The Senate voted 54 to 45 in April 2017 to confirm Neil Gorsuch to the U.S. Supreme Court to fill the spot left vacant with the death of Justice Scalia. This the first time in the history of the Supreme Court that a justice, Justice Kennedy, will serve along with a former clerk who worked with him, the new Justice Gorsuch. Gorsuch is a conservative who served on the U.S. Court of Appeals 10th Circuit, in Denver. Gorsuch will have to vote on the Trump travel ban which now goes to the Supreme Court. With the rushed approach adopted by the Trump administration not enough consideration was given to winning support in the House from 25 conservatives in the Freedom Caucus. Without their support the bill cannot be passed in the House of Representatives. The fight also includes one over what are essential health benefits including whether  maternity care would be included. As a result some moderate Republicans are also expressing opposition on the grounds that less people will be covered and fewer benefits will be provided under the Republican House plan called AHCA. President Trump has not involved himself in the details, and the bill comes very early in the first 100 days, leading to the perception that health care has become a partisan conflict without really grappling with the problems of high cost of health care and creating a solution that all can support. Democrats are seen as having made the same error early in Obama administration's first term. President Trump sees this as a much needed win with a drop in his approval ratings, making this even less of an effort to come out with a good plan.  ...

In a 5 to 4 court runling the U.S. Supreme Court gives president Trump the authorization to use $2.5 billion in Pentagon funds for building a border wall with Mexico. This was a campaign promise and energized his election campaign after years of failure to reach agreement between Democrats and Republicans on how to tackle the migration issue. In the court's decision it overturned an appellate court decision.  The Supreme Court stated in its order that the groups challenging the administration did not appear to have the legal right to do so. This indicates that the Court's conservative majority is likely to support the Trump administration in the end.  The surge in migration from Central American countries such as Guatemala through Mexico has revived the issue of migration. President Trump also secured an agreement with Guatemala to cut down on the migration.  President Trump has cited the need to control flow of illegal drugs across U.S. southern border in addition to the migrants from Mexico and Central America. In bringing the case to the Supreme Court the solicitor general, Noel Francisco wrote that the Plaintiff (Sierra Club) "interests in hiking, bird watching and fishing in designated drug smuggling corridors do not outweigh the harm to the public from halting the government's efforts to construct barriers to stanch the flow of illegal narcotics across the southern border."  The dispute between the Trump administration and the Democrats controlled House of Representatives led to court decisions stopping the use of government funds to build the wall. This led to the declaration of a national emergency along the Mexican border by president Trump on Feb. 15, 2019, after a government shutdown during an impasse with Congress on this issue.  Now the Supreme Court has given president Trump access to Defense Department funds to proceed with the wall and meet a campaign promise.   ...

The Asian-American voters are significant in some states such as New Jersey 7% of voters, Nevada 9%, Minnesota 3.1%, and California 15%. Compared to the 2012 election this is the fastest growing demographic up 16%. With lower immigration from Mexico this is likely to continue for several decades. Nationally it is 4% but growing rapidly. The Asian-Americans come from countries such as India, China, Indonesia, Vietnam, Philippines. Seib says Trump has lost as many Asian-Americans as he has gained whites who chant "build that wall," by using such rhetoric. The Asian Americans are about 48% moderate and about 23% liberal, 19% conservative. Many are in the tech and white collar fields, in the suburbs of major cities including the South. Its this location that can make them an important influence. The Democratic Party has reached out to these generally better educated voters, who have heard about building that wall with unfavorable views- 40% saying they would vote against a person with "anti-immgrant views" regardless of what the other issues are. The early 2016 poll done by the Asian and Pacific Islander Vote project shows 61% having unfavorable views of Trump and 61% having favorable views of Clinton in 2016.   ...

