Gretchen Morgenson cites two views on the newly approved Volcker Rule in December 2013. Prof. Richard Sylla of New York University sees the rule as going part way in the direction of the Glass-Steagall Act, which gave the financial markets five or six decades of financial stability. Just the fact that the rule is on the books should give the bank officers pause before engaging in questionable financial activities, is his view. Prof. David Skeel of the University of Pennsylvania Law School, believes only aggressive enforcement can make the law work because of the way it is written. He says regulators have fallen short in enforcement in the past and have not been held accountable. Only by making regulators accountable, including penalties for regulators failing to do their job, would this work says Skeel. By not imposing penalties for regulatory failures in the last crisis there is more likelihood for this sort of behaviour to continue. Instead the same regulators are now given greater powers after an earlier failure. Considering the Skeel view, the importance of the attestation- that is now required from bank senior executives that the Volcker Rule's provisions are being followed- take on an important role in ensuring enforcement. This also coincides with Mr. Volcker's view that the bank officers should have to take on the responsibility for making sure that they are doing it the right way....

Ross Sorkin says the information put out in Groupon's IPO filing by the investment banks and other information raises warning signs. Groupon has $225 million in the bank, lost $102 million in the 3rd quarter 2011 on revenue of $878 million. The company has current liabilities of $681 million and only $376 million in assets. It owes vendors $392 millon as part of the current liabilities. Groupon spent $432 million in the first 6 months of 2011 on marketing. Other information shows Eric Lefkovsky, Groupon's chairman, sold a dotcom company in 1999 which went into bankruptcy a year later. And of the $950 million in a pre-IPO round in January 2011, Groupon paid out $810 million to investors and employees. Of this Mr. Lefkovsky and his wife were given $319 million. Goldman Sachs is the lead underwriter behind Groupon's IPO offering. Because of the huge fees involved investment banks and accounting firms were willing to come up with inflated valuations and a questionable metric called Adjusted Consolidated Segment Operating Income, that showed operating income excluding major marketing and acquisition related costs....

The private -government partnership Summers and Geithner see happening for restoring confidence in the banks may be a child of necessity as Congress is not too keen on providing large bailout funds in addition to the funds approved in TARP. But it has the same problems of pricing these assets for an aggregator bank that were seen from the beginning. How does one price a bad asset? If priced too low banks may not agree and if priced higher or on generous terms it risks taxpayer money. These problems still linger on in the continuing effort to sort the problems out.

Italy's prime minister, Mario Monti, a senior EU official before becoming prime minister, has the credibility and credentials to bring the French and German sides together on a new plan forward for the European Union, says Steven Pearlstein of the Washington Post. In this report from Rome, where leaders of Italy, Spain, France and Germany are meeting to discuss solutions Pearlstein describes the solutions Monti is putting forward. The European Investment Fund would be built up so that it has funding of about $175 billion or 1% of Europe's GDP to finance truly productivity and growth enhancing projects of innovative small and medium sized business in transportation, energy, education and environmental sectors. These companies have suffered shortages of capital as banks pulled bank from lending. It is the inadequate private investment that is causing the greatest damage in this crisis and $175 billion is at the low end of the amount needed in this crisis. Other steps Monti is pushing forward- for immediate steps to tackle the crisis deposit insurance to prevent a run on banks is essential for European banks. This would come with a eurozone regulatory authority that would have the powers to regulate European banks. The European Financial Stability Facility would be the "sovereign buyer of last resort," under Monti's proposal. Eurobonds come up as a key part of the solution. This is not because German and French taxpayers would be required to finance economies of Spain and Italy. As was shown by the U.S. Troubled Asset Relief Program (TARP) a well designed program could pay for itself. This would include the EU financial authority taking up stakes in the banks getting help and closing banks that are insolvent. The key point is that if properly executed and executed in a timely and appropriate way this does not have to cost French and German taxpayers- the important thing being to support the eurozone economies before the situation deteriorates. Borrowing at 6% for Spain and Italy will only put the situation out of control as deficits rise rapidly. The concessions for tighter regulation of European banking systems, reducing risk in banking, setting up adequate reserves, closing poorly run banks, and ceding powers to a European Financial Authority that can make the final decisions, are the steps that would have to go with these arrangements. Sound financial management requires that the kind of banking risks taken in the speculative bubbles in Spain, the lack of transparency and credibility in banking estimates of bad loans in the system, and the glossing over the problems at Bankia, would have to be addressed in solutions through regulation by a credible European Financial Authority to convince skeptical German public opinion that financial accounts are conducted in a proper manner....

