The U.S. Justice Department files a civil lawsuit accusing S&P and parent company McGraw Hill of giving improper ratings to poor mortgage investments which allowed them to inflate in value, creating the conditions for a crash in these investments when the crisis happened in 2008. The penalty sought by the Justice Department and the attorney generals for 16 states is $5 billion to cover losses to investors such as state pension funds and federally insured banks and credit unions. The civil suit comes 5 years after the onset of the financial crisis of 2008, which created the greatest financial crisis since the 1930's. Negotiations for a settlement were conducted by the Justice Department with McGraw Hill for an extended period of time. The talks broke down in January 2013. In these negotiations the Justice Department sought a penalty of over $1 billion and S&P's acceptance of wrongdoing. S&P countered with a proposed settlement of $100 million. The government pushed for admission of guilt on at least one count of fraud. It is not known why the Justice Department filed this lawsuit 5 years after the crisis when the public's memory of the ratings issue is beginning to fade. Is it because the preparation of the case required this much time, the action not taken because it would be seen as punitive in 2011 when S&P downgraded the U.S. sovereign credit rating, the fragility of the economy in 2011, because of the approaching election in 2012, or some other reason. One of the reasons why it was important to take corrective action early was to preserve the integrity and credibility of financial markets, so critical for public confidence. An additional reason was to secure from credit ratings companies the internal reforms and change in leadership and culture that would prevent recurrence and damage to the economy. An example of this change is the change in leadership and culture underway at Barclays bank in Britain after the investigation into the manipulation of the London Interbank Offered Rate or LIBOR. The Justice Department action in this respect is an advance from the policy at the S.E.C., which has not insisted that companies involved in the crisis admit wrongdoing, setting up the process for changes in leadership and culture such as the one at Barclays....

The IMF and Egypt reach preliminary agreement on a $4.8 billion loan in Nov. 2012. Andreas Bauer, IMF division chief for the Middle East says fiscal reforms by reducing waste in expenditures, changing energy subsidies to better channel them to the most needy are part of the plan for Egypt. This includes tax reforms increasing progressive nature of income tax and broadening the sales tax. The goal is to bring the deficit down from 11% of GDP in 2011-2012 financial year to 8.5% in 2013-2014. As part of this plan more money can go to infrastructure investment. Monetary polcies will be geared to keeping inflation down and increasing Egypt's competitiveness to attract foreign investment and increase international reserves. Egypt's international reserves are at $15 billion in Nov. 2012. In all the program of assistance to Egypt including IMF assistance and other donor loans gives Egypt access to $14.5 billion in loans.

Amar Bhide says it is time for banks to go back to their basic functions of taking deposits and making traditional loans, and to restrict risk taking activites, so that the U.S. can return to stable sustainable growth without recurring financial crises. He suggests a simple rule- activities that the average examiner cannot understand should not be allowed, which would restrict many of the activities of banks that lack transparency and pose systemic risks. ECB President Trichet calls for the equivalent of "a fiscal federation" for the European Union, a broadening of powers of the European Commission when it comes to fiscal issues. He called for an independent agency housed within the European Commission, with powers to hand out sanctions on countries with poor fiscal management. Such sanction have to come early and could take the form of suspending member's voting rights in financial affairs. Such reforms would have to come through secondary legislation, and not a renegotiation of the EU treaty.

European Central Bank president, Mario Draghi, addressing the European Parliament in Brussels on April 25, 2012, supported both sides in the issues facing the eurozone, calling for continued vigilance on structural reforms to improve competitiveness of countries in the eurozone such as Spain and Italy, and at the same time saying it was imperative to generate economic growth. He told the European parliament: "The uncertainty about the present situation is very, very, high... Any exit strategy is premature given the current economic situation." Saying that the fiscal compact had been negotiated recently to control spending, yet what Europe needed was also a growth compact- "but my most present thought right now is to have a growth compact." He emphasized that it was now upto governments and banks to pick up the ball. The ECB's achievement was buying time with its 3 year loans to banks in Spain and Italy and other EU countries in Dec. 2011-March 2012, which he described as no ordinary achievement. Francois Hollande and Angela Merkel seized on Draghi's comments to show they were doing the right thing. Merkel conceded that growth was needed, saying sustainable initatives would be good for Europe, that what Germany was opposing was simply stimulus spending that would increase debt without the structural reforms to improve competitiveness. Hollande for his part said he would call for eurozone bonds to pay for industrial and infrastructure projects, and a financial transactions tax....