Unemployment is high in Pennsylvania as a result of the pandemic. 51 of 67 counties in the state recorded unemployment rate increases for 2020 that are in the top 20% for the U.S. Pennsylvania and Michigan are two critical states for the 2020 election. Pennsylvania has done much worse than other states including Michigan when it comes to the impact of the pandemic on unemployment rates in all counties. The U.S. Supreme Court  narrows the scope of the ban to people who have no bonafide relationship with a person or entity in the U.S., and allows partial implementation of the ban on 6 countries sought by the Trump administration. The court will hear the full case with oral arguments in October to decide. Earlier lower courts had reversed the travel ban, and president Trump filed an emergency appeal at the high court. The narrowing of the implementation is also applied to refugees. Chief Justice Roberts worked to negotiate a compromise on a middle approach, getting Justices Kennedy and the four liberal justices on board for the unsigned opinion. Conservative Justices Alito, Thomas and Gorsuch offered a partial dissent saying that the compromise was not workable in practice.

Twitter has grown since its founding in 2006, to emerge as a social media platform by 2012. Its growth is during the same period that the smartphone made its entry- the iphone in 2006 and the android phone in 2008. The short form of 140 characters works well on a mobile smartphone. It was much easier to type in the 140 characters into a smartphone than into earlier phones. Its adaptability to the smartphone and the spread of smartphones everywhere gave it tens of millions of users.  Jack Dorsey who founded Twitter tries to develop a longer form through a startup Medium and does not himself believe that the short form provides a medium for thoughtful expression. By 2016 it forms the basis of president Trump's campaign against both the establishment in the Republican and Democratic parties.  By the time of the Joe Scarborough fact check of president Trump's comments on Twitter in May 2020 so much has become muddled up that the WSJ editorial while calling the comments nasty, says the fact check itself has bias. Mr. Trump says conservative voices in the Republican party are silenced.  By institutionalizing the short form the tech platforms and tech companies have built their own structures on the decline in cultural and other literacy in America, Europe and in other countries.   ...

The 6 conservative Justices and 3 liberal Justices vote along party lines to strike down a century old New York law with restrictions on the use of concealed weapons or weapons carried openly. Following the pandemic and the war in Europe there is a shift in thinking all over America and the world, and the old politics simply don't fit in with this. David Brooks of the NYT says the Republican party is failing when it embraces Trump's version of populism with its racial division, tax plan that favors Republican donors and ignores fiscal conservative concern over deficits that affect future generations, supporting the election of Moore in Alabama, the constant Twitter comments that show prejudice. He says this will have destructive effects that could last an entire generation. This isn't the Republican party he has known for so long, says Brooks. U.S. president Trump asks for resignation of Attorney General Jeff Session after the 2018 Congressional elections. The Democratic Party gained a majority in the House of Representatives, with the Republican Party retaining control of the Senate. This makes further investigations into Russian meddling in the 2016 presidential election likely. The official probe into this meddling is being conducted by Robert Mueller, Special Counsel, which is supervised by Assistant Attorney General Rod Rosenstein because Jeff Sessions recused himself from the investigation.  The resignation leads to the Justice Department being headed by Matthew Whitaker, Mr. Session's top aide. Mr. Whitaker, a former prosecutor, is a conservative legal advocate who was critical of the Mueller investigation, in several tweets cited in this WSJ report, calling it  political fishing expedition," and calling for cutting the budget of the Mueller investigation to make it ineffective. Mr. Whitaker now supervises the Mueller investigation for 210 days till a successor is nominated by Mr. Trump. ...

