Makin's view the Fed print money to purchase mortgages directly or purchase Treasury securities directly. Monetary easing has not ocurred and Makin thinks this risks a severe recession. The 15% of homeowners with negative equity and the 20% with marginal equity have little access to credit, a serious foreclosure crisis is looming. JP Morgan Chase Bank faces six separate investigations by the U.S. Justice Department in 2013. Cases from the housing crisis are still being worked out. The Justice Department has concluded that securities laws were broken in JP Morgan's selling of mortgage backed securities in 2005-2007. A new investigation is taking place into anti-bribery law violations in hiring of children of Chinese officials. The legal settlement losses could place JP Morgan Chase ahead of Bank of America in the extent of losses. One estimate is for $6.8 billion in losses above that set aside in reserves, an amount larger than that of any other U.S. bank, according to Barclays Research.

A white paper commissoned by the New America Foundation. The authors are Daniel Alpert, managing partner of Westwood Capital, Robert Hockett, professor of financial law at Cornell University and a consultant to the New York Federal Reserve, and Nouriel Roubini, professor at New York University. Its title is: "The Way Forward: Moving from a Post-Bubble, Post-Bust Economy to Renewed Growth and Competitiveness." The authors say the current crisis requires more than the conventional solutions. They suggest a major infrastructure building program, restructuring the mortgage debt of ordinary Americans with bridge loans, reductions in principal and other solutions, and rebalancing the global economy.

Gretchen Morgenson of the Times distills key insights from 633 page report by the Financial Crisis Inquiry Commission. Morgenson points to the role of the Federal Reserve in Washington and New York in being as she describes it, defiantly inert and uninterested in controlling the mortgage bubble even when it had grown to enormous proportions.The problem now is that the same Fed has received more regulatory powers under the Dodd-Frank law. The same Fed repeatedly did not exert its authority on predatory lending. Page 94 of the report cites a total of only three institutions referred to prosecutors by the Fed from 2000 to 2006. Page 164 shows why there have been so few prosecutions for mortgage fraud from the bursting of the mortgage bubble. William Black, a former fraud investigator and professor at the University of Missouri-Kansas City School of Law, says the FBI has received virtually no assistance from the regulators, the banking regulators and the thrift regulators. The report contains some outrageous comments by one of the key players in fueling the mortgage bubble, Angelo Mozilo of Countrywide Financial. Morgenson describes him as a lender that roped unsuspecting borrowers into poisonous loans. Mozilo says in an interview on page 105 that his company prevented "social unrest" by providing loans to 25 million borrowers, many from minority groups. Never mind that this wave of poisonous loans has clogged the arteries of the nation's financial system, and resulted in foreclosures for millions of homeowners, creating a troubled housing market that hobbles the economy. Neil Barofsky, special inspector general of the Troubled Asset Relief Program, sees further bailouts ahead. He said in a report to Congress in late January 2011: "Unless and until an institution like Citigroup is either broken up, so that it is no longer a threat to the financial system, or a structure put in place that it will be left to suffer the full consequences of its own folly, the prospect of more bailouts willl potentially fuel more bad behaviour with potentially disastrous results." ...

Harry Markovitz who invented Portfolio Theory and won the Nobel Prize in 1990 on the economic crisis and solutions. His idea in portfolio theory is that you reduce risk by creating a portfolio of uncorrelated assets. Owning GM and Ford together is more risky because they are correlated. The securities owned by banks were not not portfolio type with uncorrelated risk, they were all of one type in the mortgage securties industry. He goes to the heart of the problem saying until all these securities are scrutinized and underlying mortgagesare scrutinized, sorted out down to the individual zip code level, and this is not as complicated as it seems given the amount of resources that can be thrown at this problem, and given what is at stake, and they are striped of their lack of transparency, the country and the global economies that are intertwined with America's problems cannot see a solution to this problem. And this is true for the banks like Bank of America and Chase and the government run banks like the FDIC Indymac bank, where only a small fraction of homeowners can be helped with loan modifications to make monthly payments affordable, as a big part of the mortgage loans they hold or service are in the form of mortgage securtities where they don't make the decisions. Unless mortgage securities are sorted out to restore transparency and the government steps in with help and mandates a direction, the foreclosure process will lead to dropping property prices and further deterioration and economic stagnation similiar to the experience of Japan. Markovitz says it could take a year to do this. He says "the valuation process will take as long as takes, but it is the primary step toward effectively utilizing the very controversial bailout and avoiding the structural problem of a stagnant economy." Writes Gordon Crovitz of WSJ, "to put the issue in probability terms, the odds are very remote and nonexistent that the economy can recover until these basic steps are taken."...

