CaixaBank is buying Bankia SA in Spain. Commerzbank and Deutsche Bank may reconsider merging. UBS may consider merging with Credit Suisse, though Swiss banks are in better shape.

The way in which the subprime mortgage crisis is affecting Germany. How mid sized German banks formed conduits like the larger banks in Europe and expanded them to the point where their conduits were as large as those of the large banks. Lacking the resources of the larger banks these banks were the first to fall in this crisis. Conduits are off balance sheet affiliates that borrow using short term commercial paper to invest in longer term securities. Its critical that they have access to capital borrowing because the commerical paper has to be renewed. In a crisis like this one if the borrowing ability vanishes because of perceived risk by lenders then the whole operation can blow up. So the German central bank had to intervene to support 2 of these institutions IKB Deutsche Industrie Bank and Sachsen LB and organize a rescue operation. Germany's aging rail system, the Deutsche Bahn, will get a makeover with a 86 billion euro inverstment over 10 years. FOr years it has suffered from delays, broken bridges, older trains, and lack of modernization. As the economy slows down infrastructure investment which has suffered from the Tech years, is now back in popularity with the public mood shifting across Europe and the U.S. A current five year plan budgeted just 5.6 billion euros per year and is replaced with a ten year plan with 86 billion euros so that it sends a signal for the economy, but more importantly creates planning security for investments, and makes building sites cheaper to run. As a sign of the times trains running 6 minutes were considered as "on time" in recent years. Merkel's CDU was not pursuing infrastructure investment during the austerity decade 2008-2018. As finances are being cleaned up in Europe and the U.S. and the banking mess clears, the shrinking of banks such as Deutsche Bank as a vivid and educational example, and the mood of the public shifts away from the flashy Tech years, there is a sense of the value in the public mind of the investments in infrastructure that benefit all, that prevailed in the post war years. ...

A unit of RBS, possibly in Asia, is likely to plead guilty to manipulating the London interbank offered rate (LIBOR). A settlement with U.S. prosecutors is likely by mid-Feb. 2013. A penalty of 500 million pounds or $790 million is expected as part of a legal settlement, according to people briefed on negotiations. RBS is 82% owned by the British government. This follows legal settlements totalling about $2 billion with Barclays and UBS. Banks are also concerned about the risks of private litigation. Deutsche Bank is being investigated for its involvement.

Before taking up the job of enforcement chief at the SEC, Robert Khuzami spent five years running the U.S. legal division of Deutsche Bank. In that job he worked with lawyers who advised on the collaterized debt obligations issued by the bank, and the details to be disclosed to investors. Like Goldman, Deutsche Bank has faced alllegations of not disclosing the proper information for its CDO's. Before joining Deutsche Bank, Khuzami was a prosecutor in the U.S. attorney's office in Manhattan for 11 years.

Ireland owes $139 billion to German banks and $132 billion to British banks according to the Bank for International Settlements in Basel, Switzerland. German officials said in Berlin that Deutsche Bank was especially exposed to Ireland. But Deutsche Bank does not say that, it insists the money at risk is $400 million euros, calculated after the use of derivatives to hedge risk. Total gross exposure is not revealed by Deutsche Bank. This makes investors more nervous and promotes the spread of contagion to Greece and Portugal.

The Project on Government Oversight, a nonprofit group, (POGO), put out its report in Feb 2013 on the performance of the S.E.C. in enforcement actions. The report is critical of the revolving door whereby the same lawyers who worked at large banks and financial corporations later join the enforcement agency for short periods, only to rejoin the financial companies after their work at the S.E.C. This weakens the enforcement at the S.E.C. Robert Khuzami worked at Deutsche Bank during the period when some of the problems resulting in charges against Deutsche Bank being filed happened. He was the chief of enforcement at the S.E. C. during a critical period following the 2008 financial crisis, and supported action that let companies "neither admit or deny" in legal settlements. This practice reduced the deterrent effect of enforcement actions to protect the public.

Deutsche Bank has lost two thirds of its share value and its leverage is extraordinarily high with total assets at 56 times tangible equity acccording to Morgan Stanley. Progress is being made but not enough say analysts, and raising capital now is better than waiting longer and doing that with a downward spiral in its shares. The loss announced January 14, 2009, of $ 4.8 billion euros for 4th quarter 2009, reflects a loss across all of the bank's businesses, and is a warning sign of the need to raise capital with greater urgency.

Moody's Ratings company downgraded banks in the U.S. and Europe on June 21, 2012. Morgan Stanley, J.P. Morgan Chase, Goldman Sachs, Citigroup were downgraded two notches. Morgan Stanley managed to stave off a three notch downgrade. Credit Suisse was downgraded three notches. Bank of America was down one notch, and Wells Fargo which has only a small trading operation was not reviewed. This is the first time since 2007 that Moody's has conducted a sweeping downgrade of banks. About 100 banks were reviewed by Moody's. Banks being downgraded have large trading operations or investment banking business that is subject to higher risks. Greg Bauer, a managing director of global banking at Moody's said in his statement: All of the banks affected by today's actions have significant exposure to the volatility and risk of outsized losses inherent to capital-markets activities." For Moody's the main issue was that the capital bases of banks are maintained, considering that government support is less likely than before, according to Mr. Wassenberg, Moody's managing director for European banks. The impact on banks will be fewer opportunities for trading revenues for some banks, and will raise borrowing costs for banks. Moody's also cut the ratings of large European banks with significant trading operations. This includes Deutsche Bank, Barclays, HSBC, RBS, BNP Paribas, Credit Agricole, Societe Generale, UBS, and Royal Bank of Canada....

Equity markets in Europe and the U.S. are likely to see some of the 62 trillion yen, or $630 billion, which the Bank of Japan plans to add to holdings of banks and households in two years 2013-2014. Instructions in a 2012 law say the money from fines paid by banks for LIBOR related offenses should go to communities throughout Britain. A program in North Yorkshire teaches military veterans how to use "therapeutic baking" as a way to ease stress through cooking and by kneading dough. The same social housing charity, Riverside ECHG, says its focus is on making sure people are not sleeping in bushes or cars. A program in Harrowgate uses these funds to resurface tennis courts at a treatment center for injured police. British prime minister Cameron promised during the recent election to use 227 million pounds from fines paid against Deutsche Bank in April 2015 for financing 50,000 apprenticeships. Critics say the money should have gone to people who were harmed by the banks actions, yet in the case of LIBOR related offenses it is not clear who was harmed and by how much. The idea for the 2012 law come from Chancellor George Osborne. Osborne said about sending money back into local communities- "It is fitting that the money paid in fines by people who demonstrated the poorest values in our society is used to support those who demonstrate the very best."...

Swiss shareholder activist Ethos Foundation called for personnel changes at UBS. Dominique Biedermann, head of Ethos called for the replacement of Kaspar Villiger and Carsten Kengeter, who head UBS investment bank. Biedermann said UBS should leave investment banking and former Deuthche Bundesbank President, Axel Weber, should join UBS as chairman earlier than the planned 2013 date. He suggested Hugo Baenziger, current chief risk officer at Deutsche Bank, rather than interim CEO Sergio Ermotti, who is an investment banker, as the right person for the CEO position at UBS.
