US president's sweeping powers to use tariffs as a tool for policy when American people's jobs, communities, health, is threatened by fentanyl and concentration of manufacturing jobs in China, unfair trade by EU and Japan, is the issue presented to the US Supreme Court. The US president presented it in this way- tariffs as a foreign policy tool, not a way to impose economic policy in the form of a tax on American importers or buyers which is the power allocated to Congress by the US Constitution. Justices who mentioned these powers called them sweeping powers but would not say the word fentanyl or look back at the recalcitrant behaviour of Asian nations Japan and China when it comes to unfari trading practices, where the US could literally negotiate forever and get no result, or to the enormous concentration of manufacturing power and supply channels in China that not only ships out American jobs but leaves Americans at the mercy of foreign powers for cost of living. Nowhere was this more evident as during covid years and now in rare earths export restrictions from China. The Justices assumed it was just alright to ignore this or leave it unsaid.  The cost to American buyers is small because most of the tariffs are borne by foreign suppliers in China, Japan and Germany, who as in the case of automobiles unfairly benefitted for decades and are now bearing most of the cost of tariffs. The large business in the US have increased their margins so much in the 2020-2024 period that they are now bearing some of the cost of the tariffs, as reported in WSJ. So that inflation in the US is at 3.0 % in the US less than anticipated, when average tariffs are at about 10% overall, not what the headlines say of 15-20% because of the product exceptions made in the tariffs for each nation. Justice Roberts may be right when he says more care should be exercized in the placing of a tariff, but even Roberts and Justices Barrett, Gorsuch, Kavanaugh and others know that the US has used this as a last resort, as a policy tool to protect the American people. Sweeping powers need care and caution as Justice Roberts stated- “power to impose tariffs on any product from any country in any amount for any length of time. It does seem like that’s a major authority."   ...

Not only have directors at companies like Washington Mutual, Countrywide Financial and Fannie Mae not taken responsibility for the crisis. They have simply moved on to other boardrooms says Gretchen Morgenson of the NYT. These direcotrs did little when these companies were leveraged and made dubious loans or risky investments. Says Paul Hodgson of the Corporate Library, "these directors have avoided the corporate limelight as far as blame is concerned." Companies like Sunoco, the oil company, Paccar, a truck manufacturer, and Tetra Tech each have directors from these failed companies. Thomas Gerrity, a professor of managemet at Wharton is one of the outside directors at Fannie Mae who is now at Sunoco. Robert Parry, a former president of the Federal reserve bank of San Francisco, was adirector at Countrywide from 2004 to 2008. Parry is on the board at Paccar. Says Frederick Rowe, president of Invesotrs for Director Accountability, a nonprofit shareholder advocacy group, the board member gets $475,000 a year, he plays golf with the CEO, he is apersonal friend, goes to nice places for board meetings, and he is just not going to one word that would jeopardize his position on the board. In the case of GM the board held together in one voice right up to the bankruptcy with a director who was a former CEO of Eastman Kodak and the lead person on the board, insisting that management had done everything right, all the way up to the end. These directors had to be fired once the government took an ownership interest in GM, and before this they survived just about everything, including tens of thousands of jobs lost in Michigan, and the devastation of communities and people around the state. Gretchen points out that the director dysfunction is because its almost impossible to have adirector fired for sleepwalking through the job or simply rubberstamping the maagement's decisions. Shareholders have to launch an expensive proxy fight to oust a director. Currently proposed changes by the SEC to allow those who have at least a stake of 1% in a big company to put up their own nomiees are not effective steps say shareholder advocates. John Gillespie, co-author of "Money for Nothing," a forthcoming book on board failures with David Zweig, says the problem lies in the culture of the boards which determines how directors behave. Solutions he suggests are instituting term limits for directors and separating the positions of board chairman and chief executive....

Republicans ask the president and Democrats to leave Ukraine aid on a stand alone basis and not mixed with other health or budget requests where there are differences. Republicans want to move quickly on aid to Ukraine as the invasion on the east of Ukraine builds up. In comments earlier this week Mr. Biden told a national audience in a televised speech that he wants to make Ukraine aid to be ongoing as this could be a long effort to resist the Russian invasion. Ramstein now has a new symbolism - US Joint Chiefs head Gen. Mark Milley was clear about it- "The outcome of this battle, right here today, depends on the people in this room." The battle is one in eastern Ukraine. Defense Secretary Austin was clear about also clear- "the war had galvanized the world." About 40 countries were represented at Ramstein base, some virtually. There was a sense that the previous symbolism with Anglela Merkel and Mr. Steinmeier and Mr. Schroeder may have emboldened Russia into invasion of Ukraine. ...

Wisdom shared by students on picking a place to study. Ten people look back to reflect on how their college was chosen, their experience at that college, the cost of tuition. Some changed to other schools where they fit in better, others struggled with large tuition bills when the same education could be obtained at state universities with lower tuition fees. You are never stuck says one of them as you can change schools if it is not the right one. Others point out the risk of relying on "the best school", the most "rigorous program," and one engineering student points out that one can get a good engineering education at many less costly or famous schools. The general feeling is find what will be good for you without being overawed by big names, consider cost carefully, one can get a good education at most universities and colleges just find the place where you feel valued as a person and which fits in with your sentiments and mental makeup. England coach Gareth Southgate reflects here on his penalty kick in the 1996 semifinals against Germany in Euro Soccer at the Wembley stadium. He recall that at the time the penalty kicks were handled as more a situation of luck not skill and practice. He took the kick with little practice and he recalls some negativity in his mind, and missed. Twenty two years later at a knockout stage game in Moscow he faced the similar situation playing Columbia. This time he was manager. But this time the team had changed its attitude. Penalties were seen as being about skills, practice and effort. His focus was on the process, and let the results work themselves out. He encouraged his players to take a positive attitude and think positively during the kick. Combining skill and process worked and England won that game.  In 2021 Gareth Southgate is the coach for the English team that plays against Italy in July's final at Wembley stadium. Germany's finance minister, Wolfgang Schauble, says Germany can move faster than expected to allow shared liability of eurozone debt. He also accepts the need for short term measures such as the European Stability Facility buying bonds of Spain and Italy in private markets to drive down yields. Schauble indicated this flexibility in an hour long interview with the WSJ on June 27, 2012. This comes after Angela Merkel's remarks made in talks with coalition partners the Free Democrats that she would not accept any mutualization of debt in the eurozone in her life time. Schauble reiterated his view that before joint liability of debt can take place there has to be a joint EU fiscal policy, and sequencing was critical. He called for a EU fiscal commissioner arrangement for reviewing EU member budgets and policies. At the same time he said Germany was open to some level of mutual financial support between members of the eurozone, under the right conditions.

