US DJT administration using Section 301 creates the tariffs the US Supreme Court struck down- the EU, Mexico, Canada at 10%, Japan,, India China at 12.5%- June 2 2026. These countries are not doing enough to control the importation of products made with forced labour. This only goes to show what was said at that time and which the SCOTUS itself said the DJT administration could do, find other laws by which the same tariffs could be imposed. By the time the US Supreme Court reviewed the case it was already clear that all these countries had accepted DJT tariffs, and most had negotiated fair deals with the US including making up for past abuses by these countries of the international trading system. The US Supreme Court its shortsightedness ignored this or did not quite grasp this as Justices legal knowledge of facts does not mean grasp of the facts of commerce, trade and business and the history underlying it. Jamieson Greer interviewed at the Council of Foreign Relations this week and Robert Lighhizer in Foreign Affairs (covered and summarized on these Lyrarc pages this week as found rarely in other places) have documented these abuses in detail leading to the US losing $20 trillion in wealth shifted to these countries and its manufacturing dependent communities devastated by loss of over 5 million jobs through the shortsightedness of Bush/Obama adminstrations who let this happen, and these countries that took advantage with reckless disregard for these communities in the US, on a scale unknown in history.  ...

The broken world economy has hurt the American people, in small communities and towns across the US whose societal fabric was destroyed by a system of world trade with abuses done by China. Japan, European Union, Canada and Mexico since 2000. Shortsighted American leaders and economists allowed this to happen. Robert Lighthizer on the New World Order a new system of world trade that replaces the old in 2026. The old trading system was one in which lip service was made to free trade while all the time the system was used by Japan, Germany, China, Canada, Mexico and other nations to build non tariff barriers and other policies to support their industry  at the expense of the United States leading to disillusionment in the US. The facts are mind boggling- the loss of 5 million jobs, many small communities across the US decimated with loss of jobs. About 20 trillion in wealth transfers to China and other countries over 2000-2020, with foreigners owning $27 trillion more of US assets than the US owns of theirs. US Trade Deficits that went up by 40% in 4 years of the Biden administration from $800 billion to $1.2 trillion. Economists and weak leaders got it all wrong allowing this to happen from Geoge W. Bush to Clinton Bush and Obama. Lighthizer says "shortsighted leaders aided and abetted this process," from 1990 to early 2010. Consider that US had 17.3 million  people in manufacturing, in factories all over the US in 1970, in 1999 we had the same number of jobs, even though there were changes in technology and productivity- the US held its own with the rest of the world. The Bush, Obama years were the worst for the US industry - by 2026 we have 12.6 million - loss of 4.7 million jobs since 1999. And real median household income took a big hit growing from $72,000 to $84,000 about 17% in the last 25 years, compared to twice that in the period 1975-2000 prior quarter century. The result is the fracturing of American society- and dire consequences for healthcare as communities suffered from loss of jobs leading to drug overdoses, alcohol abuse and suicides, which are common in post industrial American communities. Think of this fact: two thirds of America's workforce that does not have a college degree, that is working class people, lives 8 fewer years than college graduates, a gap that was only 2.5  years in 1992. The wars carried on by Bush and continued by Obama in the Middle East also wracked these same communities till Biden and DJT pulled out. One has only to drive across America to see this with one's own eyes. Trade may be an abstract topic for economists and politicians- there is nothing abstract about this. And the economic growth of the US has suffered with the unfair trading system with China, European Union, Japan, Canada and Mexico. From 1945 to 2000 American growth was 3.2% a year. Since 2000 only 2 years of growth over 3%. US has not seen historically normal growth for the last 19 years and at this rate (if we continued along this path) the Congressional Budget Office says 1.8% growth for 2027-2035. There are other factors yet the the major driver of this is our trade deficit of $1.2 trillion dollars a year. It is a story of remarkable persistence in the Nation's interest through 2 adminstrations- this Lighthizer story. Lighthizer fought Japanese commercial interests as Deputy Trade Representative under Ronald Reagan, and as US Trade Representative under DJT in the first DJT administration in 2016-2020. His Deputy at the time is Jamieson Greer who is now the US Trade Representative in the second DJT adminstration in 2025. For 30 years this brave American patriot has fought to reverse the bad actions of presidents and economists that have led to devastating losses in the American countryside. He says any new trading system must be perceived as fair to working people. It will survive only if working people think it is good for them. It cannot and must entrench a small, permanent elite. The benefits going to labour must be at least as great as those going to capital. It should create fulfilling high paying jobs for the vast majority of the American people. This is America's new promise to its people, its new compact with its people. ...

