US DJT administration using Section 301 creates the tariffs the US Supreme Court struck down- the EU, Mexico, Canada at 10%, Japan,, India China at 12.5%- June 2 2026. These countries are not doing enough to control the importation of products made with forced labour. This only goes to show what was said at that time and which the SCOTUS itself said the DJT administration could do, find other laws by which the same tariffs could be imposed. By the time the US Supreme Court reviewed the case it was already clear that all these countries had accepted DJT tariffs, and most had negotiated fair deals with the US including making up for past abuses by these countries of the international trading system. The US Supreme Court its shortsightedness ignored this or did not quite grasp this as Justices legal knowledge of facts does not mean grasp of the facts of commerce, trade and business and the history underlying it. Jamieson Greer interviewed at the Council of Foreign Relations this week and Robert Lighhizer in Foreign Affairs (covered and summarized on these Lyrarc pages this week as found rarely in other places) have documented these abuses in detail leading to the US losing $20 trillion in wealth shifted to these countries and its manufacturing dependent communities devastated by loss of over 5 million jobs through the shortsightedness of Bush/Obama adminstrations who let this happen, and these countries that took advantage with reckless disregard for these communities in the US, on a scale unknown in history.  ...

The Obama Center in Jackson Park, Chicago, is a 20 acre complex opening on June 19, 2026, built by Todd Williams Billie Tsien Architects. The Obamas chose land that was once use for the World Columbian Exposition World Fair. Using public space was controversial, made up for by a new branch of the Chicago Public Library, a basketball court and playgrounds. The most controversial part is the Obamalisk (obelisk type) tower which is as dour as one can get. One of Obama's speeches with letters on the tower top the architect says is not legible, but thats just fine he says, as if it is empty rhetoric. Or as Kennicott says just rhetoric, ornament, did all those words 17 years back really matter or were they merely oratorical good vibes. So much has happened since then that Kennicott rightly looks at the new Obama Tower with skepticism of what Obama ever accomplished. In healthcare the Obamacare plan is now not working or being replaced. Obama continued the wars Bush started, were they really that different.  At every turn from the entry there are questions like this. At the entry itself with the Declaration of Independence there is a display of unequal treatment, questioning the very experiment of Jefferson, Washington, by placing their formative ideas for a new society that had already been born in Britain with the abolition of slavery in 1772 with Somerset vs Stewart. Ben Franklin forming the Abolition of Slavery Society in Pennsylvania as early as 1775 and becoming its president in 1787. None of the founders get any credit for envisioning a different society, than they had to live in, and which even Abe Lincoln struggled with from 1850's till the Emancipation as way to win the Civil War. The entry to the Smithsonian has done the same. Yet it is this same document the Declaration which says "All men are created equal and they are endowed by their creator with some inalienable rights, life liberty and the pursuit of happiness,"  that has inspired  and given new hope to hundreds of millions of Chinese and Indians, Africans, and other Asians by 1900 and 1950, the vast majority of people on the planet. Philip Kennicott of the Washington Post asks the questions over and over in this report-  was America sleeping when it should have been alert? Lighthizer and Jamieson says this on this page that 5 million jobs were lost, economic growth was down by 1% to 2% instead of 3% of the period 1960-2000, and $20 trillion in America's wealth transferred overseas by the combination of Bush-Obama in the 2000-2020 period, manufacturing decimated, wages stagnant, America's working class communities destroyed, all the while this high minded rhetoric went on. As Kennicott says the period of rhetoric and oratory is gone, in the past, the presidency merely decades of decadence of America's elites as Marco Rubio says in a new book. ...

