"The identity of the Indian Constitution has evolved through the interaction of Indian citizens with the Constitution and has been accompanied by judicial interpretation... If you look at the Constitution, it does not favor unbounded economic liberalism. Rather, our Constitution seeks to find the right balance. When individuals can exercize their liberties and to be fairly rewarded for their efforts, then economic justice becomes one of the many inter-related dimensions of life. Ultimately, we share common faiths and destinies to the point that development of each individual fosters social justice in the entire world." "The basic structure doctrine of India's Constitution is that it guides and gives certain direction to its interpreters and implementers, when the path is convoluted. The craftsmanship of a judge lies in interpreting the text of the Constitution with the changing times while keeping its soul intact." This happened when Nani Palkhivala presented the idea before the Supreme Court in 1973 against prime minister Indira Gandhi's Emergency rule that parliament had limits to its powers when it came to amending the Constitution if by amending it the amendment would destroy the spirit of the Constitution or its basic idea. This includes freedom of expression, rule of law, separation of powers, freedoms guaranteed to all citizens. The amending power is limited and cannot be turned into an absolute power. Another way of looking at it is that parliament itself is organized by statutory authority. And it cannot destroy or dismantle the very basic features of the law (the Constitution) that created it in the first place.     ...

This discussion in WSJ brings up an important topic- how can America get the most out of its infrastructure dollars, make the $1 trillion infrastructure go a long way towards fixing the nation's dilapidated and crumbling roads, highways, bridges, and other infrastructure? The three experts point out that there is lack of coordination between different government agencies, between agencies and the private sector engineering firms. They are all working in silos with little connection to delivery times and delivery quality of end product. There is a lack of transparency at all levels of infrastructure work and spending, so that the end delivery and problems are not seen in relation to final delivery of end product, visible to all on one site. There is a third problem say the three experts in the lack of investment in professional development and training and technology for the people in the government agencies.  The result is that the US with its higher costs for construction work and the delays for getting approval, and the bureaucratic hurdles, ends up with getting much less for the buck than other countries. Even a newcomer to infrastructure development if it gets it right can be ahead of the US. India is looking at the pitfalls of infrastructure development and eliminating hurdles. With its Gati Shakti Master plan given the personal support of the prime minister India is correcting precisely these three missteps that are cited in the WSJ for the US infrastructure buildup. Under Gati Shakti all government agencies at city, state and federal levels fall under one umbrella to work in coordination. The focus is always on end product and delivery of end product. The siloing of projects is considered a serious pitfall and avoided at all costs. Transparency is considered essential and so is visibility in that at any time one can turn on a site and see where a project stands in its delivery date of end product. If there are problems they are put on the site so that all participants can see it to come up with solutions. By doing this a country with fewer resources can make them go a long way to come up with the kind of infrastructure that is seen in rich countries with more waste built into the process.   ...

Problems facing India as it searches for a way to modernize the country, build infrastructure, and create strong jobs growth. Glaring weaknesses are evident in a number of areas which have not been addressed: a weak public education system, food poverty for people at the lower end worsening with today's 10% food inflation, child malnutrition, weak infrastructure building capabilities, growth in services but not enough in manufacturing to create jobs, a growing black economy, and a general acceptance of illegal behaviour that has increased with the increase in opportunities for corruption and bribes in a growing economy. The political governance is weak. The dependence on smaller regional parties in ruling coalition governments weakens initiative at the federal government level. The general lack of new political leadership, and the failure to develop new leaders in the Congress party because of the six decades long presence of the Nehru family. Some striking facts- the role of the black or underground economy has actually increased over the years. Arun Kumar, chairman of the Center for Economc Studies and Planning at Jawaharlal Nehru University in New Delhi, says his estimates show it was 40% of GDP by 1996, and 50% by 2006. This means more business activity evades direct taxes, and less money is available for investments in education, infrastructure and healthcare. It also indicates a widespread tolerance of illegal activity and corruption. The other striking facts are that the calorie consumption by the bottom of the 50% of the population has been declining since 1987, according to a 2009-10 economic survey by India's Ministry of Finance. The modernization of the country appears not to be following the path taken in East Asia- by Japan, S. Korea and now China- where people moved in large migrations from farms and rural areas to cities and manufacturing jobs, resulting in gradual urbanization. Manufacturing in India is only 16% of GDP in 2009, the same as in 1991, according to the World Bank. Certain regions are doing better than others- Gujarat and the Punjab in the north, Tamilnadu, Karnataka in the south- with large population areas in Uttar Pradesh and Bihar lagging behind badly. ...

