RICO prosecutions in Georgia for racketeering use a broader definition of the term. Mr. Trump's intent matters and Attorney General Barr's telling Trump that there was no substance to fraud claims.  WSJ says the state RICO law is broadly written giving the state prosecutors more latitude than federal prosecutors when pursuing alleged criminal enterprises.The Georgia RICO law on racketeering say defense lawyers is unconstitutionally vague and overbroad. Yet the state's highest court has upheld the law and cases have been filed and successfully prosecuted in Georgia. Most recently by prosecutor DA Fanni Willis against 35 school officials and teachers for a test cheating scandal. Of 12 charged in that case 11 were convicted, one acquitted.

Trump's Attorney General William Barr was Attorney General of George Bush in 1992-1994 and brings extensive experience, which may have helped him stand his ground on December 1, 2020 rejecting claims of presidential election fraud at a meeting on Dec. 1 with Mr. Trump. In his book 'One Damn Thing After Another," Barr describes what happened on December 1, when he had lunch with Mike Balsamo of the Associated Press. Mike asked him what Barr was finding about election fraud claims. Barr's answer was that to date he had not found fraud on a scale that would have affected the outcome of the election. Gerald Seib of the WSJ says don't be shocked at the resignation of Mattis at Defense after the withdrawal decisions on Afghanistan and Syria by president Trump, the shutdown of the government in Washington D.C. over Mr. Trump's demandsfor $5 billion to build the border wall with Mexico on grounds of security. As president Trump prepares his reelection bid he is going back to his own sense of what the public and his support base want. The border wall issue was popular with his supporters, and by withdrawing troops from Afghanistan Trump is lowering the troops number to below that when president Obama left office, for a war that is unpopular in the country. Mattis is looking at it from the perspective of sacrifices made in Afghanistan by U.S. soldiers.

Neil Irwin in the NYT why the U.S. China Phase 1 Trade Agreement is more than a hill of soyabeans as he puts it, more than about all the soyabeans that the U.S. farmers can sell to China. China's economy was seeing the effect of U.S. tariffs. Additional tariffs to cover all imports from China to the U.S. would have worsened this. China avoided this by agreeing to Phase 1. The U.S. had looked for some enforcement mechanism based on China putting this down in a written agreement particularly for avoiding subsidies to state enterprises and improper access to U.S. advanced technologies. China's reluctance to do this led to Mr. Trump saying that China had reversed its position and Trump expanding the tariffs stage by stage. These issues are now set aside for Phase 2 still to be negotiated. Both sides taking what they could get. China relief from the threat of tariffs on all exports. The U.S. under Mr. Lighthizer's negotiating leadership retaining the enforcement idea through the tariffs that are still in place of 25% on half of China's exports to the U.S. The bonus for Mr. Trump is the goodwill China generates by agreeing to buy all the U.S. farmers can produce, farmers having not only stood behind Mr. Trump but also forming a key part of his support base. China will continue to compete in technological areas with the U.S., and the state enterprise model which worked for China as Mr. Xi tells visitors will continue. Phase 2 is just that Phase 2, when and if it can be negotiated between Trump with his negotiator Lighthizer and Xi with his negotiator Liu He. On key points neither side is budging. A key goal for Mr. Trump is to put the trade surplus China enjoys of $300 plus billion a year with the U.S. on a serious downward path, and bring so many of the jobs and manufacturing back home. On this trade data for 2019 and the plan for 2020 of both countries is clear. It should be down each year by 10-20% for the next few years, a major achievement of Mr. Lighthizer, who did the same with  Japan under president Reagan. ...

