The Trump administration's early proposal for NAFTA moves away from campaign pledges to completely renegotiate the treaty, instead taking the approach of working to improve the U.S. trade position in relation to Mexico and Canada. It includes seven objectives for tougher rules for labor and the environment favored by Democrats in Congress, and it also has support from Republicans with its effort to update NAFTA for changes in technology and in other areas since the accord was signed during the Clinton administration. The area in which U.S. and Mexican business are wary is one in which the Trump administration still seeks to keep the option of imposing protective tariffs, and a border-adjusted tax to level playing field for differences in taxes, as well as other measures to protect American jobs and interests. Because any renegotiated NAFTA also has to pass both houses of Congress this proposal took into account the different constituencies and interests for this issue. Robert Lighthizer, trade representative under president Reagan is likely to become the next U.S. Trade Representative and lead negotiator. U.S. president Trump pulls back from a threat to pull out of NAFTA trade agreement after calls from U.S. business, and calls from the leaders of Mexico and Canada. Mexico said the threat would hurt constructive negotiations, Mr. Trudeau told Trump it would hurt jobs on both sides of the border. Canada is facing headwinds for growth as business is reluctant to invest under the uncertainty for NAFTA. U.S. businesses lobbied heavily including the American Chamber of Commerce. Trump administration aides say they had used this as an effort to get Congress to act- delays resulting from a 90 day rule and from negotiations not to start till Congress approves of the new trade representative Mr. Lighthizer. Helping the situation was the effort by Commerce Secretary Wilbur Ross showing Trump the states that had voted for Trump that would lose jobs, and that nothing was to be gained from the action of pulling out when constructive negotiations were possible- and when Mexico and Canada were eager to start negotiations to reach a new agreement. The Trump administration sends an official notice to Congress that it intends to renegotiate the NAFTA treaty with Mexico and Canada. The new U.S. Trade Representative Mr. Lighthizer served as Deputy Trade Representative under president Reagan in 1983. He says the focus of the negotiation will to promote economic growth and jobs by making improvements to the treaty. The notice does not mention major modifications of the type that were hinted at by president Trump earlier. The leaders of Canada and Mexico had asked president Trump to renegotiate. Republicans in Congress and business in the U.S. favor improvements instead of the drastic changes. Mr. Lighthizer's approach is stated in his letter that said "NAFTA was negotiated 25 years ago, and while our economy and business has changed considerably in that period, NAFTA has not." New provisions will be needed said Lighthizer for intellectual property rights, state owned enterprises, labor and environmental areas, with effective enforcement.  Because of the rhetoric and language used in the election campaign, it is important to note that Lighthizer has in the past negotiated favorable terms for the U.S. steel industry to prevent dumping from overseas. His style is the opposite of the president. He has stated- "I am friendly when negotiating. I am not theatrical. The art of persuasion is knowing where the leverage is." ...

President Trump pushes forward with a deal with Mexico so that it can be signed before the new Mexican administration of Lopez Obrador takes over. This means leaving Canada out and having a separate deal with Canada later on. Mr. Trump sees negative connotations in the term NAFTA and would like to call it the "United States - Mexico Trade Agreement." Terms for Canada to join the agreement would be tougher and the pressure on Canada to strike a separate deal was increased with Mr. Trump saying there could be tariffs on imported Canadian made cars. Mexico has accepted revisions to NAFTA that make it harder for Mexico to challenge U.S. trade penalties. Mr. Trump's negotiating position is based on his conviction that the eagerness of other nations to sell in the U.S. market gives the U.S. a lot of clout. Mr. Trump also faces pressure from within the Republican Party to show results not just by imposing tariffs and playing hardball on trade but to come up with new trade deals. Steps taken by Mr. Trump were to impose tariffs of 25% on imports of aluminium and steel, and 25% tariffs on a list of imports from China including solar panels. President Trump hopes to get support from Democrats by including provisions that support trade unions in Mexico and higher wages in Mexico. The provisions also require higher wage labor in the U.S. to build the required U.S. content and are designed to support American jobs and wages in the auto industry.   ...