 U.S. Trade Representative Robert Lighthizer, views China's response in trade negotiations as one of conducting extended negotiations that lead to little change. This has continued says Lighthizer for over a decade putting the U.S. at a serious disadvantage in trade. At a White House meeting in August 2017 Lighthizer convinced president Trump that China was in his words "tap, tap, tapping us along."  This confirmed president Trump's own instincts about the U.S. trading relationship with China. Lighthizer is a veteran of trade negotiations, having experience in the Reagan administration as the Deputy Trade Representative in 1983 in negotiations with Japan, when Japan was in a similar situation that China is today. At the time trade negotiations with Japan were getting nowhere. Lighthizer is said to have turned one Japanese response in negotiations into a paper plane and sent it flying right back. Lighthizer does not seek the limelight but is serious about his role having published op-eds in the NYT and WSJ since 2000 about how U.S. trading relationships were putting the U.S. and U.S. workers at an unfair advantage. Many of these op-eds are in the Lyrarc archive and a Search with the term "Lighthizer" would bring up these articles. This report in NYT shows how the role of Lighthizer was not anticipated by China when it sent Liu He to Washington in November 2017 to negotiate with the U.S. President Trump made certain Liu He and other Chinese leaders would have to talk to Lighthizer first. In a session with president Jinping laid out U.S. views that the past negotiations had accomplished little and new negotiations had to be undertaken very differently from negotiations in the past. Earlier in July trade negotiations conducted by Commerce Secretary Wilbur Ross were "shut down" by president Trump because China continued to repackage earleir offers which meant little to the U.S. As a lawyer at Skadden, Arps, Slate, Meagher LLP Lighhizer represented steel industry clients hurt by subsidized Chinese steel industry imports. Mr. Trump and Lighhizer have bonded well because their instincts have been the same- that the U.S. had not been well represented in earlier negotiations by lawyers who saw themselves as speaking for American exporters.  Lighthizer is also a seasoned trade negotiator and has waited for the right time and situation to tackle the unbalanced trading relationship with China. For 30 years Lighhizer represented American manufacturers as he practiced trade law at the Skadden law firm. His strategy has been to get the administration to unite behind a clear trade strategy. He says "I try to be friendly in trade negotiations. I am not the theatrical type. The art of persuasion is about knowing where the leverage is." At this time the leverage lies in the huge trade surplus of about $300 billion China has with the U.S. The U.S. goal is to bring this down by $100 billion through this new negotiating strategy as earlier negotiations have failed. ...

WSJ annotates the letter but its annotation does not say that Japan has used the relationship with the US to its advantage, putting the US companies and industries at a serious disadvantage since 1970's. US Trade Representative under DJT first term 2016-2020 was Robert Lighthizer. Lighthizer was Deputy Trade Representative under Reagan in the 1980's negotiating with a Japan that would concede little. 2024 USTR Jamieson Greer was Deputy Trade Representative under Lighthizer. The Letter starts setting the tone that we have borne Japan's unwillingness to negotiate fairly with patience, ends stating we are ready to act. "It is a Great Honor for me to send you this letter in that it demonstrates the strength and commitment of our Trading Relationship, and the fact that the United States of America has agreed to continue working with Japan, despite having a significant Trade Deficit with your great Country." This is an highly important interview by the BBC with U.S. Trade Representative Robert Lighthizer. We have followed the path breaking work of Mr. Lighthizer at Lyrarc.com over 10 years, and have great respect for his effort on behalf of the American people and American workers. Here are some of the remarks he made at the end of the term of the Trump administration. Lighthizer says the objective of trade is not just efficiency, it must be working men and women. This is the shift that Mr. Trump has made. It will be a lasting change as leaders in both parties see this as important, says Lighthizer. There are companies that immediately want to go back to the way things were but Lighthizer says members of both parties will prevent this. This will be a lasting change. Democrats in particular could soon face strident criticism that they have let down the working class from within their party, increasing the risks of the party to represent large parts of the American population. Lighthizer says its not accurate that we started a lot of trade wars, we have simply enforced our laws and insisted on fairness for American workers. There was really no trade war in the improved NAFTA deal in the interests of American workers, which also enhanced worker protections in Mexico, for a win-win on both sides of two neighbors. "We want strong communities in the U.S. and if that means T-shirts will cost another nickel, they will cost another nickel," sums up the way Lighthizer sees it, and the way all of America would see it if one regained the idea of government for the people, of the people and with the people. "We are proud of what we have done to reorient American trade towards working people in the U.S. and less towards outsourcing and corporations," says Lighthizer. And he says that was important to do. Lighthizer only highly underestimates what he has done for America and American workers.  A lot remains to be done. The about $800 billion in overall trade deficit the U.S. has with China, Germany and the rest of the world is not sustainable, he says. There is a new US president who know's Japan's approach to trade, and the US has a lot more experience with Lighthizer and Jamieson Greer his deputy running negotiations with Scott Bessent, some 45 years later.

