"Humphrey's Executor" precedent is  being challenged by president DJT before the US Supreme Court and with it the independence of the Fed in 2025. Humphrey was an FTC official who was fired by FDR in the 1930's but died before his case went to the courts. It set the precedent that the president cannot simply fire officials he does not like. DJT challenged this by firing offfical at the National Labor Relations Board. When the US Supreme Court takes up this case it will look sceptically at this precedent, yet will find some way to protect the Fed's independence, says WSJ.

Senator Tom Cotton, chair of Intelligence Committee in Senate, questions ties of the new Intel CEO Lip-Bu Tan to China. DJT calls for a new CEO, saying there is no other solution that Tan should resign immediately. Under the Biden Administration and the previous CEO Pat Gelsinger the US government offered $8 billion in aid to Intel to maintain it's leadership in chip making technologies. Gelsinger was ousted by the Board last year after Intel's recovery effort was taking time and replaced with Lip-Bu Tan who was an early investor in Chinese chip makers. There are questions why the acting CEO Yeary is cited in WSJ reports to have considered offering Intel's chip making manufacturing for sale to TSMC to exit manufacturing, after the help Intel had gained of $8 billion from Biden to become the dominant maker of advanced chips in the US- recovering a position lost to TSMC when the US had invented the computer chip. Brazil's federal government has halted negotiations for additional doses of Chinese vaccines. In the early stages in 2020 Chinese vaccines helped Brazil cope with the devastating rise in cases. The slow pace of vaccinations in US and Europe has freed up more vaccine doses of Pfizer for other countries including Brazil. From accounting for 80% of vaccines in Brazil early in 2020, SinoVac vaccines now make up only 35% of Brazil's vaccine doses. At that time Brazil bought 100 million doses of SinoVac vaccine which were delivered. The local producer of SinoVac vaccine, the Butantan Institute will no longer make Chinese vaccines. While Sinovac vaccines are effective at preventing deaths, the vaccines have a low effectiveness rate for symptomatic infections. ...

