Greg Ip's 2026 warning about Stablecoins citing 1837-1863 privately issued bank notes fragmented fraud prone and outside the official banking system regulation will be remembered years from now when this crypto (anything but stable in the true sense of the word)  leads to a fianncial crisis. Stablecoins crypto currency that is similar to private banknotes issued between 1837 and 1863 with banks issuing their own currency- fraud widespread even with state laws like todays Genius Act. There were many bank failures and financial crises in that period. The state laws in the 1840's required the banknotes to be collateralized but fraud inevitably creeps in as it might with stablecoins.  Leading to financial crises as private capital shrinks and affects public capital that are US Federal Reserve bank notes we use as dollar bills. Today 84% of illicit activity is conducted using these crypto currencies and only 1% used for transactions. Proponents ( who stand to benefit in some way) call it a new efficient way of transactions. But the facts dont lie. Not only are stable coins used for only 1% of transactions, and illicit activity conducted through crypto coins, but also most of this currency is held overseas not in the US where it is less regulated. Federal Reserve has always questioned the value of crypto currency. Here is what Bank of International Settlements (international institution similar to Federal Reserve) has to say-“Stablecoins attempt to import credibility from public money while operating outside the established settlement system.” -Pablo Hernández de Cos, general manager of the Bank for International Settlements Holding Treasury bills as collateral does not remove the basic problem in is design. Issuers are for profit. The Federal Reserve is not for profit. And the Federal Reserve is part of a whole regulatory structure, Stable . laws have loopholes, and coins lack that kind of regulatory structure , making stablecoins prone to failure, an accident waiting to happen. Tether has $190 billion and Circle has 76 billion for about $300 billion in private capital tied up in this undertaking and posing risks to the Us and world financial system. ...

The Musk View - the Open AI lawsuit case against Sam Altman was about looting a charity by the founders. Basically Musk is saying he gave OpenAI $38 million and became one of its founders because of its non-profit business, not because it was afor profit business which would have raised many questions about the risks of for profits doing the wrong things with AI just for profit. Then Sam Altman breaks the promise of staying non-profit for his personal for profit gain, turns it into a for profit without answering any of the questions raised about the dangers of AI without regulatory safeguards into something worse than social media apps that spread fake news endangering democracies, and endangering education of a young generation, mental health risks for girls and children. Competition with China- in China much of it is controlled by the state and the state imposed limits on social media, to protect China's children and young people's educational needs. Tim Higgins says Musk lost but proved his point anyway on X and in the media so much so that speakers at commencements in American universities are being regularly booed  when they bring up AI.  Public perceptions have still not been shaped by the real issue - the massive misallocation of funds, the dubious propositions, the lack of normal financial scrutiny for return on investment that is supposed to happen in well run financial markets, ( is it or is it not a market system in the US as oligopolies are not free market systems), the failure to prove that the investments are viable by a long shot. Banks and capital markets are distorted in lending trillions of dollars to AI companies that cannot justify the investments on financial grounds of return in investment. Returns to the Nation and the American people, as well as financial returns are far better in rebuilding the  broken down infrastructure that America needs rebuilt, in investing in the industries that create jobs and strengthen competing with China and EU. How can the huge misallocation to AI of trillions of dollars, putting a burden on utilities to supply electricity for AI, and the distortion in capital markets to direct that money to infrastructure building and industrial renewal, be corrected? WSJ reports that there is a huge skeptical public on this issue. It is shown in Pew Research and Pew has not asked the question about alternative investments that are being starved of capital in what America desperately needs for reindustrialization and job creation, income creation, competition with China and the EU.   ...

Living wills of BNP Paribas SA, HSBC Holdings PLC and Royal Bank of Scotland Group PLC come under increased scrutiny from the U.S. Fed. These banks were added to 11 U.S. banks required to submit new drafts of "living wills" by the end of 2015, which ensure no damage to the U.S. economic system from a bank collapse. Only Wells Fargo & Co.'s "living will" was accepted by regulators as not causing economic damage. In making the decision the Fed and the FDIC agreed that the "living wills" were "not credible."