DJT to Japan: “Dear Mr. Japan, here’s the story. You’re going to pay a 25% tariff on your cars, you know? So we give Japan no cars. They won’t take our cars.”

US says it will just send that message to Japan in a letter if it won't negotiate a level playing field and fairness in world trade.

Following president Trump's decision to increase tariffs on $200 billion of Chinese goods on May 9, 2019, the WSJ looks at the mistakes made by both sides in misjudging each other's negotiating position. Mr. Trump says he is willing to increase the pressure on China by imposing tariffs on all Chinese imports into the U.S. after what he sees as China reneging on its commitments on trade by deleting key sections on enforcement provisions and Chinese legislation for enforcement to take place in the 150 page agreement prepared for both presidents to sign.  Early on in the negotiations between Liu He and Mr. Lighthizer, China misread the thinking on the U.S. side. Chinese thinking was that president Trump's urging for the Federal Reserve to lower rates was a perception sign of the weakening U.S. economy. It also may have misread the extent to which Mr. Trump trusts Mr. Robert Lighthizer, who Mr. Trump respects for winning a good deal with the Japanese in similar situation of Japanese rejection of U.S. demands. Mr. Trump also thinks the U.S. has a strong economy, is the largest world producer of oil, strong economic growth in the last quarter of 2018, is also negotiating better deals with other countries including the ones with Mexico, Canada and South Korea. It is also much less dependent on exports to China, giving it a stronger position with more experienced negotiators. China has whole sectors of its economy dependent on exports to the U.S., and crucial numbers of jobs at stake.  China also misread the signals from its stronger than expected economic growth from stimulus efforts in the last quarter, leading to it staking out a tougher position than the U.S. would accept. The U.S. position was set after decades of waiting for China to change and was unlikely to be affected by any temporary considerations.  As a result the U.S. not anticipating the Chinese response of deleting key sections agreed to in advance from the 150 page written agreement gave a strong response. Mr. Mnuchin who accompanied Lighthizer in talks says Mr. Lighthizer "read them the riot act" to the Chinese side. For the Chinese side the effort now shifted to continuing good faith talks without appearing to back down. ...

This report in ProPublica on October 13, 2020, by Lydia DePillis was written near the end of Robert Lighhizer's term as US Trade Representative.  Bottom Line: It is human behaviour that no country, no kingdom or group will give up its money advantages secured when the opposition was weak or disorganized till the last fight is fought. The British were not giving up India, a source of financing the war against Napoleon in 1800's and then the Industrial Revolution in 1850's, the Dutch were not giving up the financial advantages of their Spices Empire in Batavia (Indonesia). History has shown this. Once gained under a state capitalism Japan was not going to give up its financial advantages gained by the 1980's when the US was weak or disorganized, till the last battle was fought.  Lighthizer who for the relentless Japanese was equally relentless till the goal of fair and level playing field for America was secured. This is true for China today on Liberation Day. This entire report by De Pillis in 2020 shows the Chinese would be relentless in 2020 like the Japanese in the 1980's, the Dutch in Indonesia  in the 18th and 19th century and the British in India in the 19th century and 20th century. China turned Mexico and Vietnam into supply routes into the US market. It continued its efforts to gain US technology in other ways. USTR older officials from the Bush Obama years of failed negotiations with China and endless hours putting together minute details of agreements including the TransPacific Agreement of Obama were not going to like the new approach of Lighthizer so stuck were they with the old approach of no clear goal and not getting an even playing field from China. ...

