India's Supreme Court urges the Modi government to ensure protections are in place to preserve privacy rights of Indians. It said the dangers can originate from private parties or non-state actors as well as the government. A nine judge bench led by Chief Justice J.S. Khehar stated- "we commend to the Union Government the need to examine and put in place a a robust regime for data protection." The Court called for a sensitive balance between individual rights to privacy and the legitimate aims of the state which it said would include "protecting national security, preventing and investigating crime, encouraging innovation and the spread of knowledge and preventing the dissipation of social welfare benefits." The biometric identification program Aadhar was designed under the previous Congress government as an effort to control the leakage of social welfare benefits through corruption, a significant problem that hurt the poorer sections of society in rural areas. The Modi administration has pushed forward with the program and expanded it to turn it into a national identification program. As part of the plan to ensure data security the Modi government has setup a committee of experts led by former Supreme Court judge, Justice B. N. Srikrishna to identify key issues for data protection, and to propose a draft Data Protection Bill. The Ministry of Electronics and Information Technology will work with this committee over the next 2 months, as the committee prepares its report. ...

The large 11 point margin for State Supreme Court Justice Janet Protasiewicz, a Democrat, shows the effect of the issues of women's rights to abortion and of democracy are having in the state. She promised to use the new 4-3 majority in the Wisconsin State Supreme Court to nullify Wisconsin's 1849 abortion ban and overturn the state's gerrymandered Republican friendly legislative maps. It also shows the changes in the midwestern states. In Chicago Brandon Johnson came from behind to win the Mayoral election calling for new taxes and a vast program of social programs, in addition to a community involvement effort to fight crime over a candidate that focussed on the crime issue and policing. Happening in the same week these two elections give president Biden  more confidence going into the 2024 campaign that people in the midwestern states understand Mr. Biden's approach of investing in people and infrastructure with higher taxes, and rebuilding American manufacturing and technology, protecting worker rights and incomes. ...

As the state of California changes governors from Jerry Brown to Gavin Newsom, both Democrats, there is a sense of continuity as both come from families that have deep connections going back to Jerry Brown's father Pat Brown, also a former governor of the state. This comes with a change of style between the conservative Brown who espouses social justice and careful spending after battling deficits, with the ambitious Newsom who is pushing for many social programs including universal health coverage that have wide support in the state, and can be funded with the $30 billion surplus Jerry Brown handed to his successor. Under Newsom California is also seen as a state that has a different vision of the future than president Trump. 

This comes at a time when California has become more expensive to live in, less and less affordable, with inequalities aggravated by the tech boom.

He is also seen as a person aspiring for higher office and making the right connections since he went to Harvard from Niles West High school in Chicago's North Shore suburbs- from his connections with Congressman Abner Mikva, Supreme Court Justice Brennan, Attorney General Benjamin Civiletti, which he assiduously pursued. Early in his first year at Harvard as an undergraduate Garland switched from a pathway for study of medicine to social sciences because the impact was greater he believed in such work. Here peers and colleagues at Harvard Law School, the Justice Department, give high marks to Garland for his legal work and his ability to take an objective view to obtain consensus. He has obtained consensus by writing the arguments in difficult cases in a way that limit debate, by studying the issues very carefully. Garland is the chief judge of the Washington D.C. Circuit. At the Justice Department he was assistant to Civiletti, and later principal associate attorney general who worked on the Oklahoma Bombings case of 1995. ...