The Centers for Medicare and Medicaid Services ban Elizabeth Homes, CEO of Theranos, from running a blood testing laboratory for at least 2 years, and took away regulatory approval for its California lab. The questions about the irregularities in Theranos blood testing led to the voiding of all test results in 2014 and 2015 for its Edison device. Turner Adair, head of Britain's Financial Regulatory Authority thinks that banks have assumed an outsize role in the British and world economy, and are coopting their regulators. He sees the need to check many of the excesses. Why not use profits to build up reserves rather than give out huge bonuses and paychecks, he asks. He sees the need to challenge the accepted thinking on Wall Street and in the City of London, where the ideology of efficient markets became embedded, as it did also in the regulatory community. He came in the week Lehman Brothers collapsed as chairman of the FSA. And he wants to shake up the existing thinking. In March, the Turner Review. a 126 page report was published. A lot of attention was paid to his suggesting atax on financial transactions, called the Tobin tax, but its designed more to get people thinking and questionning the existing way of running banking as Turner said in an interview, "we have begun to accept this idea of liquidity as the new God." Can British or American society and the financial industry in both countries work to the benefit of both? Nobel prize winning economists and other experts have advised ashift to productive investments that grow the economy using technology, science and brainpower and new ideas, as opposed to the investment in mortgages and other speculative investments. As the regulators -including former and current heads of the SEC, and other regulatory bodies in the US, Cox, Schapiro and others- once held on to the same theory of uninhibited operation of free markets as best for generating increased wealth for society as the banking community, they tended to get co-opted in letting bad practices flourish. He says, "banks need to be willing, like the regulator, to recognize that there are some profitable activities so unlikely to have a social benefit, direct or indirect, that they should voluntarily walk away from them." Investments in science, technology and new products, as in the 60's that generated a revolution in living standards, than the mortgages and consumer lending of the last decade, is what he may be saying, as do these Nobel prize winning economists....

More revelations such as Pandora papers may not do much because the inertia is institiutionalized and the political system is available for hire, says Prof. Prem Sikka of the University of Sheffield, UK. He says armies of accountants, lawyers and financial experts support this system, the regulatory system in the UK is ineffective, and too many MP's are on the payroll of corporations, says Prof. Sikka in The Guardian. Anti-trust challenges to the Apple-Google duopoly in the U.S. and Europe. For years the regulatory process did not work as intended to maintain competition and open markets. In 2020 after years of neglect of proper regulatory functioning, fines of up to 10% of revenues are put in legislation for online harm or anti-competitive behaviour. The failure of regulators is one of the features of the last decade leading to the losses of capital that could have been better allocated to infrastructure, health education and paying down debt in the U.S. and Europe. This WSJ report says fintech or financial technology companies faced little regulation or critical oversight from regulators as regulators tried to foster growth in that sector. This puts more burden on shareholders to be vigilant, it says. Wirecard went into insolvency with huge losses and debt and accounts in the Philippines for over a billion dollars that were later proved not to exist. The astonishing aspect of the Wirecard scandal is the way German regulators not only did not investigate but pushed back against critics of the company's finances, that there was something fishy about the finances. Wirecard was established in 1999, and is described as a slow-burning story since 2016 when the stock price took off for a wild ride. This report says government regulators are relaxing important rules in the hope of coming up with a winner- this is proving to be a dangerous exercize and an exercize in folly, as it leads to losses of capital with no one taking responsibility among government officials or regulators. In the case of Wirecard the German officials even filed a criminal complaint against accusers, and banned short selling. of stock.    British and European financial watchdogs are acting as cheerleaders and watchdogs at the same time says the WSJ. Watch out it says when regulators play this kind of double role. During the financial crisis of 2008 the revolving door between companies being regulated and the regulatory agencies themselves was a defining feature of that period leading to huge losses of capital. Today this has taken on a new  and additional dimension, each time making things worse, even as infrastructure investments, investments in health and education are being deprived of capital because they benefit the public, and are not a benefit to small groups of well connected people willing to flagrantly conduct activities such as setting up accounts that do not exist for over a billion dollars.   ...

Japan's regulatory structure for the nuclear power industry is weak because of the dual role played by the regulator- Japan's Ministry of Economy, Trade and Industry. It regulates the nuclear power industry, and also promotes Japanese nuclear technology in Japan and overseas. The tasks are separated in the U.S. The Nuclear Regulatory Commission supervises nuclear plants in the U.S. It is independent of the Department of Energy which does research and promotes nuclear power. An earlier effort to correct this dual role arrangement in Japan failed, when an independent Nuclear Safety Commission was created under the cabinet. This body was never given the authority to inspect companies and mandate changes. A body that supports the commission has 4000 scientists and staff. It does research in nuclear technologies, but it has ended up becoming nothing more than a think tank, in the words of a former commission deputy chairman. What makes this situation worse, is the practice of amakudari, or "descent from heaven," a practice in Japan where senior Ministry officials retire young and take up positions in the private sector at companies like Tokyo Electric Power Company. In recent years most of the retired officials have taken positions in the energy sector. In fact Japan's Bar association investigated problems after a 2007 earthquake that shutdown a TEPCO nuclear plant. It recommended an independent regulator. The Democratic Party of Japan supported this idea before taking power in 2009. ...