Don't let the current holiday season retail sales fool you as they have held up reasonably well. The impact of the mortgage and housing crisis will be felt in a delayed manner. It won't be till 2008 that the impact will really be felt. And the impact is expected to be lasting and deep, could take the rest of 2008, 2009 and into 2010 for this protracted tightening of credit. About $300-400 billion contraction in credit is expected when banks tighten their credit lending because of losses they are taking in the mortgage crisis. This will happen in an environment of falling house prices and consumers will not have access to the $340 billion in cash from home and mortgage equity financing that they took out in 2006, estimate of the Bureau of Economic Analysis. Auto, retail, apparel, and luxury items would be hit the most. On the jobs side not all the jobs will be lost in the USA. The USA imports about $740 billion in consumer goods and autos each year, which is one third of consumer spending excluding food and energy. The lower consumption in auto and apparel would affect exporters in Japan and China and South Korea. But Chinese exports have reached a point that they are causing trade tensions and a call for strengthening the yuan. An increase in American exports and lower imports could help bring down America's trade deficit. This could give China an opportunity to build its domestic market and markets in Asia and Europe so that it is not so dependent on the US market. For the US where the savings rate is near zero this is an opportunity for consumers to build their savings and reduce debt. Europe and India and the Middle East are expected to continue growth and China may see slower but continued growth in 2008 and 2009. In the US industries like aircraft and infrastructure promoting companies that sell to countries like Russia, India Brazil, the Middle East, and China will continue to grow. And because rates are still low large nonfinancial companies still have access to funds for expansion and capital investment. In a global economy the US consumer may be one part of a much larger picture. ...

Former Attorney General of Ohio, Richard Cordray, is nominated to head the Consumer Financial Protection Bureau. Cordray was the first attorney general to file a lawsuit against a loan servicer for violation of state consumer laws. He also sued Merrill Lynch, Ally Financial, AIG and credit rating firms for actions relating to the mortgage financial crisis of 2008. He was editor in chief of the University of Chicago Law Review and clerked for U.S. Supreme Court Justices Byron White and Anthony Kennedy. What does transformational liberalism mean? What does fairness mean? What does it mean to have unemployment insurance, to have health care, to have jobs, to open the door to the middle class for a college education. Is this transformational liberalism? Or is this "transformational liberalism" a part of a vocabulary of cliches that have lost meaning as the nation confronts job losses of the magnitude of 500,000 a month, and this is only the beginning. Much of the increased debt the nation is occurring is going to provide government help to financial institutions like the $177 billion that has gone to AIG so far, just one company, and there are the Citigroups and other companies like AIG. What does it mean to have "burden sharing," when the rest of the country is frightened, scared, losing jobs, losing savings, and at this juncture cliches may have lost meaning, as its those who profited most and got us into this crisis like the investment bankers and senior management of companies in industries like the mortgage industry, auto industry who will be paying their larger share not because of redistribution, but because they may be the ones who can most bear this burden wihtout great sacrifices like cutting down on necessities and basics. See the link to Countrywide's Kurland who plans to profit both by overselling mortgages and creating the tinder that started this fire, and now to profit by buying distressed properties at pennies on the dollar, with $200 million from Black Rock as an investor, and $200 million on stock he sold before the crisis. Is a Kurland who has not been subject to any regulatory action, or management of AIG, or Citigroup or GM or the other companies receiving federal money by the hundreds of billions of dollars about to ask the half amillion of unemployed and the others threatened with job loss each month, for "burden sharing"? Nobody wants to see any of this happen, what has happened, including the debt, but it has happened, and it was not engineered in the new budget or in the few weeks since early January 2009....

