacques Cartier was out on his first trips from St Malo, France across Atlantic to explore past Newfoundland to the mouth of the St Lawrence river. The Portuguese and then the Dutch had already beaten the British and the French by 100 years- Britain's exploration of India through East India settlements in Bengal began much later in the 1600's. India like China built around river based civilizations as Adam Smith points out in his Wealth of Nations, Chapter 7, Part 3, America and East Indies-of the natives of India and China Smith says their struck "a dreadful misfortune" that arisen more by accident, that "the superiority of force seemed to be so great on the side of the Europeans, that they were able to commit with impunity every sort of injustice in these remote countries." Every Indian or Chinese will agree with this so great was the misfortune for India and China from the injustice of European nations in the 19th century so much so that Cordell Hull speaking for Franklin Roosevelt and all Americans broadcast to the world in the throes of World War II in 1942 America's call to the world for a new world order based on freedom and development for all nations of Asia, Africa and Latin America. America's Secretary of State Cordell Hull said: "In this vast struggle, we, Americans, stand united with those who, like ourselves, are fighting for the preservation of their freedom; with those who are fighting to regain the freedom of which they have been brutally deprived; with those who are fighting for the opportunity to achieve freedom."     ...

The South China Morning Post, SCMP, looks at China at the 40th year of the great economic experiment  that changed China. This started with the Deng reforms by the then Chinese leader that opened up the economy in 1978. As this report points out in 1978 Deng Xiaoping's efforts at loosening the state control of the economy and business was actually a way to get out from the effects of the Cultural Revolution and prevent another Cultural Revolution. Deng was removed from office during the Cultural Revolution. Instead of unquestioned acceptance of Mao the new criterion was "Practice is the Sole Criterion for Testing Truth." In economic and business matters this was followed so that if it worked then the experiment was expanded, gradually giving life to the Chinese model of state capitalism, economic expansion under the state with the state supporting state corporations that operate in a market economy.  This means the Communist Party was to continue its control but with experimentation away from the planned economy in the coastal provinces of Guangdong and Fujian, and then into Shanghai. Experts close to Jiang Zemin, the next leader after Deng, say China's Communist state would not have survived without the changes started by premier Deng. Farmers still did not own the land but they were free to plant and own the yields for their efforts.  Deng established the Three Benefits Principle in 1992 trip to Guangdong, whatever helped increase productivity, increased the strength of the country and improved living standards was good, you did not judge it by whether it was socialist or capitalist. Jiang Zemin's work was to follow Deng's ideas and help negotiate the entry into World Trade Organization and set up the new economic regulations. Capitalists were allowed to join the Communist Party for the first time. State and local government ownership of land was turned into an advantage as this provided one of the critical inputs in terms of land for setting up new factories, with capital coming from savings, and other inputs of technology and investment coming from the U.S. after entry into the WTO brought American and European companies to China. A steady supply of labor poured in from the countryside and urbanization became a goal of Chinese development policies. Today India and other countries in Africa, Latin America, can look at the Chinese experience and effort and look for ways to modernize, urbanize and improve living standards, productivity and strength of their economy. One key is to experiment and look for what works that can then be expanded to other locations, and build on the advantages that may open up as the experiment makes progress. Following entry into WTO China was able to take advantage of overseas markets and build an edge in manufacturing, something that was not evident even in 1992.   ...

After the Phase 1 trade deal with China led to cancellation of new tariffs on computers, mobile phones and the remaining products imported from China, tariffs are still in place on $370 billion of imports from China. President Trump says China agreed to import $32 billion of agricultural goods, with the figures reaching $50 billion in 2020. The prior high was $26 billion in 2012. This comes as a big relief for the agricultural farm sector which had 24% more bankruptcies in 2019. Farmers are now more likely to vote for president Trump as they did in the last election. In addition China agreed to buy $200 billion more of American goods over the next 2 years. This combined with the USMCA agreement to replace NAFTA, for North American trade, is good news for president Trump and for the U.S. economy for 2% annual growth. The S&P stock index went up by 29% in 2019. The big concession by China is its agreement to agree to penalties if it does not keep up its part of the bargain.  Intellectual property protection remains a challenge and Mr. Trump may have decided to take a tactical success and shore up his base of farmers and small business people before taking up these issues in the future. China for its part may have decided to make a tactical move of its own as it has nothing to lose in importing more farm products from the U.S. in exchange for being able to continue to make the computers, iPhones and tech products it manufactures, just like before. China has not conceded much in terms of its goals set  in "Made in China 2025." Both sides are taking a much needed pause to consolidate their positions, as the fundamental differences remain to be tackled. Huawei and Chinese technology issue remains as before with the U.S. wary of China's technological gains in 5G telecom equipment and keen on building and protecting America's technological advantage in future trade relations. ...