President Trump on a three day visit to the UK promised a free trade deal with Britain if it made a decisive break with the European Union. Such a free trade deal could take years, offer small benefits compared to the loss of the much larger trading relationship with the European Union. It would face hurdles in passage through Congress because Democrats controlling the House of Representatives see a decisive break with the European Union including the customs union arrangement as affecting the open border in Ireland risking the hard won peace in Northern Ireland.  Prime Minister Theresa May proposed a withdrawal arrangement that would keep the customs union arrangement but has failed to secure the support of a faction within her Conservative party that favors a decisive break from the EU. Such a break that Mr. Trump and Boris Johnson the leader of this faction -and a favored candidate to succeed prime minister May after her resignation- would reduce Britain's GDP over the next 15 years at the higher end of the range of 0.1% to 9% a year. A decisive break called a no deal Brexit with no arrangements or agreement for withdrawal with the EU, would lead to a loss closer to the 9% estimate. British experts to the EU are about $275 billion or 44% of its total exports compared to about $44 billion to the U.S., according to HMS Customs source, showing how important it is for Britain to maintain a close trading relationship with the European Union. British farmers would also face competition through agricultural imports from the U.S. in a free trade deal. During his visit Mr. Trump also stated the National Health Service, everything would be on the table in a free trade deal with the U.S.  Theresa May responded by saying that the NHS would not be open for negotiation to American corporate involvement. Public sensitivity is high on any change to the National Health Service. The trip of president Trump to London in which he supported Boris Johnson as candidate to succeed Theresa May, with discussions between Trump and Johnson for 20 minutes, and a visit by Nigel Farage to the U.S. embassy, and no meeting with Labour party leader Corbyn, only shows the widening of differences on the issue of British withdrawal from the EU making any deal for withdrawal even less likely. Mr. Moon Jae-in, South Korea's leader, emerges from this week of direct talks between president Trum and Kim Jong Un of North Korea, with many of his goals accomplished. During most of 2018 with threats and missile tests from the North relations with the U.S. had worsened, South Korea was left out in many developments relating to the Korean peninsula, and tensions had risen. After this weeks diplomacy in Singapore, the South Korean leader has reduced tensions, achieved the goal of direct talks between the U.S. and North Korea, and reduced tensions. Moon-Jae-in now has poplarity of 79% according to Gallup South Korea, and won in local elections. Even the cancellation of military exercizes by president Trump after the Kim meeting achieves a long standing goal of reducing tensions by moderating the exercizes- which are seen by North Korea as a threat. A Gallup poll shows 66% of South Koreans supporting the Kim- Trump talks. Conservatives in South Korea are still skeptical that this can last given past experience with North Korea. The consensus is still that reduction of tensions and dialogue is still the best way to resolve the disputes, with the added pressure of sanctions with China's active participation to make the effort work. ...

Gerald Seib of the WSJ points out that the winners in the passing of the Republican healthcare bill in the House by a 4 vote margin are Speaker Ryan who never wanted the job in the first place, and president Trump who showed he could cajole Republicans into getting it passed because he likes winning. Now comes the hard part says Seib, when it goes to the Senate- House conservatives are not going to be happy when they find major changes they dislike. If the bill clears the Senate in a modified version Republicans will now have to own any issues with healthcare, including says Seib things that may not work out for pre-existing conditions- or for groups that are disadvantaged, including older people.

American Enterprise Institute, conservative think tank, supports Kiel Institute of the World Economy figures that say European Union aid is about double that of the US to Ukraine. Quite the reverse was stated in casual seemingly reckless fashion to 67 million viewers by former president Trump. Moderator David Muir should have had the facts right before him to correct this as this was a much anticipated topic and perennial Trump gripe. The US is not getting creamed- no way, the Europeans are paying up and keen on doing so $187 billion to the US $98 billion. Even with the best of intentions on fact checking this is not good enough from ABC News, or for that matter the rest of the television media - the CBS's, Fox's, NBC's, CNN's, not to mention the internet media, a disservice to democratic process that is built on facts not delusion.  To someone working 2 or 3 part time jobs, or the less literate who can't do quick fact checks that can be time consuming, or educated viewers who hav little inclination to check so much that is being thrown at them- what does it mean to have grievance and grudge thrown at them leaving the impression that the US is incapable when it is in fact greatly strengthening NATO alliance including Sweden and Finland and ties with Western Europe that were damaged over time since the Reagan period in the 1980's.   ...