A few events in the last 50 years are rewriting the rules for business, finance and economics, says the WSJ in this analysis. The admitting of China to the World Trade Organization under president Clinton in 2001 was one, another was the global financial crisis in 2009 with the selling of bad mortgages by the financial industry, the euro currency financial crisis with the bad accounting, real estate industry speculation, and lack of financial oversight in countries such as Greece, Ireland, Spain. The coronavirus pandemic is one more addition to this string of crises and events that have made the working class and middle class in US and Europe poorer and in worse shape after the recovery following World War II.  The changes indicated here are some of the surface changes- such as the shift to the suburbs for cleaner air and better living, the work at home as a serious option, the new focus on health care, wellness, exercise, nutrition and mental health, remote learning and community college as a realistic option to high tuition costs by the education industry, and a pharmaceutical industry refocused on public health and vaccines as it was in its early years before its shift into a simply profit driven industry. The underlying thread for all these changes on the surface is a deeper change in the public mind- a change that redefines what the people believe in just as happened after World War II. Rebuilding the devastated economies of Europe, America and Asia required a new vision at the time after World War II. And reconstruction could only happen with all the people involved and working for the public interest.  This also created a new hope for the future. President Biden's vision is for a new set of priorities that make child care, women's position in the economy, community college education as a right for all as a first step to opening the access to education that existed after the war in 1945. Investment in infrastructure, in building new roads, bridges and rail, water, internet connections, public services in transport, better layout of urban areas, better lives for retirees, are all part of an effort to improve quality and ease of living for all parts of society, not just those who can afford it.  This is uppermost on people's minds and administrations or governments that fail to deliver or simply talk with no action, will not have the support of ordinary working men and women in all countries. This is true for countries and regions as varied in their level of development as the US, Northern Europe, Southern Europe, Japan, India, Brazil and Mexico, and African nations. Democracy, government adminstration, technology and business structures exist for the people, to improve the ease of living, quality of life, through better health, education and public services.  ...

The White House announced it has the plan for regulatory reform outlined in a 85 page white paper. It provides the bbasic steps planned and the the reasons the administration chose to modernize the existing setup analogous to redesigning and making improvements based on the existing framework rather than building from the ground up. The five key steps are: 1) Increase the power of the Federal Reserve to provide strong and consistent supervision of the larges financial firms. 2) Getting Congress to authorize the government to dismatle large firms to avoid the kind of chaotic collapse that ocurred at Lehman and which worsened this crisis. 3) New rules for derivatives trading and securites built from mortgage loans. 4) Creating anew agency to protect consumers of mortgage, credit card, and other financial products. 5) the administration having a setup to increase coordination with other countries to prevent businesses from migrating to less regulated locations. Obama's comments to CNBC were " Speed is important. We weant to do it right. We want to do it carefully. But we don't want to tilt at windmills. We want to make sure that we're getting the best possible regulatory framework in place so that we're not repeating the mistakes of the past."...

Greg Ip of the WSJ provides this exceptional report offering readers remarkable clarity on what the Republican Tax Law does- its high and low points.  High Points 1. It reduces the corporate tax rate to bring it in line with other advanced industrialized countries. The corporate tax rate in Germany and Japan is 30%, in the UK it is 19%. For 5 years businesses can write off capital equipment immediately instead of depreciating over a couple of years. This could boost investment and growth. 2.  The law takes aim at deductions that led to distortions. It limits the mortgage interest deduction, and caps the deduction for state and local taxes. This removes the incentive to pay more for homes that exacerbated the housing crisis in 2008. The Alternative Minimum Tax is largely removed. The Low Points 1. The biggest drawback is that lawmakers did not properly fund the tax cuts. Of the 10 costliest tax breaks nine were not touched, including employer health insurance, retirement savings, capital gains. Only the state and local taxes deduction was reduced. And a new tax deduction  was created, a 20% tax deduction for small business (proprietors and partnerships) paying taxes on their individual tax returns. Taxes on the wealthy or value added taxes, reducing tax breaks, is how other advanced industrialized countries paid for the corporate tax cuts, but did not happen here. Additional economic growth  to generate added tax revenues is the way Republicans in Congress say this is funded. Yet this is a questionable assumption as Britain reduced the corporate tax rate to 19% without seeing a surge in economic growth, as Greg Ip pointed out in an earlier WSJ article. At best the Joint Committee on Taxation estimates $500 billion over a decade in added revenues from added growth leaving $1 trillion to be added to the deficit. The WhartonPenn Budget Model (WPBM) estimates only $140 to $367 bill from the additional economic growth resulting in added tax revenues. Under this model only 0.03 to 0.08 percent added U.S. economic growth per year is expected from the Republican Tax Cuts. Such a situation would be bad  for the U.S. as the gradual improvement in Debt to GDP ratio to 78% following the financial crisis of 2008 would be sharply reversed taking the ratio to 97% by 2027. An unsustainable trajectory which will require tax increases in a few years and hurt investment in education, health and infrastructure into the future. This is what worries many experts most on both sides of the political spectrum today about what the Republican Congress has pushed through for a legislative "victory." This is why experts believe this is not serious tax reform and will require a new effort after 2019.   ...