Oxford Biomedica is the company that is part of the consortium making the coronavirus vaccine being developed by Oxford University's Jenner Institute.  Her Mr. Dawson describes the challenges he faced and cash crunches 4 times in 12 years, the last 4 years ago. The turning point he says was in 2012 when the cell and gene therapy was validated with a new drug developed for a form of cancer using this method. Oxford Biomedica is setting up a facility for manufacturing the vaccine in England at a 84,000 square foot former Royal Mail sorting facility in the city's business park called Oxpark. Dawson says cell and gene therapy is going to be big in health care. He did not see it coming till 2012. In 2014 he says during a cash crunch they had realized that what they had to do at Biomedica was to get to the time when it was going to be big. The Stimson Center looks at the closing of an era of Conservative politics in Japan which ended in 2025 after the death of Shinzo Abe and the 2 year premiership of Kishida. Interview is conducted by the Stimson Center of a senior Japanese political figure with 30 years of experience in the Foreign Service, and the author of the only English language book on Shinzo Abe, reflecting the paucity of research on Japan. Shinzo Abe was premier for a short time in 2005-2006 and for a full term in 2012. He made changes to Japan's SDF, its partnership with India, Australia in the Quad, and his economic policy which increased women's participation in the economy. For the first time in post war Japan there was a new sensde of confidence under Abe and he is missed sorely in Japan today. Yet as this senior Japanese politician says, Japan has changed the way the US and Europe have changed, and nationalist politics are replacing old Conservative politics of the LDP. In a way also how the deindustrialization of US, Europe and Japan has also taken place discrediting that era. Takaichi Sanae is itself a representative of the new era, as she did not hesitate to say Japan would get involved if China attacked Taiwan. Her popularity is at 62% and she has called a snap election, as she came in to replace Shigeru Ishiba in October 2025 and was not directly elected PM. Yet in the long view this is also a misconception because neither the Stimson Center or the interview participants had a keen sense of who Abe really was and Abe's grasp of the history of the Kamakura period of Buddhist Japan and China, India, of the 12th century before the foreign invasions from the north. One of Shinzo Abe's biggest legacies is the relationship that was close to his heart, the relationship with India and prime minister Modi. This week chancellor Merz of the Federal Republic of Germany was at the kite festival with PM Modi in Ahmedabad and at the Sabarmati Ashram of Gandhiji. The same degree of warmth shown by the German leader and Modi reflecting Vivekananda's time in Germany, was seen long time back between Modi and Abe. The bullet train project Mumbai to Ahmedabad and the ones that follow across India are a testimony to the warmth shown by Abe for India, and his knowledge of history from the Buddhist period in India when by the 12th century in Japan in Dogen's time Tenjiku (India) was the sacred homeland of Buddhism. Today India has revived the Buddhist traditions and centers of Buddhism, the universities and research centers for Buddhism from that period in Indian history. Buddhism started in India near Nepal in what is now Bihar state at Sarnath and Kushinagar, and spread through China to Japan and Korea. The whole continent of Asia would reflect Buddhist ideals and ideas without the intervening period of Vedic culture in India and China's Mongolian and Manchurian northern invasions, and the periods of European colonialism. Today Buddhism and The Bhagavad Gita are itself strung like pearls on a string as the Gita itself says, part of the long spiritual traditions of three nations- India, China and Japan, and of the many others Vietnam and Korea. In one Test at the Gabba in Brisbane in 1960, the West Indies and England were down in the last ball to one run and the game ended with a tie, both teams at the same score. This merger is part of a process that happened after 1970 when Penguin Books a national institution in Britain in the war years 1939-1945 was acquired by Pearson Plc, and later sold in 2013  to German publisher Bertelsmann. Penguin became a part of British culture because it sold a million cheap paperbacks at 6 pence in 1939 and continued to provide low cost access to books to all parts of the English speaking world from UK to Asia till the 1960's. The astonishing period of creativity and design of founder Allen Lane ended in 1970 after Pearson Plc focused on profitability and acquisitions. Under this new deal in 2021 a large part of the world publishing industry would come under the control of German publishing house Bertelsmann. Penguin Random House is owned by Bertelsmann and the deal would bring its rival Simon and Schuster under its control. The US Justice Department filed a lawsuit to block it. Attorney General Merrick Garland says- "American authors and consumers will pay the price of this anticompetitive merger- lower advances for authors, and ultimately fewer books and less variety for consumers." Penguin Random House already controls 22% of titles published in the US. The US publishing industry has already seen mergers leading to reduced competition. News Corp. acquired Houghton Mifflin Harcourt in May and merged it into Harper Collins. Largadere Hachette acquired Workman in September. ...

These are key provisions in the biggest climate change bill in history- Tax credits that last for over a decade for zero carbon plants- these tax credits go to companies that build new sources of emissions free electricity, for wind turbines, solar panels, battery storage, geo thermal plants. Tax credits also for new technologies that capture and bury carbon dioxide from natural gas plants and industrial facilities before it escapes into the atmosphere and heats the planet. This technology is rarely used because of high costs. Incentives for electric vehicles- It extends a tax credit of $7500 for new electric vehicles. It adds a $4000 tax credit for used electric vehicles. Tax credit goes only to people earning $150,000 a year (300,000 for joint filers) for new EV's and $75,000 (150,000 for joint filers) for used EV's. Help for people to lower energy costs - $9 billion in rebates for Americans installing energy efficient electrical appliances. And a decade of tax credits for Americans installing rooftop solar, heat pumps, water heaters and electric HVAC, or electric heating, air conditioning and ventilation technologies. Investments in Domestic Manufacturing- $60 billion for investments in clean energy manufacturing in the US. This includes $30 billion for production tax credits for solar panels, wind turbines, batteries and critical minerals processing. $10 billion in investment tax credits to build manufacturing facilities for electric cars and renewable energy technologies. This action is to halt the shifting of clean energy manufacturing overseas to China. $27 billion towards a green bank that would finance clean energy projects in disadvantaged communities. Cracking down on Methane- the bill places a fine on methane gas emissions from oil and gas wells and pipelines and other infrastructure. Fees of $900 per metric ton in 2024 and $1500 a metric ton in 2026 when it exceeds federally set limits.    ...

