Judge Engoron of the New York State Supreme Court is the rarest of judges in his style, demeanor and use of everyday expressions. He was a cabdriver and a music teacher and more like everyday people in America.  NYT shows the 92 page legal decision in which Judge Engoron sets a fine of $355 million in the civil fraud trial of Donald Trump. Engoron cites a poet and uses rare language in his everyman style, saying: "The English poet Alexander Pope (1688-1744) first declared, “To err is human, to forgive is divine.” Defendants apparently are of a different mind. After some four years of investigation and litigation, the only error (“inadvertent,” of course) that they acknowledge is the tripling of the size of the Trump Tower Penthouse, which cannot be gainsaid. Their complete lack of contrition and remorse borders on pathological. They are accused only of inflating asset values to make more money. The documents prove this over and over again. This is a venial sin, not a mortal sin. Defendants did not commit murder or arson. They did not rob a bank at gunpoint. Donald Trump is not Bernard Madoff. Yet, defendants are incapable of admitting the error of their ways. Instead, they adopt a “See no evil, hear no evil, speak no evil” posture that the evidence belies." And calling it "this is not the defendent's first rodeo"- "In considering the need for ongoing injunctive relief, this court is mindful that this action is not the first time the Trump Organization or its related entities has been found to have engaged in corporate malfeasance. Of course, the more evidence there is of defendants’ ongoing propensity to engage in fraud, the more need there is for the court to impose stricter injunctive relief. Peggy Noonan reflects on the deep changes taking place in America. Behind the changes is a strong feeling in the middle and working class that it has been ignored by the establishment in both parties. She points to Citizens United and says it is bad for the Republican Party, encouraging large donors and hedge fund billionaires, making the party less accountable to ordinary people. The Clinton's fundraising also raises similar questions. Trade policies depressing wages have worked against the working class, yet espoused by politicians of both parties. The young supporting Sanders, she says have seen little to show capitalism is working for them. Institutions such as Congress, the presidency, the political class, the Supreme Court, the media, are all in an uncertain position, as voters lose faith in the ability of these institutions to work for them. Yet she points out that it is important that the U.S. voters choose wisely- keeping in mind the importance of electing someone who can demonstrate goodness and a sound mind- not obscuring the questions about Trump. Argentina, South Africa, Mexico, India, UK, European Union elections are taking place by June 2024 and US in November 2024. Yet it is misleading to lump them together. Much discontent is there to see as in the UK with cost of living, governance, time wasted on Brexit, India with lingering effects of the pandemic on rural voters, caste based voting. In India protest vote of lower caste Dalit voters in Uttar Pradesh and Maharashtra, even with government support in forms of universal healthcare, food for poor households during pandemic extended, cooking gas, housing support, clean tap water, direct bank account deposit to accounts of poor and farmers. Yet in the states in the south and east in Orissa and Andhra Pradesh, and generally in the south the BJP vote count increased so that losses in the north were made up leaving the percentage of vote for India for Modi's BJP party at 37 percent in 2024 instead of 38% in 2019, losing the absolute majority 240 seats of 543 yet having campaigned heavily for partners who added seats 294 of 543. In the UK Keir Starmer may see some vote preference for Labor erode yet the Conservative record is in shambles even conservative experts will say, as in India where the opposition parties offer no prospects for the future and little track record for making India the second or third largest economy in the world which the BJP has set and shown to have achieved over 10 years by taking India to No. 5 in the world economies. ...

