US DJT administration using Section 301 creates the tariffs the US Supreme Court struck down- the EU, Mexico, Canada at 10%, Japan,, India China at 12.5%- June 2 2026. These countries are not doing enough to control the importation of products made with forced labour. This only goes to show what was said at that time and which the SCOTUS itself said the DJT administration could do, find other laws by which the same tariffs could be imposed. By the time the US Supreme Court reviewed the case it was already clear that all these countries had accepted DJT tariffs, and most had negotiated fair deals with the US including making up for past abuses by these countries of the international trading system. The US Supreme Court its shortsightedness ignored this or did not quite grasp this as Justices legal knowledge of facts does not mean grasp of the facts of commerce, trade and business and the history underlying it. Jamieson Greer interviewed at the Council of Foreign Relations this week and Robert Lighhizer in Foreign Affairs (covered and summarized on these Lyrarc pages this week as found rarely in other places) have documented these abuses in detail leading to the US losing $20 trillion in wealth shifted to these countries and its manufacturing dependent communities devastated by loss of over 5 million jobs through the shortsightedness of Bush/Obama adminstrations who let this happen, and these countries that took advantage with reckless disregard for these communities in the US, on a scale unknown in history.  ...

The broken world economy has hurt the American people, in small communities and towns across the US whose societal fabric was destroyed by a system of world trade with abuses done by China. Japan, European Union, Canada and Mexico since 2000. Shortsighted American leaders and economists allowed this to happen. Robert Lighthizer on the New World Order a new system of world trade that replaces the old in 2026. The old trading system was one in which lip service was made to free trade while all the time the system was used by Japan, Germany, China, Canada, Mexico and other nations to build non tariff barriers and other policies to support their industry  at the expense of the United States leading to disillusionment in the US. The facts are mind boggling- the loss of 5 million jobs, many small communities across the US decimated with loss of jobs. About 20 trillion in wealth transfers to China and other countries over 2000-2020, with foreigners owning $27 trillion more of US assets than the US owns of theirs. US Trade Deficits that went up by 40% in 4 years of the Biden administration from $800 billion to $1.2 trillion. Economists and weak leaders got it all wrong allowing this to happen from Geoge W. Bush to Clinton Bush and Obama. Lighthizer says "shortsighted leaders aided and abetted this process," from 1990 to early 2010. Consider that US had 17.3 million  people in manufacturing, in factories all over the US in 1970, in 1999 we had the same number of jobs, even though there were changes in technology and productivity- the US held its own with the rest of the world. The Bush, Obama years were the worst for the US industry - by 2026 we have 12.6 million - loss of 4.7 million jobs since 1999. And real median household income took a big hit growing from $72,000 to $84,000 about 17% in the last 25 years, compared to twice that in the period 1975-2000 prior quarter century. The result is the fracturing of American society- and dire consequences for healthcare as communities suffered from loss of jobs leading to drug overdoses, alcohol abuse and suicides, which are common in post industrial American communities. Think of this fact: two thirds of America's workforce that does not have a college degree, that is working class people, lives 8 fewer years than college graduates, a gap that was only 2.5  years in 1992. The wars carried on by Bush and continued by Obama in the Middle East also wracked these same communities till Biden and DJT pulled out. One has only to drive across America to see this with one's own eyes. Trade may be an abstract topic for economists and politicians- there is nothing abstract about this. And the economic growth of the US has suffered with the unfair trading system with China, European Union, Japan, Canada and Mexico. From 1945 to 2000 American growth was 3.2% a year. Since 2000 only 2 years of growth over 3%. US has not seen historically normal growth for the last 19 years and at this rate (if we continued along this path) the Congressional Budget Office says 1.8% growth for 2027-2035. There are other factors yet the the major driver of this is our trade deficit of $1.2 trillion dollars a year. It is a story of remarkable persistence in the Nation's interest through 2 adminstrations- this Lighthizer story. Lighthizer fought Japanese commercial interests as Deputy Trade Representative under Ronald Reagan, and as US Trade Representative under DJT in the first DJT administration in 2016-2020. His Deputy at the time is Jamieson Greer who is now the US Trade Representative in the second DJT adminstration in 2025. For 30 years this brave American patriot has fought to reverse the bad actions of presidents and economists that have led to devastating losses in the American countryside. He says any new trading system must be perceived as fair to working people. It will survive only if working people think it is good for them. It cannot and must entrench a small, permanent elite. The benefits going to labour must be at least as great as those going to capital. It should create fulfilling high paying jobs for the vast majority of the American people. This is America's new promise to its people, its new compact with its people. ...