WIth China reluctant to make concessions on agricultural imports at a recent Shanghai meeting of Mr. Lighthizer with Chinese trade representatives, the trade dispute with China has escalated. Mr. Lighthizer had little to show Mr. Trump at a meeting in the WHite House. After a 2 hour meeting Mr. Trump told his advisers that his patience was wearing thin. His response on what the U.S. should do- "tariffs." A tweet was prepared saying U.S. would place import duties of 10% on imports of additional $300 billion in Chinese goods. China responded by lowering its currency value to 7 to the dollar to offset the import duties. China also said it was suspending all agricultural imports of U.S. farm products. The U.S. designating China as a currency manipulator.  The situation today is that there is a level of mistrust between president Xi and his advisers and Mr. Trump and his team. The situation has taken a new turn with China saying the U.S. is supporting protests in Hong Kong. President Trump has stated China is waiting it out to deal with a new administration in Washington. Both sides do not see any solutions till after the U.S. elections in 2020. For China there is also the upcoming 70th anniversary of the People's Republic. ...

The Trump administration sends an official notice to Congress that it intends to renegotiate the NAFTA treaty with Mexico and Canada. The new U.S. Trade Representative Mr. Lighthizer served as Deputy Trade Representative under president Reagan in 1983. He says the focus of the negotiation will to promote economic growth and jobs by making improvements to the treaty. The notice does not mention major modifications of the type that were hinted at by president Trump earlier. The leaders of Canada and Mexico had asked president Trump to renegotiate. Republicans in Congress and business in the U.S. favor improvements instead of the drastic changes. Mr. Lighthizer's approach is stated in his letter that said "NAFTA was negotiated 25 years ago, and while our economy and business has changed considerably in that period, NAFTA has not." New provisions will be needed said Lighthizer for intellectual property rights, state owned enterprises, labor and environmental areas, with effective enforcement.  Because of the rhetoric and language used in the election campaign, it is important to note that Lighthizer has in the past negotiated favorable terms for the U.S. steel industry to prevent dumping from overseas. His style is the opposite of the president. He has stated- "I am friendly when negotiating. I am not theatrical. The art of persuasion is knowing where the leverage is." ...

U.S. strategy has shifted to keeping tariffs on Chinese imports intact as an enforcement mechanism to make sure China keeps to its commitments made in negotiations, says WSJ. U.S. trade negotiator Mr. Lighthizer sees the latest tariffs as leverage, and that tariffs would be removed only when China keeps its commitments made to the U.S. Initially Lighthizer opposed the move for additional tariffs imposed on September 1. Now he accepts the strategy to use tariffs as leverage. Mr. Trump told the Economic Club of New York that if no deal is reached in phase one then the U.S. will "substantially raise those tariffs, they are going to be raised very substantially." Because China is seen as not willing to provide written commitments with enforcement provisions the U.S. strategy has shifted to making the tariff removal an enforcement mechanism. President Trump has committed on the campaign trail to correct misalignment in trade with China. He makes the final decision in negotiations and use his negotiating style.  China sees making commitments on stopping all subsidies as affecting its sovereignty and its industrial model of state sponsored capitalism since opening in the 1990's to trade with the world. Both sides are looking for ways to gain the maximum concessions in Phase 1 of the trade deal as it is very uncertain whether any further progress can be made given the positions on each side, say experts. ...