This interview by Michael Schmidt of the NYT with president Trump shows a more conciliatory mood following the passage of the Republican tax law. Trump says he feels Mueller will treat him fairly but that the investigation will drag along for some time. Trump says this is bad for the country.  On the tax law he says he would have tackled the local and state tax deduction either not touched it or worked out a compromise if Democrats agreed to talk to him about taxes. Democrats he says thought they had McCain's vote when he left for Arizona, yet that did not happen. He says expensing for investing in equipment should unleash growth through new investment in the U.S. On infrastructure he sees a hundred Democrats joining the Republicans in Congress to do a deal. He says Democrats need him for DACA on the Dreamers issue, and he will work with them.  Other topics covered were the election itself which Trump says he fairly won by focussing on the Electoral College and going frequently to small states like Maine, up and down the East Coast knowing he would lose New York. He says there was no collusion with the Russians for his campaign and says it was Democrats who did the collusion. Following the Nuclear Security Summit in March 2016, U.S. president Obama says world leaders had expressed concern about Mr. Trump's comments in private conversations with him. Obama said- "even those countries that are used to a carnival atmosphere in their own politics want sobriety and clarity when it comes to U.S. elections because they understand that the president of the United States needs to know what's going on around the world." Obama said that comments by Mr. Trump showed a person "who doesn't know much about foreign policy or nuclear policy or the Korean Peninsula or the world generally. Trump has defended these comments in a televised townhall meeting held by CNN in Milwaukee. Since 2000 about 2% of the vote goes to third party candidates such as Greens, Libertarian, and others, in 2016 this reached 6%. It hurt Clinton the most as the Trump lead in Michigan, Pennsylvania and Wisconsin was merely 5-10% of 200,000-300,000 votes for independent candidates in Wisconsin,  in Michigan and in Pennsylvania. Hillary Clinton lacked clear focus in her campaign and her years as overseas traveling foreign minister left her out of touch with the alienation of the working class and fragmentation as Silicon valley tech and financial interests intruded into the Democratic party. This had the effect of muddying the focus on the Democrats FDR/Truman working class base and also with America's rural voters suffering from a toxic mix of problems. In 2024 the Kennedy candidacy takes as many or more votes from Mr. Trump says the WSJ. The Biden focus on workers and families gives the Democrats a clear direction along with wage gains by union labor and a resilient economy with low unemployment. This suggests that the independent candidates may not find more traction than the 2% of previous elections since 2000. ...

The resignation of U.S. Defense Secretary Mattis comes as a result of Mattis being unable to change plans by president Trump for a withdrawal from both Afghanistan and Syria. WSJ discloses that at a meeting on December 18 at the Pentagon, with John Bolton, White House National Security Advisor, Mike Pompeo, Secretary of State, and John Dunford, chairman Jt. Chiefs of Staff, Mattis could not temper the president's plans. On Thursday December 20th Mr. Mattis decided to resign. He then met Mr. Pompeo and onto the White House to meet president Trump. He and Mr. Trump discussed their contrasting world views in a 45 minute meeting, and Mr. Mattis handed over his resignation letter to Mr. Trump. Military officials were particularrly blindsided by the withdrawal from Syria. U.S. policy has vacillated back and forth in the intervention in Syria with president Obama also hesitant to commit troops in Syria. In the meeting Mattis understood that even a minimal presence in Syria was unacceptable to president Trump who ordered the removal of the 2000 troops there. The withdrawal from Afghanistan was also a result of limited patience with the war there in the 18th year and no sign that the Taliban influence had diminished since the war began- after Trump added 3000 troops to the 14,000 stationed in Afghanistan. The U.S. has 5500 troops in Iraq and there is talk about drawing this number down. The concern for the defense department is that how U.S. allies will see the withdrawal, and their perception of how reliable the U.S. is as a partner. For president Trump the cost is measured in terms of the long period the U.S. was engaged in the region without any tangible results, and U.S. not allies bearing most of the cost.      ...