Simon Nixon says the main problem with the E.U. bank stress tests of 2011 is that it did not test for sovereign defaults. For example Greek debt that is trading at 50 cents on the euro, was marked down 15%. And the lack of urgency to raise fresh capital is another problem. Simon Johnson reminds readers that in October 2008, Johnson, Peter Boone, and James Kwak, suggested that some European countries had given taxpayer-backed pledges to banks that had liabilities larger than their own gross domestic products. Their proposal included creation of a European Stability Fund with at least 2 trillion euros of credit lines guaranteed by all member nations, as well as Switzerland, Sweden, and the U.K., to buy time dealing with underlying insolvency in Ireland and other countries. Simon Johnson, is former chief economist of the IMF. He says the euro-zone only belatedly acted on this advice and the politicians never took responsibility for what they allowed to happen. The runaway financial globalization he says, was allowed to happen by US Treasury officials, but European banks were seriously involved in similar behaviour. These banks became too large relative to their economies, captured their regulators and acted recklessly. Europe's leaders haven't fully faced up to this and keep telling their voters that the problem is entirely because of US banks irresponsible behaviour. Ireland was the extreme example of this. And Johnson provides readers with the names of two books on the subject. David Lynch has "When the Luck of the Irish Ran Out," Fintan O'Toole has "Ship of Fools: How Stupidity and Corruption Killed the Celtic Tiger." Both laying out the intermingling of politicians, bankers and real-estate developers that resulted in the reckless growth and collapse of Ireland. In his own account in Atlantic magazine, May 2009, Johnson compared the US economc boom-bust-bailout cycle to what happened to Argentina, Russia and Indonesia. These were emerging middle class countries with crony capitalism, unsustainable debt and other problems. Johnson says, don't think these problems are limited to emerging markets. Its a global or general occurrence in which powerful people get together to build an economic model that brings growth based on debt. Under public pressure the German government keeps saying there must be burden sharing, that creditors must take losses also. Johnson says Angela Merkel and her colleagues have not thought through what signal this sends to the markets- which is to tell people to get out of Irish banks now. And the big German banks are telling the government they face big losses if Ireland or other European countries default. If the ECB can't pay, and the German taxpayer won't pay, Johnson asks, does the IMF have the resources to tackle Spain? If China offers to recapitalize the IMF with some of its $2.6 trillon in reserves, and becomes the largest shareholder, would the IMF headquarters be moved to Beijing as the Articles of Agreement require for the largest shareholder. ...

Germany's central bank, the Bundesbank, has 495 billion euros in claims on the European Central Bank through the interbank payment system known as Target2. Hans-Werner Sinn, president of the Ifo Institute in Munich, says the breakup of the Euro zone would mean that this claim would be put at risk. Data compiled by Tornel of the University of California, Los Angeles, and Westermann of the University of Osnabruck, Germany, show Target claims going from 7% of Bundesbank assets in the beginning of 2006 to 64% by October 2011. Collateral on these loans held by the ECB is mainly sovereign debt of the financially weakest ECB countries such as Greece, Ireland, Portugal and Spain. Losses on these loans are to be distributed among 17 eurozone central banks according to the proportion of their share in ECB capital, with Germany's being 28%. However with dire finances in some countries Germany could end up with a much larger share of losses. This gives Germany one more reason for the statement that the breakup of the eurozone is unthinkable....