U.S. Trade Representative Robert Lighthizer was the negotiator who tackled Japan's huge trade surplus in the eighties under president Reagan. In 1985 he was the Deputy Trade Representative under Reagan. He negotiating a trade deal with China that includes U.S. tariffs on Chinese products. Here he tells the incoming Biden administration that the tariffs were a good idea in the American interest, and should remain in place till China reduces the huge trade surplus with the U.S. Lighthizer says "we want a China policy that thinks about the geopolitical competition between the United States and an adversary- an economic adversary." As this report says the cleavage with China has widened since then with the the virus that started in Wuhan, China, then spread to the U.S., killing more than 387,000 Americans and with 23 million people affected by the virus. Lighthizer has serious questions about the approach of the Biden team to seek consultations with allies in Europe and Asia. With his long experience  he is one of the very few who understand how things work. He says the U.S. started dialogues in the 90's. Nothing happened. "All of them were just a waste of time," says Lighthizer. Other countries could slow or veto U.S. actions. This is why the new incoming administration needs to show it has learned from history. U.S. president Trump names Robert Lighthizer, the U.S. Trade Representative, as head of trade negotiations with China, following a weekend summit of G-20 in Buenos Aires where he setup a truce with Chinese president Xi Jinping. The truce means the next round of tariffs on $200 billion of Chinese goods will be suspended. China had hoped Treasury Secretary Mnuchin would head the negotiations. Mnuchin had negotiated with China earlier. Lighthizer has taken a long view on the negotiations wanting to strengthen the U.S. position particularly in relation to protecting U.S. technological edge and preventing transfer of U.S. technology to China. Trade expert Pillsbury of the Hudson Institute says this steers the negotiations from informal under Mnuchin to the legal negotiations under a trade negotiating team of Lighthizer that have set forth the charges against Beijing under U.S. trade law. The outcome sought is a legally binding document that commits China to getting certain results to reduce its trade surplus with U.S. of about $1 billion each day. Mr. Trump called for "level the field" in a message after the G-20 summit. Specific details of about 142 issues in trade were brought up in the talks of Trump with Chinese president Xi in Buenos Aires. ...

In this thoughtful essay Bob Davis of the WSJ asks whether the decision of the Clinton administration to admit China into the World Trade Organization was a bad one for the U.S.  Mr. Clinton in 2000 tried to persuade Congress citing words of president Woodrow Wilson that of a dream "of a world full of free markets, free elections, and free peoples working together."  Every year China would have its most favored nation status renewed with help from supporters in Congress. After WTO entry this was not necessary. Chinese leaders saw the entry into WTO as a way to knock down trade barriers, to act a wrecking ball for the planned economy, to give the economy a big boost.  In 1994 China was a relatively backward economy with 60% of the population living on less than $1.90 a day. Hard to imagine today.  Not everyone was convinced that it was good for the U.S. This included a trade attorney who had tackled a huge trade deficit with Japan in the Reagan period- Robert Lighthizer. Lighthizer was Deputy Trade Representative negotiating with the Japanese. His prediction was that no job in America would be safe once China entered the WTO, that China would become a dominant trading nation.  Robert Cassidy, 73, trade negotiator for president Clinton looks back on that time and says that he regrets what has happened, that all his work night and a day only benefited business and hurt workers. David Autor, MIT economist and his colleagues,  in a later study documented loss of 2.4 million jobs to Chinese competition between 1999 and 2011, in many manufacturing towns dotting the landscape of America, particularly in the midwestern states. And the expectation that the higher economic growth would lead to less political control did not turn out to be true.  In the process multinationals rushed to China after WTO entry and China became the world's manufacturing floor. By 2013 China's per capita income reached $7000, after years of fast GDP growth approaching 10% a year.  About 400 million Chinese were lifted out of poverty from living on less than $1.90 per day from 1999 to 2011, according to the World Bank. A big problem was that the U.S. did not plan for the change from WTO entry. No resources were allocated for the plan to let American workers adjust through worker retraining and special trade handicapped income support, to allow for a slow planned shift. Instead the pace of growth was faster than that which the U.S. faced with the Japanese export offensive in the eighties. China experienced double digit growth after 2000. The irony is that the Republican administrations that followed Clinton followed a policy of free trade to the advantage of China's state run economy when working class Americans voted mostly for the Democratic Party. Little was done and little said in the media from Democrats and Republicans in Congress and the establishment during this time even after Mr. David Autor documented the effects of trade in the U.S.  Till Mr. Trump recognizing the alienation in communities hit by job losses from trade upended American politics, shifted this part of the electorate to the Republican base. Mr. Lighthizer's view is that complaints about China should be left out of WTO because it is naive to tackle it that way. With a $375 billion China trade deficit for 2017 the challenge has to be met in a different way, and the U.S. has to rely on regaining its economic strength within a fair trading framework. Having negotiated with the Japanese Mr. Lighthizer sees the approach adopted then as the one right for today. During the long negotiations Lighthizer is said to have received many negotiating positions of the Japanese signifying no change in long sessions. He once simply made a paper plane and sent it right back, in one of these sessions. He meant that the U.S. was serious about reversing the imbalance in trade. ...

