Apple's offshore money of $102 billion is managed from the U.S. and much of it in banks in Manhattan, only technically for tax purposes recorded in foreign subsidiaries in Ireland and other locations. Other companies using this practice include Microsoft, HP, Google, and Abbott Labs, with a total of $1.6 trillion kept by U.S. companies overseas to avoid paying a 35% tax rate for repatriating it home.

Robert Morgenthau, District Attorney for Manhattan, 1975-2009, says there is more money on deposit in the Cayman Islands, than in all the banks of New York put together, with 19,000 companies listed there. Cayman is one of several tax havens. Apple use Luxembourg for iTunes. Other tax havens are the British Virgin Islands, Gibraltar, Antigua, Bermuda, the Bahamas. He cites the Senate's Permanent Sub-Committee on Investigations in 2008, which gives the estimate of $5 trillion to $7 trillion sheltered in offshore places on this list, by Americans, Chinese, Europeans and others. Morgenthau says these tax havens help American and European companies not only to avoid taxes, but also structure complex international transactions. He estimates these transactions cost the U.S. Treasury about $40 billion from outright tax fraud each year.

This report on Danish wind energy company Orsted, looks at the journey of the largest developer of wind energy in the world from a company sending natural gas from North Sea to Europe to a joint developer with Denmark's Vestas of offshore wind farms. Last year Orsted, pronounced Ehrr-sted in Danish for the O and named after a Danish scientist, decided to invest $57 billion in offshore wind farms by 2027. It was not easy and the path required a bold vision and bold action to invest in wind energy for the long term even as debt piled up from losses in natural gas competing with coal, climate change committments were not yet strong, subsidies were required to make wind energy competitive, and debt was piling up. It would take a decade of hard work and technological innovation to produce wind energy that could outcompete coal and natural gas on cost without subsidies. The year is 2009 with the Climate Change Conference in Copenhagen. The predecessor company to Orsted was losing money in natural gas with lower cost coal energy generation in Europe at the time. Yet the mood was changing governments were willing to invest in renewables. In 2012 a new CEO Paulsen did a review of 12 businesses of this Danish energy company and decided wind energy was the only one with long term prospects. The Copenhagen Climate Change Conference created new awareness for the need to come up with a long term solution for energy that has no negative health effects and is renewable. That Conference set a goal of 20% for renewable energy by 2020 in the total mix for Europe up from 14%. Paulsen saw an opportunity in the crisis at the company then called Danish Oil and Natural Gas. The new company was called Orsted and the old divisions in fossil energy were sold to invest in wind farms offshore. The way Paulsen saw the situation was that the company had to take radical action whether it wanted to do so or not. By 2012 Danish pension funds were investing in large offshore wind farms of Orsted, taking a stake of as much as 50% in the Nysted wind farm. The Danish government which owned 80% of Orsted thought its projects were risky. Hard work with Vestas which builds the turbines in Denmark paid off in developing a huge new turbine that would bring costs down 65% comparing 2020 with 2012.  In 2018 the European Union was spending about 92 billion euros or $112 billion on energy subsidies including to wind farms. Britain also heavily subsidized offshore wind farms such as Hornsea 1 at about $198 a megawatt hour for 15 years double the electricity price in recent years. Windy conditions and shallow waters in the North Sea were favorable. Technology was being developed with Vestas which would reduce the cost each year. By 2016 Orsted was listed in Copenhagen. The remaining oil and gas business was then sold for $1 billion. The returns are less in wind than coal and natural gas- about 7-8% a year but the big thing is that there is certainty in this compared to coal and natural gas which are volatile and uncertain. The lesson companies are learning in renewables is that with solar and wind technology can. bring down costs, a lot of hard work and creative work lies ahead, that crisis can be turned into opportunity for companies that can be focussed enough to produce results. ...

This NYT editorial brings up the 14-19% tax proposed by U.S. president Obama for overseas profits of U.S. companies. The 5.25% tax in 2005 under the Bush administration for repatriation of about $300 billion did not result in a positive experience says NYT, as most of the money went into dividend payments, share buybacks, and severance for laid off employees. It led to a new surge in unrepatriated profits in the expectation of another tax holiday of this type. A Senate investigation in 2013 showed Apple has $100 billion in Ireland with no tax paid on much of this amount, as cited here. The NYT says Apple shows arrogance in thinking the EU Commission which has taken up cases on tax avoidance of Fiat, Starbucks, Amazon, BASF, would not look at Apple in Ireland. It calls tax deferral on overseas profits as the root of the problem, as it allowed companies initially to look at investment opportunities, but now simply to stash the money abroad till some better tax arrangement can be achieved with U.S. Treasury. The Obama administration proposal was to immediately tax existing profits at 14%, whether repatriated or not, and thereafter at 19% on profits moved offshore. The NYT is in favor of ending corporate tax deferral altogether, and applying taxes on profits in the same year they are made.  ...