He announces reciprocal tariffs on all nations with large trading imbalances with the US, a 34% tariff on China and a 20% tariff on all imports from the European Union. These nations he says have taken advantage of the US and looted and pillaged the US workers and communities for decades mainly because of the presidents who sat in the White House executive room and allowed this to happen. US Treasury Secretary Scott Bessent advised all trading nations-  "My advice to every country right now is, do not retaliate." His advice- "sit back, take it in.... Because if you retaliate, there will be escalation". The US is in no mood to be lectured or retaliated when these countries including China, Japan, South Korea and the EU, Taiwan, India a list of about 20 nations have taken unfair advantage of the US in trade for 3 decades. ...

One negative effect of the trade war with the U.S. is an increased emphasis on energy security and increased use of coal in China. After China committed to goals for climate change coal use declined in 2014, after reaching a high in 2013. The attack on Saudi oil facilities showed risk in its reliance on Saudi oil. China's import dependency for oil reached an all time high of 72% in 2018, according to BP 2019 Statistical Review. Gradually the commitment to climate change and lower use of coal has changed since 2016 with the withdrawal of the U.S. from the Paris Climate Change Agreement. Initially after the U.S. withdrawal under president Trump China made bold commitment to lead the fight against climate change but has since wavered. In an October 2019 speech Premier Li Kequiang called for the development of the coal industry to ensure energy security.  As China's economy slowed in 2019 in the face of U.S. tariffs and a trade war with the U.S. efforts are being made to increase infrastructure investment which has driven coal use higher. China's steel output reached a record of 750 million metric tons in 2019. The amount of coal fired capacity under construction in China now exceeds the rest of the world combined, much of it from plants permitted before 2017, according to Global Energy Monitor. China is also expected to become the world's largest importer of natural gas by 2020. Even the Russian gas fields from Siberia supply only a fifth of China's energy demands in 2020.  China has made large strides in renewable energy helping it meet its Paris Agreement targets. Renewable energy is about 10% of China's energy mix, but its use showed growth of 29% in 2018, making up half of the world's growth. China's use of coal in the energy mix has dropped to 58% in 2018 from 72% in 2008, according to BP 2019 Statistical Review, as a result of renewable energy investments. At the Madrid Climate Conference China renewed its commitment to the Paris Climate Change Agreement. Then let these young people decide who should run the country and its government for the next 4-8 years. The founders never intended this and never anticipated this threat. Congressmen Republican Gallagher of Wisconsin and Democrat Krisnamoorthi of Illinois introduced a bipartisan bill to ban TikTok in the US considering that it was foreign adversary application when its literacy effects are even more a concern. Byte Dance has appealed the law that goes into effect Jan 19, 2025. The appeal is now before a 3 person panel of the Columbia Circuit Court of Appeals of Sri Srinivasan, Neomi Rao, and Douglas Ginsburg. Does Byte Dance have recourse to the First Amendment rights in the US Constitution when the US sees Byte Dance as a foreign adversary controlled internet social media service, is the question before the Appeals Court and next before the US Supreme Court. The US government has shown the judges confidential classified data that shows why it thinks there is foreign adversary influence of some sort.  It is interesting to note that national literacy standards and the ability of average American young people to know enough about American history and civics that is in a dire state today and a key vulnerability for US democracy. This is gravely harmed by social media influence. Only negative effects on mental health of children and young girls has been put forward. Too many hours spent on social media is a negative influence which is why China and now Australia and UK have put restrictions on is use. US has none. India has banned Tik Tok for security reasons. Floyd Norris says the announcement by the ECB on Dec. 20, 2011, that 523 banks borrowed 489 billion euros under the newly created Long Term Financing Operation goes a long way towards giving Europe time to address the debt crisis. A major problem is recapitalization of European banks and the ECB's action helps address this problem. This is one of the achievements of the December summit of European leaders, though it was not the way markets had expected. Markets were focussed on large scale bond buying by the European Central Bank or issuance of euro bonds. ECB head, Mario Draghi, aware of widespread opposition in Germany to such proposals made it clear this was not going to happen. The Long Term Financing Operation of the ECB provides unlimited amounts of loans to European banks at 1% for 3 years, and accepts sovereign government debt as well as other types of securities as collateral. The result of this action was to lower the yield on a recent Spanish bond auction to 1.7% for three month bills from 5.1% the prior month. Spanish and Italian banks can now buy government debt of their countries and use the bonds as collateral at the ECB for three year loans at 1%. This Norris estimates will generate profits of about 37 billion euros for European banks from the difference between the ECB rate of 1% and the rate on two year bonds of Spain and Italy of 3.6% and 5.1% respectively for the bond purchases of 489 billion euros- calculated on a spread of 2.5 percentage points over three years. Another infusion of funds from the ECB will occur in February 2012. The new capital infusion gives European banks less reason to reduce lending in the eurozone as they work to meet the higher capital reserve requirements set under new Basel III rules. This is especially important given the austerity measures being implemented across the eurozone countries and Britain to reduce government deficits, and in light of the lower growth expected as a result....