Steve Bannon is described in this indepth report by Scott Shane as a workaholic, born to working class family with his father a telephone line operator, who went to Virginia Tech and joined the Navy in the hope of advancing a career in politics. At Virginia Tech he won a leadership position of the student organization. He was described by another student who knew him well as passionate but not likely to get much done. The period at Virginia Tech and in the Navy were the Carter years followed by election of Ronald Reagan. The election of Reagan had a huge influence on Bannon- the same overtones of that campaign of Reagan are seen today in the forgotten men and women, white working class families that Conservatives then and Tea Party Conservatives in the Obama years felt ignored. The downward drift of the lower middle class families that saw incomes drop as manufacturing hollowed out in the U.S. with foreign competition, the failure of establishment politicians of both parties to protect American manufacturing and working class families, added to the sense of angst for Bannon. Bannon just like politicians in the Obama camp such as Emmanuel, found the way to politics through finance and gains made as the banking sector and financial institutions made huge financial gains by 2008. This was a stepping stone for their political ambitions. Emmanuel who is also a workaholic and passionate about his views worked to elect a black president, Bannon choosing to do the opposite and push for bringing back the Reagan era. Most on the liberal side see him as part of a racist movement. Reagan was none of those things. How does one reconcile the two? It is possible that seeing the fight against the established politics as an impossible task, Bannon in his passionate temperament did not object to the support of right wing extremists, in the same way that Trump did. As both Trump and Bannon have people of Jewish origin and black people in their circle of friends or family. What incensed Bannon as described here by Scott Shane of the NYT, was that after the financial crisis of 2008, hardly any bank executives who had committed wrongdoing went to jail, his father's line operator retirement savings were devastated by the financial crisis, and working class families struggled harder than ever, that his daughter at West Point was with mostly children of working class families who were the ones fighting America's wars. Many ironies abound in the story. Bannon got his business start in the same financial institutions that were involved in the financial crisis of 2008, Bannon & Co was acquired by Societe Generale. He is from an Irish Catholic working class family in Richmond and attended Benedictine High School, with a mother Doris that worked on the campaign to elect Douglas Wilder, a Democrat, as the first African American governor of Virgina.  The other ironies are in that Bannon sees Trump as "an imperfect vessel" but still good enough, and Trump sees himself as "making all the decisions" when asked about Bannon, as a range of interests struggle to form a coherent movement on the right in American politics- an unlikely combination of a telephone operator's son and real estate magnate's son who built his own real estate business in luxury real estate towers far removed from ordinary men and women they represent. ...

Britain's parliament voted 358 in favor and 234 against to back prime minister Boris Johnson in his effort to get Britain to leave the European Union by January 31, 2020. Negotiation will not be extended beyond 2020. With a comfortable 80 seat majority and many lawmakers newly elected in parliament in favor of Brexit the process appeared easy compared to the problems faced by Theresa May who lacked a majority. In October Mr. Johnson negotiated a deal with the EU which stated how Britain plans to leave the EU. This covered citizens' rights, a financial settlement to leave, and an arrangement to avoid a physical border in Ireland. With another vote in parliament and passage in the House of Lords the process now appears certain to be completed before January end 2020. To get Brexit done Mr. Johnson sought blue collar support in the north of England and the Midlands, a region neglected by Labour and the old Conservatives. Too much of the focus had remained on London. This strategy worked after neglect of working class districts by Labour under Blair and Brown. Mr. Johnson's approach was to commit the Conservatives to new infrastructure spending, spending on schools and the NHS, just as Mr. Trump had done in the U.S. to permanently change the Republican party. This combined with an appeal to patriotism and the idea of Britain drew strong support across England in the election. ...

This WSJ report by Collins, Belkin, Parti and Whyte takes an indepth look at the issues surrounding anti-semitism on US campuses, in particular UC Berkeley, U Penn, Harvard, Columbia universities. It looks at what happened in the first term and how with the Gaza war the issues of antisemitism on US campuses increased and the DJT administration, Education Secretary McMahon, Assistant Attorney General for Civil Rights Harmeet Dhillon, and domestic advisers in the Trump administration, decided it was time to rein in the antisemitism seen at top ranked universities.  On the campus of UC Berkeley in Feb 2019, Hayden Williams was a young conservative activist who set up a table to recruit students to Turning Point USA. He was punched in the face in an argument which attracted media attention. DJT said at the time that "we got to do something about this." In meetings with Hayden Trump discussed actions such as cutting off federal funding to universities with free speech violations. This is the genesis of the current action says WSJ where Harvard faces cut offs of funding for lack of action to control antisemitism on campus and the president asking Harvard to stop enrollment of international students. Some international students have been involved in the activism tending towards antisemitism.  There is also the sense that some universities are admitting far too many, as many as 40% of the enrolment, from overseas students- a form of neglect of local American students, who now have less access to the resources that the federal government is giving to these universities which they should be entitled to as Americans. U Chicago, Harvard and Penn are in the 30%+ range for overseas students and Columbia around 40%. ...