NIgeria needs $60 billion betwen 2008 to 2012 to fund oil development costs, its share of the funding of joint projects with international oil companies. But the Nigerian state oil company needs to borrow half that amount. And credit markes are tight and will remain so for a long time so where will it find the money to fund shortfalls. Nigerian foreign minister said last week that production was just 1.5 million barrels a day. Observers pegged production at 2 million barrels a day. Violence in the Niger Delta is raising production costs ant CEO of Amni Nigerian oil company says costs are 250 percent higher than offshore counting security costs and kidnapping insurance for employees. Other problems with west african production are the high costs of developing the offshore fields and their rapid depletion rates as international oil companies seek to recoup their costs quickly. So even as new drilling takes place in offshore fields in Angola and Guinea the outlook is not so good. Consultancy John Mckenzie sees production declining by 2013. And PFC Energy estimates sees production peak at 7.1 million barrels a day in 2014 from current 5.8 million barrels. In the past African production has made up for declines in places like Russia and Mexico, now this is less likely. ...

Labour will introduce 40 bills in parliament to make changes in renewable energy, the environment, transport railways, and for cost of living action. Great Britain Railways and Great Britain Energy are two public companies to be set up to reach goals in public transport modernization and in getting a five fold increase in solar needed to meet 68% cut in emissions by 2030 (Paris Accords commitment). Great Britain Energy will be capitalized with 8.3 billon pounds. (Labour scaled down its 28 billion pounds Green Energy Plan because of Tory mismanagement of finances but will continue to invest in vital projects). The answer is to take a creative approach. More money will be released through the Crown estate bill that will have the crown estate use its auctions of offshore land for wind energy and make investments in green energy. National Wealth Fund will invest in low carbon projects.  Fro water Labour will hold the water bosses to account and put companies such as Thames Water in special measures. Renationalisation was considered but was considered costly at this time, other action is being taken.  Nine bills are part of the 40– the planning and infrastructure bill; the better buses bill; the three rail bills, which are the passenger railway services (public ownership) bill, rail reform bill and high speed rail (Crewe to Manchester) bill; the Great British Energy bill and crown estate bill; the sustainable aviation fuels bill; and the water (special measures bill) – that all focus on protecting the environment. ...

This WSJ editorial says the EU bailout deal for Cyprus of March 25, 2013, which shut down Cyprus Popular Bank, and aggressively downsizes Bank of Cyprus, is the right move. Under this bailout deal no money from the EU's $10 billion to the Cyprus government goes to bailout banks. Cyprus Popular Bank is allowed to go bust, with only insured deposits below $100,000 protected. Larger depositors are compensated with equity shares in a "bad bank," holding this bank's questionable assets. The good assets of this bank are transferred to the Bank of Cyprus. Bank of Cyprus, the largest bank, will have depositors and creditors take haircuts so that it can maintain a 9% capital ratio- estimated losses of depositors being 35%. All this leaves Cyprus with lower debt of 140% of GDP than under other plans. A large part of these losses will be borne by Russian depositors taking advantage of Cyprus as an offshore tax haven. Germay's Angela Merkel and finance minister Schauble face German voters in 2013 elections. Merkel and Schauble did not want to be seen burdening German taxpayers for bailouts in Cyprus to help affluent Russian depositors....

The writedown on Greece bonds held by large banks in Cyprus of 50% after an EU agreement in Oct 2011, added to the stress on Cyprus banks from the property bubble, and from loans to Greek companies. The central bank and the country's president at the time were not on speaking terms according to reports and the regulatory was extremely weak. The head of Laiki bank was a Greek tycoon and made loans to well connected Greek companies. The property bubble created problems that remained hidden till the large writedown on Greece bonds led to an impossible situation in 2011. Cyprus's economic model of an offshore tax haven, which included laundering of dirty money according to reports, was based on lax banking laws. These very banking laws made regulatory supervision, capital requirements and eurozone wide deposit guarantees, the necessary framework for the euro currency that is now being built, outside the scope of this economic model. Seen from this perspective of setting a sound basis for the euro, the German position that this economic model had to go was a logical move. Something the Cypriot leaders and the bank management entirely failed to anticipate and grasp. These very lax banking laws made it impossible to know the real condition of the banks, and plan for contingencies, right down to the end. ...