Jon Stewart's farewell on "The Daily Show," on August 6, 2015- the first show appeared in 1999- ended on the day the first Republican presidential debate was put on by Fox News. A year after Jon Stewart started his show he made his mark on television by creating a new genre- comedy that informs people. "Indecision 2000" was a new show that covered the 2000 U.S. presidential election ending with the small number of paper ballots in Florida determining the election. A whole generation of young people grew up watching his show which provided some of the bold vigilance so essential for a effective democracy, including coverage of the 2009 financial crisis. It included a show in which the host of the CNBC show "Mad Money" was told boldly that it was disingenuous that the crisis caught everybody on Wall Street by surprise, when informed people knew about the bad mortgages that were being wildly securitized. This was handled with the subtle humor that continued the conversation in an intelligent way, so typical of Jon Stewart. He is also remarkable for helping so many of his colleagues make a mark, including Stephen Colbert, which amplified his influence on discourse in American society. It included questionning those who benefitted from the intelligent debate with humor that Jon Stewart engaged in- president Obama was asked why the homeowners got so little help compared to the banks involved in the faulty mortgages, as a question of fairness. Veterans from the Iraq war were welcomed to see how the show was developed and get training. Stewart defused anger and channelled it into constructive discourse in American society, during 2 wars, a global financial crisis, and 4 presidential elections- "with malice towards none, with charity for all"- he will be sorely missed....

Dexia, the Belgian-French bank, reported a net loss of 11.64 billion euros for 2011, including 4.05 billion euros from selling Dexia Bank Belgium to the Belgian government in Oct 2011, and a 3.36 billion euro loss on Greek government bond holdings as a result of restructuring of Greece's debt. Other losses were 2.6 billion euros from an acceleration of the sale of a portfolio of U.S. mortgage backed securities, and about 1 billion euros from the sale of the Paris based public finance business to savings banks operated by the French government. Dexia ends up with a negative total equity of 320 million euros at the end of 2011. Dexia was one of the hardest hit European banks in the 2008-2009 financial crisis.

The WSJ report indicated no legislation was required, but the NYT report here says the program would require legislation. Moody's revenue model before the early 1970's was based on charging for Moody's publications. This changed in the early 1970's when Moody's and other ratings agencies began charging for opinions. And in 1975 the SEC secured the ratings agencies positions by allowing banks to base their capital requirements on the ratings of securities they held. Before the early 1970's Moody's in the words of Thomas McGuire , a former director of corporate development who left in 1996, acted like a watchdog that regarded the financial markets as its turf and barked and growled when anybody it did'nt know came near it. And its founder Moody, took his mission seriously which gave the company its stern reputation as a safeguarder of the public's interest in the integrity and character of dealings in securities. McGuire was never happy with the change made by the SEC which relied on ratings as a form of regulation, because the ratings agencies would be able to sell ratings even if they failed investors and the public interest. He even states in a speech to the SEC in 1995, that the government regulators are inadvertently putting the ratings people in an improper position because they were ordinary people with ordinary motivations, and the government regulators would have to share accountability for any scandals that result when it let these ordinary people subject to the same pressures for profit and gain assume some regulatory duties. The rest of the story is one in which just such an ordinary person with pecuniary motives turned up in the form of John Rutherford Jr., who became CEO of Moody's in 1998, and focussed the entire company on profit in a way that it had never done before, even expecting each Moody's analyst to produce at least $1 million in revenue each year. In a business with its serious watchdog role that was never intended to be meant to be a purely profit business, but a private business run for profit but not for maximinzing profit, with the singular motive of its management in safeguarding fiercely its independence and integrity as its raison-de-etre. ...