Japan has pledged to increase trade with India with $42 billion in investment in India over 5 years. In the 20 years 2000-2019 when Japan invested heavily in China, Japan invested only $32 billion in India. The US and Germany also invested heavily in China, compared to the investment in India.  Business in the US, Germany, the EU, and Japan integrated their economies with China over two decades. The Trump administration brought attention to the US working class and the effects of trade and investment that hurt workers in the domestic economy. The election of Biden in the US, Scholz in Germany and Kishida in Japan have shifted focus to the working class, inequality, lack of infrastructure investment in the domestic economy, and the effects of business decisions that cost jobs in the domestic economy. It is in this context that foreign investment is being shifted to India, Vietnam, and other manufacturing locations in Asia as the entire world supply chain is being reinvented to protect workers in the domestic economy, and the local economies. The pandemic and the war in Europe are now accelerating the reinvention of world supply chains. Indi abstained from the vote in the United Nations on Ukraine yet it maintains that all disputes be settled through peaceful resolution under international law. After Mohandas Gandhi one of the main leaders of modern India is one who came from the untouchable castes, the lowest caste in India's caste system which had declined over centuries. Babasaheb Ambedkar comes from Ratnagiri district in Maharashtra from a family that had gained its way out of the caste constraints by working for the British East India Company. He later studied at Elphinstone College in Bombay, and went to Columbia University on a scholarship. He finished Masters degrees at Columbia University and later at the London School of Economics, in economics and political science.  Returning to India he wrote "Annhilation of Caste" in 1936. Mohandas Gandhi was at this time working on his own movement to get rid of the untouchability that over centuries made its way into the original caste system and weakened the foundations of Indian society. To understand this one has to know that in many upper castes it was seen as becoming an outcaste even to travel overseas, which by itself may have led to the decline that India experienced in the period 1500-1950, and which Gandhi personally experienced and fought his way out of. By 1942 even the British recognized Ambedkar's efforts and he was Minister of Law and Justice in the war cabinet. In 1947 Ambedkar was chosen to lead the team that would write India's Constitution. In his latter years Ambedkar became a Buddhist and has written several books on Buddhism. By 2015 Ambedkar day was recognized as a public holiday by the new government and his memory is enshrined in the efforts now underway in India's largest state of Uttar Pradesh to bring modern ideas, and modernization through next generation infrastructure, and opportunity for Dalits of which caste Ambedkar was one, and the same for all of the 250 million people of Uttar Pradesh, almost the size of America. ...

The impact is huge. Out of 180 million rural families only 33 million families have clean drinking water from tap water in the country. Clean water brings life to the countryside and access through individual tap water connection brings a revolution to people's lives in a country of 1.2 billion people. This report in the Economic Times tells us what most of us do not know that with the growth in population from about 300 million after independence in 1947 to 1.2 billion today and the drought conditions in parts of the country, the per capita water availability has fallen sharply today. Dropping from 5000 cubic metres of water per capita in India in 1951 to 1545 cubic metres of water in 2011.  The infrastructure capital to be invested is 3.5 trillion rupees or $ 50 billion. $50 billion in cement, pipes, construction, pumps, equipment, wages, conservation, skill building, knowledge in water management to revive the rural economy. Hit hard by coronavirus it boosts the rural economy. The infrastructure project could be a model for other Asian, African and Latin American countries.  Cholera and other water borne diseases can never be eliminated without clean drinking water from tap water for all families in India.