President Trump on a three day visit to the UK promised a free trade deal with Britain if it made a decisive break with the European Union. Such a free trade deal could take years, offer small benefits compared to the loss of the much larger trading relationship with the European Union. It would face hurdles in passage through Congress because Democrats controlling the House of Representatives see a decisive break with the European Union including the customs union arrangement as affecting the open border in Ireland risking the hard won peace in Northern Ireland.  Prime Minister Theresa May proposed a withdrawal arrangement that would keep the customs union arrangement but has failed to secure the support of a faction within her Conservative party that favors a decisive break from the EU. Such a break that Mr. Trump and Boris Johnson the leader of this faction -and a favored candidate to succeed prime minister May after her resignation- would reduce Britain's GDP over the next 15 years at the higher end of the range of 0.1% to 9% a year. A decisive break called a no deal Brexit with no arrangements or agreement for withdrawal with the EU, would lead to a loss closer to the 9% estimate. British experts to the EU are about $275 billion or 44% of its total exports compared to about $44 billion to the U.S., according to HMS Customs source, showing how important it is for Britain to maintain a close trading relationship with the European Union. British farmers would also face competition through agricultural imports from the U.S. in a free trade deal. During his visit Mr. Trump also stated the National Health Service, everything would be on the table in a free trade deal with the U.S.  Theresa May responded by saying that the NHS would not be open for negotiation to American corporate involvement. Public sensitivity is high on any change to the National Health Service. The trip of president Trump to London in which he supported Boris Johnson as candidate to succeed Theresa May, with discussions between Trump and Johnson for 20 minutes, and a visit by Nigel Farage to the U.S. embassy, and no meeting with Labour party leader Corbyn, only shows the widening of differences on the issue of British withdrawal from the EU making any deal for withdrawal even less likely. Labour party leader Jeremy Corbyn now favors a second referendum on whether Britain should leave the EU.  ...

President Trump outlines a plan for Afghanistan that increases the U.S. troop presence from about 8500 with an addition of 4000 more troops and advisors, in addition to a counter terrorism force. To war weary public in the U.S. he says: "I share your frustration over a foreign policy that has spent too much time, energy, money- and most importantly, lives- trying to rebuild countries in our own image instead of pursuing our security interests above all other considerations." About his criticism of the war when president Obama was in office as a huge costly waste of resources Trump said: My original instinct was to pull out, and historically I like to follow my instincts... I heard that decisions are much different when you sit behind the desk at the Oval Office." After resisting the advice of his own advisers Trump decided to fire Bannon who had supported use of American private security contractors for the war in Afghanistan, and used parts of the media to question national security advisor McMaster's views on this. Gen. Mattis, completed a strategy review that showed the mistake of creating a vacuum would repeat the situation of Iraq where president Obama withdrew forces in 2011, leading to a sequence of negative events- with Russia, Iran and Islamic State moving into the vacuum, making American intervention in the war necessary, increase in terrorist incidents worldwide, and a flood of refugees into Europe. Ironically clearing the path for an outsider's bid for the White House, with Brexit in which refugee fears and uncontrolled immigration played a part, and the news of terrorism and the war in Syria-Iraq creating a sense of insecurity. A key difference in the Trump approach with Obama's approach is that "conditions on the ground, not arbitrary timetables will guide our actions from now on," in line with Trump's criticism of Obama's approach. The military in the U.S. has long maintained that the best approach would have been to insist on U.S. presence in negotiations with the Iraqi government under the sectarian prime minister Nouri Maliki. Gen. Mattis was head of Central Command under the Obama administration and must have pushed the view of the military to president Obama to no avail. Failure to do so led to the growth of Shiite militias and the alienation of Sunnis in Mosul, leading to the fall of Mosul to Islamic State thus creating the current crisis. Gen. Mattis and Lt. Gen McMaster are intimately aware of the problem and must have convinced Trump that this is what really happened, that a repeat would waste the sacrifices of American soldiers in the twin wars. Trump gave this as his reason when he said in his televised speech to the nation- essentially a criticism of Bush that he expanded the conflict too quickly, and Obama exiting too quickly to create a void. Trump call his policy "principled realism."  The roots of the crisis are in the India-Pakistan conflict. Like the conflict in South East Asia the conflict in South Asia extending from Iran to India and Pakistan, may take a generation to overcome. A rapprochement between India and Pakistan, beginning with trade and economic relations, is not only in America's interest, it also provides the basis for a realistic American withdrawal. ...

