This report in the Washington Post says Hillary Clinton accepted $675,000 in speaking fees from Goldman Sachs. After this was raised in a question by Anderson Cooper of CNN, at a CNN Town Hall in Derrry, New Hampshire, on Feb. 3, 2016, Hillary Clinton has postponed 2 speaking events, one at an affiliate of Bain Capital and one organized by the chief legal officer of BlackRock asset management firm. Anderson Cooper's question to Hillary was whether she had made " bad error in judgement" by accepting that amount for 3 speeches. Her answers "that's what they offered," and "they're not giving me very much money now," were not seen positively in the media. Federal Election Commission reports cited by the Washington Post show that donors from hedge fnds, banks, insurance companies, financial services firms gave $21.4 million for Clinton's 2016 campaign, out of a total of $157.8 million. Including allied superPACS the Clinton 2016 campaign received $44.1 million from financial industry donors compared to $39.7 million received by Bill Clinton, according to this WP report. Compared to Hillary Clinton, Bernie Sanders has raised about $75,000 of the $75 million he raised for the 2016 campaign from the financial industry, says WP....

Judge Rakoff is interviewed by Adam Liptak as an essay by Rakoff appears in the December 22 issue of The New York Review of Books. Judge Rakoff is critical of the Justice Department for not prosecuting individuals responsible in the 2008-2009 financial crisis and merely offering excuses. He discounts the Justice Department argument that proving intent is difficult or that proving fraud is hard because of the sophisticated counterparties on both sides. He says assistant attorney general in the criminal division Bauer's assertion that you have to prove the individual involved made a false statement, intended to commit a crime, and that the other side depended on this for what they were doing, is misleading. The government is not required to prove that one party to a transaction relied on another party. On the difficulty to prove wilful criminal intent for individuals several layers above those who made and marketed the bad securities, Rakoff says the legal doctrine of wilfull blindness could have been used. Reflecting on why the Justice Department has not prosecuted individuals for wrongdoing the way Milken, Keating and Skilling were prosecuted in prior financial crises, Rakoff comes up with a explanation. He says the government's own role and the role of firms throughout the financial system is suspect in the 2008-2009 financial crisis unlike prior crises. Not only regulators are failing to to do their job. The financial system offers incentives for the packaging of bad debt securities. Fannie Mae has government backing and its management buys these securities to expand access to housing for low income people. The profits made on these securities brings U.S. and foreign banks into this business and leads to a proliferation of these securities around the globe to the point that small towns near the North Pole end up with these securities in their portfolio. This complicates things for prosecutors who in some situations have themselves worked for banks selling these securities. In its slow deliberative way the Obama administration, the Justice Department, and the S.E.C.'s new head, move to prosecute firms during the administration's second term, but not enough is done and tackling individual responsibility for deterring future wrongdoing in the interests of a safe and fair financial system seems a long way off....

A man with a handgun and magazine of ammunition is shot by federal law enforcement officer on Jan. 24, 2026 as protestors confront federal law enforcement officers in Minneapolis. Earlier federal law enforcement in California, and in other states, Washington DC, Nashville Tennessee, have led to protests but not of the kind in Minneapolis, Minnesota. Minneapolis is a state with liberal views yet it also has a strange mix as it was in Minneapolis that local police shot an unarmed black man during the Covid epidemic. This time it is not local police in that role but local police under the orders of the state and local authorites, the mayor and state governor Frey and Walz, not cooperating with the federal law enforcement of immigration law in the US that seeks to remove migrants with crime records from the US neighborhoods and streets. Walz was selected by Kamala Harris to run on the Democratic ticket for president in the US against DJT and Vance in 2025. Republicans allege serious fraud in Minnesota and misuse of state funds that have added to the dangerous mix of politics in the state, that is found nowhere else in America. From the Republican point of view unwanted migrants from certain unstable countries with criminal records were allowed to settle in the state. Democrats and Democrat media are not cooperating as the national elections in the US were lost on just this issue of migrants illegal entry numbering about 7 million over the last administration of Biden with costs to the US of over $110 billion in federal and local funds. No one knows where this will end up yet the view world wide over migration is moving to safe neighborhoods and safe streets as essential human rights, essential women's rights, essential rights of all Americans and all Europeans, that the problems of failed states cannot be solved on American or European soil. The Monroe Doctrine was put in place for just this reason as respecting Russia as a power in its area of influence in Northern Europe means no intervention by Russia or  China in the western hemisphere, so that the US never faces the situation of Guatemala and central American states, or of Venezuelan failed states in sending millions in a stream through Mexico for illegal entry on US southern border. Overall US policy, domestic and foreign has changed to ensure safety wellbeing in the US as the first and only priority for all its citizens and the sum of good citizenship the main objective for the Nation. ...