Under a new law going into effect on Oct. 1, 2017 and supported by Angela Merkel's government, all social networks will be required to delete within 24 hours "all illegal content." This is an effort to take immediate action against hate speech, libel and other illegal content. Companies could be fined upto $57 million. Germany's Justice Minister Heiko Maas said "we cannot accept that social networks ignore our laws." Mr. Maas says the voluntary effort setup earlier had not worked as the social media companies were too slow. The law now means the networks will devote more resources, with Facebook increasing the staff for this purpose doubling it almost from 4500 to 7500, showing that the problem had not been addressed the way it needed to be. The new law details 22 sections of the criminal code that social networks need to enforce. Including laws banning libel, character defamation, hate speech, insults against religions, offensive statements and privacy violations. Britain's May and France's Macron have also called the efforts of the networks insufficient. A similar law in the U.S. before the 2016 election could have saved the country from many of the problems arising from illegal content being posted, including damage to the image of the U.S., inciting deep divisions, racial tensions, hate rhetoric and defamation leading to coarsening of public dialogue and debate.  During 2016 many European leaders were exposed to hate speech including Angela Merkel. The social networks were slow to respond and did not take their civic duty as seriously as they should have considering the grave damage to the social and political fabric of the U.S. and the European Union countries. The governments also took time to act, studying the problem carefully before taking action leading to further damage, one reason the current legislation was passed quickly and decisively. Experts say other countries will act following the German example to preserve civil dialogue and strengthen democracy. ...

Venezuela faces an uncertain future after U.S. efforts to support Mr. Guaido and call for new free and fair elections have failed. With help from Russia the Venezuelan economy is showing signs of recovery from the steep decline and high inflation in 2019. Oil production is expected to reach 1 million barrels a day in 2020 after falling to 650,000- 700,000 barrels a day in 2019. Russia's oil company Rosneft provides critical help for Venezuelan oil sales and maintenance in oil fields.  National Security Adviser John Bolton is faulted for his advice to president Trump on Venezuela, that merely voicing support for 36 year old Guaido, would lead to regime change without action from the U.S. With the recovery in Venezuela with help from Russia and Cuba, Mr. Guaido's popularity has dropped by 20 points to 38%, according to a Venezuelan pollster Datanalisis. Most Cubans and Venezuelans in the U.S. are in Florida where there is support for new elections, and Mr. Trump continues to support Mr. Guaido. The lack of support for change from other countries including Europe, India, Turkey, and Mexico have led to a stalled situation in Venezuela. There is concern for the steep inflation, the migration of about 4.5 million Venezuelans, the shortages of critical supplies as a result of the economic collapse in 2019. The situation is stabilizing for the government yet the future of Venezuela with U.S. sanctions and weak economy leaves Venezuela in a precarious situation. Venezuela continues to be an example of how well meaning changes for social justice can lead to political changes that bring about economic collapse. This happens  when business and the economy flounder under mismanagement and corruption under crony socialism, a variant of crony capitalism. The old capitalist class and the privileged families who ran the country under its old two party system are gone. Replaced with a new class. The trying out of untested economic ideas in the quest for social balance leads to economic mismanagement, loss of critical human resources which leave the country, and a higher degree of poverty with shortages than before.  Today in Latin America Brazil shows how allowing generous pension benefits at the expense of basic needs and public services in the budget can hurt the economy. Argentina's overborrowing once again shows how this leads to IMF loans and harsh economic austerity. Chile shows how not financing pensions and public services can lead to collapse of public confidence and riots. Venezuela shows how the quest for social justice and reducing privilege can itself get flawed, leading to mass migration of as many as 4.5 million citizens. This happens under models that vary from free enterprise models to socialist or nationalist models showing that models can be less relevant than good sense and good management. In the beginning and for some time each of these models worked well, commodity price supported booms concealed real problems. Avoiding extremes, prudent spending, good investment and hard work, investment in education and infrastructure, building consensus, and good management, is critical for the future to avoid the bad outcomes facing much of Latin America. A lesson also for Asian and African countries that basic virtue is more important than socialism or free enterprise or nationalism when it comes to development.   ...

