Two law school professors at Fordham University, Kysar and Sugin, say the Republican tax bill is extreme because it was not based on working with Democrats. As a result not a single Democrat supported this tax legislation. The problem- when the Republicans lose their majority in Congress- a serious possibility after the loss in a Senate race in deep red state Alabama- the whole issue of tax legislation would come up again. This is not without precedent as the Democrats won the presidential election in 2008 and Republicans made a sweeping victory in Congress in 2010.This is why Senators Casey and Wyden (Democrats) and Orrin Hatch (Republican) head of the Finance Committee stated on the floor of the Senate on Dec. 19, 2017, that the next time and in future both parties need to engage in real discussion on taxes. The lack of serious discussion on the health care bill passed by Obama in 2008 has created some of the same problems today that this tax bill passed in a similar way without discussion with the other party is likely to face by 2019. No one needs to look further to realize that the political system is failing in its job of grappling and solving the nation's problems. Kysar and Sugin say this bill is like the 1981 tax cuts skewed towards high income Americans which failed to generate economic growth as intended an led to a swift reversal with tax increases in 1982 and years that followed in 1983, 1984. President Obama failed to address tax reform after appointing the Bowles Commission and not taking up its recommendations to reduce deductions. Another effort at changing the system was made without serious debate, a kind of Republican response to the way Democrats passed the Affordable Care healthcare bill in 2008. Real changes to update the tax laws may be put off till both parties can wrap their hands around the problem together. ...

A former solicitor general questions the 4 page summary of Attorney General Barr as a misrepresentation of the findings of the Mueller investigation following the protest by Mr. Mueller himself that the findings were distorted in the summary. It defeated the very purpose of appointing the Special Counsel. It was upto Congress to come up with its conclusions according to how the U.S. constitutional process was intended to work on questions of national importance, and not the Attorney General appointed by the president. Neal Katyal helped draft the regulations about the way a special counsel is supposed to operate. He can show the findings on each matter whether the president is cleared or not cleared, bu it is Congress that has to make up its mind and come up to its own conclusions. That is Congress's role and not the Attorney General's role. By taking on Congress's role and drafting a 4 page report that exonerates the president Mr. Barr has violated the letter and the spirit of the regulations set for the Special Counsel's office. Mr. Katyal concludes this article saying -"There is no more sacred duty for Congress than gettting to the bottom of whether our president has taken care that the laws of this country have been faithfully executed." He says in drafting the special counsel office regulations he and others had thought of the possibility of there being "a nefarious Attorney General" though "we didn't predict this amount of duplicity."  The U.S. Congress now faces the challenge of getting to the bottom of the matter and drawing its own conclusions. Katyal questions polls showing that the public does not want further inquiry because he says the Attorney General has created confusion, misrepresented Mr. Mueller and delayed the release of the Mueller Report to the public.     ...

Medtronic's former CEO, Bill George, says Medtronic's plan to reincorporate in Ireland as part of the merger with Covidien is intended to make it possible to use cash piled up overseas. The cash overseas if repatriated to the U.S. would incur corporate taxes of 35%. Medtronic can use its overseas cash resources to finance the acquisition of Covidien. The combination of the two companies will enhance cash flow, says Medtronic's CEO, Omar Ishak. Covidien's overseas cash and future earning from its businesses is not subject to U.S. repatriation taxes. As a result the combined company following merger will have only 40% of total cash "trapped" overseas, compared to 60% before a merger.

The language and tone of the leaders says something about what is likely to be the outcome of the G20 summit. Its a first for significant participation, as countries as diverse as Russia, China, India, Indonesia, Saudi Arabia, and the Netherlands are represented. The credible positions of both sides, the US, UK and Japan, and the European side of France, Germany and the Czech Republic, well presented, provide for some serious discussion and negotiations. France's Sarkozy and Germany's Merkel want to see a global regulator that would reach inside the borders of the US with stricter regulation. Sarkozy calls this "nonnegotiable." And he said that he would reject an agreement that puts off stringent new regulations on banks, tax havens, and hedge funds. He said "the compromise has to come from all countries around the world." US President Obama said that if there is going to be renewed growth it can't just be the US as the engine, everybody is going to have to pick up the pace," at the same time saying that the US had to be concerned about its own deficits. The fact is that the US stimulus will mostly help a severely impacted domestic economy recover with social safey net payments to local and state governments and unemployment insurance, as well as targeted investments in infrastructure, education, energy and health care. It will not mean anywhere near the kinds of imports the US made from other countries, especially China. And Obama made that clear when he said the US will never return to that situation, where the US had become a "voracious consumer market." For the Germans the major market for their middle companies is China, and China has its own stimulus spending on infrastructure spending, which should provide for continued imports of machinery from Germany at a much lower level. Thus Germany and France see a strong tendency to call the source of the crisis and repeat that call till the US listens, and refer to the failure of free market capitalism in its unregulated form. And to insist on fixing it through a global regulator with strict and systemwide rules. So you hear this in Merkel's words, "the foundation for this finacial architecture must be laid now, that is why we seem to be so tough." While the vivacious Sarkozy talks of compromise, and a US gesture in regulation in return for Franc's gesture of joining NATO, the mild mannered Merkel is clear and focussed about her concern. She rejects the idea of linking stimulus spending demands of the Anglo-Americans with the Franco-German demands for global systemwide regulation. "This is not a bargaining chip," she says. The media may mistakenly report lack of consensus as a failure of the summit. But in the long run in the presence of good positions on both sides, it could lead to some tough negotiations even if continued at another meeting. And result in something serious, credible and lasting in its impact, rather than something that was easy and did not in Andy Grove's useful words involve "constructive confrontation." ...