Greg Ip points out in this WSJ analysis that the new NAFTA after negotiations and warnings from Mr. Trump to scrap NAFTA, is not very different from the old NAFTA. Mexico made concessions on auto exports and labor rights, wages. Canada made concessions for the dairy industry. Yet the combined influence of business interests, Canada's lobbying in U.S. Congress and state governments, and the restraint shown by Trump's own advisers prevailed in limiting Mr. Trump's tendencies to go for a "America first" agenda. It shows, says Ip, that there is resilience in the existing order.  It also shows what future trade negotiations with the European Union and Japan over steel and autos could look like. President Trump will continue to face resistance within from his advisers and from exporters, business, Congress, on following an exclusively "America First" agenda. President Trump will need to extol NAFTA in its current version the USMCA, U.S. Mexico Canada Agreement, to get it through the U.S. Congress in 2019.   Mexico's main concessions on autos were to agree to potential tariffs if exports exceed 2.6 million vehicles.  This keeps Mexico's status as a major auto export hub intact. Auto experts say VW and Mazda may simply pay the tariff of 2.5% for lower priced models assembled in Mexico that do not qualify for duty free entry instead of shifting production to the U.S. Current shipments from Mexico are not affected as U.S. demand is weak. Labor rights and higher wages in Mexico's auto industry are a win-win for Mexico and the U.S.. They are supported by the socialist administration of newly elected Mexican president Obrador. Canada's main concession was to expand U.S. access to Canada's protected dairy industry, with Canada already prepared to make the concession. Mr. Trump had also to consider the possibility that excluding Canada from the USMCA would have not passed Congress, and face even more resistance in a Democratic controlled Congress after 2019 elections.  The support Canada has received in Congress does not extend to China, which gets much less support in Congress, leading to higher uncertainty in the negotiations with China and possibly different outcome with the size of the trade imbalance of $1 billion a day factored in.   ...

Any hopes that the U.S. would compromise on its position on trade issues were dampened after the G-7 Summit meetings in Canada. Europe and Canada are frustrated at their inability to move Mr. Trump on trade issues. Mr. Trump made jabs on trade, terrorism and immigration during 2 days of meetings. There is also uncertainty about the NAFTA though trade negotiations on NAFTA continue in Quebec. Trump says the negotiations were friendly and moving along until Mr. Trudeau made his own remarks about not being pushed around by its larger neighbor. There is a two week period before the 25% tariff on steel coming into the U.S. goes into effect. This gives time for Canada, Mexico, the EU, Japan and other countries to come up with offers to negotiate or as with the EU come up with its own plan to put tariffs on some American goods. An exemption for Canada is supported by the United Steel Workers Union, as many American companies make steel across the borders. Canada sends the most steel and aluminium to the U.S. With the departure of Gary Cohn as economic advisor, Mr. Lighthizer, the U.S. Trade Representative who pushed for the tariff plan becomes a trusted advisor to the President. Lighthizer is to be seen in Lyrarc pages as having consistently supported fair trade and protecting U.S. workers in these situations since his work in the Reagan administration. The other advisors who are ascendent are Peter Navarro, a trade expert, and Wilbur Ross, the Commerce Secretary. The fears within Mexico's auto industry that the TPP will allow imports of cheap Chinese auto parts hurting its auto industry, and reversing years of gains made under NAFTA. The Trump administration released its framework for NAFTA negotiations. The framework is designed to reduce the U.S. trade deficit and promote "Buy America" provisions. It will challenge Mexico on labor and environmental matters, which is likely to win the support of Democrats. A mechanism for preventing countries from getting unfair advantage through currency manipulation is part of the framework, yet less of an issue with Mexico and Canada. It will also work to protect U.S. trade interests in an effort to appeal to workers who supported Trump in the 2016 election. Overall it does not deviate much from established U.S. trade policy, according to the WSJ. For this reason the new guidelines were welcomed by the Mexican and Canadian governments. Mexico and Canada also see this as an effort to modernize the agreement to reflect changes in technology and commerce since NAFTA was signed. Under fast track trade promotion authority the president's Trade Representative Mr. Lighthizer can start negotiations in 30 days. One of the matters up for change is the Chapter 19 dispute settlement mechanism which makes it easier for Canada and Mexico to avert trade sanctions. Instead of killing the NAFTA trade agreement Trump and his advisors prefer renegotiating the treaty. Priorities for the Trump administration are reducing the U.S. deficit with Mexico of $61 billion. Trade with Mexico and Canada is worth $1.1 trillion and the complex supply chains works such that product components cross borders more than once to become finished products. Mexico promotes its auto and other industries as duty free access to the U.S. for foreign investment. Special tariffs would reduce the trade deficit with Mexico and firms that moved production to Mexico would pay additional taxes. A provision that allows Mexican and Canadian companies to challenge U.S. regulations would also be removed. Rep. Brad Sherman (Democrat) says he supports the renegotiation so that duties of 4% are imposed to reduce the deficit to $25 billion.

