US tariffs under Section 301 of Trade Act as lasting and approved by the US Supreme Court, would make tariffs at average of 17% from 11% under temporary steps today after Supreme Court's decision on tariffs. Many countries like Japan, S. Korea, made deals accepting the 15% in taxes.  Under Section 301 Jamieson Greer USTR opened investigations on 60 economies not prohibiting use of forced labour in supply chains. USTR made its preliminary finding this month and proposed 10% tariff on closest trading partners, including Canada, Mexico and the European Union. And proposing 12.5% tariff on 40 nations including China, Japan, India, S. Korea and others, covering 99% of US trade. So that tariffs are back, and now permanent under Section 301 of the Trade Act. US Supreme Court had not rejected government power to impose tariffs, only that is was using the wrong method. All along DJT administration knew about Section 301, and did not use it earlier because it requires investigations of unfair trade and public discussion which takes time compared to other tools. Now Jamieson Greer has prepared the Section 302 route through his agency's investigations, and tariffs are here to stay. They are superseded only when the US signs a trade agreement with a nation, and there it set a rate of 10% or 15% depending o the country. ...

Tariffs are unconventional tools for border security yet appropriate in situations such as these. Canada could have done this before a 25% tariff was announced by DJT- it would have been common sense for Canada to do what it did after the tariff before the tariff- put 10,000 frontline personnel at the Canadian border with the US, appoint a minister in charge of drug flows and fentanyl, and list cartels as terrorists. Considering the damage to the US from the border it was imperative that Canada, and Mexico took responsibility for the borders a long time ago. 

Within 24 hours of the Trump announcement of 25% tariff on Canada and Mexico the leaders of the two countries turned around to do what should have been done a long time back.

US Trade Representative Jamieson Greer says this is not chaos in tariff policy because you don't change 70 years of policy overnight. He says China's is highest because it has the highest trade deficit, then EU, Japan, South Korea at 15% because of the smaller deficits with these nations, Vietnam because it is used  by China to send products to the US, India because of geopolitical reasons buying Russian oil. See Dasha Burns, Politico White House Bureau Chief's  interview with USTR Jamieson Greer.  He says about India- Jamieson USTR calls India "an outlier" and says "I'm confident we will get a deal with India in the near future." India he says has largely corrected its imports of Russian oil and negotiations are underway for a deal.  ON USMCA Greer says of the $31 trillion in trade with Canada and Mexico $29 trillion is us right. trade between Canda and Mexico is small. So he says it makes sense to negotiate separately with Canada and separately with Mexico. This suggests that there doesnt need to be a USMCA- separate deals are just fine says Greer. Mexico has gained much in automobiles under USMCA- US wants to make more in the US including auto parts which it can do by negotiating this with Mexico. It does not make a ton of economic sense to marry the three economies together, says Greer, as the import export profiles, lab,or situations are all different. Are Tariffs good for the economy and do they lead to higher prices? Greer says inflation was down in the first DJT term in trade with China and tariffs. Greer says there is never a 1 to 1 with tariffs. It tariffs become a kind of leveage in getting agreements. That is the style of these tariffs. You tell Ecuador or Brazil we don't make these here so there will be no tariffs on bananas and on coffee. Says Greer- we have seen inflation in check, imported goods relatively low priced. We have seen that we can have growth and higher wages with tariffs at the same time. The growth in 2025 third quarter at 3.8% annual growth, and Atlanta Fed predicting 4.2% growth in 2026. And tariff money can be used for paying down the debt and financing America's reindustrialization, Greer says members of Congress are asking about this.When a new administration comes tariffs will still be part of the playbook. ...

