It also calls for prevention- "Prevention also requires providing a safe space for public engagement in governance." The British American concept of governance through elections has to be modified with emphasis on as Srinivasan and Beuer state correctly -creating a safe space for public engagement in governance. Textualism or strict interpretation of the Constitution word for word may be back but one can never be sure. No sooner is one decision made in a certain direction with a particular approach to the law whether it be textualism or something else it then comes up for rethinking a few years later, under a different approach to the law or from a new angle. This is the law practiced in most British style courts of law including the US.  Former Justice Breyer of the US Supreme Court replaced by his law clerk Ketanji Jackson, is interviewed by NYT's Adam Liptak. Today so much is written about Breyer as a non textualist, and Gorsuch, Kavanaugh recent additions to the Court as textualist or strict interpreters of the Constitution based on when it was written with what intent. Yet as thinking individuals who like the rest of the American people grow in their understanding all Justices cannot be categorized  in this way. Breyer says he worked with retired Justices Kennedy and Souter and found them to be willing and keen on hearing all angles. Then it has to be said that both Kavanaugh and Gorsuch were law clerks for Kennedy. Much of American law at the highest court actually is no better than any other human creation - it tries to approximate as best one can the people of the US. Sotomayor coming from Puerto Rican descent, Ketanji Jackson from minority black, Kavanaugh and Gorsuch from Georgetown preparatory schools where Kavanaugh's paternal grandfather attended Yale something even JFK could not claim, Chief Justice Roberts coming from a company professional type background, Barrett a professor at a Catholic university, Kagan with a Bostonian JFK style background, Alito old Italian and Clarence old minority black background. Breyer retired recently to make way for a younger judge, Judge Ketanji Jackson who was law clerk to Breyer. Breyer is writing a new book which he hopes the conservatives on the Supreme Court will read- Justices Kavanaugh, Barrett and Gorsuch. The book coming out March 26 has the title- Reading the Constitution- Why I Chose Pragmatism not Textualism. He hope these Justices will read the book and say their colleague was making sense, would say that it was not a bad point. ...

A case on whether a US government official can pressure social media platforms to remove content the government deems harmful is before the US Supreme Court. During the pandemic president Biden sought to quell rumors and misinformation about Covid vaccines. An Appeals court in Louisiana took a very conservative position that social media platforms could not be pressured in any way even from the bully pulpit not as a bully, meaning even persuasion was not allowed. The US Supreme Court will issue its decision in 3 months after it votes and the majority opinion is assigned to be written by one of the Justices It appears to be skeptical of the Louisiana Appeals court position.This NYT report shows exchanges between the Louisiana lawyer, deputy Solicitor General Fletcher speaking for the government, and Justice Kavanaugh. Justice Kavanaugh seems to agree with Fletcher that as long as it was a bully pulpit, that the president is saying it is harmful, but not threatening, it is acceptable under the First Amendment for president to do so. The president saying the rumor and misinformation was "killing people" was still only bully pulpit, no threat was involved.  ...

Housing markets in US that went up with jump in demand during the pandemic, markets in Nashville, Austin, Phoenix, are now in downswing. Migration patterns turbocharged by the pandemic are now fading. Overbuilding, slowing in population growth and lack of affordability are creating  vacant office space, and unsold single family homes. From 2020 to 2022 Austin house prices jumped by 60% with very low borrowing costs,, now in 2024 they are down 11% from the peak in 2022. Demand  dropped with a surge in interest rates creating unaffordability. By 2023 home sales reached a 30 year low. even today Austin homes are seen as 35% overvalued as home prices increased at over twice the rate of per capita incomes of 22%.

Higher inflation and interest rates at 2.2% are having a profound effect on the Japanese economy. Japan is starting a new era of positive interest rates with the first interest rate increase in 17 years this week. Pay raises reached an average of 5.28% in 2023, according to the Japan Trade Union Confederation where the highest for the previous decade was 2.4%. PM Kishida has pursued a course that encourages workers to get needed pay raises. It will affect everything from US mortgages to how much money stays at home and is invested in Japan. Japan holds $4.2 trillion in foreign investment holdings of which $1.1 trillion is in US Treasury bonds. As the differential with US interest rates decreases - varying from 1.5% to 3%- it will increase investment in the Japanese economy and in manufacturing at home. Japan has seen low wages and a hollowing out of its manufacturing sector similar to the US creating a sense of less hope for the future. This shift to investing in Japan is a change for reasons of supply chain reliability and increasing confidence of workers and worker's families in Japan. ...

Another huge turnaround. This time in college basketball. UC Long Beach coach Jim Monson has coached the basketball team since 2007. In 2012 he took the team to the NCAA tournament. After winning over Michigan and USC he lost 5 games straight after losing a star player from an injury. He offered to resign at the end of the season.The School's athletic director wanted him out the same day. Munson got to stay and won three games straight to the Big West title. Clearly New Yorkers can as a community do better. As Paris gets ready for the Olympics the efforts of City Hall and the French local and federal governments can be something for New York to learn from. Clearly as home to Wall Street New Yorkers should get their priorities straight and invest in the subway system taking a page from Tokyo and other cities that are doing infinitely better in their subway systems with modernization and attractive subway facilities. Surely this takes investment in people and facilities on a scale with tens of billions of dollars in investment which can be diverted from wasteful spending in many startups, and tax dollars going into what comes first for New Yorkers using the subway system every day. Today New Yorkers are like the people of Mumbai who until the efforts of the Modi government to invest in the complete modernization of subway and trains had given up hope so entrenched were old systems and old ideas.

The EU moves to support Egypt's precarious economy with 7.4 billion in euros of aid and help for its economy. This comes at a crucial time for a country with 106 million people facing economic difficulties. 5 billion euros of concessional loans, 1.8 billion euros of investment, 600 million euros of grants including 200 million euros to manage migration. The oil and gas revenues decreased by 23% in 2023 over 2022. After 2 years of war and particularly after contraction in 2022 the Russian economy is recovering and has surprised most forecasters. The problem with military industrial complex growth is that it leads to uneven growth with negect of some areas. In Russia the reduced access to western advanced technology is compensated by increase in technological capacity of countries such as China. A bigger problem is the loss of human resources during the war in Ukraine, and Russians who left the country seeking better lives in other countries.  ...