Prime minister Matteo Renzi focussed on some critical aspects of how other Europeans see the negotiations in the Greece bailout in June 2015. Considering that the EU had relaxed conditions for the surplus, a critical condition for reducing austerity programs in Greece and focussing on reforms, and considering the high unemployment not insisted on further cuts to the public sector employees, the conditions put forward focussing on reforms such as collection of taxes are seen as essental by other eurozone countries, including Spain, Portugal, Ireland and Italy. Renzi told II Sole 24 Ore- "The point is that Greece may get different conditions, but it has to abide by the rules. It's not the case that we have taken early retiremnt pensions away from the people of Italy just to allow the Greeks to have them! We have brought in labor reform, but it is not the case that, with our money, a number of Greek shipowners can continue not to pay taxes.. I could go on." If he went on he would cite the tax collection laws and methods in Italy which were changed under prime minister Monti to tackle tax evasion in Italy, with no effort to collect the $11 billion in estimated taxes that are not collected in Greece. Italy banned cash payment above 1000 euros and started a cross referencing initiative to tackle tax evasion under premier Monti. Greece took up tax evasion legislation in 2010 in parliament but opposition from many groups led to no action. In 2012 Labor minister Elsa Fornero broke down in tears as she described raising the retirement age for women to 66 in the private sector from 60, saying this was to prevent "collective impoverishment." Italy lacks childcare and older women help with childcare for grandchildren. Renzi was probably thinking of these changes in Italy. He went on to say- " If there is a mass get-out clause over the rules, what will happen in Spain in October? And in France in a year and half? It is one thing to ask for flexibility amid abidance by the rules. It is another thing to think that one is the craftiest of them all, in other words to be the that does not abide by the rules. We want them to save Greece. But the people of Greece also have to want that." On tax evasion and other issues for long term financial health Greece is seen as not following basic financial rules for sustaining the euro....

Pearlstein touches on the main issues raised by Obama's regulatory reform proposals. A thorough and independent analysis by a panel of seasoned regulators and independent experts would have done better, Pearlstein says. It would take more time, but the regulatory reforms need to be thorough, considering the damage that has been done to the financial system, and considering the opportunity to do something serious about this. It would have also shielded the administration from criticism if tough action was needed in some areas. Hearing all sides of the matters at hand, and weighing the pros and the cons on each issue is helpful, but there are gaps in this approach when some of the key actors like Geithner and Summers have worked too closely in the past with the financial firms that are being regulated, and may have a tendency and bias in that direction. The President's lack of expertise in these areas, and a desire to keep the regulatory hand as light as possible, and intense obying by financial firms, can tilt things away from serious regulatory reform. The danger is that the opportunity to fix things with major structural changes where necessary, and some tough actions where needed may be lost. Some of the obvious gaps are mentioned by Pearlstein. There is no measure to tackle the situation with the ratings agencies. There will be more transparency than before but complex derivative trading can take place prettty much like before. Credit default swaps will continue as before. If you set up acouncil of regulators, then why not bite the bullet and consolidate them into a single agency, asks Pearlstein? Banks will continue to have their proprietary trading desks, from where they ran up huge losses, these act like in-house hedge funds. Ultimately a lot depends on who is running these agencies, or the Fed, and what is the prevailing opinion about markets in the country. The prevailing opinion that the less regulation the better for free markets, and the lack of independent regulators, and poor appointments, had a lot to do with the capture of the regulatory agencies by the the firms they were supposed to regulate. And on this point the President is on safer ground, as he can ensure that he appoints tough regulators and create a new culture that puts regulation right where it should be, as a necessary ingredient for free markets, just like rules of the road. And in one area the President has created a new structure, a new agency with powers- this is where consumer protections are at stake- so that the abuses that took place with mortgages do not take place....