President Trump's willingness to use U.S. economic strength through tariffs, sanctions and other methods comes from the view that in the decade of the 1990s and 2000s U.S. worker and the U.S. was suckered by others. In this situation it was seen as acceptable to use U.S. tariffs and economic pressure to fix a global trading system and a China trade surplus with the U.S. exceeding $300 billion a year. Mr. Lighthizer it should be remembered, now the top trade negotiator with China was also the trade negotiator with Japan when it enjoyed a similar trade surplus with the U.S. during the Reagan administration. Economic pressure did not have to be ratcheted up to this level with Japan at the time. Japan was an ally at the time in the Cold War, Today China is seen as both a global competitor in world affairs and a technological competitor. Unlike the situation with Japan many Republican and Democratic administrations had failed to tackle the growing trade imbalance with China till it had become unsustainable. The views of Mr. Trump on trade were views articulated by Mr. Lighthizer for the last ten years resulting in a shift in opinion on trade in the U.S. by 2016 where a majority of people in the U.S. felt that globalization and world trade was working against American workers and industry. Mr. Trump as a Republican was both responding to the failure of others to tackle trade issues hurting the U.S. worker and business, as well as rallying support from workers, farmers and business to his party.   ...

Robert Lighthizer, U.S. Trade Representative, makes a passionate plea for the dignity of work in America, the founding principle for the society of opportunity that America has been and the reason it was settled by immigrants from Europe over 200 years. He points out that trade policy is not about geopolitics or about efficiency as others perceive, it is about what kind of society we want to live in. Is it about a society of opportunity? This is the foundation on which this American continent was settled by settlers from Britain and Europe, and the basis of the growth over two hundred years till the last four decades. From 2000 and China's entry into the World Trade Organization under president Clinton to 2016 the U.S. manufacturing base has shrunk with the loss of five million jobs, two million jobs lost to China in the period 1999-2011 alone. And 350,000 automobile manufacturing jobs to Mexico since 1994, one third of all U.S. automobile jobs. Without the initiative and hard work of Mr. Lighthizer both American workers and Mexican workers would be stuck in low paying jobs. The USMCA he negotiated changed all that by giving Mexican workers fair wages and American workers and manufacturing the opportunity for revival.  This view was also expressed by Intel founder Andy Grove, a founder of one of the first pioneer companies in Silicon Valley. Grove asked the question after seeing the outsourcing of production out of America and the condition of the American worker- he said for him it was about what kind of society he wanted to live in. It was all about the dignity of the American worker long ignored by economists who live in a world of theory and the elite that has lived for so long apart from the places where the fabric of American workers and working life was torn apart. It was a question that touched Andy Grove's heart just as it does for Robert Lighthizer and others who are fighting to make America a society of opportunity for the American worker and opportunity for the American people, for dignity in America. It also charts a new course for the French worker, the British worker, the Indian worker, as other countries learn from the American experience. We have covered Grove and Lighthizer from the early days of their leadership and wise reminders to the people of what America is and stands for. Lighthizer points out one huge error that makes the thinking of these economists and elite that have not listened for so long, more than a bit crazy, reckless and callous. He says there about half of 250 million adults who lack a college diploma in America. Historically manufacturing has provided stable well paying employment. Even if with investment in education they were taught to write software code, there aren't enough jobs for them. The combined total of jobs at Apple Google, Facebook and Netflix is 300,000 jobs. Neil Irwin in the NYT why the U.S. China Phase 1 Trade Agreement is more than a hill of soyabeans as he puts it, more than about all the soyabeans that the U.S. farmers can sell to China. China's economy was seeing the effect of U.S. tariffs. Additional tariffs to cover all imports from China to the U.S. would have worsened this. China avoided this by agreeing to Phase 1. The U.S. had looked for some enforcement mechanism based on China putting this down in a written agreement particularly for avoiding subsidies to state enterprises and improper access to U.S. advanced technologies. China's reluctance to do this led to Mr. Trump saying that China had reversed its position and Trump expanding the tariffs stage by stage. These issues are now set aside for Phase 2 still to be negotiated. Both sides taking what they could get. China relief from the threat of tariffs on all exports. The U.S. under Mr. Lighthizer's negotiating leadership retaining the enforcement idea through the tariffs that are still in place of 25% on half of China's exports to the U.S. The bonus for Mr. Trump is the goodwill China generates by agreeing to buy all the U.S. farmers can produce, farmers having not only stood behind Mr. Trump but also forming a key part of his support base. China will continue to compete in technological areas with the U.S., and the state enterprise model which worked for China as Mr. Xi tells visitors will continue. Phase 2 is just that Phase 2, when and if it can be negotiated between Trump with his negotiator Lighthizer and Xi with his negotiator Liu He. On key points neither side is budging. A key goal for Mr. Trump is to put the trade surplus China enjoys of $300 plus billion a year with the U.S. on a serious downward path, and bring so many of the jobs and manufacturing back home. President Trump plans to introduce  tariffs of 25 percent on steel and 10 percent on aluminium. It is not clear whether this will be targeted at Countries flooding the U.S. market with cheap metals, or generally for all countries. Executives from the steel industry and aluminium industries met with Trump at the White House. This would fulfill one of the president's campaign promises.

