India's Supreme Court and Novatis leukemia drug Gleevec

The issues of what drugs are patentable in India,"evergreening" for patents, and public health concerns throughout developing countries, that are now before the Indian Supreme Court. India permitted the patenting of drugs only since 2005 under a WTO agreement, and there are restrictions on "evergreening," or small modifications of existing drugs for marketing. Novartis and other pharmaceutical companies aim to use the case to restrict Indian generic pharmaceuticals manufacturers from coming up with lowcost versions of new drugs. The leukemia treatment developed by Novartis costs over $70,000, by comparison Indian generic manufacturers can make a version of this for $2500.
