Nathaniel Taplin of the WSJ says the tariffs put on $50 billion high tech products by the U.S. and retaliatory tariffs on $50 billion products are not about a trade war but a way both countries will negotiate setting out their two positions.  A look at the role of foreign firms in China shows China has access to new technology using these firms as a conduit and these firms are also generating more jobs, being highly productive. These firms Taplin says will set back their investments if no agreement is reached or if it is harder to bring Chinese made products into the U.S. At this time China badly needs this investment and technology access because of their dynamism compared to inefficient state run firms as it struggles under a massive debt load with very high debt to GDP ratio.  A major issue is job growth as companies getting foreign investment are much more effective in jobs generation, delivering 10% of all urban job growth from 2007 to 2016, using just 5.5% of total investment. Return on assets at 9% compares to 4% at state run firms. If this dynamism is reduced or affected in some way China could have to provide more unproductive debt buildup stimulus.  For these reasons China has good reason to make concessions, says Taplin. Trump administration will ask for greater semiconductor purchases, much looser joint venture or foreign ownership requirements, higher Chinese payment for U.S. intellectual property. For all these reasons this is not about a trade war but about serious negotiations taking place so that there is a level playing field in the next phase of competition in high tech between the U.S., China and the E.U. changing the dynamics of the trade relationship in ways that reverse the trends of the past. ...

The SEC filed the Goldman civil suit the same day that its Inspector General released a report on the gross failure of the SEC for a decade to catch the Ponzi scheme of Allen Stanford. As a result of the lawsuit against Goldman that report never got the front page coverage it deserved leaving most people unaware of some crucial facts about SEC behaviour. The IG report shows how the enforcement chief of the SEC Fort Worth office quashed his staff's efforts to investigate- and following this how he goes into private practice landing Stanford as a client. The Goldman Abacus case has a whole cast of characters, the SEC, the Ratings agencies, and even the supposed victims German bank IKB. IKB sold commercial paper IOU's to investors in mid 2007 that were worthless to investors by the end of that year. IKB's CEO Stefan Ornstein went on trial in Germany for lying about IKB's financial condition before its collapse.

The last days and the last hours for Wachovia, as Robert Steel- formerly at the Treasury, who became CEO at Wachovia in July 2008- tried to save Wachovia as its share price plummeted. The immediate cause of the crisis was an imminent downgrade of ratings of Wachovia by the credit ratings agencies just as as the bank had billions of dollars in debt coming due this week, and the collapse of WaMu that created crisis conditions for Wachovia with its large holdings of so called toxic assets. Steel tried to negotiate a deal with Wells Fargo's Kovacevich, who initially offered a price in the tens of billions (about $20 billion), and said he could do it on his own without FDIC help. Then on the last day he backed off saying he had concerns for some of Wachovia loan portfolios. At this point Fed, FDIC and Treasury officials were huddled together in meetings to figure out what should be done. Steel was in conversations with Citigroup's Pandit at this point, and FDIC offered to guarantee losses on bad loan portfolios of Wachovia above $42 billion, in exchange Citi would give the FDIC warrants on Citi stock and preferred shares worth $12 billion as an insurance payment. The price at which Citigroup acquired Wachovia at this point was nearly $2 billion. One thing remained. What about the bondholders. WaMu's bondholders were wiped out, so this time Treasury did not want to rattle the credit markets further. It needed someone to shoulder Wachovia's $54 billion debt, which Citigroup at this point agreed to do. Citi gets a large number of Wachovia branches and depositors with this deal, combining the $393 billion of deposits of Wachovia with its $208 billion in deposits, making it the 3rd largest bank in the USA in terms of deposits after Bank of America and Chase. The Bush administration's and Paulson's thinking that letting the government buy parts of the banking system was unthinkable, as recently as late September, may have led to squandering of valuable time. Now Paulson is following Gordon Brown's lead in planning an injection of capital in banks in return for equity stakes, using much of the $700 billion Congress has authorized, and Paulson says the package that passed Congress gives Treasury all the authority it needs to do so. The failure to be open to this thinking earlier may have cost valuable time in addressing this crisis. And now there are second thoughts on whether it was wise to let Lehman fall into bankruptcy, because the Administration had not correctly anticipated or calculated the true cost of the Lehmann bankruptcy in terms of the way it created a crisis in the rest of the financial system. Paulson has still not taken Gordon Brown's lead in guaranteeing lending between the banks which the British are doing as part of their plan. Is the administration too slow in its response and a bit wrongheaded or stubborn headed as each step of the crisis has moved faster than its ability to respond, and its response being one step behind. Frederic Mishkin of Columbia University a former Fed Governor says, "if you delay and create uncertainty, the amount of money you have to put up goes up." It appears from Paulson's remarks over time first turning down proposals for capital injection into banks for equity stakes, and now in making that route central to his plan, that Paulson and Bernanke simply did not anticipate the shutting down of credit markets and the collapse of stock market prices that occurred, and they had no backup plan prepared for a situation such as this. And on top of this the backup plan they went out to sell to Congress turned out to be short on details and in this sense naive for the amount requested. And then by refusing to consider alternatives such as capital injection for equity stakes, it was wrong headed, if not closed minded. William Poole who retired in August as President of the Federal Reserve Bank of St. Louis, says that " I am not aware that Treasury presented any evidence on auctions that have been successful when they are used for assets that are so heterogenous", referring to the reverse auctions that would take weeks to set up and would be terribly complicated to buy up troubled assets, as part of the plan presented to Congress in but 3 pages. Now the plan appears to be to let Fannie and Freddie, which were given $100 billion by the Treasury as authorized by Congress, to move ahead with the purchase of troubled mortgage securities, something for which Fannie and Freddie have the capabilities. In the end the crisis in confidence and near panic generated in the markets and the climate of fear may go way beyond the actual losses incurred from debt securities, and some of this may be the result of a clumsy and poorly thought out approach by Bernanke and Paulson. The cost of fixing the problem will be higher and the recession more prolonged because of this. It is a situation of capable people blinded by ideological reasons to see what is happening and in Bernanke's case not making enough of a case to Treasury about his reservations and his own thinking that capital injection was the right approach, as people familiar with the early planning say Bernanke argued that it would be easier and more efficient to inject capital directly into banks. ...

