US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026. In this way the goals of the US as a Nation can be achieved of reducing the supply channels concentration in China, cutting supply chain concentration in China, for fair trade with trading partners EU/Japan, and for action on fentanyl and drug trafficking. Justice Roberts and his team have a lot to think about in this effort by the Nation to correct abuses that should never been allowed to happen. ...

Earlier expectation was that the U.S. would give waivers to countries that had made substantial progress to cut oil imports. Trump was exuberant about the advantages secured by U.S. tech companies in global business, saying- "there's nobody like you in the world. The discussions covered need for more vocational education, advantages and disadvantages of trade with China, and immigration. The US Fed under Jerome Powell stress tests of 31 banks for 2024 shows the banks can withstand a rise in unemployment to 10% and 36% drop in house prices. This is relevant now that the new administration of DJT makes another effort to correct the huge trade imbalance with China, Mexico and Canada, which itself is destabilizing in the long run and needs to be addressed. The first term of DJT failed to correct the imbalance with new tariffs kept in place by the Biden administration. This is not just one's imagination, reports suggest China has poured $230 billion of subsidies into its EV industry since 2003 mandate given by premier Jen Biao to dominate that industry. And now has capacity of 20 million car production a year, twice the domestic demand in gasoline cars, wanting to send the surplus production to the US and Europe. This isn't the 1930's type of tariffs, it is simply to get a fair even playing field for trade, where no one side is massively subsidizing and dumping which is one of the principles of WTO free trade that is being broken by China and Mexico. Specifically the anti dumping clause in Article 6 of the 1994 GATT agreement on free world trading mechanism to ensure free and fair trade. ...

India's challenges in securing $1.3 trillion in capital over 5 years for infrastructure spending. This is needed including capital from the private sector to support government funding, so that India can build the infrastructure to create new manufacturing hubs that compete with China as the world's manufacturing workplace. The Biden administration's determination to compete effectively with China using is own supply chain in Asia, and the EU's plan to follow what the Biden administration does, is likely to create a new kind of environment by 2024-2025 that will create a steady flow of capital to India and other parts of Asia to finance this effort for rebuilding its supply chain. The Biden administration is seeking to build a culture change from the old culture pushed by Reagan type free marketers that delivered lost decades in manufacturing and jobs in manufacturing for the US. Biden's State of the Union message was clear- "Folks we're just getting started. We're just getting started." By 2024-2025 the Adani story may just be a footnote to this story as other manufacturers and investors pick up the infrastructure challenges facing the US, EU and India for a new supply chain for the Free World built around self-reliance. The Ukraine war and China incidents such as one that happened recently, will accelerate the rebuilding of the new supply chain on the part of the US and the EU with partners in Asia. And change decades old assumptions and trade relationships over months, not years. ...

Export oriented companies have to rethink their strategy says Thilo Brodtmann, the executive director of the German Engineering Federation, Supply chain disruptions and the pandemic have led to many German companies reexamining their reliance on Chinese suppliers. Human rights and democracy are now part of the reorienting of business in a new direction. The war in Ukraine is also having an impact. Reducing CO2 emissions is also a major part of the reexamination. Chancellor Scholz told the Hanover Fair at the opening ceremony -"We need to bring along with us emerging and developing countries, whose demographics and economic dynamics are turning them into new centers of power." Brodtmann says the solution is "to become independent and to have a completely different value chain." The head of the German Associaltion of Electrical and Electronics Industry Wolfgang Weber says "I'm quite sure that German companies are ready to invest in any of these countries in Asia, Latin America, and Africa to diversify their supply chains." However such new markets are not very well represented at the Hanover Fair, so that policymakers and German business have a lot of work to do to open up new markets across the world in Asia, Latin America and Africa. India, Indonesia and Vietnam are considered to offer good prospects for diversifying Germany's supply chain and a lot of work needs to be done. ...