US DJT administration using Section 301 creates the tariffs the US Supreme Court struck down- the EU, Mexico, Canada at 10%, Japan,, India China at 12.5%- June 2 2026. These countries are not doing enough to control the importation of products made with forced labour. This only goes to show what was said at that time and which the SCOTUS itself said the DJT administration could do, find other laws by which the same tariffs could be imposed. By the time the US Supreme Court reviewed the case it was already clear that all these countries had accepted DJT tariffs, and most had negotiated fair deals with the US including making up for past abuses by these countries of the international trading system. The US Supreme Court its shortsightedness ignored this or did not quite grasp this as Justices legal knowledge of facts does not mean grasp of the facts of commerce, trade and business and the history underlying it. Jamieson Greer interviewed at the Council of Foreign Relations this week and Robert Lighhizer in Foreign Affairs (covered and summarized on these Lyrarc pages this week as found rarely in other places) have documented these abuses in detail leading to the US losing $20 trillion in wealth shifted to these countries and its manufacturing dependent communities devastated by loss of over 5 million jobs through the shortsightedness of Bush/Obama adminstrations who let this happen, and these countries that took advantage with reckless disregard for these communities in the US, on a scale unknown in history.  ...

President Trump tells Mexico to either slow the increasing flow of migrants from Guatemala or face higher tariffs on Mexico's exports to the U.S. For the first time in recent decades Trump uses tariffs as a tool of diplomacy to reverse policies of countries with which it is in an unfavorable position. For the first time Trump uses negotiations to convey America's position that when it comes to some issues such as migration or trade because of the slippage in America's middle class incomes the U.S. should be considered as the same as a developing country. So that no preference should be given to other countries to the detriment of people in the U.S. when it comes to jobs, incomes, and funding for social services. Much of this set of laws are already in place and being used by the US. A law passed in 1930 is another avenue for tariffs Section 338 of ther Tariff Act of 1930. The US government and US president DJT could also have Congress enact a new law as it has majority in both the Senate and the House and the president could make acase for the reasonable use of tariffs with the EU and Japan having taken advantage of trade to the disadvantage of the US. There is also broad support for fentanyl action by the president using economic action on tariffs on nations Canada, Mexico, China that continue to let the flow of fentanyl across their borders for use by drug trafficking gangs in Mexico to send over US land border at the 2000 mile long US-Mexico border.

US- China trade relations 2025 and XI's rare earth minerals export restrictions response to US tariffs. DJT resonse was 100% tariff on China from 57%. After meeting Xi in Busan, South Korea, after the APEC meetings, US settled on 10% reduction in tariffs from the 57% tariffs on Chinese products down now to 47%. The 100% tariff was withdrawn by DJT and China's Xi settled on withdrawing restrictions on exports of rare earth minerals. The fentanyl tariffs are still in place and the WSJ editorial says not much is likely to happen on fentanyl action by China to stop exports of fentanyl that reach the US through Mexico. China says it will take in soyabeans exports. US signs agreement with Australia to develop alternative supplies of rare earth minerals. The WSJ says for tariffs action to work US should not tariff allies. Yet broad tariffs action was necessary as partners Japan, South Korea, Taiwan and the EU, Canada and Mexico were also nations that created an unfair trade situation for the US. The media in US and in Europe presents the US and China on a confrontational course little aware that there is quietly emerging a new trend encouraged by both leaders of the two world powers. "Strategic Stability" in US -China relations instead of China seen as a rival and a threat- is now the goal of Xi Jinping of China in 2026 US-China dialogues and meetings. This was abundantly clear during the DJT visit to Beijing August 14 2026 and will continue to shape relations during Xi's visit in September. This is different from the confrontational attitude taken by both DJT in the first administration and Biden in his four years in office. The result is that these tensions are being gradually brought down which started in 2014, were exacerbated by Covid pandemic in 2019, and were put to the test in 2025 with tariffs policies of the incoming DJT administration. A decade of mistrust now being replaced by  buildup of cooperation, establishing a sense of trust and friendship. Partly out of necessity and partly from choice.This was not secured by giving up on issues the US or China saw as important. US did not concede anything on issues of fentanyl entering the US from Mexico, and tariffs for reducing trade deficits. Similarly China did not concede much on issues it saw as important, mutual respect for China as a significant power, and seeing China's different system of government and industrialization as legitimate and worthy of respect. On Hong Kong and on Taiwan both sides decided to see ambiguity and live and let live as the best option. So that in 2026 nothing, not the Iran War or anything that happens in the Middle East is to be allowed to deter both sides from making the educated good and decent choices that are available to them based on attitude of mutual respect.  ...

