 President DJT has several options after SC Tariffs decision -Sections 122 Trade Act of 1972 has 150 day limit and 15% maximum tariff rate, and Sections 232 and 301 of the Trade Expansion Act of 1962 is specifically designed for China and countries with high trade deficits. DJT pointed out at the press conference following the Supreme Court decision pointed out that he had these options at the beginning in April for tariffs. He chose IEEPA instead because the other options required work that would take several months showing the unfair treatment of the US by other nations. It is likely that the president used IEEPA for speed yet kept open the options to replace it with the option that would work best. The new studies will have been started much earlier in 2025 so that the president can introduce all his tariffs under new arrangements. Another aspect of this is that the president has negotiated Free Trade Agreements with most of the nations that are large trade partners from India, China, Vietnam, South Korea, Japan to UK, EU, Germany, France with the idea of boosting the US economy with tariffs of 10-15%. ...

The hearings relate to an arbitration panel award of 404 million euros to Mr. Tapie in relation to a claim he made against state supported bank Credit Lyonnais. EIA says half of the benefit of higher fuel efficiency standards for Automobiles 2010-2020 in US was lost because of SUV's and the incentivizing of SUV's in the 2006 CAFE standards have made things worse. The first SUV's came in the 1980's. By 2004 SUV's made up half of car sales and by 2025 outsold cars 2 to 1. What if we took all SUV's and large cars off the roads, or even some of these SUV's by deincentivizing of SUV's in the US CAFE corporate fuel efficiency standards? What would be the savings in crude oil and in carbon footprint? Would it be about the same as releasing an additional 400 million barrels of oil into the markets in addition to the 400 million barrels that are now released through EIA and member countries? This New Yorker essay touches on this idea. During the Iran war the volatile Middle East as a source of oil supplies is a major problem for countries. Some are rationing supplies and in one country 40 million children are not going to school for 2 weeks starting this week because of the sources of oil are so precarious, government offices will only have half of the employees, the rest working from home (almost like Covid pandemic). Many other countries face that situation. The International Energy Agency recently reported that, if “SUVs were an individual country, they would rank sixth in the world for absolute emissions in 2021, emitting over 900 million tonnes of CO2.” The agency says governments must redesign their CAFE standards and their policies so that it would reduce S.U.V. sales, tax gas guzzling vehicles. EIA cites governments in the EU doing this- “Some governments have already started introducing relevant measures, such as France and Germany, which have put a tax on large and high-emissions cars.” Within SUV's also there is an opportunity to reduce the size and make more efficient space utilization designs. Small savings also add up. One has to realize that the current freedom to use energy freely in places like the US with self sufficiency in oil comes with a sense of responsibility for using it wisely so that it can be exported to cut the trade deficit, precisely what the president is doing with India, to cut a trade deficit of $58 billion before it gets to $100 billion. Section 301 is already in place for investigations by the US of 18 countries for a new basis to use tariffs after the Supreme Court decision. A similar approach is taken with EU for hundreds of billions of reductions in trade deficit that will only strengthen the US dollar and the US economy in the long run , and be good for stock markets and jobs as it reduces oil prices and increases the manufacturing capacity/cost for the Nation. Europe, India and China can do the same. Remember that in 2010 SUV's made up 17% of total world sales, and by 2025 SUV's made up 46% of world vehicle sales. This would create another 400 million barrels for the oil markets, which would triple what was released through EIA  this week to 1.2 billion barrels and this would create 120 days of supply replacement for the 10 million b/d lost from Straits of Hormuz, and effectively end the Iran War as it would be clear that prices can be kept low even in the $50's. Essentially buying time till the SU can get more production in Venezuela and other parts of the world to replace much of the Middle Eastern oil that is ending up in a quagmire. This is the best way for the US and Europe, India, China to ensure jobs growth, economic growth with low cost crude oil in the $50 range and ensure much of the poorer countries like Egypt and Indonesia, Vietnam, Sri Lanka, Pakistan, Bangladesh, have access to oil at prices they can afford and eliminate poverty. ...

The Spanish Supreme Court verdict giving jail sentences to 11 Catalan leaders for the part they played in pushing for independence of the Catalan region in 2017, has resulted in clashes of protesters with police. The socialist government of Pedro Sanchez faces elections on November 10, 2019.  The government faces the option of activating Article 155 of the Constitution suspending the state government for central rule from Madrid.  One of the problems Spain now faces is that there is no clear majority for independence with the region divided between people who prefer to remain in a united Spain and people who prefer Catalan independence. In a recent BBC Hardtalk this was brought up in questions put to the Catalan independent movement spokesperson. The support for independence has actually declined in recent years. The Guardian cites a Catalan government poll in July showing 48% of Catalans oppose independence and 44% support it. Independence is not supported by the EU and it is not clear whether Catalan economy would do better outside Spain, as some of the causes of the economic problems stem from the banking and housing crisis in Spain and overborrowing. Mr Sanchez on the Madrid side and the Republican Left on the Catalan side favor negotiations on economic issues raised by Catalan people. As a result there may be less support than previously for outright independence, particularly when it is realized that the economic issues come from mismanagement and corruption and that the new Spanish constitution was designed to give regions special rights after the Franco years.  ...