Fletcher cites statistics from the federal Bureau of Labor Statistics showing that between December 2007 and June 2010, private sector employment in Texas went down by 0.6%. During that period public sector jobs increased by 6.4%. Government employees make up about 17% of the workforce in Texas. The Texas economy gets a large amount of federal money because of military installations and NASA- $227 billion in 2009, according to the Census Bureau. By comparison California received $346 billon in 2009. During the recession period after the global financial crisis of 2008, Texas received $25 billion in stimulus money. Richard Fisher of the Dallas Federal Reserve Bank acknowleges the federal money going into Texas, yet he points out the driving force in the economy of Texas is still the private sector. For the private sector there are several advantages to being in Texas. There are lower taxes- no state income tax and lower business taxes. The large supply of land for development and few land-use restrictions make development easier. Corporate efficiency was a key advantage cited by Fluor when it moved from Orange County, California to Texas. A growing energy sector has helped, along with the growing trade with Mexico. The housing regulations in the state have acted as a check on housing prices, and left Texas with less of the detrimental effects of the housing mortgage crisis than the rest of the nation, especially California and Florida. The governor of Texas, Rick Perry, says he is not against all regulation, and the kind of housing regulation in Texas certainly has played a good role for Texas. Perry's tort reforms have reduced the legal burden on business prevalent in the rest of the U.S....

Andy Kessler says this is sucker's rally that took Citi from $1 share to $4 a share, and helped financial stocks. He says its not only ajobless recovery but also a recovery wothout profits. He gives four reasons. Armageddon is off the table but the problems remain of toxic assets and undercapitalized banks no matter what the stress test are saying (more negotiated Ok's than tests), zero yields with interest on savings at 0.2%, Bernanke's printing press with the Fed going all out to get money to the economy fast announcement of inention to purchase $300 billion of longterm bonds, and $750 billion of mortgage backed securities. Mervyn King of the Bank of England and Ben Bernanke both were academics at MIT, and both share the approach they are taking for quantitative easing or credit easing. They are buying up assets like government bonds in the case of Bank of England to reduce the yields, and commerical paper, mortgage backed securities, and consumer debt in the case of the Fed, also to reduce yields and drive up prices. The idea is to act more decisively than the Bank of Japan did during Japan's banking crisis, and flood the system with cash so that there is real impact. There is less danger of inflation in this downturn, which is one of the calculations that the Fed and the Bank of England are both making as they do this.

Fifteen heads ofhome building and financial services firms each got $100 million in cash compensation and sales of stock during the past 5 years according to a WSJ analysis. Four of those heads of companies including heads of Bear Stearns and Lehman Brothers led companies that filed for bankruptcy. The overall study looked at heads of 120 public companies in sectors like banking and mortgage finance, student lending, stock brokerage, and home building, showed that top directors and executives of the firms cashed out a total of $21 billion during the past 5 years. In the tech bubble of the late 1990's more than 50 individuals each made more than $100 million from selling shares just prior to the crash, with many founding companies that were never profitable. With much of the profit coming in areas like mortgage finance and banking where many of the errors dangerous leveraging and risktaking, and failure in ethics, caused the global financial crisis, the whole issue of executive compensation without results or pernicious to the public interest is taking centre focus for today's public opinion. With the auto industry also there is a perception that there was poor management and failure to respond to national and later customer need for energy conservation till late in the day, and yet the executive compensation and entrenched management behaviours and lobbying in Congress suggested a management impervious to public opinion....

As one wonders how the housing crisis will affect sales of items like cars and other items, its interesting to note that in addition to subprime borrowers who should never have taken the mortgage in the first place because of lack of proper credit background, there are borrowers who were otherwise healthy but are in a financial bind because of house flipping or speculative buying in the hope of gaining from the speculative price increases. These are defaults on prime quality loans and about 21 to 32 percent of the prime quality loan defaults in California, Nevada, Arizona, and Florida are mortgages with homes not occupied by the owner. Note that Goldman Sachs estimates that housing prices will fall about 7% this year and another 7% next year. These estimates may change as the housing crisis deepens with more foreclosures on subprime and prime properties.

Gretchen Morgenson sees systemic risk looking ahead beyond 2013 in the $4.6 trillion repurchase obligations market or repo market. Problems in the repo market caused the collapse of Lehman Brothers in the financial crisis of 2008. Bernanke, Dudley, Bair and other finance officials have referred to the risk in the repo market which have not been reduced since the 2008 financial crisis. In the repo market money market mutual funds provide short term funding to banks accepting collateral such as mortgage securities. These are overnight loans made to banks and other financial institutions based entirely on trust. During normal functioning the trades are rolled over. The risk is that the trust disappears in a few days as happened for Bear Stearns and Lehman and the firms not able to obtain this short term financing. This is a very unstable form of financing and Lehman depended on it because of the low cost and not having to set aside capital for the trades.