There is a vigorous debate in the White House between advisors who advocate limiting the measures such as Gen Mattis at Defense, Gary Cohn at the Economic Council, on one side, and the Trade Representative Robert Lighthizer, Peter Navarro, on the other. 

Mr. Lighthizer has convinced the president of the need for strong action, yet he has hesitated in the past. Now president Trump says he wants "free, fair and smart trade," and will not let "American companies and workers be taken advantage of any longer."

If the trade war escalates to the point at which president Trump imposes tariffs on all Chinese goods imported into the U.S. on Jan. 1, 2019, China could retaliate with its own tariffs and this might affect Boeing aircraft as well. The negotiations so far have shown China misread the U.S. and Mr. Trump leading to a strong U.S. response.  There is also the importance of not losing face, Mr. Xi's domestic audience, Chinese industry that sees a fundamental change from state subsidies model as eroding its position and offering resistance, patriotic sentiment making it harder to meet U.S. demands. Fundamentally for Mr. Trump it is about U.S. trade deficit and changing the huge trade surplus of almost $1 trillion that China enjoys each year with the U.S. which has been and is no longer sustainable. Mr. Trump also has the backing of Republicans on this issue and Democrats cannot afford to be soft on this issue as it involves American workers and jobs are at stake. Both sides could be in for a protracted negotiation as Mr. Trump feels it is right for Americans to expect fair trade and technology transfer that respects American concerns. In addition the U.S. could sense that it exports less to China, is less dependent on exports than China, and as the party that is hurt by unfair practices insist on its position. After Japan agreed to U.S. demands that it reverse a huge trade surplus in the seventies in which Mr. Lighthizer was the negotiator its growth declined sharply and is economy stagnated. China may sense inside that this could happen to its economy. There is a two week period before the 25% tariff on steel coming into the U.S. goes into effect. This gives time for Canada, Mexico, the EU, Japan and other countries to come up with offers to negotiate or as with the EU come up with its own plan to put tariffs on some American goods. An exemption for Canada is supported by the United Steel Workers Union, as many American companies make steel across the borders. Canada sends the most steel and aluminium to the U.S. With the departure of Gary Cohn as economic advisor, Mr. Lighthizer, the U.S. Trade Representative who pushed for the tariff plan becomes a trusted advisor to the President. Lighthizer is to be seen in Lyrarc pages as having consistently supported fair trade and protecting U.S. workers in these situations since his work in the Reagan administration. The other advisors who are ascendent are Peter Navarro, a trade expert, and Wilbur Ross, the Commerce Secretary. For the first time the U.S. focuses on the huge trade deficit with China in a serious way. The trade negotiating team led by Robert Lighthizer has set forth its negotiating terms.  1. China must reduce its trade deficit with the U.S. by $100 billion in the first 12 months. In the next 12 months it must reduce its deficit by another $100 billion. In 2 years the trade deficit the U.S. has with China must come down by $200 billion. The issue is no longer just the tariffs on steel, it is about the core issue of balance in  trade. 2. The U.S. says subsidies to state industries in the "Made in China 2025" program must stop. Here the focus is on gaining an unfair technological advantage with a combination of U.S. technology imports and subsidies to state advanced manufacturing industries to erode over time the U.S. technological lead.  3.  