US Trade Representative Jamieson Greer says this is not chaos in tariff policy because you don't change 70 years of policy overnight. He says China's is highest because it has the highest trade deficit, then EU, Japan, South Korea at 15% because of the smaller deficits with these nations, Vietnam because it is used  by China to send products to the US, India because of geopolitical reasons buying Russian oil. See Dasha Burns, Politico White House Bureau Chief's  interview with USTR Jamieson Greer.  He says about India- Jamieson USTR calls India "an outlier" and says "I'm confident we will get a deal with India in the near future." India he says has largely corrected its imports of Russian oil and negotiations are underway for a deal.  ON USMCA Greer says of the $31 trillion in trade with Canada and Mexico $29 trillion is us right. trade between Canda and Mexico is small. So he says it makes sense to negotiate separately with Canada and separately with Mexico. This suggests that there doesnt need to be a USMCA- separate deals are just fine says Greer. Mexico has gained much in automobiles under USMCA- US wants to make more in the US including auto parts which it can do by negotiating this with Mexico. It does not make a ton of economic sense to marry the three economies together, says Greer, as the import export profiles, lab,or situations are all different. Are Tariffs good for the economy and do they lead to higher prices? Greer says inflation was down in the first DJT term in trade with China and tariffs. Greer says there is never a 1 to 1 with tariffs. It tariffs become a kind of leveage in getting agreements. That is the style of these tariffs. You tell Ecuador or Brazil we don't make these here so there will be no tariffs on bananas and on coffee. Says Greer- we have seen inflation in check, imported goods relatively low priced. We have seen that we can have growth and higher wages with tariffs at the same time. The growth in 2025 third quarter at 3.8% annual growth, and Atlanta Fed predicting 4.2% growth in 2026. And tariff money can be used for paying down the debt and financing America's reindustrialization, Greer says members of Congress are asking about this.When a new administration comes tariffs will still be part of the playbook. ...

Tariffs are unconventional tools for border security yet appropriate in situations such as these. Canada could have done this before a 25% tariff was announced by DJT- it would have been common sense for Canada to do what it did after the tariff before the tariff- put 10,000 frontline personnel at the Canadian border with the US, appoint a minister in charge of drug flows and fentanyl, and list cartels as terrorists. Considering the damage to the US from the border it was imperative that Canada, and Mexico took responsibility for the borders a long time ago. 

Within 24 hours of the Trump announcement of 25% tariff on Canada and Mexico the leaders of the two countries turned around to do what should have been done a long time back.

Plan B for US president DJT on Tariffs - Section 122 of the 1974 Trade Act to place a 150 day 15% tariff. Section 232 of the Trade Expansion Act of 1962. Trade Investigations under Section 301. Much of this set of laws are already in place and being used by the US. A law passed in 1930 is another avenue for tariffs Section 338 of ther Tariff Act of 1930. The US government and US president DJT could also have Congress enact a new law as it has majority in both the Senate and the House and the president could make acase for the reasonable use of tariffs with the EU and Japan having taken advantage of trade to the disadvantage of the US. There is also broad support for fentanyl action by the president using economic action on tariffs on nations Canada, Mexico, China that continue to let the flow of fentanyl across their borders for use by drug trafficking gangs in Mexico to send over US land border at the 2000 mile long US-Mexico border.