To understand the way DJT has selected key people- it follows a traditional Republican pattern getting the best qualified Republicans on board. Some of them may not be as good as the ones they replace but some may be better administrators with good judgement. Sheila Bair of Wichita, Kansas, ran the FDIC from 2006-2011 and was one of the finest at FDIC who also contributed to solve the 2009 financial crisis.  Gary Gensler was slow in acting on cryptocurrency and other regulatory matters. He is one of the first to go in the new DJT administration. At the SEC a former SEC commissioner now legal officer at Robin Hood, or law partner at Sullivan and Cromwell. At CFPB a law professor at George Mason University or a previous Comptroller of the Currency. To understand where DJT is headed there are opposing ideas cap credit card interest rates at 10% that no Democratic administration ever brought up, and discarding a rule challenged in courts that caps credit card late fees. The VP Vance's instincts also come into play as he has also fought to lighten the burden on consumers. The Comptroller of the Currency- A law partner at Jones Day, who was Deputy Comptroller of the Currency in the past. The five member FDIC can only have maximum of 3 members from one political party. Sorkin discusses the speech made by Hillary Clinton at NYU's Stern School of Business on her capital gains tax plan to encourage long term investing by giving the current tax break of 23.8% tax on capital gains for the highest tax bracket only in year 6 following the investment. Black Rock CEO Fink is one of the supporters of delaying the current capital gains tax - his proposal was to treat capital gains favorably only after 3 years, and then decrease the tax rate on a sliding scale for each year following. Pulliam and Demos look at the murky world of pre IPO trading of shares by venture capital companies and by employees of the pre-IPO companies in the secondary market. Federal and state laws permit pre-IPO trading for unregistered securities. The SEC has not issued more than a couple of enforcement actions for the trading of pre-IPO shares from startup companies. Wealth is now created before an IPO is done. During the 2000 tech boom most of the surge in price happened after the IPO- Amazon's IPO giving the company a valuation of $400 million based on IPO price then, compared to $171 billion in 2015, and Facebook worth $104 billion at the IPO price in 2012, and twice that in 2015. 78 privately held companies are worth over $1 billion in 2015, with combined valuation of $310 billion. The surge in prices of pre-IPO shares comes from the huge demand from investors, who are willing to accept that not much financial information will be disclosed by the startup companies, in the hope of quickly earning a large profit. The estimates of pre-IPO trading for the shares is in the range of $10- $30 billion in shares traded in 2014. This is what the WSJ's Puliam and Demos learned from extensive interviews with traders, investmetn bankers, hedge fund managers, venture capital executives, lawyers and company officials....

Astoundingly in America 90 percent of people support universal background checks, yet private party sellers are not required to conduct background checks when selling guns. According to a Pew Research Center poll 67 percent of people support a ban on selling assault weapons to civilians, yet no such ban exists. It has taken this long just for president Trump to come out in favor of background checks. Ironically mass shootings have led to higher stock prices for gun manufacturers such as Smith and Wesson, as DW.com points out.  The National Rifle Association, NRA, has five million members and it lobbies hard to prevent gun control measures being passed in Congress. Members of Congress are even rated A to F based on their support for the NRA. Today an estimated 42% of Americans own guns, with 265 million guns in private hands. The NRA sees gun owning rights as part of the Second Amendment of the U.S. Constitution, believing that the right to bear arms is a basic right supported by the Constitution. The NRA over many decades has shown no flexibility in its stance and fierce lobbying has brought down every gun control measure introduced. ...

Skeptical reception of the Administration's plan as Senators on the Banking Committee question, Paulson, Bernanke, Cox and Lockhart. The plan is only a few pages long and has no details wich alarms Senators as letting Treasury act with absolute impunity. The Senators are concerned about accountability, transparency and strict oversight. They are also concerned about protecting taxpayers money and taking equity in return for funds as on way to ensure that the taxpayers benefit from the upside in this as with the Swedish example in 1992. And Senators are concerned about the high rate of foreclosures and the need to help homeowners avoid foreclosure about which this plan is silent leaving in the words of one senator " a gaping hole" in the plan as home prices will continue to deteriorate as long as nothing serious and comprehensive is done about the foreclosure rate. Neither Bernanke or Paulson had anything to say about addressing foreclosures with broad comprehensive steps. And reflecting the outrage across the country the Senators want to see a cap on executive compensation of CEO's or some way in which CEO's of these financial institutions benefit while the taxpayers bear the burden. Summing up for the committee the head of the Senate Banking committee said that the Administrations plan was "unacceptable." ...