This WSJ story shows how China started its steel industry from small beginnings when Chinese leader Deng visited a Nippon Steel plant in 1978. He made the decision to go big with Baosteel, with an investment of $6 billion, with the words- "if we do it lets do it big." This was 36 times the Chinese foreign exchange reserves at the time. From 4% of steel production, this went up and up, passing the U.S. in 1993, past Japan in 1996, and in 2018 producing three times the steel of U.S., Russia and China combined, producing 923 million metric tons of steel in 2018, or more than half of world production of steel. With steel China was able to build its automobile industry, shipbuilding, bridges, infrastructure, high speed rail network. This was done using global demand, subsidies from the government, cheap loans and tax breaks. Markets worldwide were affected by substantial excess production in China. From Baosteel the spread of the steel industry to all 23 Chinese provinces led to China accounting for 25% of world exports. By 2016 5 million workers mostly from the agrarian countryside were employed in the steel industry, helping China transform itself into an rapidly urbanizing and modern economy. It was a period when the rail network was tripled between 1975-2017, with shipping companies that ensured access to Australian coal and Brazilian iron ore. From 2011 to 2017 Chinese steel dropped global prices by 57% triggering closure of steel mills in EUrope and the U.S. About a third of trade complaints since 2001 by G20 countries against China are about steel. After entry into the WOrld Trade Organization Chinese steel exports rose to 8% of GDP from 2%. Subsidies, cheap energy, and shift of agrarian workers to cities. U.S. investigations around 2006 showed Chinese steelmakers subsidies covered 30% to 45% of the subsidized value of steel pipes exported overseas. China's steel prices were set 20-40% lower than the U.S. China responded to complaints saying it was trade protectionism. The WTO rules call for full disclosing of all subsidies. This was disclosed 5 years after joining WTO in 2001, and only for central subsidies. Local government subsidies were not disclosed till 2016- the U.S. says 15 years late. Still the Bush and Obama administrations failed to take action. In 2018 Mr. Trump seized on this as a campaign issue that resonated with American workers in manufacturing communities across the U.S. In 2018 November president Trump announced a 25% tariff on imports of Chinese steel. A six month probe by U.S. officials had already shown 40% of sales value came from subsidies for corrosion resistant steel from China. The U.S. Trade Commission imposed tariffs of its own from 39% to 241%, with the Trump tariffs of 25% coming as an additional tariff to tackle the trade surplus with China. Meanwhile in China the government is closing uncompetitive smaller steel mills and in 2016 it combined baosteel with Wuhan Steel to create a larger company, and consolidate remaining companies. Baosteel now provides the steel for CIMC to dominate the steel container business, and to make ship to shore cranes, and make the San Francisco-Oakland Bay Bridge.  It also goes to show what can be accomplished from small beginnings for countries in the developing world from Asia to Africa and Latin America, with government and industry focussed on development and growth.   ...

Krauthammer cites Congressional Budget Office numbers that show the Obama U.S. health care law continues the spiralling costs of health care with new government mandates at a time of severe budget cuts in education and other areas- for 2013-2022 the costs come to $1.76 trillion. The initial Obama administration figures of 10 year costs of $938 billion announced in 2010 reflected the fact that the new U.S. health care law would take 4 years to fully go into effect. Costs after 2021 are shown to be $250 billion each year in the CBO figures. The law is now before the Supreme Court in 2012, which has to decide on the basis of the limits of the Commerce Clause.

The Trump administration's early proposal for NAFTA moves away from campaign pledges to completely renegotiate the treaty, instead taking the approach of working to improve the U.S. trade position in relation to Mexico and Canada. It includes seven objectives for tougher rules for labor and the environment favored by Democrats in Congress, and it also has support from Republicans with its effort to update NAFTA for changes in technology and in other areas since the accord was signed during the Clinton administration. The area in which U.S. and Mexican business are wary is one in which the Trump administration still seeks to keep the option of imposing protective tariffs, and a border-adjusted tax to level playing field for differences in taxes, as well as other measures to protect American jobs and interests. Because any renegotiated NAFTA also has to pass both houses of Congress this proposal took into account the different constituencies and interests for this issue. Robert Lighthizer, trade representative under president Reagan is likely to become the next U.S. Trade Representative and lead negotiator. Most of the Address followed a familiar pathabout the economy, about the reasons for the Iran war being the nuclear threat most of all, and the way the president has sought to tackle the threat of ballistic missiles that could soon reach US and Europe. It was an update one month into the war with Iran. One part of it showed a focus on keeping the war short compared to other conflicts and limiting US losses by being very careful on that point. DJT cited the wars of the past 1 year 7 months for WW1, 3 years and 8 months for WWII, Korean War 3 years and 1 month, that soon stretched on for decades in the conflicts that followed. Vietnam 18 years, Iraq 8 years- wars that dragged on and led to US losing its economic position as the strongest nation economically. This one with limited goals nuclear threat removal and ballistic missile removal as the key goals on for 32 days, and right from the start clearly setting what US would not do and do- not take on role of opening Straits of Hormuz and asking China, Britain, countries that get the oil from Hormuz to take this on as China and Japan get 90% of their oil imports from Hormuz Straits. US is self sufficient and does not need that oil from Hormuz. It was the message to the MAGA base that does not want this war to become like the ones carried on for 8 years by Bush and Obama in Iraq which they clearly reject- the bigger goal is the US economy and reindustrialization not the deindustrialization that happened under  Bush and Obama destroying the US industrial base while fighting wars in remote places.  It was also meant to counter the idea of a president not conscious of responsibilities for limiting the duration of the conflict by removing goals such as opening Hormuz Straits which would involve the US in something it does not need and is the job of other nations who need that oil like China, Japan, Britain and India. ...