Saudi global forum on oil price issues meets even as differnces emerge inside OPEC with Algeria, Iran and Venezuela opposed to increasing oil supplies and to a unilateral decision by the Saudis to increase production. After the Bush visit the Saudis increased production by 300,000 barrels a day or 3% to 9.45 million barrels a day. The bulk of the unused production capacity of 2 million barrels a day in OPEC is with the Saudis. The Algerians and the Saudis blame the price increases on futures speculation, lack of refining capacity to produce gasoline in the western countries, and geopolitical tension. For the Saudis and the Kuwaitis there is also resentment that they are asked to use their declining oil supplies while the USA is not allowing offshore drilling and drilling inside its borders to the extent that it could. Note that the ordinary Saudis lower and middle classes are not seeing much change in their lives as inflation is high, and the prices of food and other needs is reducing their purchasing power. Much of the oil price windfall is going into large projects to build aluminium and other plants, and to build new cities in the desert for a growing population, which effectively rechannels the money back to western countries who are actively involved in these projects. The projects themselves may produce value but it is still an open question whether this is the best way to invest this money. And the other serious question is whether this will come at the expense of future oil earnings as the world reduces its dependence on oil. The money is also spread very disparately across the Middle East, with neighboring countries like Yemen in southern Arabia without oil revenues suffering serious lack of development. The political structures like Saudi Arabia created after the first world war by western powers, itself may impede a proper distribution of commodity resource revenues across the region....

Fact checking Apple CEO Tim Cook's statements on the EU Commission ruling for $13 billion in back taxes, shows that CEO Tim Cook's statement that "we never asked for, nor did we receive any special deals," is not true. Ireland let Apple determine what it would pay in tax, and Apple had the benefit of loopholes in Irish tax laws, the fact check by experts shows here. Apple's Cook also says it would hurt investment and jobs in Ireland. Another NYT article showed that the entire healthcare budget of Ireland would be covered by the $13 billion, and 66% of its budget for social support services to the public. Apple has 22,000 employees in Europe and 6000 in Ireland in 2016. Based on the $13 billion owed in taxes, for every job in Ireland the cost to Ireland is 2.17 million euros, and for every job in the EU the cost is 590,000 euros. Apple could turn around and locate in some other place, other than Ireland, in which case Ireland does not get the 6000 jobs. This is Ireland's incentive to give Apple tax benefits. Only if all EU countries had common tax laws would it be possible to avoid this situation, and generate much needed tax revenues at a time of cuts in public spending in healthcare, education, and social services, and invest in infrastructure, worker retraining. The alternative is for the EU to look at other remedies. This is what the EU Commissioner Vestager did when she announced that this was a state subsidy and illegal under EU rules. Because the appeal by Apple goes to the EU Courts the appeal is difficult say legal experts. The EU courts look at the legal aspects of the ruling, was it justified, not at the overall aspect of the ruling by Vestager, as EU Competition Commissioner. This may be why there is so much outcry from Apple, and other digital companies.  ...

About half of foreign investment in poor developing countries is sent through tax havens resulting in tax revenues lost to poor countries. Here Max Bearak of the Washington Post points to a offshore to offshore transaction when Vodafone bought a company Hutchison Essar in India- Vodafone based in Netherlands and Hutchison in the Cayman and British Virgin Islands both tax havens- the result being a loss of $2.2 billion in tax revenues to India. This is about what it costs to provide subsidized meals to schoolchildren in India, says Bearak. The Tax Justice Network says the figure of Angel Gurria of the OECD that 3 times the foreign aid is lost through such tax evasion is a bit low, its estimate is as high as ten times foreign aid lost through tax evasion of this type.

Brazil's infrastructure needs include port and road facilities for its agricultural exports and mining industry. Road and rail transport networks for passengers are small considering Brazil's size. The rail network is smaller than that of France and only 12% of the one million mile road network is paved. Brazilian petroleum fund Petrosal will invest in infrastructure needs. Investments are being made to upgrade port facilities by Santos Brazil, and investment in toll roads by CCR, a private-highways company. The government is planning investments in infrastructure to prepare for the World Cup in 2014 and the Olympic Games in 2016.