Three NBC reporters talk to people in areas in southern France, including Cogolin, which voted in a National Front mayor. This report describes the contrast between the National Front under Jean Le Pen and his daughter, Marie Le Pen. Marie took over the party leadership in 2011, and has downplayed her father's more racist ideology, even calling her self Marine dropping her last name. About 22% of French women are expected to vote for Marine, according to Elabe polling agency. In previous elections only 12% of French women had supported Marine's father because of overt racism. Yet recent remarks by Marine about Vichy regime shootings have revived some of the old memories of the National Front among some women. High unemployment and sense of neglect has led to a search for alternatives, and the terrorist incidents in Nice and Paris have added to the momentum for the National Front that calls for tougher measures. The Republican Party candidate Fillon, now has the support of Alain Juppe of Bordeaux, and former president Sarkozy. Fillon is also advocating tougher measures, and it is not clear how many votes would shift from Fillon on the right to Le Pen.  ...

Sheila Bair, chairwoman of the the FDIC, says the banking industry is showing "continuing signs of improvement, and the process of repairing bank balance sheets is well along, but not yet complete." The bank failures are easing and the FDIC insurance fund which had a negative balance of $7.4 billion at the end of 2010, now has a negative balance of $1 billion. John Hills, a law professor at Indiana University and author of "The Political Centrist," says tough political exchanges are endemic to the American political system. Others say putting crosshairs on representatives in Congress like Giffords on websites or its equivalent wasn't the practice since the times of Jefferson and Adams. We looked at the letters of George Washington during the long struggle with the British and it showed composure and civility even in dire circumstances and difficulties. Criticism by Washington of the lack of help and risks he was exposed to throughout the war was worded carefully, with civility and yet conveys the great urgency. What about the letters of Jefferson and Adams who were on opposite sides of the debates of that time, a time more infused with momentous issues because of the French revolutionary tide in those years? A letter to Abigail Adams, from Washington, June 13, 1804, gives a glimpse of that relationship: "The friendship with which you honored me has ever been valued, and fully reciprocated, and altho' events have been passing which may be trying to some minds, I never believed yours to be of that kind, nor felt that my own was. Neither my estimate of your character, nor the esteem founded on that, have ever been lessened for a single moment, although doubts whether it would be acceptable may have forbidden manifestations of it. Mr Adams friendship and mine began at an earlier date. It accompanied us thro' long and important scenes. The different conclusions that we had drawn from our political reading and reflections were not permitted to lessen mutual esteem, each party being conscious they were the result of an honest conviction in the other. Like differences of opinion existing among our fellow citizens attached them to the one or the other of us, and produced a rivalship in their minds which did not exist in ours." The opening of bars and restaurants risks restarting the coronavirus epidemic in South Korea again after a 29 year old man visited 5 clubs and later tested positive. Contact tracing identified the man but similar cases in the Itaewon neighborhood have led to the conclusion that about one third of 5000 people believed to be involved in bars have not been traced. Over 50 cases have been traced to this one person alone. 

It is now believed that the entire South Korean efort could unravel with the mistakes of a few people. Now president Moon says "its not over till its over," and that it will be a long time before the coronavirus is ended completely. He warned a new wave of infections could happen anytime anywhere.

This article from the John Hopkins University experts in Chinese investment in Africa say the charges that China was setting up debt levels for African countries beyond sustainability levels set by IMF are not founded except in a few instances. Only in Congo, Zambia and Djibouti does China account for over half of public debt, says the report. This comes as criticism is mounting about African countries being burdened with debt from Chinese financing of projects and loans.