The European bank stress tests could trigger the restructuring of the troubled landesbank sector in Germany say German experts. The landesbanks do about 25% of the lending in Germany and are in severe financial stress. The landesbanks suffered hundreds of billions of losses in the US subprime mortgage securities. There has been no serious reform of the landesbanks. Even though the management of one of the landesbanks Bayerische Landesbank in Munich was under criminal investigation- the management made bad decisions that led to the losses in bad investments totalling 25% of the Bavarian state's yearly budget. A similiar problem is unfolding in Spain where the Spanish government has initiated action for the troubled cajas bank sector, the regional savings banks in Spain. In Spain the government and opposition came together to reach an agreemet to consolidate the cajas from 45 to about 20 and set aside a fund of 99 billion euros for this task. In Germany the landesbanks are controlled by German states and regional savings banks, so the German government has no direct control over this failing banking sector....

The maximum that can be paid out to executives in upfront cash for bonuses is 20% under the rules set by the European Union starting in 2011. And the amount of time that at least 40% of an EU banker's bonus must be deferred is 3-5 years. The US has not set up similiar rules restricting up front cash bonuses to prevent executives from taking excessive risks. During the 2008 financial many banking executives collected huge bonuses by taking excessive risks, even though the banks suffered huge losses after the departure of the executives. Now the SEC, the Federal Reserve and other government agencies in the US are reviewing the rules. Projected pace of Wall Street profits in 2010 are 28.7 billion for 2010, and the fear is for a repeat of the situation in 2008 as the US has no rules similiar to the EU. Britain's Financial Services Authority passed similar restrictions recently. The Dodd-Frank legislation for financial reforms requires the pay related regulations to be set by April 2011. That legislation specifically prohibits any bonus plan that "encourages inappropriate risks" at financial firms with more than $1 billion in assets. The view of the European Union's financial services commissioner, Michael Barnier, is that not enough has ben done in this area in the US, and doing nothing is to ignore the right lessons from the financial crisis....

ECB president Mario Draghi tells a newsconference on April 14, 2015, that the bond buying program is "proceeding smoothly." He said that he does not see scarcity in the bond market. The ECB plans to continue its purchases of government bonds and other debt at a rate of 60 billion euros a month through September 2016. He said the program of very low interest rates for a very long time "is fertile terrain for financial instability imbalances," but he did not see evidence of systemically large financial imbalances at this time. The ECB approach would be to tackle the risks by using its power as a bank regulator, not by changing monetary policy, said Draghi. He was optimistic about the initial results, saying "more accomodative monetary policy is being translated into better credit conditions, which is something we have not seen before." The euro is down to $1.06 and low oil prices have helped improve economic conditions, as well as ongoing structural reforms pushed by the EU and ECB. Draghi's forecast for economic growth in the eurozone is now up from 1% to 1.5% for 2015....

Mark Carney, chief of the central bank of Canada, was chosen to be the next Governor of the Bank of England, succeeding Mervyn King. Carney's private sector experience with Goldman Sachs has given him contacts with people in the city of London and in British industry. He also studied at Oxford for a doctorate in economics. He helped Canada strengthen the economic reforms made in the previous 15-20 years, in his position as head of the Bank of Canada, say experts. This helped Canada withstand the 2008 financial crisis better than other countries. He says he can "play a constructive role in relaunching this institution with its new responsibilities."

The constructive contribution made by the G-20 meetings of leaders towards building agreement on economic and other policies for peace and progress in the global economy. The meetings were especially useful for coordinating policy and addressing issues arising in the global economy after the 2008 financial crisis. Here Li Baodong, China's vice minister for international organizations and conferences, international economic affairs, describes the path ahead: IMF reforms implementation, better coordination of macroeconomic policies, pursuing the anti-protectionist and free trade policies with further support to the WTO and ministerial MC9 meeting in Bali in Dec. 2013, and infrastructure financing proposals for developing countries on the agenda at the St Petersburg, Russia, G-2- meeting in Sept. 2013. Baodong says the mechanism called the Framework for Strong, Sustainable and Balanced Growth as part of the G-20 meetings is a major achievement. Each G-20 economy submits it macroeconomic policy plan for a Mutual Assessment Process under this arrangement. The progress from the Bretton Woods financial architecture to the new arrangement- from the G-6 to the G-20 to include developing countries from India to Mexico and Brazil- is another major achievement, not fully recognized by the public, says Baodong. Interestingly Baodong makes particular mention to global rebalancing, rather than pushing what he calls the impossible task of increasing demand to get growth. This is a realization coming to China's economic policymakers under the new Jinping-Keqiang administration after the overly aggressive effort to stimulate demand in the 2009-2011 Stimulus, and the ensuing financial problems in the banking and credit system. It is indicative of the policy shift and its implementation underway in China in 2013-2015....