US Business has considerable apprehension about the former president in 2024 compared to its willingness to consider Trump in 2016. At the time executives from investment bank Goldman Sachs and heads of oil companies joined the Trump administration. This time US business and corporate interests are apprehensive about becoming the target of a tweet they might find the next morning under a Trump administration. They are not supportive of student loan forgiveness, but when it comes to the CHIPS and Science Act they see president Biden as effective and helping industry. Business leaders have a negative view on the Trump effort through appointment of 3 Supreme Court Justices of overturning decades old rights of women on abortion, and on this issue alone many will support Harris-Walz, overriding other concerns they might have. The visions of Harris and Trump are so vastly different with one calling climate change a hoax and hyping up social issues and infrastructure needs without any record of delivery when in office, and the other a strong position on climate change, wages and income, delivering on infrastructure and CHIPS that US Business. The result is that it leaves US Business with no better option in 2024 than to support the vision  that takes America forward. There are different sections of the business community which have different priorities.  Silicon Valley, and oil, pharmaceuticals because it profits most from light regulation which brings with it social costs is a special issue not addressed here. Other business, banking, automobiles, and a range of other industries have other priorities yet also see the need for the economy and the US to move forward with a different vision than one that simply ignores climate change, and fails to address child care, child poverty, wide disparities in wealth, and other issues facing of wages, cost of living facing most Americans.  ...

Also evident here is that Sarah Vine writing in the Daily Mail discloses more grief about all this messing up her social life than the way the vote to leave the EU will eventually affect the country's standing, its credit rating, and the economy, and how it affects the lives of ordinary British people. ...

As Frank Bruni in NYT, and many others are saying US president Biden seen along with the team of Jake Sullivan at NSA, Anthony Blinken at State, Janet Yellen at Treasury, and Katherine Tsai at USTR, Pat Schumer Majority Leader in the US Senate and other cabinet members may be the best team in terms of experience and talent that the US has had in many decades, combining relative youth (Sullivan and Tsai) with many years of experience (Schumer, Yellen and the president). The president's experience in US Congress for about 40 years was invaluable in getting through Congress the Chips and Science Act, the Inflation Reduction Act, and the assistance to families during the pandemic. Only LBJ in recent post war American history had this kind of experience in getting Medicare and Social Security legislation through Congress. Combining this with the experience and negotiating skill for legislation of Pat Schumer Senate Majority Leader is something not seen since the 1960's. This team comes with a clear dedication and plan to restore democracy to the people by building infrastructure, rebuilding American manufacturing and protecting workers and families through cost of living action and higher wages. As Jake Sullivan NSA, a law clerk for Supreme Court Justice, and one who with the advice of the president has put domestic policy at the heart of foreign policy, puts it for workers and families in the US, these are goals he said at Brookings, "we must, we will achieve." Compare that with every other administration since FDR and Kennedy/LBJ for workers and families everything pales in comparison.  ...

Erlanger and Smale of the NYT describe the reaction in Europe, from Chatham House in London, Bruegel think tank in Brussels, and the German Council of Foreign Relations in Berlin, to the election results in the first round in France. There is a sense of relief that the poll results held and that Macron is the front runner, yet a sense that the issues of social justice, taking account of the marginalized need to be addressed. The parliamentary elections in June, soon after the second round of voting, are also seen as a factor as governing without the support of the legislature would mean very little gets done. For the first time the main parties are not being represented in the presidential office, with a fractured Socialist party and the Republican Party candidate not in the second round.  The Dutch elections, followed by the French and German elections could push back the populism in a negative direction of withdrawing from the global community and openness in the economy.  The economic reform message of  Macron resonates in Germany, as France suffers from high unemployment and needs to build a stronger economy. A stronger French economy is the sure way to bring French people together after the divisions of the current election.       ...