Judge Engoron of the New York State Supreme Court is the rarest of judges in his style, demeanor and use of everyday expressions. He was a cabdriver and a music teacher and more like everyday people in America.  NYT shows the 92 page legal decision in which Judge Engoron sets a fine of $355 million in the civil fraud trial of Donald Trump. Engoron cites a poet and uses rare language in his everyman style, saying: "The English poet Alexander Pope (1688-1744) first declared, “To err is human, to forgive is divine.” Defendants apparently are of a different mind. After some four years of investigation and litigation, the only error (“inadvertent,” of course) that they acknowledge is the tripling of the size of the Trump Tower Penthouse, which cannot be gainsaid. Their complete lack of contrition and remorse borders on pathological. They are accused only of inflating asset values to make more money. The documents prove this over and over again. This is a venial sin, not a mortal sin. Defendants did not commit murder or arson. They did not rob a bank at gunpoint. Donald Trump is not Bernard Madoff. Yet, defendants are incapable of admitting the error of their ways. Instead, they adopt a “See no evil, hear no evil, speak no evil” posture that the evidence belies." And calling it "this is not the defendent's first rodeo"- "In considering the need for ongoing injunctive relief, this court is mindful that this action is not the first time the Trump Organization or its related entities has been found to have engaged in corporate malfeasance. Of course, the more evidence there is of defendants’ ongoing propensity to engage in fraud, the more need there is for the court to impose stricter injunctive relief. This is not defendants’ first rodeo."     ...

The corporate share buybacks announced by U.S. companies in the last 3 months now exceed $200 billion, more than double than in 2017, according to a WSJ analysis. This includes Cisco, Wells Fargo, AbbVie, Amgen, Alphabet (Google). The surge in corporate buybacks started in December after the tax cut of the Trump administration cut U.S. taxes by $1.5 trillion over a decade, cutting the corporate tax rate for large companies from 35% to 21%. The tax cut also included a one time tax for repatriation of $2 trillion held by U.S. companies overseas. This WSJ analysis says there are questions whether the tax cut is working, whether it will encourage new investment, lead to companies increasing wages, or whether this will largely result in corporations returning money to investors with larger dividends and corporate buybacks. Morgan Stanley's analysis of earnings transcripts of companies in the S&P 500 show 44% of the companies say they will use some portion of the tax gains to make capital investments and increase wages, with 28% going in the opposite direction and using them to return money to shareholders. Experts caution that corporate buybacks do not always lead to the company's stock outperforming the stock market. The future of companies depends more on the capital investments and in human capital. There is a sense that workers wages have stagnated since the mortgage financial crisis in 2008, with the economic crisis, globalization and outsourcing, reduced alternatives for workers, geographic pressures in relocation, all pushing wages down.  This is being closely watched with articles on stagnation in wage growth this week in the NYT and WSJ, and earlier in the Economist magazine. Reports on the Trump administration tax cuts passed by a Republican Congress suggested a large tilt towards benefitting the highest income households. Problem with higher stock prices reaching the broader middle class are recognized in that one third of stocks are owned by overseas investors, and 84% of the remaining stocks are owned by the wealthiest 10%. Republicans have turned to bonuses typically of $1000 per person given by companies yet this amounts now to about a few billion dollars over an estimated 4 million Americans, says this WSJ analysis. This is not enough to justify a huge tax cut and raise the deficit by over a trillion over 10 years on the assumption that it would lead to higher wages or capital investment when about $200 billion goes to boosting stock prices. This comes at a time when the American middle class is not broadly invested in the stock market after the exit following the battering stock prices took during the 2008 financial crisis. ...