Bank of Korea's senior deputy governor, Lee Ju-yeol, says he feels "heavy resposibility" for the policies pursued by S. Korea's central bank in the years following the financial crisis of 2008, when inflation fighting efforts of the bank were set aside to focus on growth. Inflation has increased in S. Interview with Paulson as he presents his plan for reform of the US regulatory system for the nation's financial markets. Everywhere he looks he says he sees that the plumbing has not changed with the realities. He suggests a Mortgage Origination Commission to prevent some of the abuses in mortgage origination through better training and licensing and rules and supervision of state regulatory authorites with grading of the state regulation. He would give the Fed more powers to supervise and go wherever it needs to go to check on things.

The Editorial Board of The Financial Times (UK-Japan) says Germany needs leadership to fix problems, not just manage crises. The Merkel years were marked with Angela Merkel fixing the euro crisis- itself a legacy of missteps under her mentor chancellor Kohl who pushed too fast for entry into eurozone of countries such as Greece without meeting requirements. As Annalena Baerbock points out the actions taken by Merkel are still being questioned such as the austerity policies. Baerbock says in a rare interview- "The major lesson from the eurocrisis is that austerity can end up suffocating an economy, which is why fiscal reform was needed. Germany and Europe needs to become the engine room for innovation again." A fuller and more objective reassessment of Merkel policies by the German people is likely to happen after the elections. Merkel only moved away from austerity policies after the pandemic, committing to European solidarity and sharing the burden of aiding the economies of southern Europe in 2020. This happened at the end of her administration following 10 years of austerity, a period in which Germany invested little in her infrastructure or modernization. Much of the goodwill for democratic practice and forms of government among German people generated by Adenauer and Wily Brandt in the early postwar years was wasted with her migration policies which were also reversed by 2019, as Mr. Biden is doing in 2021 in the US. The potential for good with new direction of a combined Biden administration in the US and a Scholz-Baerbock  administration in Germany and Europe is immense and sorely needed. ...

John Taylor, says Obama and Alan Krueger (Obama's new head of the U.S. Council of Economic Advisors), said some of the same things in early September, 2011, that were part of Obama's old plan to revive the U.S. economy. And the old plan has failed to produce results. The part that puts construction crews to work on the roads, railways and airports was tried earlier in the stimulus plan. Because of a lack of showel ready projects, and the state governments putting most of the money in their state coffers, this only increased infrastructure by a miniscule 0.05 percent of GDP, according to research by Taylor and John Cogan. Taylor's sees the moves by the Obama administration and the Bernanke Fed as not only being ineffective, but having the opposite effect of lowering investment and consumption demand through increased concerns about the federal debt, another financial crisis or the risk of inflation or deflation. The U.S. private sector has the money to make the investments that create jobs but their concerns have led to holding back. Taylor points to the need for a comprehensive economic strategy to replace these temporary interventions. The debt limit agreement of 2011 is a part of this strategy, and he agrees with reducing spending in a gradual way in a weak economy. The other parts of this strategy he says are entitlement reform, tax reform, regulatory reform, monetary reform, including a reappraisal of the role of government in the economy. This should lead to a more stable and predictable economic environment and reduced uncertainty about the future, which is critical to improving supply and demand....

WIth governments of conservative parties in power in France, Germany and Italy, taking steps to help industries and companies affected by the financial crisis, and working to protect jobs, these parties have shelved their market oriented reforms and are enacting policies that protect workers. As a result they are becoming stronger and the socialists and social democratic parties are looking weaker, especially when these parties in France and Germany and Italy have fractured into many groups. Another reason the conservative parties are popular is that by preserving and strengthening the social safety net for health care and by strengthening infrastructure and public transport investment, and exercizing good judgement and pragmatic and unideological based policy in a global economy facing unanticipated problems, they have come to be seen as reliable.