China is expected to cut its tariffs by about two thirds on imported products so that the tariffs match that of the U.S. This is the first serious negotiation the U.S. has conducted with China on the core issue of the trade surplus which is growing with a stronger dollar not declining. The surplus approaches $1 billion each day for about $365 billion a year, unsustainable from any perspective. The vital issue of the erosion of the U.S. technological advantage under the Made in China 2025 has turned this issue into one in which the U.S. is unlikely to back down. Especially now that Mr. Lighthizer is leading the  negotiations and has the confidence of the president of the U.S. Lighthizer is a veteran of negotiations from an earlier period -under the Reagan administration in a similar situation with another national competitor- then it was the Japanese. For the first time in decades the U.S. trade deficit with China is falling significantly. China's exports to the U.S. dropped 12.5% to $296 billion in 2019 from $323 billion in 2018, according to Chinese customs data. Actually China's trade surplus with the U.S would have fallen even more had not the U.S. exports to China declined by 21%. With the Phase 1 trade deal negotiated recently U.S. exports to China will increase significantly, while 25% tariff on $250 billion in Chinese goods still in place limits China's exports. This means in 2021 and 2022 and years ahead China's surplus should shrink much faster achieving one of the principal goals of Mr. Trump and his trade negotiator Mr. Lighthizer. Mr. Lighthizer was chosen by Mr. Trump for having accomplished a similar goal decades back in the eighties with Japan's surplus. Even though China has not stated this in writing, American officials have said China will increase purchases of American goods and services by at least $200 billion over the next 2 years from 2017 levels. China and the U.S. have essentially agreed that the two economies so tightly intertwined works to the detriment of the U.S. with the Chinese surplus creating tensions. China will now have the European Union as the largest trading partner followed by south east Asian countries, and other regions. China decided that its priority is technological development and was unwilling to meet U.S. demands to reduce its efforts for technological competition and access to western technologies. Instead opting for shifting it economy away from dependence on exports to the U.S. in a gradual way. The other demand of the U.S. for stopping state subsidies is also a concession China is not willing to make as it sees it as an economic feature of its business model that is working and a competitive advantage.  This leaves the U.S. with a limited win so that trade and resulting jobs can be brought into favoring the U.S. a key Trump goal, and not a win in the technological competition with China which will continue. ...

This editorial in the WSJ argues against Trade Representative Lighthizer's move to increase the percentage of North American content in a vehicle so that it creates more jobs. Currently Nafta rules require 62.5% of a duty free vehicle be made in North America. Lighthizer wants to lower the content coming from Asia or Europe. This is not favored by Canada and Mexico and it makes Mexico less competitive than it is now.

Robert Lighthizer was one of the early voices on unfair and imbalanced trade with other nations subsidizing their industry at the expense of American jobs in manufacturing long before DJT took up the issue in 2015-2016. Lighthizer as US Trade Representative negotiated the new USMCA that replaced NAFTA agreement for North American trade with Mexico and Canada. 

Lighthizer was seeking a larger role than USTR, either Commerce or Treasury, yet he was reluctant to campaign for this or go to Mar-a-Lago to make his case. As a result says WSJ, he was passed over as Luttnick and Bessent tried to get DJT's attention. Another reason he was passed over is that DJT is  sees the continuing flow of fentanyl and the migrant flows from Mexico, the sourcing from China, as serious issues that require using trade as part of the solution by 2024 if Mexico, Canada and China do not cooperate and hurt US interests.
