U.S. president Nixon's lawyer John Dean who testified against Mr. Nixon writes in the NYT about the parallels between his testimony and the testimony given this week by Mr. Trump's lawyer  Michael Cohen. 37% said Dean's testimony was credible and 35% said Cohen's was credible in polls.

Dean says the number of people who surfaced supporting his account increased and it is likely to grow for Mr. Cohen's account. 

John Dean says he found one line in the Cohen testimony worth remembering from Cohen's closing statement. It refers to the authoritarian type of presidency he says he finds in the Trump presidency. It said that Cohen thought that if Mr. Trump loses the election in 2020 there would not be a peaceful transition.

Donald Trump is acquitted in the second impeachment trial with a vote in the Senate of 53 in favor to 47 against. A two thirds majority is required to impeach a president. Senators Burr of North Carolina and Cassidy of Louisiana were Republicans who joined the expected ones to vote for impeachment- the Republicans Mitt Romney of Utah, Pat Toomey of Pennsylvania, Ben Sasse of Nebraska, Susan Collins of Maine, Lisa Murkowski of Alaska. The Republican defense lawyer insisted that Trump's speech to his supporters was not an intention to incite them on the day of the Capitol riot on Jan. 6, 2021 but an expression of his rights to free speech guaranteed under the U.S. Constitution First Amendment. He made the point that the prosecution lawyers had selectively focused attention on the words "fight like hell" and taken them out of the entire context in which they were made, ignoring key parts of Mr. Trump's speech. The defense argued that the president had already left office and this made an impeachment unconstitutional. Seventy five million voters voted for Mr. Trump and he cited this as the most number of votes won by a sitting president. President Biden is shifting his attention to the president's agenda and needs Republican support to pass key legislation including financial help to households, unemployed, and business to recover from the pandemic. The U.S. health effort behind the vaccination drive and seeing the struggle in Europe to access key medical supplies of vaccine is also leading to new efforts to move beyond the rhetoric to the hard work ahead with support of all parties. As part of this the trial once it reached the Senate was quickly resolved in about 5 days. The defense used only a small fraction of the time allotted with bipartisan effort to not let the trial drag on, bipartisan effort to putting some statements simply on the record and not calling witnesses.   ...

RICO prosecutions in Georgia for racketeering use a broader definition of the term. Mr. Trump's intent matters and Attorney General Barr's telling Trump that there was no substance to fraud claims.  WSJ says the state RICO law is broadly written giving the state prosecutors more latitude than federal prosecutors when pursuing alleged criminal enterprises.The Georgia RICO law on racketeering say defense lawyers is unconstitutionally vague and overbroad. Yet the state's highest court has upheld the law and cases have been filed and successfully prosecuted in Georgia. Most recently by prosecutor DA Fanni Willis against 35 school officials and teachers for a test cheating scandal. Of 12 charged in that case 11 were convicted, one acquitted.

The White House says the president has the power to fire special counsel Mueller following the FBI raid on Trump lawyer Michael Cohen's properties. Senate Majority leader Mitch McConnell says Mueller "should be allowed to finish his job." Senator Grassley, chairman of the Judiciary Committee, said on CNN that it would be "suicide" for Mr. Trump to fire the special counsel.  U.S. Trade Representative Robert Lighthizer, views China's response in trade negotiations as one of conducting extended negotiations that lead to little change. This has continued says Lighthizer for over a decade putting the U.S. at a serious disadvantage in trade. At a White House meeting in August 2017 Lighthizer convinced president Trump that China was in his words "tap, tap, tapping us along."  This confirmed president Trump's own instincts about the U.S. trading relationship with China. Lighthizer is a veteran of trade negotiations, having experience in the Reagan administration as the Deputy Trade Representative in 1983 in negotiations with Japan, when Japan was in a similar situation that China is today. At the time trade negotiations with Japan were getting nowhere. Lighthizer is said to have turned one Japanese response in negotiations into a paper plane and sent it flying right back. Lighthizer does not seek the limelight but is serious about his role having published op-eds in the NYT and WSJ since 2000 about how U.S. trading relationships were putting the U.S. and U.S. workers at an unfair advantage. Many of these op-eds are in the Lyrarc archive and a Search with the term "Lighthizer" would bring up these articles. This report in NYT shows how the role of Lighthizer was not anticipated by China when it sent Liu He to Washington in November 2017 to negotiate with the U.S. President Trump made certain Liu He and other Chinese leaders would have to talk to Lighthizer first. In a session with president Jinping laid out U.S. views that the past negotiations had accomplished little and new negotiations had to be undertaken very differently from negotiations in the past. Earlier in July trade negotiations conducted by Commerce Secretary Wilbur Ross were "shut down" by president Trump because China continued to repackage earleir offers which meant little to the U.S. As a lawyer at Skadden, Arps, Slate, Meagher LLP Lighhizer represented steel industry clients hurt by subsidized Chinese steel industry imports. Mr. Trump and Lighhizer have bonded well because their instincts have been the same- that the U.S. had not been well represented in earlier negotiations by lawyers who saw themselves as speaking for American exporters.  Lighthizer is also a seasoned trade negotiator and has waited for the right time and situation to tackle the unbalanced trading relationship with China. For 30 years Lighhizer represented American manufacturers as he practiced trade law at the Skadden law firm. His strategy has been to get the administration to unite behind a clear trade strategy. He says "I try to be friendly in trade negotiations. I am not the theatrical type. The art of persuasion is about knowing where the leverage is." At this time the leverage lies in the huge trade surplus of about $300 billion China has with the U.S. The U.S. goal is to bring this down by $100 billion through this new negotiating strategy as earlier negotiations have failed. ...

The Economist looks at the summary of the Mueller Report. The special counsel did not find that the Trump campaign was in collusion with the Russian government in its interference in the 2016 election. 

The Economist points out that Mr. Mueller accomplished the task of cleaning political campaigns of corruption and other questionable behaviour. In the case of Mr. Manafort campaign manager, and Roger Stone, the president's lawyer, Mr. Mueller's investigation set the precedent of how such investigations would take place in the future.  The investigation also looked into candidates business interests, including building a skyscraper in Moscow. This editorial says Mr. Mueller's conduct was exemplary.

NYT's Homan who traveled 640 miles across Colorado and Woolf look at the reelection bid of a 33 year old owner of a restaurant and bar in the small town of Rifle in Colorado, Lauren Boebert. She represents the Trump centric activists at the state and county organizations who differ from other parts of the Republican party including more conventional Republicans like Jeff Hurd who graduated from Notre Dame and is a lawyer in Grand Junction. Hurd is challenging Boebert in the Republican primary. Boebert won the Congressional seat from Colorado's Third District over Adam Frisch by a mere 546 votes. After controversy regarding her behavior at Beetlejuice theatre Boebert is seen as lagging behind the Democrat's Adam Frisch, a Aspen councilman who ran out of funds in the last election yet is well financed this time.

The WSJ first reported just days before the 2016 presidential election about National Enquirer suppressing a story relating to Karen McDougall and the former president. That story did not get much media coverage. In 2018 WSJ reported a similar story relating to Stormy Daniels and the former president. At the time not much attention was paid to these stories says WSJ and the legal consequences were not anticipated. Last week a NY jury made a conviction on 34 counts of the former president Trump on the Stormy Daniels hush money payment with testimony by the former president's lawyer David Cohen. During the history of the US since its founding in 1776 under men of courage and leadership qualities of George Washington, John Adams and Jefferson, to the recent presidents from Lincoln, Teddy Roosevelt, FDR, Truman, Eisenhower, Kennedy-LBJ, never faced a situation of this kind.