Protests in Hannover, Germany, as U.S. president Obama visits the Hannover Trade Fair. Protesters oppose the Trans-Atlantic Trade and Investment Treaty promoted by president Obama. A recent Bertelsmann Stiftung research institute poll shows larger rejection of the treaty in Germany than a mid-Feb. poll by German broadcaster ZDF showing about half of Germans opposed. Interviews with a dozen protesters show suspicion about large corporate interests, and fears that the talks are secretive, a sense that the interests of ordinary people would be neglected. Britain's Labor Party leader makes a speech favoring strong Britain- EU relations in an effort to attract support from pro-EU Conservatives in parliament and bring about early elections. Corbyn says he favors Britain's membership in the EU customs union putting pressure on prime minister Theresa May who favors Britain leaving the EU customs union so it can strike free trade deals on its own. Irish peace process and the views of the Republic of Ireland and of Scotland would be respected with the Corbyn approach. The auto sector has an outsized effect on economic growth that is not easily grasped. The IMF sees a fifth of slowdown in growth of global gross domestic product and a third of world trade coming just from low demand for autos. The auto sector feeds into demand for steel, aluminium, copper, plastic and electronics, so it feeds into other sectors. Aging populations, stagnant incomes, ride sharing, and economic headwinds on trade for China, slower demand with lower economic activity in India from bad loans and low credit in the finance sector, all have cut into growth. Tariffs from president Trump and tit for tat tariffs increase costs and cut into profits. In Europe there is added factor of mandated drop in carbon dioxide emissions by 20% by 2021. The new technology will increase costs of autos by 800 to 5000 euros and add 5-11% to the selling price, reducing sales by about 5%.  A fast growing market is India but companies such as Ford and GM have moved out as it slows down. Higher emissions standards in India for 2020 are likely to increase prices in a very price sensitive market. Lower availability of credit in China and India have led to drop in sales of about 15% in both major markets for autos since mid 2018.   ...

Russian and Chinese losses of 28 million dead are 15 times the losses of US and UK combined of 1.8 million dead. With the scale of losses of such magnitude Victory Day celebrations in Tianjin can be seen in the context of this shared history and major losses overcome as much of the world knows with US help. A sobering view is that the colonial powers Imperial Japanese Army, French and British policies caused famines in World War II leading to 6-7 million deaths in India, Indonesia and Vietnam which is 4 times the 1.7 million US and UK deaths. Views of China in the Context of the Ukraine War and Russia are very different in US than in France and Europe and are widening in differences in 2025. In the US as in this report in the WSJ China is seen as a trade partner and competitor with certain issues, many of China's university leaders and experts question the prospect of a long term alliance with Russia, and for DJT Russia is a nuclear power with which US seeks good relations and a political settlement of the Ukraine War. In France as shown in the article in Le Monde adjacent to this the European attitudes towards Russia throughout European history since 1700 of regional rivalry between France and Russia, Germany and Russia since 1900, Britain and Russia since 1700. FDR led the alliance with Russia against the Nazis and Imperial Japanese in the 1930's and 1940's. Herbert Hoover led the effort to bring relief supplies and aid to Russian in the period of the Civil War after the Bolshevik Revolution in 1917. With China America kept the government in China functioning as it retreated from the invasion by the Imperial Japanese Army in the 1930's and 1940's and the only hope with Gen. Joe Stilwell in China alongside Chinese leaders. ...

Indonesia is a country with a long history of Hindu and Buddhist culture before conversion to Islam through traders from Malaysia and Sufi saints in the sixteenth and seventeenth century. Hanuman and other deities from India are also part of the existing culture and traditions. Communist influence has been alien to this culture and tradition as in India. It was part of the Dutch empire in the east and a source of European trade in spices from the seventeenth century. It is also a extensive island chain of Java, Sumatra and other islands with a population of 280 million very closely linked to India culturally and with links to America since independence. Indonesia was given a great deal of importance during the Cold War with Robert Kennedy and other leaders visiting Indonesia during the period after Sukarno in the sixties. By 2000 the US engagement with China had evolved to the point that neglected India, Indonesia and the entire south east Asian region in a preference for links with China.  The British division of India led to the US links with India and Indonesia being shaped by that division and the Cold War with Russia. The confusion of the struggle against colonial rule of the British and Dutch led to leaders such as Nehru and Sukarno who compounded the difficulties of the Cold War and perpetuated with it the old British idea of a divided South Asia on a religious basis that had supported British rule and set the conditions that made it possible for a small group of English civil servants to run the country. This led to the Indian and Indonesian relationship with the US being stifled as the US struggled to rid itself of the British obsession with a divided India. Culturally India and Indonesia are part of an extended region in Asia with development aspirations and a youthful population that aspires to better infrastructure, better education, healthcare and ease of living, and the better opportunities in life. This is what migration did for Europeans who left for America for a new life on the east coast and on the prairies of America. It has little to do with the obsessions of the British and the Dutch that divided the region between the Indus and the Ganges and divided the Indonesian islands. That phase is now coming to an end as China reverts to its Communist period leadership under a new generation led by Mr. Jinping, a son of one of the veterans of the Communist Revolution of 1949. The US has to evolve its relations with India, Indonesia, Vietnam and other countries into new ties of trade, culture and technological exchange. This is needed as it winds down its close trade relations with China in its supply chain to rebuild a new supply chain after the trade wars and the pandemic revealed the deep flaws of that supply chain. What is needed is not the efforts of one changing adminstration after another, but an effort started by president Biden that will last through different administrations as the US engages with Asia in the way that it engaged with Europe after FDR and Truman for most of the twentieth century. And one that rids itself of the obsessions of divided regions from the colonial period of the Dutch and the British. The1.6 billion people in India and Indonesia share a  common aspiration of being a major part of the Free World with America. ...