There are problems with TikTok as social media app that are shown under The Enemy Within in Movement for Global Literacy of Lyrarc.com that relate to global literacy of children spending many hours on the app taking time away from homework and reading, when over half of American children 12-18  perform below basic requirements on reading proficiency tests. Similar loss of reading comprehension in UK and France. China can regulate its internet by restricting it in ways that won't hurt literacy in China. India has banned the app.  There are problems with TikTok that relate to literacy and cultural literacy that Democrats or Republicans or the Supreme Court have failed to bring up let alone address. These concerns should grow in the minds of Americans concerned about preserving the cultural literacy that has existed in the US for the last 200 years- it is about who Americans are as a Nation of immigrants from Europe of the Renaissance and the Modern World. US is a mix of population from European nations of 204 million, of a black population of about 48 million in 2025, 7 million native Americans, and Spanish speaking Americans of 62 million, Asian population of 25 million. The US is at a critical juncture in deciding what kind of a nation it will be. Will it lose it's basic character of a nation which draws its inspiration from European civilization's defining characteristics of the Renaissance, the evolution of science and democratic forms of government leading to creation of the Modern World. The 25 million Asians immigrated to the US for a large part seeking this kind of modernization of society from what they left behind and this is largely true of Spanish speaking immigrants and Spanish settlers who settled California, Texas and Florida as Spain settled the American colonies before the English and French. TikTok ban opposed decreased from 2023 to end of 2024 by 18% from 50% to 32%, according to Pew Research. Pew does not say that this is the result of growing use of TikTok by teenagers and children for entertainment by 12-15% in the period 2023-2025. Between 2021 and 2023 use of TikTok in the US increased by 12% from 21% to 33% from which we can extrapolate that it increased by about 12-15% between 2023 and 2025 if it is growing at the same pace. Politicians oblivious of the effects on cultural literacy in the US are allowing it to be embedded in the US in ways that hurt basic reading and cultural literacy skills. ...

Spiegel Online provides a inside look at the leader of the Law and Justice Party which was elected to power in 2015. The liberal opposition that was in power since the fall of communism has seen its popularity decline in the rural areas of Poland, especially in the east. The urban-rural divide seen in other countries such as France is acutely present in Poland and other parts of Eastern Europe, with poor governance and a tendency for economic gains made under capitalism following the fall of communism to go to more educated people in the large cities. The party's leaders are Lech and Jaroslav Kaczynski who were president and prime minister from 2005 to 2007. At the time they were seen as outsiders lacking the sophistication and experience in government of the liberal opposition under Donald Tusk, who now is head of the EU Council since 2014. Tusk was prime minister of Poland from 2007 to 2014. Lech Kaczynski was killed in a plane crash in 2010. Jaroslav Kaczynski appoints members of his party to key positions in government including prime minister Duda. Kaczynski is strident about the manner in which the gains since Poland joined the European Union have gone only to certain groups able to benefit from capitalism. At a recent party congress near Warsaw he is quoted here as saying: "We are here to ensure that everyone in Poland has the same opportunities, regardless of where they live, in the cities or the country." Kaczynski's appeal is in offering a generous welfare state for the middle classes- small businessmen in villages and towns across Poland, common people, with subsidies to tackle the cost of living. His focus is on the "pathological" consequences of economic liberalism after the fall of the Iron Curtain, privatization that benefitted a few, including Kaczynski says former communists and dissidents. Small businessmen felt the inroads of large private retail chains, and families felt the problems of lack of investment in schools and kindergartens. The liberal opposition can only offer the hope that being a reliable EU ally will ensure prosperity, which does not go well with the eastern part of Poland. As a result the Kaczynski government is moving away from the ideas that anchor the European Union. It sees the rule of law and independence of the judiciary as something that can be changed to where the president appoints members of the Supreme Court and the judiciary. Protests in Warsaw and the large cities are taking place against these moves. Der Spiegel says this could end up the way it happened in Britain where it simply stumbled into leaving the EU just by accident. This is the situation in 2017. It could be a temporary process that is a response to the excesses of capitalism. As Kaczynski says to create a level playing field for all parts of Polish society by smoothing out some of the harsh effects of rampant capitalism. Or as Spiegel Online points out a shaky period in which the EU and Poland are at odds- ironically with Donald Tusk as the head of the EU confronting both Theresa May and Kaczynski.  ...

Krauthammer cites Congressional Budget Office numbers that show the Obama U.S. health care law continues the spiralling costs of health care with new government mandates at a time of severe budget cuts in education and other areas- for 2013-2022 the costs come to $1.76 trillion. The initial Obama administration figures of 10 year costs of $938 billion announced in 2010 reflected the fact that the new U.S. health care law would take 4 years to fully go into effect. Costs after 2021 are shown to be $250 billion each year in the CBO figures. The law is now before the Supreme Court in 2012, which has to decide on the basis of the limits of the Commerce Clause.

A study by AARP of 514 brand name and generic drugs between 2005 and 2009, shows that generic drug prices went down an average of 31% during this period, and brand name drug prices went up by 41%. One of the authors of the report says that it is important to look at individual drug prices and not studies showing total spending on drugs, because this is a significant cost for people paying out-of-pocket, It drives up insurance premiums, and pushes retirees into coverage gaps in Medicare Part D drug program. Analysts indicate pharmaceutical companies are increasing prices on drugs before patent expiration to get as much profit before the patents expire.

This editorial in the WSJ points out the dangers to the Republican party in taking the stand on immigraton along the lines suggested by Donald Trump in August 2015- deportation for all illegal immigrants, no birthright citizenship for children of illegal immigrants, and no remittances allowed for illegal immigrants to their home countries. It points out that remittances actually improve the economies of the countries south of the U.S. border in Latin America and reduce illegal immigration. There is a need for seasonal workers in farm areas where there is a severe shortage of workers even at $17 an hour. Reducing immigration is better accomplished by more guest worker programs. A likely result would be the move of farms and factories to regions with low cost labor in Latin America or other countries. For the Republican Party this type of policy would bring back the period of the 1920's, says the WSJ, when Irish and Italian immigration was opposed by the party, alienating the two ethnic groups till they were won back in the Reagan period- a sure way to lose in 2016....