Britain's Medicine and Healthcare Products Regulatory Agency looks at the information provided by the company. People in China with 800 yuan or $114 can now invest in low cost mutual funds. They can invest in 5700 domestic mutual funds offered by Vanguard's partner in China Ant Financial Services Group. Vanguard offers investment advice in assembling mutual funds. The investment advice will depend on algorithms not people to provide investment advice.  Ant owns 51% Vanguard 49%. Chinese investors are known for speculative approach to investing and making risky investments. By contrast Vanguard's approach in the U.S. is more careful and makes a serious effort to reduce risk with its index based mutual funds which it pioneered. China is making an effort to bring American companies into its financial  markets as part of the opening up sought by the U.S. Vanguard CEO Tim Buckley says his goal is "to fundamentally change for the better how individuals in China invest." Vanguard says it has taken the long view having worked for a long time on getting regulatory approval and its own approach for investing to introduce in China. It studied the market since 2018 talking to industry peers, regulators and clients. It says Chinese regulators appreciate Vanguard taking the long view. Today Vanguard's office in China has only 20 employees, and it has stayed away from setting up private investment funds for wealthy individuals and institutions which is permitted for western firms in China such as Fidelity International.  Vanguard's Mr.Bogle pioneered low cost index mutual funds that follow and index as opposed to having mutual fund managers determine investments. This takes the guesswork and individual bias out of the equation as experience has proven that over the long run this approach works best. Vanguard now has $6 trillion in funds under management, and is by far the largest mutual funds company in the world. It now has the potential to tackle a huge market of 900 million individuals in China. ...

The questions about LIBOR rate manipulation were first raised in front page articles in the Wall Street Journal in spring 2008. In 2013 Deutsche Bank's U.S. financial systems were strongly criticized by the U.S. Federal Reserve. In April 2015 Deutsche Bank made a $2.5 billion legal settlement with the U.S. and British regulators for LIBOR rate rigging and admitted wrongdoing. It took BaFin the German regulator a long time to flag these irregularities in a strong manner, in its letter to Deutsche Bank. The comments in the Senior Management Review section of its report for the first time expressed in this level of detail the problems at Deutsche Bank, including problems with 11 current or former executives of Deutsche Bank. The letter and report were sent to the bank's management board May 11, 2015. A month later co-CEO's Anshu Jain and Jurgen Fritschen resigned. Ba Fin's top supervisor of large banks, Frauke Menke sent the letter. By the time BaFin acted many other regulators had already flagged the problems at the bank, and the media including the WSJ had already covered the problems in great detail. Between the first report in the WSJ on Libor rate irregularities and the May 11, 2015 report was a period of 7 years. ...

This Wall Street Journal editorial comes out in favor of higher capital reserve requirements similiar to that suggested by Federal Reserve Board governor Daniel Tarullo. The Journal says that if regulators are serious in the U.S. about controlling systemic risk, then the 14% rule or a 15% rule for assets held in reserve by banks should be adopted. Daniel Tarullo had suggested a 14% capital reserve requirement. These requirements would be phased in gradually over several years. Basel III requirements require only a 7% requirement and is phased in over many years. Capital standards are likely to be gamed. For this reason the requirement for only Tier 1 capital to be eligible is essential. What about the Basel III standards and the European banks? Would this put them in a better position to earn higher returns. This should be a problem left for European taxpayers to tackle says the Journal. As long as U.S. taxpayers are supporting U.S. banks with an implicit subsidy to take on larger amounts of risk -because they will be saved in a crisis with taxpayer dollars- the Journal says it makes sense to require 10-14% in capital reserves. It cites the Japanese banks which were highly overleveraged with lower capital reserves compared to American banks, and fared poorly. The Dodd-Frank bill imposes a complicated set of regulatory requirements with regulators required to write new sets of rules. The editorial concludes that it is far better to tackle the problems in the banking system with a sufficiently high requirement for capital reserves to manage risks than to have the detailed rule making on every subject that Dodd-Frank suggests....

Starter interrupt devices have been installed by U.S. auto loan lenders on about 2 million vehicles, and feeding the boom for making subprime loans by reducing the delinquency rate. Its a new virtual repo system unlike anything known before, described in this exceptional piece by Corkery and Silver-Greenberg, with implications that reach beyond borrowers to the safety of the U.S. financial system. It means the lenders have a false incentive to reach deeper into the pool of subprime borrowers with lower and lower credit ratings, with the securities marketed using these loans spread out over the entire financial system waiting for another implosion like the one in 2008. Consider that the subprime auto loans have reached 27% of total loans in 2013, and $145 billion of subprime auto loans were made in just the first quarter of 2014. At some point this could reach the 36% in 2006 before the implosion in subprime securities of 2008, destabilizing the U.S. and global financial system. Are the regulators again asleep at the job? ...