President Biden and leaders in the EU, Japan, India and other countries helped negotiate the global minimum tax. Companies would have to pay a minimum tax of 15% in 140 jurisdictions so that tax base shifting could not happen. Yet the US will not get the benefit of these increased taxes to invest more into R&D, manufacturing, infrastructure and strengthen its economy because Republicans have not supported it in Congress. The OECD countries, major EU countries from the EU, Japan and South Korea will get an additional revenue of $192 billion in 2024 as a result of the Global Minimum Tax. Yet even here the GMT is making a difference as companies see not much difference in the different jurisdictions for tax rates the shift is for companies to setup in the US especially for American companies who had always had their base in the US till the tax shifting began.

Refugees in Germany are 3.48 million in 2024 at 4 percent of the population, government data shows. This is 60,000 more than in 2023. One third of them are from Ukraine and many of them seek a return to their home country. Clara Bunger a member of the German parliament requested the information from the government. A serious problem for higher education, for universities and colleges in the US is the failure to focus on reducing cost. It costs $120,000 for a 4 year education at Michigan State University.Tution fees for one year have gone from about $10,000 to $20,000 over 12 years 2012- 2024 for state universities. Another priority should be reading comprehension as shown in Lyrarc's Movement for Global Literacy. This opinion piece describes the problems with colleges and universities further aggravating the fragmentation of the electorate into college educated and non college educated, with focus on theories of race and history when it should be focused on cost that makes it unaffordable to the vast majority of Americans. Priorities are misplaced and do not reflect the need to give good reading and math skills beyond high school in an advanced country where by 2010 about half the young population lacked reading comprehension in the ACT tests going further downhill since then. ...

Issues of lack of leadership on climate change that face David Malpass, head of the World Bank are discussed in this report in The Guardian. The Biden administration sees this as a problem because of the need for strong leadership and action in developing countries on climate change, and for financing to support this. The fast food industry in US relies on the franchise model which has been deeply affected by depressed wages, poor working conditions and other worker abuses. Governor Gavin Newsom signs into law on Labor Day 2022, the FAST Recovery Act which established a state council tasked with setting wage standards for the entire franchise and food industry. Workers will now get a seat at the table to set standards for wages, and health and safety standards for the industry. Wages will be set at $22 per hour starting next year for about half a million workers in the franchise and fast food industry in California.

The US Justice Department imposes a $225 million fine on Teva Pharmaceutical and requires it to sell its Pravastatin drug line as part of a deferred prosecution settlement on price fixing charges. The  public was overcharged by $350 million according to a 2020 indictment. Collective fines on price fixing charges in the generic rugs industry amount to $680 million reports WSJ. Teva will also have to donate $50 million to needy patients. This is another way the Biden Justice Department is bringing down the cost of living by keeping a close eye on drug costs pushed up by illegal price fixing.

Of the $12 billion in planned improvements for NY subway infrastructure this year only $2.9 billion will be spent in 2024. Congestion pricing is expected to generate $15 billion which is allocated to fund NY subway infrastructure. Lawsuits from the Governor of New Jersey and others now affect how much money goes into the subway improvements. This is not for a modernization of the NY Subway which would cost much more. It shows how year after year essential infrastructure is being starved of funding even as money gets allocated to non essential investments by capital markets in the US, and waste is rampant in capital market investments.