Its of huge importance that the banks who had a capital injection of $125 billion on Monday October 13, go out and lend some of that capital but this looks increasingly unlikely for the next quarter for some of the banks with gaping holes in their balance sheets and even for a couple of quarters according to some analysts. Merrill's Thain said it was unlikely considering Merrill's losses that it would do so for another quarter and Barclsy's analyst Roge Freeman "its quarters off , if not months off, before you see that capital being put to work." In that case proposals that help homeowners become critically important as more and more howeowners in a downward spiral could find themselves under water which is a point that has not been grasped by the Bush administration. As access is denied to credit markets unemployment rises for small and large businesses and this alone leads to more troubled omeowner loans. nd the auto and credit card debt problems still remain to be worked out creating more downward spiral....

The shocks to the UK banking system resumed Monday with the announcement on January 19 that RBS faced losses of a huge magnitude, of 28 billion pounds for 2008 with fresh losses in 2009. RBS shares went down 66%, and at closing on on January 21, 2009, were at 12.5 pence. Lloyds Banking Group shares are at 45.1 pence, at 66 pence. Barclays which has avoided taking government money saw its shares drop 25% on January 16. The government is hoping that its plan to provide insurance that would limit bank's losses on bad loans and investments will work, but uncertainty on how the insurance will be priced is raising doubts about the plan's effectiveness to restore confidence. Especially when RBS is collapsing. The government owns 70% of RBS and 43% of Lloyds. The next step would be nationalization of the banks. According to WSJ nationalization would mean that taxpayers have new liabilities of about $3 trillion or $4 trillion, an amount far exceeding the UK's entire annual economic output.

Gordon Brown, Britain's prime minister and the finance minister Alistair Darling have lifted their reputations with their decisive plan and execution of it to inject capital and take majority ownership of British banks RBS and HBOS/Lloyds. This comes after earlier missteps which led to a bank run on Northern Rock bank. Their plan is now held up as a model plan around the globe and is being followed in the US and in other countries. It could not have come at a better time, as in the US Fed chairman Bernanke and Treasury Secretary Paulson were having some missteps of their own with their plan to buy up troubled assets. That turned out to be difficult to carry out and may take months- very costly missteps leading to freezing up of global credit markets and criticism from most economists and experts. Nocera says the Galleon hedge fund prosecutions do not extend to others who benefitted or had knowledge of what was happening, as has happened in the Madoff case. Justice Khanwilkar of the Indian Supreme Court (2016-2022) is appointed the second Lokpal of India. He wrote some of the key decisions of the court in recent years. As Lokpal he is head of the Anti-Corruption Authority of India, that was established in 2013 after the protests against widespread corruption and leakage of funds led by Anna Hazare of Maharashtra that led to loss of confidence in the government of that year. Justice Khanwilkar supported the strict provisions of the Prevention of Money Laudering Act (PMLA) that provide the essentials for a developing country to ensure good governance and prevent the leakage of funds that are destructive for improving the ease of living, and for the confidence of the people in the government. He also decriminalised homosexuality, and upheld the Gujarat government for handling of events in 2002. He was alsopart of the 5 Judge SC bench that upheld Aadhar documentation of every citizen of India that made it possible under Digital India to deposit money directly to bank accounts preventing leakage of funds going to hundreds of millions of needy Indians. This was key to supporting families across India during the pandemic. In 2020 he passed a ruling on regulating the NGO's in India and use of foreign funding, the Foreign Contribution Regulation Amendment Act (FCRA), which ensures the government of a developing country of over 1 billion people can be run by the will of the people for the people, free from interference by foreign ideologies and interests. He tackled a key environmental case in 1996 when surrounding tanneries were polluting the river Ganges. The range of Khanwilkar's decisions is as prolific as it is critical for shaping a modern nation of 1.4 billion people. He served as the Standing Counsel of the Election Commission of India aiding in the operation of EC that is crucial for Indian election process.. He wrote 226 judgements and sat on 817 benches, a hardworking and disciplined judge that is a reflection of the best of India from the period of Indian renewal under Vivekananda and Gandhi to this day. Khanwilkar started his career in 1982, representing the state of Maharashtra as Standing Counsel at the Supreme Court, and was later Chief Justice of Himachal Pradesh, Chief Justice of Madhya Pradesh. ...