For a decade America's leaders remained silent on taking action on all fronts including trade on countries that were sources of fentanyl. The largest and most advanced economy in the world did not take action to protect its people when countries acted with impunity on fentanyl flows. That action is being taken now. It took action by DJT for what Canada and Mexico could have done from common sense. This is an unconventional use of tariffs by the US. Yet this was an unconventional situation in which the US under several administrations Republican and Democrat Clinton-Bush-Obama, allowed the situation at the Border leave the US in a deteriorating situation with its neighbors to the north and south. Canada and Mexico could have acted before the 25% yet they did not act till the tariff was imposed. A situation such as this cannot be found in the history of the United States of America from its founding in 1776, not in 225 years has the US seen such loss of life from fentanyl and drugs crossing its borders, or the constant flow of illegal migration, neglect of its auto industry and jobs in the US. Action that needed to come ten years back is finally taken. The new US president DJT says- "I have had many talks with China about the massive amounts of drugs, in particular fentanyl, being sent into the United States – but to no avail. Representatives of China told me they would enforce their maximum penalty, including the death sentence, for any drug dealers caught doing this, but unfortunately, they never followed through. As a result, drugs are pouring into our country, mostly through Mexico, at levels never seen before. Until they stop, we will charge China an additional 10% tariff, on top of any existing tariffs, on all of their products entering the United States.”  "On 20 January, as one of my first executive orders, I will sign all necessary documents to impose a 25% tariff on all products coming into the United States from Mexico and Canada, along with addressing its ridiculous open borders. The WSJ is still calling the president's stop fentanyl flows tariffs on CMC Canada Mexico and China economic tariffs in this editorial board opinion. It is incomprehensible that little or no mention is made in most of the media of the magnitude of injury to the US, the 490,000 deaths in America over 12 years as the result of Canada, Mexico and China not taking the needed action to stop fentanyl flows into the US. There is also the added factor of lack of a level playing field in trade which has resulted in the same communities in many cases having suffered from in the case of China loss of 25 million jobs over the last 10 years and loss of $250 billion in infrastructure and public services for schools, libraries, childcare, and health care clinics that were lost from losses in taxes for local communities in the US. This has decimated life in these communities and in small towns across America.  In the case of Mexico the illegal migrant flows that were not stopped at the border have put an added burden on already underfunded and strained public services in local communities in the US. This is the reason for much of the frustration and anger that has built up over time in these communities with the response from the DJT administration to find solutions. CMC countries could have taken action on their own, yet the US had waited too long for this action. Reciprocal in reciprocal tariffs is about fairness, a level playing field, something that China had agreed to in the spirit of the WTO entry in 1994 and American desire to aid China industrialize build a modern economy. Instead US business was coopted by China during the industrialization process 1995-2010, 2010-2020, including in the first term of the DJT administration even when tariffs were imposed. This happened with transfer of technologies happening late into the first term of the DJT administration 2016-2020, which has led to a much of the pent up frustration and action in the first 100 days of DJT in 2025.  ...

US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026. In this way the goals of the US as a Nation can be achieved of reducing the supply channels concentration in China, cutting supply chain concentration in China, for fair trade with trading partners EU/Japan, and for action on fentanyl and drug trafficking. Justice Roberts and his team have a lot to think about in this effort by the Nation to correct abuses that should never been allowed to happen. ...

The Guardian's Greenhouse says the UAW sees the tariff action with 25% tariff on cars imported into the US starting April 2 2025, as a positive step.  Shawn Fain of the UAW who had the support of president Biden during his term 2020-2024 says DJT's actions match those taken by Biden to help working class Americans and the middle class. Supporting the president “for stepping up to end the free trade disaster that has devastated working-class communities for decades”. “Ending the race to the bottom in the auto industry starts with fixing our broken trade deals, and the Trump administration has made history with today’s actions.” Greenhouse is concerned that the way it is being implemented can create problems with tariffs on one day and off the next. The reason for the on again off again action was to give Mexico, Canada, and China time to respond with action they have not taken on fentanyl flows into the US, and Mexico time to address migrant trafficking across its borders. The US International Trade Commission study in 2024 on the 25% tariff on US auto imports cited by BBC shows it would reduce imports by 75%, increase prices by a modest 5%, and increase revenues of auto makers in the US by 5%. Figures such as prices going up by $6000 may apply to BMW's that are imported from Germany and carry high price tags for a very small very affluent customer group unrepresentative of the US automobile market. ...

