Many of the problems in Minnesota came from the tactics employed by a Border patrol agent Bovino who took over Minnesota immigration enforcement in the state. He was removed by the Border head Tom Homan who said some of the tactics used were not what ICE normally has used in the past. The immigration enforcement in California, and other states, and law enforcement in Washington DC and Nashville did not meet any of the confrontations that happened in Minnesota. Democrats and Republicans are negotiating ways to come up with law enforcement that does not disturb entire neighborhoods and can be conducted peacefully.

Former FBI chief Comey told Senators at a Senate Intelligence Committee hearing that he felt pressure from president Trump to drop the investigation into Mr. Flynn, a Trump adviser. He also said that he leaked accounts of his conversations with the president through a friend, in the hope that this would lead to appointment of a special counsel. Later Mr. Mueller was appointed Special Counsel. Comey said he would not say that this was an obstruction of justice but something that Special Counsel Mueller had to examine.  Comey said his intuition told him he had to document all conversations with president Trump, so that there would not be any questions about what was said.

An emergency appeal to have the case on the travel ban to the Supreme Court has the disadvantage that of the 8 Justices on the court the ruling could end up at 4 against and 4 in favor. The 4 liberal Justices are unlikely to support it. Another more likely scenario is taking a conventional petition approach and this would mean a decision on whether the Supreme Court hears the case would come by April, and hearings starting in October. By that time Neil Gorsuch could be on the Supreme Court filling Judge Scalia's vacant position- leading to a decision, instead of a tie that leaves the appeals court decision to stop the travel ban in place.

Section 230 is a law passed in 1996 that makes the Social Media Companies and Media companies such as Meta and Google and others to have no liability for content posted on their sites. This has allowed these companies to grow and develop monopolies on the internet. Senator Whitehouse of Rhode Island describes the biggest problem as being the Section 230 which needs to be removed. The following mothers who are Senators and mothers or grand mothers of children were very vocal on this point- Katie Britt-Alabama, Martha Blackburn-Tennessee, Ashley Woody-Florida (former Attorney General of Florida).  Senators who are fathers or grandfathers of children speaking are-Josh Hawley-Missouri,      Whitehouse-Rhode Island, Bluementhal-Connecticut, Corbyn-Texas, Chuck Grassley-Iowa. Senator Whitehouse says-  "I understand Senator Graham was with respect to getting rid Of Section 230 Um, I strongly believe that Section 230 has long outlived its use, and it is now a real vessel for evil. That needs to come to an end. Um, the laws that Section 230 protects these big platforms from are very often laws that go back to the common law of England. that we inherited when this country was initially founded. I mean, these are long lasting, well tested. Important Legal constraints that have They've met the test of time, not by the year, by the decade, but by the century. And yet because of this crazy Section 230, these Ancient and highly respected doctrines just don't reach these people. And it really makes no sense that if you're a Internet platform you get treated one way. You do the exact same thing. And you're a publisher, you get treated a completely different way. And so I think that the time has come. I think it's pretty widely known that there were a core 4 of us. Ready to proceed with a bipartisan bill 2 and 2. Ostensibly because of free speech but really because of monopolies and campaign contributions, and beyond this because of the idea that rapid internet growth gives the US economic and business leadership in the world. That is not how it has turned out instead by weakening the education of the children of the Nation this has created the idea in China and other nations that the US's period of world leadership has passed. In the overall scheme of things social media has weakened education in America as children of the Nation spend countless hours away from classroom education on their smartphones. Australia and other countries including China regulate the use of the smartphones and internet social media for children under the age of 14. This regulation strengthens education in these countries at the same time that the absence of limits weakens education competitiveness in America, and creates the idea that America's days of leadership in education have passed.The loss of this leadership means the loss of American leadership in the world in a decisive way. ...