Tariffs are unconventional tools for border security yet appropriate in situations such as these. Canada could have done this before a 25% tariff was announced by DJT- it would have been common sense for Canada to do what it did after the tariff before the tariff- put 10,000 frontline personnel at the Canadian border with the US, appoint a minister in charge of drug flows and fentanyl, and list cartels as terrorists. Considering the damage to the US from the border it was imperative that Canada, and Mexico took responsibility for the borders a long time ago. 

Within 24 hours of the Trump announcement of 25% tariff on Canada and Mexico the leaders of the two countries turned around to do what should have been done a long time back.

US Trade Representative Jamieson Greer says this is not chaos in tariff policy because you don't change 70 years of policy overnight. He says China's is highest because it has the highest trade deficit, then EU, Japan, South Korea at 15% because of the smaller deficits with these nations, Vietnam because it is used  by China to send products to the US, India because of geopolitical reasons buying Russian oil. See Dasha Burns, Politico White House Bureau Chief's  interview with USTR Jamieson Greer.  He says about India- Jamieson USTR calls India "an outlier" and says "I'm confident we will get a deal with India in the near future." India he says has largely corrected its imports of Russian oil and negotiations are underway for a deal.  ON USMCA Greer says of the $31 trillion in trade with Canada and Mexico $29 trillion is us right. trade between Canda and Mexico is small. So he says it makes sense to negotiate separately with Canada and separately with Mexico. This suggests that there doesnt need to be a USMCA- separate deals are just fine says Greer. Mexico has gained much in automobiles under USMCA- US wants to make more in the US including auto parts which it can do by negotiating this with Mexico. It does not make a ton of economic sense to marry the three economies together, says Greer, as the import export profiles, lab,or situations are all different. Are Tariffs good for the economy and do they lead to higher prices? Greer says inflation was down in the first DJT term in trade with China and tariffs. Greer says there is never a 1 to 1 with tariffs. It tariffs become a kind of leveage in getting agreements. That is the style of these tariffs. You tell Ecuador or Brazil we don't make these here so there will be no tariffs on bananas and on coffee. Says Greer- we have seen inflation in check, imported goods relatively low priced. We have seen that we can have growth and higher wages with tariffs at the same time. The growth in 2025 third quarter at 3.8% annual growth, and Atlanta Fed predicting 4.2% growth in 2026. And tariff money can be used for paying down the debt and financing America's reindustrialization, Greer says members of Congress are asking about this.When a new administration comes tariffs will still be part of the playbook. ...

Much of this set of laws are already in place and being used by the US. A law passed in 1930 is another avenue for tariffs Section 338 of ther Tariff Act of 1930. The US government and US president DJT could also have Congress enact a new law as it has majority in both the Senate and the House and the president could make acase for the reasonable use of tariffs with the EU and Japan having taken advantage of trade to the disadvantage of the US. There is also broad support for fentanyl action by the president using economic action on tariffs on nations Canada, Mexico, China that continue to let the flow of fentanyl across their borders for use by drug trafficking gangs in Mexico to send over US land border at the 2000 mile long US-Mexico border.