NAFTA removed existing tariffs on over half of the exports from Mexico to the U.S. and phased out remaining tariffs between the U.S., Canada and Mexico. The U.S. had two way trade of $918 billion with Canada and Mexico in 2010, according to the Office of the U.S. Trade Representative. Canada is the U.S.'s top trading partner, with $462 billion in trade through Sept. 2012, and U.S. trade with Mexico- expected to overtake China- is at $369 billion in the same 9 month period of 2012.

The Trump administration is looking at ways to protect U.S. automobile manufacturing by enforcing stricter environmental rules for automobile imports. The EPA is looking at whether VW which has 3.5% of the American market can be asked to meet stricter standards because the diesel emissions scandal gives the U.S. legal justification to set stricter emissions rules. VW has accepted that it used illegal software to evade government emissions tests. Such non tariff barriers are faced by the U.S. companies in Japanese, South Korean, Chinese markets. It is not clear how this would affect the 17.1 million cars made in NAFTA factories with parts made in one country and shipped for assembly in another country, between Canada, Mexico and the U.S.

One foreign policy expert says president Trump tried to reverse everything in Obama's foreign policy almost to the point of an obsession. He visits Saudi Arabia before visiting Mexico and Canada, close neighbors, as other presidents have done. The relationships with Mexico and Canada deteriorated. Yet Mr. Trump has a good personal connection with Trudeau of Canada and Macron of France.  Taking the advice of advisers including Commerce Secretary Wilbur Ross, president Trump despite tough talk on the North American Free Trade Agreement, takes a moderate approach on NAFTA renegotiation. Trump also softens some of the rhetoric on China as he seeks Chinese help to restrain North Korea. An international coalition of states supported by the U.S. reverses gains by Islamic State, with Iraq and Iran gaining over Islamic State. President Obama's policy of not taking decisive action, reversed towards the end of the second term, had led to the rise of Islamic State and the refugee crisis in Europe as refugees left Syria and Iraq. NATO or the South Korean defense was not significantly weakened as feared at the beginning of the first year. Missile defense proceeded in South Korea with U.S. missile systems. The appointment of a senior senator from Texas, Kay Hutchinson, signaled that the NATO policy had not changed significantly. As a result it could be said that the year 2018 began with a bang about the risks internationally with president Trump's unconventional approach, and ended without some of the worst fears being realized. Relations between North and South Korea improved as Koreans decided to work together for peace in the peninsula- with North Korea agreeing to participate in the Winter Olympics in South Korea.   ...

Robert Lighthizer was one of the early voices on unfair and imbalanced trade with other nations subsidizing their industry at the expense of American jobs in manufacturing long before DJT took up the issue in 2015-2016. Lighthizer as US Trade Representative negotiated the new USMCA that replaced NAFTA agreement for North American trade with Mexico and Canada. 

Lighthizer was seeking a larger role than USTR, either Commerce or Treasury, yet he was reluctant to campaign for this or go to Mar-a-Lago to make his case. As a result says WSJ, he was passed over as Luttnick and Bessent tried to get DJT's attention. Another reason he was passed over is that DJT is  sees the continuing flow of fentanyl and the migrant flows from Mexico, the sourcing from China, as serious issues that require using trade as part of the solution by 2024 if Mexico, Canada and China do not cooperate and hurt US interests.

The current trade disputes and negotiations between the European Union and the U.S. are leading to European carmakers looking again at their supply chains to come up with ways of increasing manufacturing autos in the U.S. Daimler CEO Zetsche says Mercedes Benz will increase engine manufacturing in the U.S. BMW CEO Kruger says the USMCA agreement as the new NAFTA is called, will accelerate investments in manufacturing in the U.S.- more U.S. production for the U.S. market.

The USMCA require at least 75% of car's value built in the U.S. up from 62%. Also 40-45% of the car has to be made at wages of at least $16 per hour. The cap for cars made in Canada and Mexico and exported to the U.S. is 5.2 million with 4.1 million currently shipped into the U.S. Any cars over this or not qualifying with the rules pay a tariff of 2.5%.