Argentina's president Macri's party alliance Cambiemos, or Let's Change, wins in 5 of Argentina's largest electoral districts, becoming the first to do so since 1985. The opposition under former president Christina Kirchner remains divided. Though Macri's bloc in parliament is still a minority bloc, it gained a significant number of seats in the midterm elections, increasing the prospects for reforms in labor, tax, and pensions proposed by Cambiemos. Though Chrisitna Kirchner won a seat in parliament in the election the Peronist Party she leads remains a much weaker force today. For a decade after the Argentine financial crisis the Kirchners remained popular following a rejection of international creditors,  now the opinion has shifted about the Peronist party, and the direction of the country has shifted towards integration in the world economy. Italy's prime minister, Mario Monti put it best when he said in a speech in Brussels in April 2012: "If a country becomes more productive and competitive, but there is no demand for its products domestically or around it, growth will not materialize." There is a new shift in opinion towards a balance of fiscal discipline with growth measures to get Europe back on track. The feeling in different parts of Europe is that the German view of austerity alone will not work for Europe. And the view is coming from the far right to the far left, from Marie Le Pen, far right presidential candidate in France, to the far right leader whose move to withdraw support to the government in Netherlands on the issue of austerity measures led to its collapse. Geert Wilders, leader of the Freedom Party in the Netherlands, said: "we don't want our pensioners to bleed just to meet the dictates from Brussels." The IMF has put out research that questions what is now called "the German hypothesis." The "German hypothesis," is based on the unique experience of Germany with the Hartz reforms under chancellor Schroeder which were based on wage restraint by workers, the German "kurzarbeit" program of government support for retaining workers with lower pay during cyclical downturns, improving competitiveness of German companies, and conservative budget practices. There appear to be two exceptions to this. One is that demand has to be strong outside or domestically for a country to reduce unemployment and improve productive capacity utlilization as it increases competitiveness. This was the case as Germany made the Hartz reforms under Schroeder. Wage restraint acts as a form of devaluing currency for reducing the cost of its products to improve exports. All leading parties and the unions are now in favor of wage restraint and lowering wages to preserve jobs to improve France's competitive position. Germany had the benefit of a decade to implement these reforms to reduce unemployment, because demand was not declining domestically or around it during its reforms. The situation is different in Spain where in all likelihood demand would shrink further with unemployment rising from 25% to higher levels, and higher sales taxes. This is why Francois Heisbourg, special advisor at the Paris based Foundation for Strategic Research, says about the current situation in Europe, that destroyiing Greece with strict austerity alone wasn't something the EU can look back at with the sense of having done the right thing, for Spain it appears misguided and lacking careful thought. The editors of the Wall Street Journal expressed the same sense when they described the March 2012 bailout of Greece as a tragic sideshow, because the main purpose was to buy time and insulate the other larger economies in the EU by giving the French, Spanish and German banks time to improve their financial position. The Journal called it bad for Greece leaving it with debt at 120% of GDP till 2020 and no economic growth, and bad for democracy as it was done against overwhelming Greek public opinion- The Tragic Greek Sideshow, Feb. 22, 2012. Volker Perthes, director of the German Institute for International and Security Affairs, a Berlin think tank, says the Germans have always viewed German leadership in Europe with discomfort, and would prefer a leadership where several states, France, Italy, Spain, and other countries in the EU coalesce around consensus positions. This is historically true for the German position since chancellor Adenauer. With the Free Democrats in decline, and the Social Democrats and the Pirate party doing well in recent German elections and favoring consensus in Europe, Merkel's Christian Democrats need to rethink their policy to give greater weight to economic growth for a consensus position in Europe. ...

Amar Bhide says its time the government demanded that bankers take time to know their borrowers rather than punch in a few numbers into some models on the computer. Especially because the government is now virtually the guarantor of all the obligations of the banking system, including housing loans, and this much is owed to taxpayers. He says the 2300 page Dodd-Frank bill for financial reform sets forth a whole range of new rules, requiring a lot from regulators to write and implement the details, but does nothing to put back the old-fashioned borrower-by-borrower banking prudence that is essential for US economy.