A recent poll shows Mr. Trump increasing his support from a bloc of voters that disapprove of his job performance but still give credit to Mr. Trump for an improving economy. A new WSJ/NBC poll shows 51% of Americans disapprove of his overall job performance, with 46% approving. The same percentage that say they disapprove of job performance are also saying they give him credit for a stronger economy up from the 44% in April 2017 who said they approved his way of handling the economy. Wages have increased 3.2%  in each of the last 2 months and unemployment is at an historic low over 50 years. One group that has a 10 point gap when it comes to the economic performance is among Independents, where 38% approve of Mr. Trump but 48% approve his economic performance. A big jump is among Hispanics who have benefited greatly with new jobs in construction and other areas of the economy. Trump's 46% approval rating in May 2019 is among the highest he has achieved, rising 3 points since the last identical poll in March 2019. About 29% still think the Mueller Report clears Mr. Trump of wrongdoing as they did in March. Still things can change as 42% believe the Mueller Report does not clear Mr. Trump of wrongdoing, and another 29% haven't made up their mind. On impeachment hearings about 48% think Congress should let Mr. Trump finish out his term, 49% think there is either enough evidence or Congress should continue investigating with an eye to future impeachment hearings. The survey margin of error is about 4 percentage points, covers 900 adults.  ...

Under the law overturned by the US Supreme Court it was illegal to carry a gun openly and a permit was needed in New York to carry it concealed. Three Supreme Court Justices appointed by president Trump were of a disposition that opposed gun control laws- Gorsuch, Kavanaugh, and Barrett. The requirement under the New York law was that you had to show "good moral character" and "cause" to carry a concealed weapon or carry a gun openly. Many other states have such laws in California, Hawaii and urban states in the north east. Republican states are loosening gun control laws. This comes as many random shooting incidents are taking place in the US some in schools and grocery stores, the most recent being a shooting in Buffalo, NY. The vote was 6-3 after the Supreme Court for years had avoided hearing such cases based on Second Amendment rights from the Constitution that some had interpreted to include freely carrying guns without any common sense restrictions. This issue is second only to abortion as a cultural issue in the US on which sides are taken by the public including the Supreme Court Justices selected by Mr. Trump. Though not directly apparent these and issues of immigration, other cultural issues surrounding gay rights are putting those who would normally come together on issues of national interest on opposite sides when it comes to common sense support for everyday issues of feeding families, keeping workers employed in good factories at home, child care, education, health care, fair wages, restoring America's manufacturing leadership and bringing back manufacturing to the US. The emergence of Tech and tech companies, Silicon Valley, the finance sector in New York, has reinforced the prejudice in these opposing sides as Tech and the finance sector have largely embedded themselves into the Democratic side. Tech and finance sector employees with higher incomes have largely insulated themselves from the interests of ordinary workers and families creating a split Democratic party when it comes to supporting workers and families who form the vast majority of the American people. In a sense today the national interest is separate from these cultural issues and supporters of national interests can be found in both parties who can look beyond and above these cultural issues. It is also where many of these cultural issues can be resolved to some degree using common sense on which most informed members of Congress can agree. This is true for gun control as a group of bipartisan Senators from both parties are preparing gun control around common sense principles that today are even beyond the capacity of the Supreme Court of the US that itself now reflects a raucous public sphere. ...

Republican McConnell and Democrat Schumer in interviews in recent days with The Washington Post, as the focus on the rest of 2024  is on what will the new US Senate look like, who is in majority, and who is in minority after November. A small faction in his Republican party opposed McConnell's bipartisan compromise. McConnell says after 17 years in the US Senate, that one has to remember what Harry Truman said. Truman America's post war president in 1950's said if you want a friend in Washington, buy a dog. Yet the Post also says the two McConnell and Schumer worked closely for 4 months to negotiate the bipartisan compromise on immigration to close the border. The first time the two sides have come  this close in this century says the Washington Post. Looking at the 22 Republisenators that supported McConnell and voted for the aid to Ukraine one finds most are senior and the majority of the senators with the most experience, compared to a small faction of newcomers without anywhere near the same experience. This is why the dissension in Congress can also be seen as not telling the whole story, when the most experienced people in the Senate and the House of both parties have come together on the big issues even when the fringes of both are engaged in unconstructive confrontation. You could see that when the younger J.D. Vance of Ohio addressed the heads of all the major US banks this past week in a Congressional Senate hearing and the difference when the more experienced Van Hollen of Maryland talked to the same banking heads. And when Senator Tillis of North Carolina one of the older experienced Senate Republicans made a strong plea for aid to Ukraine on the House floor and in his earlier support for the bipartisan change to asylum and parole immigration laws in the US. A broad center is emerging around coming together, around the most experienced people in the US Congress that sets the country in the right direction.   ...