As the WSJ reports Softbank and Masayoshi Sen was delirious in his own words during the tech booms of the last 20 years and its founder talked about bigger and bigger capital allocation even as productivity of capital declined rapidly. This happened astonishingly with little restraint in capital markets shown by participants even as healthcare in the ten years before the pandemic was not adequately funded, and education, infrastructure, manufacturing technologies were neglected which would have provided better returns on capital and served the interests of the American people and the world in a way that would have been said was well done had this been done. The Biden administration makes its decision- it will continue the tariffs president Trump placed on about half of Chinese imports into the US. It also seeks new talks with China on trade. US is also pursuing other policies on trade that were not pursued by the Trump administration. These alliances would jointly approach China on trade, economic and security matters.  Another approach is for the US to build at home. The Biden administration is also aware that China is doubling down on technology purchases within China from Chinese firms to support its own high tech industries. In response it is laying down a policy of its own for the future step by step. Mario Draghi, president of the European Central Bank appears before the Economic and Monetary Affairs Committee of the European Parliament. He said the ECB had resumed normal lending to Greece's four major banks after the 18 billion euro recapitalization of the Greek banks by the government of Greece using bailout funds assigned for this purpose. Draghi tod the parliament: "The ECB will continue lending to solvent banks. We will avoid bank runs on solvent banks." At the same time he asked the EU to setup a deposit insurance fund for European banks and regulation of banks at the European level. On the actions taken by European leaders Draghi had strong criticism for the slow response always one step behind action needed and a day late, saying: "The next step is for our leaders to clarify what is the vision for a certain number of years from now. The sooner this has been specified the better. Dispel this fog." He described the configuration for the eurozone of the last ten years as unsustainable unless steps are taken, with leaders having to decide quickly what kind of eurozone they want to see. On Bankia's recapitalization by the Spanish government, Draghi said everybody winds up doing the right thing after many delays at the highest possible cost and price. At 83 years he is the most resilient and active Senator in the US. Bernie Sanders support was key for president Biden's election in 2020. “It should come as no great surprise that a Democratic party which has abandoned working-class people would find that the working class has abandoned them,” Sanders said. “First, it was the white working class, and now it is Latino and Black workers as well. While the Democratic leadership defends the status quo, the American people are angry and want change. And they’re right. “Today, while the very rich are doing phenomenally well, 60% of Americans live paycheck to paycheck and we have more income and wealth inequality than ever before. Unbelievably, real, inflation-accounted-for weekly wages for the average American worker are actually lower now than they were 50 years ago. “Today, despite an explosion in technology and worker productivity, many young people will have a worse standard of living than their parents. And many of them worry that Artificial Intelligence and robotics will make a bad situation even worse. “Today, despite spending far more per capita than other countries, we remain the only wealthy nation not to guarantee healthcare to all as a human right and we pay, by far, the highest prices in the world for prescription drugs. We, alone among major countries, cannot even guarantee paid family and medical leave.” ...

Christoph Hasselbach of DW.com says the idea of European Union brings so much good for Europe that it should not be diminished by use of pressure or punishment. He refers to the firm opinion in Brussels, of Mr. Juncker and Merkel, that there can be no cherry picking when it comes to remaining in the EU. This led in Jan. 2017 to British prime minister May saying Britain would not go begging to Brussels, and would simply opt out of the European Union and the single market. Hasselbach offers an interesting and plausible explanation for the Brexit vote shifting by a small margin to the exit side. He says rightly that uncontrolled immigration fears were used by the politicians supporting exit. Interestingly he says the worries in the UK were not just for current people but for future citizens from the hundreds of thousands of refugees who would become German citizens in a few years. Would they try to settle in the UK- prime minister Cameron failed to provide a convincing answer, says Hasselbach. He is right to point out as we have at Lyrarc that it is healthy to have questions and even some skeptical views about Brussels, that the appeal of the EU must depend on not being dogmatic about it, but being open and willing to accept questions.   ...

The advice to reduce cancer risk is not surprisingly the same from D. Michael Sekeres of the University of Miami- stay away from sugar, alcohol and tobacco products and take in more fruits, vegetables and whole grains, ancient grains and exercise regularly. The magnitude of what this would achieve on a a national scale when food habits have gone downhill for decades is what is also at stake. It would do what nothing else could do for the nation's health on a massive scale which is why it is the right thing to put much of our focus on, to create a culture that put much importance on the quality and kinds of food, on artificial vs natural, on food grown in good environments, on local vs shipped long distances, on processing vs not processing, all the time thinking of one's own health and what it will do for the quality of life we live. Just a fraction of the savings in medical care would pay for education and parks, green areas in neighborhoods, public health services, high levels of sanitation, leading to better well being that leads to more productive and intelligent citizens. It would lower the levels of multiple diseases and create a healthy society. ...