The settlement fine is $4.3 billion and is intended to ensure strict compliance with US laws. Jerome Powell at the Fed will be governor till Jan 2028 and Fed chair till May 2026. Powell plans to complete his term in office and preserve the Fed's independence as designed in the charter for the central bank.

A cut in interest rates by a quarter percentage point from the U.S. central bank is a decision that comes from the U.S. not wanting to see too wide a gap in interest rates with the European Union. Losing demand to Europe and resulting lower inflation is an outcome prevented by the U.S. acting to protect its own economy with  acut in its rate. The ECB rate at 0.4% is about 3 percentage points below the Federal Reserve's rate in the U.S. After the cuts in rates to near zero by the central banks of U.S. and Europe following the financial crisis caused by poor lending practices of banks, the U.S. central bank began a process of bringing rates to about 3%. Lower rates near zero badly hurt savings accounts of ordinary Americans. By December 2018 the rates had reached 2.25%.  President Trump has called for lower rates. because of the advantages it gives Europe in trade balances with a weaker currency that follows from lower interest rates. Capital flows to the country with higher rates and increases the value of the currency creating trade disadvantages and lower trade balances. WIth European interest rates much lower than the U.S. it pushes down the value of the euro vs the dollar and the British pound lower from Brexit fears. This increases European exports putting the U.S.  at a disadvantage. As the WSJ points out the U.S. central bank says though Mr. Trump is looking at trade balances and U.S. advantage, and Mr. Powell at the U.S. central bank is looking at U.S. inflation, the result for policy is the same- the U.S. acting to cut rates and stay close to what the European Union is doing. Bond yields in Europe have dropped from a negative 0.24% to negative 0.32% with the ECB's head Mr. Draghi moving to cut rates. The announcement of Ms. Christine Lagarde as the new head of the ECB to succeed Draghi and her views to push demand up, is pushing bond yields down. The U.S. as part of the globally linked economy has to act in line with policies in Europe. ...

The Editorial Board of the Washington Post says people should be concerned about going back to the 70's when New York City struggled with funding and went downhill. The very goal of affordability that Mamdani is trying to achieve could end up being hit because the methods may not work at all. It says free bus service means a transit funding hole, city run stores would hurt privately run stores, and a rent freeze would depress housing supply. Greg Ip in the WSJ compares Austin with NYC with Austin seeing 20% increase in housing supply to NYC 3% in 2020-2024. Austin had a 23% jump in one year in housing prices but it came down and over 4 years rent increases in NYC are 20% in Austin 11%.  It is only that much of the New Yorker educated elites have let the city down so much by not finding solutions to the affordability crisis and not focusing on fixing infrastructure and modernization of the American cities, in the last three decades that this has happened- as a desperate young population turns to giveaways or free services across the board as a solution that never works. A fiscal crisis could happen as in the 1970's creating another vicious cycle says the Washington Post. It says one can only hope that the damage is at the margins. ...

US and China agree on the first step to a broader trade deal. US offers to take in Chinese students at American Universities, something DJT says he was good with.  “Chinese students using our college and universities,” adding that such attendance has “always been good with me.”  China for its part will not slow move export of magnets and rare earth minerals on which it has established a near monopoly of the supplies. These rare earth minerals are needed for technology products made in the US. US tariffs of 55% will still say in place as "deterrance" that the other side keeps its promises and to cut the trade deficit with China not simply talk about it has has happened for a decade of Bush, Obama, Biden. Treasury Secretary Bessent and Jamieson Greer US Trade Representative were at London talks with Commerce Secretary Howard Luttnick to find ways to get an impasse resolved. The Reagan administration obtained the concessions it needed from Japan. The negotiator for the U.S. side during the Reagan years - Robert Lighthizer. Lighthizer is using his experience in winning concessions from Japan in his role as top trade negotiator with China.  As the WSJ points out Japan ceased to be a threat to the U.S. faster than anyone thought possible. 

But there is one problem even if this happens the warning is that the imbalances with Japan simply transferred over time to China. The warning is for America's tendency to spend money it does not have, and for how long.