The meeting of EU leaders in Brussels in Oct. 2012 focusses on the issue of setting up banking supervision for eurozone banks. France pushed hard for setting up the banking supervisory authority by Jan 2013. German chancellor Merkel facing elections in Sept. 2013 pushed for a longer time frame into 2013. Setting up the banking supervision, a basic part of the new eurozone financial architecture, would clear the way for direct aid to Spanish banks. In the end Germany and France agreed to complete the legislation setting up the supervisory system by the end of 2012, and getting the supervisory authority- to be placed under the ECB- operational "over the course of 2013," in Merkel's words.

Russia's leading business paper Vedemosti summed up the situation on Dec. 17, 2014, in its editorial- "This is a very dangerous situation; we are separated from a fully fledged run on the banks by just a few days..If the currency market is not reassured right now, the banking system will require large external support." Warning signs were evident at a banking conference in Moscow in October 2014 when the Economy minister, the central bank head Nabiullina, and the head of the largest bank Sberbank, German Gref, expressed skepticism about the economic policies and the risks involved. Not until Dec. 17, was a decisive response evident and the risks of a collapsing ruble openly addressed with economic actions by the Putin administration. A collapsing ruble would have repercussions on the global financial markets and slowing global economy, increasing potential geopolitical risk, and adding to risk of contagion for other emerging markets, which was reflected in the nervousness of global financial markets on Dec 15-16, 2014....

She was critical of smug views that the current situation was acceptable for working class families concerned about immigration and jobs. She also pointed out that the policies of central banks including the Bank of England hurt working class families and savers." She pointed out the development that has also happened in the U.S. economy and other European countries as the Federal Reserve and the ECB cut rates to near zero. "People with assets have got richer. Its now known that some of the money that the government used to bailout AIG is going to Deutsche Bank and Goldman Sachs, so that they can pay the hedge funds to whome they sold credit default swaps. The way it works is this. Hedge funds bet against the housing market that if mortgage defaults reach a certain level they would be paid a large amount. To do this they buy credit default swaps from banks like Deutsche Bank and Goldman. In turn Deutsch and Goldman go out and hedge the risks of selling these credit default swaps. Its hard to find someone to sell this insurance, but AIG becomes the dominant insurer for these credit default swaps. What does AIG get out of this. Only fractions of apenny for every dollar of insurance sold to the banks, less than $10 million for $1 billion of insurance. These swaps were sold in 2005, when some of these hedge funds saw risks in the housing markets excesses, and they were making the bets for an event that was a very plausible one, with very little risk to themselves. And the banks were passing on a lot of the risk for insurance on the cheap to AIG, which ends being the sucker holding a big part of the risk. What did have to gain from this, and why it agreed to sell this insurance is a mystery. Its this insurance that has caused AIG its biggest headache, to have to set aside money to pay the banks who in turn pay the hedge funds. When these pools of mortgage assets of companies like Countrywide Financial, which were created by Deutsche Bank and Goldman, called by names such as 'START' and 'ABACUS', went down in value AIG has to set aside money to pay the banks. As these assets fall in value from mid September to December 2008, AIG and by this the government which now owns 80% of AIG, paid $5.4 billion to Deutsche and $8.1 billion to Goldman under credit default swap contracts AIG has written. This adds up to $52 billion paid to all the banks that bought insurance for credit default swaps they sold and covered with AIG insurance. And this is a large part of the $170 billion of government money to AIG. Its for this kind of financial wizardry that makes little sense, and showed no sense of responsibility for the firm, that the Financial Products Group's 370 employees are to be rewarded with $400 million in bonuses, with binding contracts as reported in the Washington Post. The $165 million so widely reported in bonuses sent out recently, are only a part of the $400 million. While this is going on its surreal that on the other side Michigan is hurting , auto states in the midwest are hurting badly. And $17 billion barely makes it through in time to keep GM and Chrysler running in December 2008, and the money can be called in by the government in February 2009 leading to these companies ending up in bankruptcy. This puts the situation in new perspective, and Rattner who heads the group looking at the GM restructuring must be aware of this, when he said bankruptcy is not necessarily the best option and the loans would not be called in by the government. Its job losses in the economy, and the fragile nature of the economic outlook, and also the way in which money is being scandalously wasted in other places like AIG with no purpose, that Rattner must have in the back of his mind as he looks at money for GM restructuring and jobs for hurting workers. ...