Increasingly complex political coalitions are away centrist parties of the establishment have maintained power in Europe. Traditional political parties on the right allied with business and working class parties allied with organized labour are replaced by a fragmented landscape with parties emerging at the far right and far left. This is also a result of the deep recession following the global financial crisis of 2009, changes in international trade and globalization that have increased inequality, and the migration crisis in Europe.  In Germany and Netherlands centrist parties have formed coalitions to remain in power. In France and Italy mainstream socialist parties suffered defeat, in France to a newly formed party by Mr. Macron, and in Italy to a party started by a comedian Beppe Grillo called the Five Star Movement which allied with the Northern League party at the far right. In Spain's general election in 2019 the Socialists showed a new trend of going back to their roots as working class parties. By addressing minimum wage and other issues relating to equality the Socialist party in Spain increased its share of the vote by 6% to 29% in 2019 elections. Previously in the last 2 decades the Socialist parties had moved away from their focus on equality towards economic efficiency. The tradeoff between equality and economic efficiency moved away from equality in Europe and the U.S. during the last 3 decades,leaving Socialist parties exposed to losing some of their working class base to new parties formed to address today's issues of fairness and social justice.   ...

Israel's Yesh Atid (there is a future) party came in second with 19 seats after the party of prime minister Netanyahu in Jan 2013 Israeli elecions. Yair Lapid helped organize the middle class protests for social justice in the summer of 2011. He founded the Yesh Atid party to fight for better opportunities for the struggling middle class. Many of the votes came from Tel Aviv. Lapid writes a column for the newspaper Yediot Aharonot under the title, "Where's the money?" He writes in the newspaper: "This is the big question asked by Israel's middle class, the same sector on whose behalf I am going into politics. Where's the money? Why is it that the productive sector, which pays the taxes, fufills its obligations, performs reserve duy and carries the entire country on its back, doesn't see the money?" The summer protests were about an Israeli middle class that is falling behind like the middle class in the U.S. Yair Lapid started as a print journalist and went on to anchor the Channel 2 Friday evening news. His father is a Holocaust survivor from Budapest, Hungary, who went on to become Justice minister. Unlike his father who was strongly secular, Yatid's support comes from all parts of Israeli society including the ultra-religious, and is mainly focussed on the middle class. ...

The issue of inequality is arousing public sentiment in Germany with this becoming an election issue along with the euro crisis and energy reform. The term Gerechtigkeit means "justice" in German and is associated with the idea of equality. The Social Democrats Party and the Greens talk about this in terms of "social scissors" opening wider. The Minder Initiative which passed in Switzerland enabling shareholders to restrict executive pay has led to public discussion in Germany for a similiar approach to be adopted by Germany. The ruling Christian Democratic Party (CDU) of Angela Merkel and the Bavarian Christian Social Union (CSU) party are different from other parties in Europe because of their Catholic and Lutheran roots which favor social solidarity. The FDP party in the ruling coalition supports free market principles but lacks popular support. The Economist cites the work of the German think tank DIW on inequality, which shows inequality showing sharp rise after German reunification around 1991, especially in East Germany. The situation moderates with improvements in inequality in East Germany and a slight improvement in West Germany after 2005. Both East and W. Germany have moved up overall in the Ginni coefficeint which measures inequality from about 0.4 in 1991 to about 0.5 in 2010, showing that the situation has stabilized at a higher level of inequality. Part of this could be because of the shift to temporary workers at lower wages about this time as German industry made efforts to keep wages down and improve competitiveness, even as overall conditions in the economy improved in the last decade. The Economist cites another study by the Initiative for a New Social Market Economy, a German think tank, which compares Germany with other members of the OECD. Germany ranks closer to Scandinavian countries in seventh place in this study, but does poorly in equal oportunities with 14th place. Germany lags behind other OECD and European countries in opportunities for women to work full time. Germany lacks enough daycare facilities for small children so that their mothers can work full time. There is a shortage of about 150,000 for preschool daycare openings in Germany, acccording to information cited by Deutsche Welle from government sources....