After months of uncertainty and waiting for concessions, offering temporary exemptions, the Trump administration announced tariffs will go into effect on steel and aluminium imported from the European Union, Canada and Mexico. A tariff of 10% on aluminium and 25% on steel goes into effect on May 31st, 2018. The tariffs affect about half of the imports of steel and aluminium into the U.S. and are intended to keep promises to protect American industry made by president Trump during his election campaign.

Mexico and the European Union are imposing retaliatory tariffs. The European Union will impose tariffs on $3 billion of American goods in retaliation.

10% tariff on Canada's exports to the US after Ontario Reagan ad misrepresenting trade facts is aired on television. The ad seeks to show US tariffs in the light of the Smoot Hawley tariffs of the 1930's, when the tariffs today date back to Reagan's use of tariffs when Asian partners (at that time Japan in the 1980's) followed unfair trade practices to the detriment of American workers and industry. The US Trade Representative who acted for Reagan was Lighthizer, the same USTR who worked for DJT in the first term to fight the unfair trading practices of China, and whose deputy USTR Jamieson is now the USTR in DJT second term negotiating with Asian partners. Tariffs ae being used as an additional tookl in the toolbox by DJT and Lighthizer/Jamieson to counter the unfair trading practices of other nations, which includes partners of the US such as Japan, South Korea, Taiwan, and EU. It also includes nations such as Switzerland who ignored US interests in trade whie having open access to the US market. Most of these nations know that these practices harmful to world trade exist, only Canada, China and some other countries have pretended they do not exist and they are the so called "champions of free trade." These nations attempt to make DJT appear to be doing this on whim when this is an issue in trade relations between the US and Asian partners, the EU, and Canada/Mexico for the last 50 years. DJT plans an additional 10% tariff on Chinese imports to the US for its role in not shutting off the fentanyl flows. US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026. In this way the goals of the US as a Nation can be achieved of reducing the supply channels concentration in China, cutting supply chain concentration in China, for fair trade with trading partners EU/Japan, and for action on fentanyl and drug trafficking. Justice Roberts and his team have a lot to think about in this effort by the Nation to correct abuses that should never been allowed to happen. ...

Real tariffs are less than 12% of imports much lower than expected because of exemptions and tariffs announced and later dropped, CEO's have said that the impact of tariffs is much less than expected, and some say the worst is behind us. The administration of DJT and Treasury Secretary Bessent has shown much more flexibility and responded to the stock market declines in its tariffs posture. Bessent says the purpose of tariffs was not the revenues itself but getting other nations to play by the rules for fair play in world trade, rather than try to take the largest share of trade for their nations in the case of China, EU, Canada, Mexico and Japan which have all profited from unfair trade practices. The perception of tariffs is now changed.

There is a two week period before the 25% tariff on steel coming into the U.S. goes into effect. This gives time for Canada, Mexico, the EU, Japan and other countries to come up with offers to negotiate or as with the EU come up with its own plan to put tariffs on some American goods. An exemption for Canada is supported by the United Steel Workers Union, as many American companies make steel across the borders. Canada sends the most steel and aluminium to the U.S. With the departure of Gary Cohn as economic advisor, Mr. Lighthizer, the U.S. Trade Representative who pushed for the tariff plan becomes a trusted advisor to the President. Lighthizer is to be seen in Lyrarc pages as having consistently supported fair trade and protecting U.S. workers in these situations since his work in the Reagan administration. The other advisors who are ascendent are Peter Navarro, a trade expert, and Wilbur Ross, the Commerce Secretary. Ross is an experienced business veteran in consolidation of steel and auto parts companies, who pushed for a moderate position to renegotiate NAFTA and convinced president Trump to pursue renegotiation instead of rejecting NAFTA following calls from president Nieto of Mexico and Trudeau of Canada. ...