The US Fed under Jerome Powell stress tests of 31 banks for 2024 shows the banks can withstand a rise in unemployment to 10% and 36% drop in house prices. This is relevant now that the new administration of DJT makes another effort to correct the huge trade imbalance with China, Mexico and Canada, which itself is destabilizing in the long run and needs to be addressed. The first term of DJT failed to correct the imbalance with new tariffs kept in place by the Biden administration. This is not just one's imagination, reports suggest China has poured $230 billion of subsidies into its EV industry since 2003 mandate given by premier Jen Biao to dominate that industry. And now has capacity of 20 million car production a year, twice the domestic demand in gasoline cars, wanting to send the surplus production to the US and Europe. This isn't the 1930's type of tariffs, it is simply to get a fair even playing field for trade, where no one side is massively subsidizing and dumping which is one of the principles of WTO free trade that is being broken by China and Mexico. Specifically the anti dumping clause in Article 6 of the 1994 GATT agreement on free world trading mechanism to ensure free and fair trade. ...

DJT plans for 25% tariff on all imported cars goes into effect April 2, 2025. It is intended to promote additional investment in the US auto industry, boosting jobs and wages in the US. These countries have now wrapped their behavior around national sentiment even though they very well know how the US has looked out for Europe, and especially China throughout cataclysmic events in the 20th century and the 21st century such as foreign occupation and failures in modernization. By 2015 the US which had given Europe the Marshall Plan and helped Japan rebuild from the ashes of World War II, South Korea rebuild from the devastation of the Korean war, and China rebuild after the failed industrialization experiments of the 1960's and 1970's, was now facing nations that only saw this as a One Way Street, making the US look stupid and showing a degree of irresponsible behaviour on fentanyl, drug and migrant trafficking  by Canada Mexico and China that has few parallels in history. The narrative from the US is that the US allowed Europe, Japan and South Korea, and Mexico as a manufacturing base for these countries 25 years since the 1970's when Japanese Toyota vehicles made inroads into the US market to help these countries recover, a post Marshall Plan benefit given to Europe and Asia. During 1995-2015 a series of weak administrations Clinton-Bush-Obama allowed the US manufacturing base to decline under a falsely premised globalization that served US financial interests but hurt US manufacturing towns and communities across the country.  This means BMW, VW cars imported from Germany, Subaru, Toyota, Nissan, Honda cars from Japan, Hyundai and Kia cars from South Korea, Chinese EV vehicles, and cars made in Mexico for Asian and European makers, all will face this tariff. ...

Trade economists from Ivy League universities, are still peddling the old theories on trade from textbooks that make no sense and have got America in this huge mess that it is in where other countries are ripping America off with unfair trade practices. These economists have turned a blind eye, turned their backs to the great damage done to industrial towns and communities across America for two decades with the loss of manufacturing. Take Irwin's point that the US would have to monitor rates on 13000 tariff line items. This is ridiculous because the US simply needs to monitor the key products such as semiconductors, oil and gas, LNG. In just one negotiation with India the US having a trade deficit DJT states of $100 billion with India- terrible trade. By opening up supply of LNG and oil US can fill India's needs for Oil and LNG and cut the deficit to zero. Who came up with this idea. Indian PM Modi and his trade team. Once it was known that the status quo was unacceptable India came up with its own ideas lets import what we get from Russia from the US. Yes we had discounts from Russia but that was when oil prices were high. DJT's effort to get oil prices down by increasing US production will make it possible for India to get this oil at similar prices. India is a much bigger economy now than during Covid 5 years back India can do this. US and India win-win by doing joint aviation production deals and US gains with sale of F-35 stealth fighters. It is just common sense. Sadly, much of this is common sense that is beyond Ivy League Economics departments at American universities.  Reciprocal Tariffs make a lot of sense because this is how fairness is done- for China, for India. In the case of Mexico, Canada, China, on stopping flow of fentanyl- this reciprocal tariff is not a tariff it is as Commerce Secretarty Luttnick pointed out domestic policy of the United States. Which country would tolerate 490,000 deaths from fentanyl over 12 years and not take domesti policy action. It is not that the policy actions are taken it is that these action should have been taken a long time back. ...