In 17 countries identified as vulnerable including Ethiopia and Cameroon, China was the largest creditor but yet more than half of the debt was held by western banks and other lenders. In Mozambique it was Credit Suisse bank. In other words China is not preying intentionally to put countries into financial distress from debt buildup.

Simon Nixon says the main problem with the E.U. bank stress tests of 2011 is that it did not test for sovereign defaults. For example Greek debt that is trading at 50 cents on the euro, was marked down 15%. And the lack of urgency to raise fresh capital is another problem. BJP led by prime minister Narendra Modi wins a huge majority of 325 seats out of 405 in India's largest state Uttar Pradesh for the state assembly elections. The national opposition party Congress wins only 7 seats in what was once the main source of Congress support during the period of Jawaharlal Nehru and Indira Gandhi. This will enable the BJP to push forward with the modernization program for infrastructure and roads, and other development. Opposition in the upper house Rajya Sabha and lack of support from states will not be a major hurdle in development now that BJP has won in states such as Orissa, Maharashtra, Uttar Pradesh, and Uttarkhand in recent state elections after its win in the 2014 national parliamentary election. This also gives credibility to the government's other efforts such as demonetisation to fight corruption in real estate and other areas. India's GDP is a fraction of China's and it is smaller than that of countries such as Indonesia, because of the poor administration and lack of development in India's 2 largest states of Uttar Pradesh and Bihar in the northern Hindi speaking region. To double the GDP from its current level will require doubling the GDP of Uttar Pradesh and Bihar. Bihar's state government is run by a former BJP leader, who has also pushed for improving standards of living and economic growth.  ...

Greg Ip points out in this WSJ analysis that the new NAFTA after negotiations and warnings from Mr. Trump to scrap NAFTA, is not very different from the old NAFTA. Mexico made concessions on auto exports and labor rights, wages. Canada made concessions for the dairy industry. Yet the combined influence of business interests, Canada's lobbying in U.S. Congress and state governments, and the restraint shown by Trump's own advisers prevailed in limiting Mr. Trump's tendencies to go for a "America first" agenda. It shows, says Ip, that there is resilience in the existing order.  It also shows what future trade negotiations with the European Union and Japan over steel and autos could look like. President Trump will continue to face resistance within from his advisers and from exporters, business, Congress, on following an exclusively "America First" agenda. President Trump will need to extol NAFTA in its current version the USMCA, U.S. Mexico Canada Agreement, to get it through the U.S. Congress in 2019.   Mexico's main concessions on autos were to agree to potential tariffs if exports exceed 2.6 million vehicles.  This keeps Mexico's status as a major auto export hub intact. Auto experts say VW and Mazda may simply pay the tariff of 2.5% for lower priced models assembled in Mexico that do not qualify for duty free entry instead of shifting production to the U.S. Current shipments from Mexico are not affected as U.S. demand is weak. Labor rights and higher wages in Mexico's auto industry are a win-win for Mexico and the U.S.. They are supported by the socialist administration of newly elected Mexican president Obrador. Canada's main concession was to expand U.S. access to Canada's protected dairy industry, with Canada already prepared to make the concession. Mr. Trump had also to consider the possibility that excluding Canada from the USMCA would have not passed Congress, and face even more resistance in a Democratic controlled Congress after 2019 elections.  The support Canada has received in Congress does not extend to China, which gets much less support in Congress, leading to higher uncertainty in the negotiations with China and possibly different outcome with the size of the trade imbalance of $1 billion a day factored in.   ...

Obama told the crowd he understood the public's mood for change and that he himself had benefitted from it. Yet he said that it did not add up. Obama said: "This guy is suddenly going to be your champion? I mean, he spent most of his life trying to stay as far away from working people as he could, and now this guy is going to be the champion of the working people. Huh." "I mean he wasn't going to let you in his golf course. He wasn't going to let you buy in his condo. And now suddenly this guy is going to be your champion."

China's housing developers are increasing the issuance of high yield bonds in 2013. European and American companies have issued $120 billion in junk bonds for Jan-March 2013. Chinese companies issued $8 billion to overseas investors for Jan-March 2013, increasing from $2.3 billion in junk bonds issued in the same period for 2012, according to Dealogic. Yields are dropping. In the U.S. yields have dropped from an historical level of 10% to 6% on junk bonds. The same pattern is seen for China's junk bonds. Yields for bonds issued by Chinese housing developers have dropped from 11-12% to 7-8%. Investors are taking on higher risks on these bonds and the current yields do not reflect higher risk, as the bonds are issued from overseas subsidiaries for foreign investors. As with the bankruptcy of Suntech Power, foreign bondholders could lose everything. These junk bonds are not backed by the company assets in mainland China, and local banks and creditors in China come first in getting their money back. ...