Peggy Noonan says that Trump's group has broken from the Republican Party. She also describes the Republican party as broken, that it cannot look to the past or 1980. She says two unwon wars, with one a catastrophe, and a great recession are enough to break any party. Worse the top of the party believes in things such as immigration, trade, entitlements, that the bottom doesn't, says Noonan. You have a situation where the base has left the party leadership. She describes Hillary Clinton as having a web of relationships and arrangements from the past, and with the idea that is popular among Republicans that she is only interested in acquiring power. Sanders is respected by Conservatives for his sincerity. Noonan sees God's role as chastising in this election, reminding people about what can go wrong and what needs to be done as the damage is surveyed for democracy and the country. The only reason for hope Noonan sees is in the way the 2016 U.S. presidential election is turning the decision over to the young people of America, who can decide who shapes the future. ...

Woman and better educated suburban people supported Nikki Haley. By contrast rural less educated went to the former president. What happens to these Haley supporters is important in 2024. Many are conservatives yet they are not finding a home in the new Republican party that has shifted from what it was before to look very different from before the 2009 financial crisis. The gradual disappearance of manufacturing in America as it was shipped overseas and the damage to communities built around it, the neglect of rural areas, the spiralling cost of healthcare, were already ripping apart the social fabric, only to be hit with the 2009 financial crisis from banking mismanagement and greed. The social and economic fabric which was next hit by the pandemic is only now recovering under president Biden. The Trump one term with all its good intentions failed to deliver on infrastructure and rebuilding manufacturing. The Biden work is a work in progress yet of a scale that America did in the 1950's to become the dominant nation after World War II through Truman, Ike and JFK. ...

Two weeks after his election Donald Trump says the U.S. will not join the Trans Pacific Trade Agreement during his term in office. Barack Obama took seven years to negotiate the trade agreement which was opposed by trade unions, the auto industry and was unpopular in the midwestern U.S. because of the impact of trade in hollowing out the manufacturing sector. Here Frank Sieren of the DW.com points out that the agreement was not really about trade, as most of the gains of trade had already been realized according to experts. It was part of the "pivot to Asia" to maintain American dominance in the region, says Sieren. After China pulled together some Asian and European countries into its trade agreement, the Regional Comprehensive Economic Partnership (RCEP), the U.S. pushed for TPP as a counterweight to the China sponsored trade zone. China says it will try to integrate the countries in TPP into the trade zone it has sponsored. President Trump has said that the U.S. is better off negotiating agreements with each country and not getting into multilateral trade agreements. He fought the election campaign on the basis of the opposition to TPP and trade agreements that unfairly hurt American workers. This could have provided the 110,000 margin of victory in the states suffering from the hollowing out in manufacturing such as Michigan, Wisconsin, Ohio and Pennsylvania. A similar hollowing out in Ontario favored Justin Trudeau's Liberals against the Conservatives in Canada's election. ...