House Speaker Pelosi and Majority leader Reid prempt the Bond-Levin proposal to use the $25 billion of funds from the energy efficiency retooling for operating expenses. They said there were just not enough votes to pass the change. And the general feeling was that the automakers had hurt their case more than they had helped it after 2 days of hearings in the Senate and the House on November 18-19, 2008. Pelosi put it this way, "until they show us the plan, we cannot show them the money." The automakers were asked to come up with a plan that shows accountability and viability. Pelosi is from California, a state that has seen its mandate for controlling auto emissions held up by the automakers lobbying and the Bush administration EPA, and which favors higher fuel efficiency, higher than the numbers passed in recent legislation, also held up by the automakers lobbying efforts. So there is a three way battle going on with the states in the midwest and the Bush administration pitted against Pelosi-Reid-Waxman and the younger Obama supporters in Congress for the $25 billion in energy efficiency retooling to be used for salaries and so on. And the other battle pitting the midwestern states against all those who call for strict conditions including firing management, and serious restructuring within or outside prepackaged bankruptcy. Reid and Pelosi called for Congress to reconvene on December 2. Reid said that what happened this week has not been good for the auto industry,, which is ominous, because the hearings showed an unrepentant automaker management which did not accept any of the errors made by management long before the credit crisis in October, which riled Congressmen. Another thing was the reference to corporate jets which came up in the hearings, and Reid emphasized as did others that these guys flying in in their corporate jets did not send a good message to people in Searchlight or Reno, Nevada. The reason this is important is that executive compensation and golden parachutes are moving right to the top as they do in such times, as evidenced by the story in the Wall Street Journal frontpage on November 20 about 120 executives making $21 billion in compensation in the last 5 years including failed companies, see the link. . ...

Bob Herbert of the NYT after hearing that Obama told John Harwood in an interview with the Times recently that jobs is a lagging indicator, it comes last, and that the economy has turned the corner, is incredulous. The new numbers for September show 263,000 jobless. He asks does Obama get it? 15.1 million people are unemployed. ANd only 10-13 % of people polled by the Economic Policy Institute feel they have fared well. He is concerned that Obama is so focused on health care and Afghnistan that joblessness is not getting his attention the way it should be. And he is concerned that the infrastructure building that was supposed to set the new vision for America has been shelved under the new President.

RFK Jr. nomination heads to the full Senate for confirmation as Health Secretary to bring new ideas and solutions to tackle obesity and disease in the US. He called the US health condition dismal as it is, not just for what is spent. RFK Jr called the US a sinking ship when it comes to the health of its people as he answered questions from Senators at Senate hearings. Ron Johnson, Senator from Wisconsin, said RFK Jr. was an answer to his prayers for someone who could help tackle this crisis. RFK Jr. said he was pro-vaccine and his opposition was only to some aspects of vaccines in certain situations. He also said that his father Robert Kennedy who died in 1968 when RFK Jr. was only 14 years old had told him when he was just 13 that it was important to have a fierce skepticism.  The magnitude of the crisis is so large and the budget is so large that only someone with the experience and one who has fought hard won battles against coal and for the environment for decades, and with the tenacity of RFK, is capable of taking the action needed today. Pete Domenici of the Domenici-Rivlin deficit reduction commission and Sam Nunn are part of the initiative- Strengthening America- Our Children's Future. Other members of this initiative are Warren Rudman and Evan Bayh. Here they provide ideas on how to address the fiscal cliff of automatic cuts in spending that are approaching at year end under an agreement between Republicans and Democrats in Congress. The agreement was designed to offer the worst outcome for Republicans (huge cuts in defense spending) and worst outcome for Democrats (cuts in entitlemnt spending) as a last ditch effort to force the two parties to come to an agreement on deficit reduction. It comes after president Obama failed to accept the Simpson-Bowles deficit reduction commission proposals as a basis for working out a plan and as Republicans in Congress were dead set on avoiding any tax increases. In a recent WSJ editorial praising the CEO statement of 80 U.S. CEO's- organized by the Fix the Debt initiative inspired by Simpson and Bowles- the Journal called the CEO's support for tax increases encouraging and was critical of Republican "deadenders" who flatly opposed any tax increases. Domenici and Rivlin say kicking the can down the road again as Congress has a tendency to do is not the answer and a vigorous effort by responsible members of Congress is needed to come up with deficit reduction using the proposals of Simpson-Bowles commission and Domenici-Rivlin commission. This will end the uncertainty plaguing business confidence that is leading to decline in business investment- decline of 1.3% in the 3rd quarter of 2012- and a weakening of economic recovery. To this end Domenici and Nunn have brought together 35 members of Congress to push forward and held four public forums with experts including hearing from John Taylor, Martin Feldstein and Larry Summers....