The Dean of Harvard Medical School says the Health Reform bill gets an "F" grade. He say its disingenuous to call this reform, and Congressmen and the White House are deceiving the public if they attempt to pass this off as reform. What it will do is accelerate health care spending in the US, and the bill has simply postponed most of the major health care problems, especially the ones that drive cost including the fee for service system and delivery of health care.There are no substantial efforts to control the growth in health care costs or improve the quality of care, which makes this effort unacceptable as reform. In his discussions with other health care leaders and economists, Dean Jeffrey Flier, says he has found the opinion unanimous on this point, that whatever the final legislation looks like in Congress, it will only serve to accelerate health care spending rather than contain it. On the present system's failings he is explicit- the current system he says promotes fragmented care making it difficult to assess outcomes, the true costs of care are disguised, and competition based on price and quality is made impossible. The new legislation while expanding access to coverage makes a terrible tradeoff of an accelerated crisis of health care costs and merely continues the current dysfunctional system. The experience of Massachusetts, where access to care was expanded but spending went up, is that this won't work. He points to the Special Commission on Health Care Payment System in Massachusetts recommendation, that the health care system there must be changed from a fee for service system to one with "capitated" payments. So what is really disingenuous about this whole affair? Congressmen making it look as if reform has happened and congratulating themselves on increasing access to health care, when many of the serious problems of funding health care, skyrocketing costs, and a dysfunctional system, have only been kicked further down the road for some future legislators to tackle. With the national debt about 12 trillon dollars when this plan is factored in, this is cause for serious concern. ...

Mike Pompeo, U.S. Secretary of State meets with Tory group of MP's that want to see other issues relating to China tackled following exclusion of Huawei from UK 5G networks, and suspension of the extradition treaty with Hong Kong. This includes 120,000 Chinese students attending British universities and many students involved in advanced scientific research. Both Labour party leaders and Conservative party leaders support taking action to protect British interests relating to sharing sensitive technology, and national security. The U.S. is moving forward with a decoupling of economic relations with China on issues of sensitive technology, transfer of technology,  ownership of American tech companies, manufacturing jobs and regaining industrial strength, and on trade that transfers wealth from America to China. Britain is having to restructure its relations with China based on the general trend in U.S. China relations. China is the UK's 6th destination for exports of goods and services, only 3.6%. U.S. is far larger about 14%. The UK also has one third of its investments overseas going to the U.S. The U.S. has total investments in the UK of 758 billion dollars in 2018, showing that Britain's relationship with the U.S. is very close. ...

Mexico sends 80% of its exports to the US, and China a significant $439 billion in additional exports to US, which makes it incredible that for so long it did not take effective action to stop fentanyl flows, and Mexico allowed migrant trafficking across it's borders through 2016-2024. Even in the face of this becoming an explosive issue in the US with DJT elected in 2016 and the Border Wall being built. A silent but still existing in plain sight idea that the US would tolerate such flows became part of the culture in media outlets in the US and Europe and China and other parts of the world, even when there was a storm of discontent building about manufacturing shipped overseas hurting communities in the US since 2010, with added burden of safety endangered in these neighborhoods from fentanyl, drugs and illegal migrants. What worsened this situation and pain in the US was the idea that somehow it was the US's fault, an incomprehensible disdain for the US, US that enabled the modernization of China, Mexico, and Canada's economies. China sends $439 billion in exports more than the US does to China (US exports $143 billion China $582 billion in 2024). It is only surface presentation of indignation of face saving that these trading partners are showing when the real facts point to an extraordinary and incomprehensible disdain for the US as a nation in decline. There is a feeling in parts of Europe of American disdain for  Europe, without mention of the disdain for the US in Europe, China, Mexico and Canada and other parts of the world. Particularly disdain for neglected communities in the US that have suffered for far too long under previous administrations of Clinton-Bush-Obama with shipping of manufacturing and jobs overseas and inaction on drugs and illegal migrant flows. The EU Canada retaliatory approach has not worked. When DJT proposed doubling the tariffs imposed by US in the face of Canada EU retaliatory steps, the EU and Canada pulled back. Part of the reason is that in the case of Canada it is an economy one tenth the size of the US. The other is that there are real concerns on the US side that Canada EU are not playing fairly in trade. And Canada, Mexico, China, have not stopped the flow of fentanyl into the US.  ...