Germany's Constitutional Court says it will require some time to look into the issues related to plaintiffs complaints about the creation of the European Stability Mechanism on June 29, 2012, by a vote of the German parliament, and whether it is unconstitutional. Finance minister Schauble urged the court not to delay because it woud affect market perceptions about Germany's commitment to tackle the eurozone crisis. Petitions were filed with the Constituional Court by a group of academics led by Peter Gauweiler, a member of parliament from Bavaria, and a Social Democrat Herta Daubler-Gmelin, a former Justice minister on behalf of 12,000 citizens. The petitions say the creation of the ESM and the fiscal pact are unconstitutional because it forces parliament to cede powers over Germany's federal budget. Jens Weidmann, head of the Bundesbank, said a quick decision by the court is not likely to end the crisis, as this would not end without the necessary structural and economic reforms.

A small group of founders of the Pay Pal company Sacks, Thiel and Musk  are only a small fraction of the larger tech universe that includes Apple, Google and Amazon and other technology companies in many industries including auto, aerospace, chips, other manufacturing,  possibly no more than 10--20%. They are now enabled by US Supreme Court decisions to allow business supported PAC's to operate freely to influence political events in 2024 for promoting their own business interests.  The influence operates through social media channels in ways that limit verifying of information because of the speed with which information can be posted on the internet. This has eliminated leakages of funds. Our culture is that our efforts should match the opportunities before us. Mission Life is a new road we take for the climate. When we look at the future every government faces many questions by international interdependence and national sovereignty, the international rule of law, and how to contribute to the global good, and bring the wisdom of our culture to this good. As we transform our countries should we not transform global financial and governance institutions? For this we require future planning, that brings cohesive, collaborative effort. This means Global South voices must be heard. And its priorities moved up front. Joe Nocera of the NYT, says prosecution of individuals responsible in the 2008 mortgage financial crisis is mostly a joke. Not one official of Countrywide Financial, says Nocera, that was at the heart of the financial wrongdoing in the crisis has been prosecuted. This may be one of the strangest aspects of this crisis and the behaviour of the Obama administration, the Justice Department and the regulatory agencies including the SEC remains dubious at best, when it comes to how little can be seen in this area that Nocera points out. By contrast says Nocera, about 1100 prosecutions were done in the S&L crisis and Charles Keating, a key figure in the crisis was prosecuted. When he inquired why the government was so intent on prosecuting figures involved in the S&L crisis, Nocera was told it was because the country insisted that this happen. This is because without this the deterrent effect no longer has an effect in preventing future behaviour of this type. Now he points out this is what the country is insisting happen. Regulatory actions alone may not create enough of a deterrent to protect the ordinary people who were worst hit in the crisis from another crisis. The exacerbated social tensions emerging from the crisis have created a large fragile part of the population with minimal savings that can hardly afford future hits of this type....

The head of the CDU party who would become chancellor after Merkel, makes an emotional plea to the British people to change their mind and remain in the European Union. In an affectionate letter to The Times of London many leading figures from politics, industry and the arts in Germany made a plea that Britain remain in the EU "from the bottom of their hearts." A look at dozens of letters in response to this article in The Times shows that many Britons feel that Britain would have voted to remain if Germany and Merkel had given prime minister Cameron a better response during negotiations in 2016. Even chancellor Merkel warned Germans not to take an indifferent or complacent attitude to Britain's staying in the EU. The letter makes amends by saying there is an indissoluble bond between Britain and Germany because of the help given by Britain to rebuild Germany after the war. "Without your great nation this nation would not be what it is today, defined by freedom and prosperity," the letter says. It says "should Britain wish to leave the EU it will always have friends in Germany and Europe. But Britons should equally know that know choice is irreversible. Our door will always remain open: Europe is home."  Katarina Barley, Germany's Justice Minister whose father is British, says she supports a second referendum on Brexit. The letter is signed by Andrea Nahles, head of the Social Democrats, Annalena Baerbock head of the Greens party. Also signing it are the heads of Daimler, Airbus and the German Federation of Industry. Annegret Karrenbauer, head of the CDU says it is looking for constructive proposals from Britain, now that the deal put forward in the British parliament was defeated by a large margin. "We will not block the path to Britain remaining in the EU." The letter is significant in that it changes the whole tone of German leaders across the spectrum towards Britain- as critical to the idea of Europe, and the dawning in German minds that Europe would never be Europe without Britain, would never be Europe simply with France and Germany and the other nations. ...

