Investigators cited in Congressional hearings say the blowout preventor, a 450 ton set of valves, in the BP oil rig explosion and leak, had a dead battery and was leaking hydraulic fluid. It was the last recourse to prevent an accident. The "deadman switch" that is a device used to trigger the preventor if it loses communication with the rig, as it woud in the event of an explosion, did not work because at least one of its two batteries was dead. The leak in the hydraulics that control the valves could have made the valves not able to function as required to shut the well down.

The handling of the oil spill by the Obama administration threatens to permanently affect the image of the Obama administration. There may be a spillover effect from BP's ineptness that draws in Obama's and Interior Secretary Ken Salazar's handling of the crisis. The Obama administration relied too much on BP to bring an end to the crisis. And it has not articulated aclear policy for regulation of technologically sophisticated industries like investment banking, deepwater oil drilling and other industries of this type where alot can go wrong. Tough inspections are needed in these industries and strict regulation for the proper operation of capitalism. Financial regulatory reform bills in Congress also have suffered from being whittled down so that strict regulation is far from being a reality to avoid future crises.

Vice President Biden talks with Charlie Rose and tells hime he thinks BP has done the best they could . Apart from being slow in giving the correct figures about how much oil is coming out of the pipe, Biden says BP as responded to every request of the Obama administration. Charlie Rose specifically asks Biden, hasn't his administration lost its story and isn't it looking more and more like the Carter Administration during the Iranian Crisis. Biden's response is that the President has acted swiftly. Rose asks about the talk of a new norm for unemployment as unemployment remains sticky on the way down, and hiring has not picked up though layoffs have slowed down. Biden's response is that he and Obama don't buy into a new norm and are out to build anew economy. It appears there is a misconnect somewhere between the questions about genuine concerns and the responses.

Judge Richard Leon of the District of Columbia agrees with Senators Wyden, Udall and Heinrich that the NSA's bulk collection of phone data program in the U.S. violates the Fourth Amendment of the U.S. Constitution. This is the first successfu legal challenge to the program. It was put forward by Larry Klayman, a conservative public-interest lawyer. The American Civil Liberties Union has filed a similiar lawsuit in the Southern District of New York. In his ruling Judge Leon, appointed by president Bush in 2002, said: "I cannot imagine a more indiscriminate and arbitrary invasion than this systematic and high tech collection and retention of personal data on virtually every single citizen for purposes of querying and analyzing it without prior judicial approval. Surely such a program infringes on that degree of privacy that the founders enshrined in the Fourth Amendment." Judge Leon stayed his injunction for 6 months so that the government can appeal his ruling because of the national security interests involved. The U.S. government's case was made with the argument that there are no fourth Amendment protections for collection of metadata information such as numbers called and received, date and time and duration as reflected in the 1979 case, Smith v. Maryland. Judge Leon rejected this saying that in the 34 years since that case the whole relationship of people with the phone has changed and the record collection with today's technology reveals a constantly updating picture of a person's life....

Compared with 2007 when participatory notes (p-notes), which provide anonymity for institutional investors, comprised 56% of foreign institutional investment, the p-notes comprise only 15% in 2010. This is good for India as investors are registering as institutional investors and there is less likelihood of speculative capital behaviour, as institutions think longer term. India received $18 billion in stock market investments from overseas investors in 2007, a record amount, and with $11 billion invested so far this will be exceeded in 2010.

The huge risks the misallocated stimulus capital from real estate speculation poses for the Chinese economy. China's government rapidly expanded lending after the 2008 global financial crisis. One estimate is that about 10 trillion yuan in new loans were made in 2009, over twice the amount of 2008, expanding the loan portfolio and money supply by one third. A major problem is vacant homes as Chinese put their money in second homes as an investment. Chinese are not investing in the stock market because of the volatility, and with the low yields in bonds and banks money is going into real estate. According to a Morgan Stanley economist, about 25-30% of private commercial and housing space is vacant. This happens just as middle class Chinese are being priced out of the housing market. Prices went up by 12% in the housing market this year according to the China National Bureau of Statistics. Couples wanting to leave their parent's homes find it difficult to do so. Herbert cites figures from the Center for Labor Market Studies at Northeastern University in Boston which divides households into 10 groups based on annual household income at looks at unemployment levels in eachfot 4th quarter 2009. The highest group with incomes of larger than $150,000 had unemployment of 3.2%, the next group at $100,000 to $149,999 at 4%, households earning $60,000 to $75,000 had jobless rate of 6.4%, with $50,000 to $59,000 a 7.8% jobless rate. Its only when you get $40,000 to $49,000 that you see jobless rates of 9%, that is close to the national average. The worst pain is in the lower middle class groups with the 7.8% and 9% unemployment and in the income groups of $12,500 to $20,000 which have 19.1% unemployment. For workers at the bottom the unemployment rate is 31%! The workers in service industries, such as food preparers, building cleaners, less educated, high school dropouts, blue collar workers, workers in the construction industry, many blacks and Hispanics, are all hard hit. This also gives some idea why the jobless situation does not cause the same anguish in the media coverage as most of it is concentrated among young people, immigrants, illegal immigrants, Hispanics, minorities, and in service and construction industry type occupations. This creates a fragile situation from a social cohesion perspective especially as the lower middle class is also in the same situation and this combined with the working class blue collar and service and construction workers is a large segmet of society....

With its slogan "Expect More, Pay less" Target has tried to combine low prices with moving upmarket, carrying designer merchandise and chic styling without breaking the family budget. Now with the recession and consumers becoming frugal in the USA, Target and its new CEO who took on the role in May 2008, Steinhafel, is looking at Wal-Mart to see how it can also emphasize the low prices in this recessionary climate. With store sales fallig by 10% in early 2009 Target executives were concerned that something needed to be done. And the thing was to bring even lower prices withor making customers feel cheap. Its chief marketing officer natty Francis always believed in the marketing philosophy of the 1952 book about Marshall Field "Give the Lady What She Wants." Question was what the lady wanted in today's environment. Instead of the old aspirational image of the designers behind Target apparel, Francis now put up the idea of how good value can be chic too. Target designers emphasized how the lady can look "frugalista fabulous." The other challenge was introducig groceries in the store. And instead of packaged foods he idea was to introduce fresh foods which have higher margins. Protype grocery stores were put up and the concept launched. And now instead of gradual rollout, Target went hyper local putting fresh food in all 30 Philadelphia stores. And the marketing ads, radio, newspaper circulars, TV everything made Philly residents aware of the move. Sales went up by 5to 10%. Now the concept has proven to work and Target plans to put in in 350 stores in 2010. And Nat Francis thinks Target did not move fast enough considering how quickly consumers have turned frugal. In the new frugal environment Target research showed its working-mom was obsessing about the price of milk not the thigh-high boots, and she was visiting the grocery store twice aweek and Target only 3 times amonth. Showing groceries mattered. Meantime Target's markeing is ore focussed and its creating the perception that Target and Wal-mart are so close on price. Target is actually devoting 75% of its advertising budget to price compared to 25% in 2008. So a 32 inch panel TV is $246, a coffeemaker is $3. Yet Target executives don't want to undo a strategy built up over years of a better customer experience, designer merchandise at lwer prices, something that would differentiate it from Wal-Mart. So the moves may simply be an adjustment to comport with the thriftier savings oriented times....