Falsifying business records is a misdemeanor in New York, only a second crime turns it into a felony. WSJ Editorial Board asks the question what is the second crime in the Trump indictment that turns a misdemeanor into a felony under New York law. District Attorney Alvin Bragg says "under New York election law it is illegal to promote a candidacy by unlawful means." With the hush money payments Mr. Trump is seen as promoting his candidacy unlawfully, and the payments themselves as illegally done campaign contributions. Another aspect of law is that the situation was not brought up in 2017, yet is perceived very differently in 2023. Much more is known in 2023 than in the early days of  the election campaign in 2017.

19 percent of China's exports went to the US in 2017, in 2024 this is 15%, but wait, the difference of 4 percent it is simply coming back to the US but through Southeast Asia. As a result some of the same issues that puzzled Trump negotiators exist today. China's exports surged 12.7% in October 2024 over the prior year. Biden was facing this situation and had yet to respond to the surge in exports to US. These exports were sent to Mexico and to Southeast Asia to circumvent the tariffs. It is the same situation revisited in 2024 with two other aspects of the Chinese economy-economic stimulus gets smaller and the housing and construction industry has imploded, the economy has slower growth. The overall price level in the US with a 60% tariff plus 10% for all countries would be 0.72 addition to the price level of 1.10 percent today- that is when including the depreciation of China's yuan by 10%. as it did last time. The result would be price level in the US at 1.82%, according to J.P. Morgan. Drag on China's GDP of the Trump tariffs in first term was 0.65% according to one investment bank GS, with 60% tariffs it would be 2%. Trump secured a return of $116 billion or 58% of the $200 billion China said it would buy of US exports. The other 42%- the deal was not completed in the end. ...

This editorial in the WSJ points out that president Trump's and the Iranian government's response in the firing of missiles at a U.S. airbase in Iraq were intended to quiet things down so that there was no escalation. Both sides were in effect standing down which president Trump called a good thing. 

Beyond deterrence the U.S. effort is also to work with its European allies to open a path to renegotiating the 2015 Iran nuclear deal so that a long term settlement can be reached for the region.

Gerlad Seib points out that one should look less at what president Trump accomplished in the first 100 days and more at how he operated and learned during this initial period. This is certainly true because much of what happened in the first 100 days contradicts some of the tone that Trump setup during the campaign. When it comes to governing Trump has made an effort to learn and adapt and show resilience in the face of early setbacks on the travel ban and the health care bill, the Flynn episode. After this early period Trump took on a more disciplined approach, gave more room to and listened to more respected advisors- Tillerson on foreign affairs in shaping policy with Russia leading to Tillerson's presence at Lucca massacre memorial in Italy sending a clear signal about U.S. policies in line with its role in the past century in world affairs, Gary Cohn and Ross on economic policy and seeking Cohn's advice on tax plan, Ross's on NAFTA negotiations with Mexico. As a result the NAFTA fears were calmed down with statements by Wilbur Ross, the Commerce Secretary, that the goal was a win-win relationship with Mexico. Trump worked with his party in Congress to have the Supreme Court nomination of Gorsuch approved. Meetings with Merkel of Germany and Jinping of China were carefully planned and new relationships established as Seib points out, without ruffling trade relations. The appointment of Robert Lighthizer, as Trade Representative, also shows that efforts to give the U.S. a more level playing field in trade will be resolutely pursued in the win-win context. Lyrarc has profiled Lighthizer earlier in this decade after his op-eds in the media as he correctly anticipated the changing public mood on the need for fairness in trade relations. On relations with China and South Korea, Jim Mattis has taken the lead, and Pence's visit to South Korea also show deftness in handling what is one of the most difficult issues in foreign affairs. Mattis and Tillerson also have helped reinforce the Republican party policies on NATO and Europe, with the visit of NATO secretary general Stoltenberg to the White House. In the end it is how much you can learn in the first year, how much you listen, and the courage to act in difficult situations, the willingness to act contrary to one's instincts and self interest where necessary, that matters. This is especially true in an environment where as Seib points out the Democratic Party stands opposed to the Trump administration following a bitter election campaign.   ...