This conversation of the president with the NYT is remarkable for its frankness about people close to the president during the election campaign, particularly Jeff Sessions of Alabama. Sessions was the only leading Senator in Congress who supported Mr. Trump from the beginning. Southern states came out heavily for Mr. Trump as part of the traditional Republican base. The president also says Mueller should stay only with information related to Russia and not stray from that to delve into Trump's finances. During the election efforts were made to get Mr. Trump to disclose more about his finances as a real estate businessman- most of these efforts failed and not much is known about president Trump's finances. The president says he never said he would order the Justice Department to fire Mr. Mueller, yet he left open this possiblility, according to the NYT, as the president feels it has affected the first 6 months of the Trump presidency. This interview with president Trump was published on July 20, 2017, the day after an editorial in the WSJ by the Editorial Board of the Journal on July 19, 2017, calling for transparency from president Trump on the Russia investigation. This was an exceptional and powerful editorial by its editorial board telling president Trump that he must tell everything he knows now or face the risk of losing public confidence, and risk his presidency. Krueger and Posner, eminent economists, say the reason wages have stagnated in the U.S. with wages not having budged much over a decade 2008-2018, is not only because of globalization and automation as long term trends. They attribute this stagnation in wages to "monopsony power," or power American corporations have over workers because of their stronger bargaining position and because workers have few alternatives.  For most of this period 2008-2018 high unemployment as reflected by the people out of work and taking part time jobs or having stopped looking for work, shifted bargaining power to companies. The Economist magazine pointed out that workers have not shared in the profit and gains corporations made during this period. Here Krueger and Posner show additional factors such as non compete clauses in worker agreements that have depressed wages. Half of franchise agreements prohibit competition for labor. Outsourcing work to other companies that hire workers means these outsourcing companies have more power over workers than the original companies using the labor. Unions represent only 7 percent of private sector workers by 2017, compared to 35 percent in the 1950's, so that there are no mechanisms to counteract the greater bargaining power gained by companies vs. workers. The way workers have roots in the communities they live and the consolidation of employers into a few companies in a particular area, mean fewer options exist for workers.  Senators Warren and Booker and the anti-trust division of the U.S. Justice Department are in agreement on this issue of widespread use of noncompete agreements that is considered unlawful, says this report in the NYT, offering hope for a solution to bring a better balance between the rights of workers to fair wages and companies seeking profit for stakeholders. Issues about workers, lack of gains for workers, prevalent outsourcing, and the frustrations of labor with parties that had lost touch with their worker base- such as Labor in Britain, SPD in Germany, Socialist Party in France and the Democratic Party in the U.S. - have led to political upsets with support shifting to other parties. This has not led to significant change to improve bargaining power of workers to correct the imbalance that now exists between labor and companies, leading to calls for change. Eric Posner is a law professor at the University of Chicago law school and co-author of a new book "Radical Markets: uprooting Capitalism and Democracy for a Just Society." This book turns the popular notion on its head that free markets have produced the imbalances that hurt social cohesion and democracy, by saying it is precisely the suppression of free competition such as for labor that have created this unhealthy situation. This is true in other areas where monopoly power has developed in other parts of the U.S and European economies in 2008-2018, as also for distortions in capital allocation that hurt infrastructure and other public investment. Krueger is a professor of public affairs at Princeton University and former head of the President's Council of Economic Advisors in 2011 under Obama, showing that Democrats themselves failed to correct this imbalance leading to a shift to other parties and Mr. Trump, who also appear to lack ideas or solutions to this problem that affects social cohesion and democracy.