Boris Johnson leads a new British government that is composed mostly of ministers who want to see Brexit happen, and giving the positions of Home Secretary and Foreign Secretary to persons who do not care what happens as long as Britain leaves the European Union. Johnson's date is October 31st for leaving the EU. Sajid Javid, a former Deutsche Bank AG executive is the new chancellor of the exchequer. Priti Patel is new Home Secretary. Dominic Raab a former lawyer who has called for parliament to be suspended if need be so that Brexit can be pushed through is the new Foreign Secretary. Dominic Cummings who headed the Leave campaign for the Brexit referendum in 2016 is the new adviser at 10 Downing Street. Johnson's strategy is to pack the cabinet with people loyal to his vision of leaving the EU October 31st regardless of what the EU does.  The EU has not changed its position and is even less likely to consider any new Irish border proposals. Three top ministers are opposed to Mr. Johnson's views and resigned. Treasury chief Philip Hammond, Deputy primeminister David Lidington, Justice Secretary David Gauke, all resigned in opposition to Mr. Johnson simply pulling Britain out of the EU. Johnson once said all he feared from Britain abruptly leaving the EU was a shortage of Mars bars. During the election in the Conservative party Mr. Johnson was mostly quiet and avoided any gaffes to sound statesman like, yet as the process unfolds Mr. Johnson is likely to face the same problems faced by his predecessor Mrs. May. Added to this is the new opposition of moderates like Mr. Hammond and Gauke in the Conservative party that could topple the government and lead to a general election with just three vote swing in the other direction doing this. Mr. Johnson has prepared for this by having Mr. Cummings as a top adviser in the event he faces a general election. Meantime the Labour party initially not favoring a second referendum with Mr. Corbyn's ambiguous views on Brexit, as shifted gradually to the leadership and the rank and file all favoring a second referendum and for Remain. As Greg Ip has pointed out in the WSJ this week the conditions have changed with protectionism, nationalism and hostility to globalization, and president Trump not planning concessions of any sort even for the UK in trade negotiations. Mexican president Nieto's poll numbers are at all time low of 24%, according to Reforma newspaper. He took office in late 2012 and has been hurt by human rights scandal of the murder of 43 students in the state of Guerrero, corruption issues, and failure to improve the economy. The invitation to Trump to visit Mexico left even people close to the president surprised, and was criticized widely inside Mexico. It is not clear what Trump or Nieto gained from the trip. As Trump continued his talk about building a wall on the Mexican border and having Mexico pay for the estimated $23 billion it would cost. He did this in a speech to supporters in Pheonix on the same day he met Nieto, showing the use of teleprompters and prepared script was not his way of campaigning. Just as the message to black people that Democrats take them for granted cannot resonate without the basic message delivered with compassion and understanding- such as done by the presidents Bush and Reagan- so also the message to Hispanic people is suffering from the same lack of empathy. Recent polls show only 3% of blacks support Trump. McCain and Romney gained only 4-6% in the U.S. presidential elections of 2008 and 2012. The message of the wall is also baffling as an election strategy. A Gallup poll in July 2016 shows only 15% of Americans opposing a pathway to citizenship for illegal immigrants, and only 24% of Republicans. There is another problem in the strategy. The rhetoric about walls and mass deportations, and the Trump temperament combined with handling of nuclear weapons is not winning college educated women in the suburbs with polls showing Trump lagging behind Clinton by about 20 points or 4 million voters with this group. It is hard to undo the damage done by this kind of rhetoric used in the primary elections as it gains distrust of voters. It would require a bad economy with illegal immigrants taking local jobs, and handling of immigration seen as weak, for such a message to gain some national traction. Both are absent for the most part with a steadily improving economy since 2012, lower unemployment, a tough enforcement policy on deportatons under Obama that exceeded that under Geoge W. Bush, and the talk of a wall comes with illegal immigration having declined steeply since the 2008 financial crisis. The real culprit appears to be elsewhere, the triple hit taken from hollowing out of the manufacturing economy that hurt the Conservatives in Canada, the insecurity created for older whites from the job losses and hits to net worth from the 2008-2009 financial crisis, and the increasing loss of access to health care and educational opportunities with high  costs. About 62 million households or the bottom half of the distribution in the U.S. have a net worth of about $10,000, a quarter of this group having zero net worth, according to the Federal Reserve's Janet Yellen at an Inequality Conference in Oct 2014. Problems no wall is going to solve, problems that built up over 2 decades, problems that will take a generation to fix.  It shows the tech miracle of the last 2 decades as a mirage for quality of life of the middle and working class.