This opinion in the Hindusthan Times points out that prime minister Modi's speech at Kozhikode following a militant attack in Kashmir in September 2016, reflects a long standing policy since the late 1970's of Congress party and BJP or Janata party administrations. The idea is to encourage cross border exchanges to reduce tensions. The emphasis in back channel talks between India and Pakistan also emphasize the idea of CBM, cross border movement. The prime minister of Pakistan, Nawaz Sharif, has also expressed in the past the importance of cross border movement and trade as ways to improve the economies of both countries. The idea of building up trade and increased exchanges between the two countries is supported also by the U.S. and other western countries. The example of Ireland and Northern Ireland where trade and cross border exchanges are considered important by all parties after Brexit, is an example of how important this is.

US Trade Representative Lighthizer in the Report on China's Entry into WTO sees this as a mistake in the policy of president Clinton. Clinton has said that was a mistake. David Sacks raised this issue in a podcast with Larry Summers, an economist who was deputy to Robert Rubin and Deputy Treasury Secretary, then Treasury Secretary succeeding Rubin in 1999. Clinton on the advice of Rubin and Summers set up the framework for China to join the World Trade Organization without the safeguards and the setup that would prevent it using state capitalism and subisidies to build its own economy with exports, to ally with American corporations to support the outshoring of almost the entire industrial base of the US. Shocking as it sounds this has happened, had happened by 2016, when Donald Trump with the advice of USTR Lighthizer took the first steps to reverse this with Tariff policy, which was supported by president Biden, and continues in its new phase under DJT in 2025. Rubin and Summers had supported deregulation of financial markets and removal of the Glass Steagall Act by 1999. This was to led to the financial crisis of 2009 that was to be one of three body blows to the American working and middle class. The others China entering WTO without safeguards that led to deindustrializing US and loss of its manufacturing base, loss of 5 million jobs, tens of thousands of factories. Donald Trump's plan has suffered form lack of specifics, shifting comments, lack of careful study, and excessive use of slogans. Both candidates oppose trade agreements that shift jobs overseas. Trump's plan also suffers from lack of credibility overseas as this is important in a global business structure, with fears of protectionism increasing. and reminding people of the protectionism under Smoot-Hawley that increased the damage from the depression of the thirties. ...

Trade economists from Ivy League universities, are still peddling the old theories on trade from textbooks that make no sense and have got America in this huge mess that it is in where other countries are ripping America off with unfair trade practices. These economists have turned a blind eye, turned their backs to the great damage done to industrial towns and communities across America for two decades with the loss of manufacturing. Take Irwin's point that the US would have to monitor rates on 13000 tariff line items. This is ridiculous because the US simply needs to monitor the key products such as semiconductors, oil and gas, LNG. In just one negotiation with India the US having a trade deficit DJT states of $100 billion with India- terrible trade. By opening up supply of LNG and oil US can fill India's needs for Oil and LNG and cut the deficit to zero. Who came up with this idea. Indian PM Modi and his trade team. Once it was known that the status quo was unacceptable India came up with its own ideas lets import what we get from Russia from the US. Yes we had discounts from Russia but that was when oil prices were high. DJT's effort to get oil prices down by increasing US production will make it possible for India to get this oil at similar prices. India is a much bigger economy now than during Covid 5 years back India can do this. US and India win-win by doing joint aviation production deals and US gains with sale of F-35 stealth fighters. It is just common sense. Sadly, much of this is common sense that is beyond Ivy League Economics departments at American universities.  Reciprocal Tariffs make a lot of sense because this is how fairness is done- for China, for India. In the case of Mexico, Canada, China, on stopping flow of fentanyl- this reciprocal tariff is not a tariff it is as Commerce Secretarty Luttnick pointed out domestic policy of the United States. Which country would tolerate 490,000 deaths from fentanyl over 12 years and not take domesti policy action. It is not that the policy actions are taken it is that these action should have been taken a long time back. ...