This personal portraiture of Sarkozy reflects Sarkozy as a man, but it says little about some changes he brought, which could be regarded as his singular achievements. One is his courage in discontinuing old colonial policy in Africa and the Middle East. Sarkozy took the initiative in Libya and Tunisia, and Libya owes much to Sarkozy. Sarkozy also worked to build closer European ties, something he came under much criticism, such as his ties to chancellor Merkel. Pictures of Sarkozy and Merkel on the beach in Deauville, France, come to mind. This is a path Hollande is also likely to take, except that he would bring to bear the French viewpoint, which is a good thing. It would still benefit from the idea that Sarkozy gave the German viewpoint a good hearing before it was fairly rejected in France on its merits and economic good sense.

Textualism or strict interpretation of the Constitution word for word may be back but one can never be sure. No sooner is one decision made in a certain direction with a particular approach to the law whether it be textualism or something else it then comes up for rethinking a few years later, under a different approach to the law or from a new angle. This is the law practiced in most British style courts of law including the US.  Former Justice Breyer of the US Supreme Court replaced by his law clerk Ketanji Jackson, is interviewed by NYT's Adam Liptak. Today so much is written about Breyer as a non textualist, and Gorsuch, Kavanaugh recent additions to the Court as textualist or strict interpreters of the Constitution based on when it was written with what intent. Yet as thinking individuals who like the rest of the American people grow in their understanding all Justices cannot be categorized  in this way. Breyer says he worked with retired Justices Kennedy and Souter and found them to be willing and keen on hearing all angles. Then it has to be said that both Kavanaugh and Gorsuch were law clerks for Kennedy. Much of American law at the highest court actually is no better than any other human creation - it tries to approximate as best one can the people of the US. Sotomayor coming from Puerto Rican descent, Ketanji Jackson from minority black, Kavanaugh and Gorsuch from Georgetown preparatory schools where Kavanaugh's paternal grandfather attended Yale something even JFK could not claim, Chief Justice Roberts coming from a company professional type background, Barrett a professor at a Catholic university, Kagan with a Bostonian JFK style background, Alito old Italian and Clarence old minority black background. Breyer retired recently to make way for a younger judge, Judge Ketanji Jackson who was law clerk to Breyer. Breyer is writing a new book which he hopes the conservatives on the Supreme Court will read- Justices Kavanaugh, Barrett and Gorsuch. The book coming out March 26 has the title- Reading the Constitution- Why I Chose Pragmatism not Textualism. He hope these Justices will read the book and say their colleague was making sense, would say that it was not a bad point. ...

Rappaport of the NYT asks how it is possible that the U.S. Treasury is critical of the EU Commission's ruling that Apple pay back $13 billion in taxes because of its low tax rate of .005% in Europe, when Treasury is strongly critical of tax avoidance. The negligible tax by Ireland, base of Apple operations, is seen as a state subsidy not available to competitors. It also, as the EU Commission says, does not correspond to economic reality because the revenues are mostly made outside Ireland. An arrangement that is basically a strategy of tax avoidance. Today the leading candidates for president, Trump and Clinton, the major parties, and Congress, all are critical of tax avoidance strategies which deprive Treasury of much needed revenues. Restoring upward mobility is a priority today and programs to provide tution free access to public colleges, healthcare access, and infrastructure development, require public funding. Then why is the U.S.Treasury critical of the EU ruling? It is because Treasury sees this as money that should be coming to Treasury not the EU. However Treasury has failed to make this clear. The Financial Accountability and Corporate Transparency Coalition's Clark Gascoigne, calls it very ironic. And other experts say the money would not be coming to the U.S. anyway unless a low tax rate induces Apple to repatriate profits to the U.S. One expert calls it hypocritical. Senator Schumer says he agrees with Paul Ryan that tax legislation for a low tax rate for repatriation of profits back to the U.S. should be the next step, so that an infrastructure fund can be setup. Senator Levin and transparency advocates sees the EU action as normal and to be expected, as the anti-establishment sentiment today comes from such dealings that create the impression that the system is rigged in favor of some corporations. ...