During 2012 and 2013 the U.S. put pressure on China and India to cut oil imports from Iran to increase the effectiveness of sanctions. As negotiations eased the sanctions, China increased oil imports in 2014 by 30% in 2014 over the prior year. China's Foreign Ministry sees a "win-win spirit" in the nuclear deal that opens up economic relations with Iran. Analysts say China has setup three new storage facilities on its eastern coast with about 45 million barrels of new capacity, which could be filled with new supplies as its growth slows and demand decreases. China's imports were about 7 million barrels a day in June 2015.

Most Americans pay less in taxes, including state, local and federal taxes, today than in 1980 in inflation adjusted dollars. The taxes have gone down by 2-3% for incomes in the range of $50,000 to $150,000, and gone down by 3-4% for incomes between $150,000 and $350,000. Taxes have gone down over 7% for incomes above $350,000. The main reason is the decline in federal income taxes.Tax rates increased in the period to 1990 and declined from 1990 to 2010. The Democratic party and president Obama are pushing for increase in taxes for incomes above $250,000. Republicans are resisting the changes citing disincentives to investment and growth for small business which generates a large proportion of new jobs created in the U.S. economy. The New York Times study shows the percent of the U.S. population that makes between $200,000 and $350,000 almost doubling in the period 1980-2010 and at the same time its share of the U.S. income remaining the same - many small business owners who hire employees would fall into this income category. Republican's response is for tax reforms that reduce loopholes, deductions and other tax expeditures that disproportionately help the wealthy. Democrats say this cannot create enough revenues to address the deficit, when mortgage deductions, charitable deductions are excluded. The back and forth is leading to stalemate but also opening up discussion for the first time on whether the mortgage and charitable deductions make sense in today's environment. A significant portion of revenues lost in the mortgage deduction goes to affluent households, subsidizing larger borrowings to build larger homes than otherwise, according to the Brookings Institution. Politicians have resisted changes that would go against powerful lobyying groups in the past, yet the impasse has opened up new thinking outside the box because of the pressing need to come up with a solution....

Krugman points out that the federal tax rate for the top 1% is 34% in 2013, according to the Congressional Budget Office, because president Obama let the high end Bush tax cuts to expire. It is the number to remember says Krugman- 34. In 2008 the figure was 28.2. Under Hillary Clinton the average tax rate for the top 1% would go up by 3.4 percentage points, according to the Tax Policy Center. Some of this would help pay for the tution plan to provide access to the middle class to public universities. A shift in priorities away from focussing on high growth to lower sustainable growth was announced by China's premier Wen Jiabao at the National People's Congress, China's parliament, in March 2012. This shift will reduce investment in infrastructure, power generation and exports, which will affect the level of imports of commodities from commodity producing nations in the Middle East, Australia, Canada and Brazil. It should increase imports of software, computers, entertainment, tourism and high tech goods from the U.S. and Europe. Chinese leaders have said they would make this kind of shift for some years now but growth has consistently increased more than the target rate, and domestic consumption as a percentage of the economy has actually decreased in the last decade. Now 9-10% growth rates may be a thing of the past and the target of 7.5% set this year may be actually closer to the real figure. The Chinese leaders have belatedly realized the need to make these changes now because slowing markets in Europe -which is seeing declining growth and high unemployment- and in the U.S., make the issue impossible to avoid. Wen told the Congress: "Accelerating the transformation of the pattern of economc development... is both a long term task and our most pressing task at present... Domestically it has become more urgent but also more difficult... to alleviate the problem of unbalanced, uncoordinated and unsustainable development." This is his way of saying that its unavoidable and better to start in earnest now, and at the same time recognizing the resistance to change from the stateowned companies and the other interests who have benefitted from surging growth, and now occupy a central role in the power structure. An opinion article in the People's Daily, China's official newspaper, said: "imperfect reforms are to be preferred to a crisis caused by no reforms." The World Bank's president Zoellick is respected by the Chinese leaders. He also urged them to make changes now. The recent report of the DRC, China's planning research arm, and the World Bank, also laid out the new direction away from a focus on infrastructure to domestic consumption. The fear is sudden deceleration in the absence of policy action. The impact of this will be negative for commodities over time, leading to slower growth in Australia, Brazil, and Canada. It should boost imports from Europe and the U.S. of high tech, consumer, pharmaceutical goods over time....