US- China trade relations 2025 and XI's rare earth minerals export restrictions response to US tariffs. DJT resonse was 100% tariff on China from 57%. After meeting Xi in Busan, South Korea, after the APEC meetings, US settled on 10% reduction in tariffs from the 57% tariffs on Chinese products down now to 47%. The 100% tariff was withdrawn by DJT and China's Xi settled on withdrawing restrictions on exports of rare earth minerals. The WSJ says for tariffs action to work US should not tariff allies. Yet broad tariffs action was necessary as partners Japan, South Korea, Taiwan and the EU, Canada and Mexico were also nations that created an unfair trade situation for the US. 10% tariff on Canada's exports to the US after Ontario Reagan ad misrepresenting trade facts is aired on television. The ad seeks to show US tariffs in the light of the Smoot Hawley tariffs of the 1930's, when the tariffs today date back to Reagan's use of tariffs when Asian partners (at that time Japan in the 1980's) followed unfair trade practices to the detriment of American workers and industry. The US Trade Representative who acted for Reagan was Lighthizer, the same USTR who worked for DJT in the first term to fight the unfair trading practices of China, and whose deputy USTR Jamieson is now the USTR in DJT second term negotiating with Asian partners. Tariffs ae being used as an additional tookl in the toolbox by DJT and Lighthizer/Jamieson to counter the unfair trading practices of other nations, which includes partners of the US such as Japan, South Korea, Taiwan, and EU. It also includes nations such as Switzerland who ignored US interests in trade whie having open access to the US market. Most of these nations know that these practices harmful to world trade exist, only Canada, China and some other countries have pretended they do not exist and they are the so called "champions of free trade." These nations attempt to make DJT appear to be doing this on whim when this is an issue in trade relations between the US and Asian partners, the EU, and Canada/Mexico for the last 50 years. For a decade America's leaders remained silent on taking action on all fronts including trade on countries that were sources of fentanyl. Ontario ad on tariffs uses Reagan's word out of context- does not say Reagan speech was to impose tariffs on Japan till problems get fixed. Problems that had arisen in the 1980's because of Japan's use of unfair trade practices. This is the issue of Canada, Mexico, China and other nations that use unfair trade practices that then hurt American workers. Reagan was saying he understood that Senators Smoot and Hawley got things wrong when they imposed tariffs in the 1930's, that he was doing this in a very different situation the use by Japan of blatantly unfair trading practices. This is the case with Canada, China, Mexico and other nations today, that have acted as if they know nothing about these unfair trade practices. Healthy world trade requires every nation to follow the rules of fair trade practices. It took action by DJT for what Canada and Mexico could have done from common sense. This is an unconventional use of tariffs by the US. Yet this was an unconventional situation in which the US under several administrations Republican and Democrat Clinton-Bush-Obama, allowed the situation at the Border leave the US in a deteriorating situation with its neighbors to the north and south. Canada and Mexico could have acted before the 25% yet they did not act till the tariff was imposed. Real tariffs are less than 12% of imports much lower than expected because of exemptions and tariffs announced and later dropped, CEO's have said that the impact of tariffs is much less than expected, and some say the worst is behind us. The administration of DJT and Treasury Secretary Bessent has shown much more flexibility and responded to the stock market declines in its tariffs posture. Bessent says the purpose of tariffs was not the revenues itself but getting other nations to play by the rules for fair play in world trade, rather than try to take the largest share of trade for their nations in the case of China, EU, Canada, Mexico and Japan which have all profited from unfair trade practices. There is a two week period before the 25% tariff on steel coming into the U.S. goes into effect. This gives time for Canada, Mexico, the EU, Japan and other countries to come up with offers to negotiate or as with the EU come up with its own plan to put tariffs on some American goods. An exemption for Canada is supported by the United Steel Workers Union, as many American companies make steel across the borders. Canada sends the most steel and aluminium to the U.S. With the departure of Gary Cohn as economic advisor, Mr. Lighthizer, the U.S. Trade Representative who pushed for the tariff plan becomes a trusted advisor to the President. The US could put 25% on Canada and Mexico starting February 1 for inadequate border security to stop the flow of illegal drugs, fentanyl and migrants to the US. By executive order DJT asks agencies to report on the issues of trade by April 1.

US Canada two way trade is about $1 trillion. Three quarters of Canadian exports go to the US and US imports half of imported oil from Canada. Canada's Trudeau says Canada will respond dollar for dollar to US tariffs.

After months of uncertainty and waiting for concessions, offering temporary exemptions, the Trump administration announced tariffs will go into effect on steel and aluminium imported from the European Union, Canada and Mexico. A tariff of 10% on aluminium and 25% on steel goes into effect on May 31st, 2018. The tariffs affect about half of the imports of steel and aluminium into the U.S. and are intended to keep promises to protect American industry made by president Trump during his election campaign.

Mexico and the European Union are imposing retaliatory tariffs. The European Union will impose tariffs on $3 billion of American goods in retaliation.

Reciprocal tariffs are seen as based on fairness- "we charge them what they charge us."  Why is this action necessary?  Because Canada, Mexico, EU, South Korea, Japan, China gained unfair advantages due to the inaction of administrations dating back to Clinton, Bush, Obama which were never reversed. Other nations have no incentive to trade on the principle of fairness inducing the US to take action to open discussions on fair trade and on what the tariffs should be going forward from 2025. US Trade Representative Lighthizer under DJT first term was Deputy Trade Representative under Reagan when he negotiated fair trade with the Japanese in the 1980's who he says stalled and stalled till finally agreeing to real discussions. So this is nothing new China, Canada and Mexico have taken the place of Japan. In this second term of DJT Lighthizer's Deputy Trade Representative is now the US Trade Representative. This means the discussions are in the hands of seasoned American trade officials with a keen grasp of details supported by Scott Bessent at Treasury and Luttnick at Commerce Department. What it is NOT is an effort to coerce other nations by the US. Like Japan in the 1980's with Reagan and Lighthizer as USTR, in 2025 China, Canada, Mexico, South Korea Taiwan and other nations would like to slow this return to fair trade by stalling and stalling, and presenting a different picture of the facts.
